Review every AI-generated game asset on three separate tracks: human authorship and copyrightability, permission and infringement risk, and storefront compliance. A favorable result on one track does not resolve the others. For a U.S. release on Steam, keep an asset-level record of its origin, human contributions, applicable terms, third-party material screening, and disclosure decision, then recheck the final build and marketing claims before submission.

This guide reflects U.S. Copyright Office and Steamworks materials available on October 13, 2026. It does not establish law in other countries or rules for other storefronts. Confirm the terms for the exact tool, model version, release territory, platform and build, and send uncertain, high-impact questions to qualified counsel.

Start with three questions, not one

Calling an image, sound effect, voice line, animation, or piece of narrative “AI-generated” does not tell you whether you can use it, claim rights in it, or ship it on a particular store. Record three answers independently for each asset.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Review track Question to answer What a positive answer does—and does not do
Authorship and copyrightability What human-authored expression is present in this asset or in the larger game? It may support protection for the human-authored expression under applicable law. It does not prove that every element is protected or that you have permission to use third-party material.
Permission and infringement What rights and restrictions apply to the tool or model, inputs, output, contributors and any material recognizable in the result? It determines whether your planned use is authorized and what conditions apply. An asset can be usable without giving you exclusive copyright, and a potentially copyrightable asset can still be unauthorized.
Platform compliance What must the intended storefront disclose, and what promises must the submitted game meet? Accurate disclosure helps satisfy platform process requirements. It is not a license, a waiver of content rules, or a guarantee of approval.

Use one record per asset and roll the decisions up to each release build. That prevents a late store survey from becoming the first time anyone asks where an asset came from.

What the U.S. Copyright Office says about AI-assisted game assets

The U.S. Copyright Office’s Part 2 report on the copyrightability of generative-AI outputs, published January 29, 2025, focuses on the human expression that can be identified in the result. The Office describes protection where a human determines sufficient expressive elements, where human-authored work is perceptible in the output, and where a person makes creative arrangements or modifications. It says that merely supplying prompts is not enough.

The Office also explains that AI assistance, or the inclusion of AI-generated material in a larger human-generated work, does not automatically prevent copyrightability. Its NewsNet issue 1060 states: “The Office confirms that the use of AI to assist in the process of creation or the inclusion of AI-generated material in a larger human-generated work does not bar copyrightability.” That is guidance about U.S. copyrightability, not a promise that any particular asset is protected.

Evaluate the expressive contribution, not the label

For each asset, identify the parts a person actually authored, selected, arranged or changed. A human may have contributed protected expression in a character design, a hand-painted texture pass, a carefully arranged environment, a composed edit, or an original performance incorporated into an AI-assisted result. Preserve working files that make those choices visible.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not treat prompt iteration by itself as a substitute for human authorship. Nor should you assume that extensive editing automatically creates a copyright. The relevant question is what expressive choices the human made and how substantial and perceptible they are under the law that applies to the claim.

Workflow example What to document Careful conclusion
A model produces an image from a text prompt with no human selection or editing. Prompt, model and version, date, generated variants and the one selected. Prompting alone is not enough under the Copyright Office’s current U.S. guidance; do not claim exclusive rights merely from the prompt.
A designer chooses among variants and builds a deliberate scene layout from them. All candidate variants, selection rationale, composition files and layer history. The human arrangement may contain protectable expression. Assess the actual choices rather than the fact that a model supplied components.
An artist paints, reshapes, lights and textures a generated base. Before-and-after files, brush or vector layers, timestamps and the artist’s notes. Human modifications can matter, but the generated portions and any third-party material still require a separate rights review.
AI-assisted material appears inside a game with human-authored code, art direction, writing or level design. Asset boundaries, authorship by component, integration files and the final build. AI material does not automatically disqualify the larger human-generated work. Separate the portions when making ownership or registration decisions.

This U.S. guidance does not decide the law of another country, the treatment of a named asset, or whether an output contains someone else’s protected expression. If you plan a registration, license, enforcement claim or sale, describe the human-authored portions accurately and obtain legal advice for the relevant jurisdiction.

Check permission and licensing at every layer

Copyrightability asks what you might own. Permission asks what you are allowed to do. Review both, because a model output can be too weakly human-authored for an exclusive copyright claim yet still expose your game to a third-party claim, a contract violation or a platform breach.

Tool and model terms

Save the terms that governed the exact tool, model, service tier and date of generation. Check provisions on commercial use, output ownership, modification, redistribution, attribution, sublicensing, indemnity, prohibited uses, account sharing and termination. Terms can change, and a current web page may not be the version that applied when the asset was made. Record the version or archive you actually relied on.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Inputs and source material

List reference images, sketches, sounds, voices, text, motion capture, fonts, marketplace files and other inputs. For each, record who supplied it and what license covers it. Unknown provenance is a review finding, not a harmless blank. Pause release, replace the input or obtain permission when you cannot establish a defensible right to use it.

Output and downstream use

Read the governing terms for the output itself. Look for restrictions on selling or sublicensing the result, using it in a game, training another system, publishing it in marketing, or granting rights to players. Do not infer a provider’s policy from a general statement that “commercial use” is allowed; the details may still restrict redistribution, attribution or third-party claims.

Recognizable third-party material

Screen for characters, logos, artwork, music, voices, likenesses, scripts, locations and other recognizable material. A generated asset that resembles a protected character or reproduces a logo can create risk even if your prompt was original. Similarity tools and reverse-image searches are useful for prioritizing manual review, but they are not legal determinations and cannot prove that no claim exists.

Contributors, vendors and marketplaces

If a contractor, freelancer, vendor or marketplace supplied the source or finished asset, retain the agreement, invoice, contributor warranty and chain of permission. Confirm that the person had authority to grant the rights your game needs, including rights to modify, combine, distribute and sublicense the asset worldwide if that is your release plan.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Evidence to capture Questions for the reviewer Escalate when
Tool/model name, version, account or service tier, generation date and saved terms What uses, attribution and redistribution does the applicable text permit? The terms are missing, conflicting, changed after generation or unclear about game distribution.
Prompts, references, source files and contributor records Can every input be traced to a person or license? An input is anonymous, scraped, borrowed without permission or outside the stated license.
Output variants, edits and integration files Which portions are human-authored, and which are generated or third-party? The team cannot identify boundaries or wants to claim the entire result as exclusively human-authored.
Similarity findings and manual notes Does the asset evoke a protected character, brand, recording, voice or artwork in the intended context? The resemblance is prominent, commercially important or disputed by a rights holder.

A practical, asset-level review workflow

The following seven-step process is a risk-management workflow for development teams, not an official legal checklist. Apply it to every shipped AI-assisted asset, including assets that players see only briefly.

  1. Identify the asset

Assign a stable asset ID and record the file name, checksum or version, asset type, intended use, location in the game, whether players can access it, and the shipped build in which it appears. Include concept art, textures, icons, music, sound effects, dialogue, localization, animation, code-generated content and marketing-facing assets when they are created or selected with AI.

  2. Record origin and tools

Note the person or vendor who created or selected the asset; the tool, model or service; relevant versions; generation and edit dates; and the workflow stage where AI contributed. Preserve source project files and prompt or iteration records where appropriate. A prompt log demonstrates process history, not ownership or permission by itself.

  3. Check terms and permissions

Attach the applicable tool, model, marketplace and contributor terms for the date of use. Mark whether commercial use, modification, attribution, redistribution and sublicensing are permitted. Record what is known about inputs and source materials, and flag unknown provenance for review instead of assuming it is clear.

  4. Describe human authorship

Write a short, asset-specific account of the expressive elements a human created, selected, arranged or modified. Link to layered files, sketches, timelines, session files or other evidence. Separate human-authored portions from generated portions when making ownership, licensing or registration claims.

  5. Screen for third-party material and claims

Check recognizable characters, logos, artwork, music, voices, likenesses and other protected material. Compare the result with references and document the reviewer’s reasoning. Use automated similarity checks only to prioritize manual investigation; do not report a “no match” result as a legal clearance.

  6. Map the asset to each platform’s disclosure rules

For Steam, classify whether the asset is pre-generated content shipped with the game or live-generated content created while the game runs, then include it in the Content Survey as required. For every other storefront, perform a separate review because the Steam rules do not establish another platform’s policy.

  7. Approve, replace or escalate

Assign a reviewer and date, record the decision and its rationale, and route uncertain or high-impact assets to qualified counsel or the relevant rights holder. If an asset is replaced, preserve the replacement decision and verify that the final build, store page, trailer, screenshots and other marketing materials match the approved record.

A compact record format

A useful record can be a spreadsheet row, database entry or ticket linked to the project files. At minimum, capture:

  • Stable asset ID, file/version, type, game location and build.
  • Creator or selector, vendor, tool/model, version, dates and workflow stage.
  • Input sources and permission evidence.
  • Applicable terms, restrictions, attribution and sublicensing notes.
  • Human-authored elements and links to working files.
  • Third-party screening results, reviewer, date and unresolved questions.
  • Platform classification, disclosure status, approval, replacement or escalation decision.

Steam’s AI disclosure and review requirements

Steam’s Content Survey distinguishes two categories. Pre-generated content is made with AI tools during development, ships with the game and is consumed by players; Steam gives artwork, sound, narrative and localization as examples. Live-generated content is made with AI tools while the game is running.

If you use AI services during development or in the product, Steam asks you to describe the implementation. Valve says it evaluates AI output under the same standards as non-AI content, including whether the game keeps its promise not to include illegal or infringing content and whether it matches its marketing materials. Its documentation states: “In our prerelease review, we will evaluate the output of AI generated content in your game the same way we evaluate all non-AI content – including a check that your game meets those promises.”

For live-generated content, provide information about the guardrails intended to prevent illegal output. Describe the controls that actually ship—such as input filtering, blocked categories, moderation, reporting, logging, rate limits or human review—rather than promising controls that exist only in a design document.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Disclosure is not a rights waiver

Steam’s documentation says that disclosure does not waive its content rules. Completing the survey does not grant permission to use a copyrighted image, voice, recording, character or trademark, and it does not cure a breach of a model or contributor agreement. Keep the permission review and the platform disclosure as separate records.

Plan for survey changes and review time

Some survey answers cannot be edited after the build and store page are approved without first contacting Steam Support. Revisit the survey whenever shipped content or the AI implementation changes, and follow Steam’s current instructions for updating an answer.

Steam’s Review Process documentation gives a typical store-presence and build review period of 3–5 business days and recommends submitting at least 7 business days before release to allow for changes. These are platform estimates, not a guaranteed schedule; check the live documentation when planning a launch.

Steam category Typical example Review evidence to keep

Compare assets with a consistent risk framework

When two candidate assets serve the same game function, compare them on four axes. This is an internal prioritization framework, not a legal score or a substitute for counsel.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Axis Lower operational risk looks like Higher operational risk looks like Action
Human contribution and documentation Clear human selection or modification with layered files and a dated record Prompt-only generation, missing source files or uncertain boundaries Preserve evidence, add human-authored work where appropriate, or obtain advice before making ownership claims.
Provenance and rights certainty Inputs, terms and contributor permissions are identified and archived Unknown source material, unavailable terms or unclear redistribution rights Pause, clarify permission or replace the asset.
Similarity and third-party material No meaningful resemblance found after documented manual screening Recognizable character, logo, recording, voice or artwork Seek permission, redesign the asset or escalate to counsel and the rights holder.
Platform and operational burden Pre-generated asset, accurate disclosure and stable final build Live generation, weak guardrails, changing behavior or marketing that omits required context Document controls, test the shipped implementation and update platform disclosures before submission.

If the safer candidate is less visually distinctive but has clear provenance and a manageable disclosure burden, that difference may outweigh a small creative benefit. Make the trade-off explicit in the decision record rather than leaving it to the final approver’s memory.

Release gates that catch problems before submission

Run these gates against the exact release candidate, not an earlier development build:

  • Inventory gate: every AI-assisted asset in the build has a stable ID and an owner.
  • Terms gate: the team has archived the applicable tool, model, vendor and source-material terms for the dates used.
  • Authorship gate: human contributions are described accurately, with working files attached where a copyright or registration claim may depend on them.
  • Rights gate: recognizable third-party material and unresolved provenance issues are cleared, replaced or escalated.
  • Platform gate: Steam’s pre-generated/live-generated classification and survey answers match the actual implementation; other storefronts have their own documented review.
  • Marketing gate: the store page, screenshots, trailers and descriptions do not promise a level of originality, authorship or content control that the build cannot support.
  • Change gate: a late asset swap, model update, new live feature or new marketing claim triggers a fresh review instead of silently inheriting an old approval.

Common review failures and how to correct them

“The asset is AI-made, so nobody can claim it.”

That conclusion is too broad. The Copyright Office’s U.S. guidance is about human-authored expression, while infringement and contract questions can still arise from inputs, outputs or recognizable material. Correct the record by separating authorship analysis from permission analysis.

“Our prompt history proves ownership.”

Prompt history is useful provenance evidence, but the Office says prompting alone is not enough for copyrightability. Keep the log, then document selection, arrangement and modifications separately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“We disclosed it to Steam, so it is licensed.”

Disclosure addresses a platform process. It does not grant rights or waive Steam’s content standards. Preserve a separate permission file and resolve third-party claims before submission.

“A similarity scanner found nothing, so review is complete.”

Automated checks can miss context, altered material, audio, voices and emerging claims. Record the result as triage evidence, perform a human review and escalate prominent or disputed similarities.

“We answered the survey once and can leave it alone.”

Changes to shipped content or implementation can make an old answer inaccurate, and some approved answers require Steam Support to edit. Add a change-trigger to release management and recheck the current instructions.

“The model’s current terms are enough.”

Terms can differ by version, service tier and date. Archive the terms that governed the generation and verify that a vendor or contributor could grant the rights your distribution plan requires.

When to involve counsel and what the evidence cannot establish

Seek qualified advice before release when an asset is central to the game’s identity, closely resembles a known work or person, uses an uncertain voice or likeness, came from an unclear source, is subject to conflicting terms, or will support a major ownership, registration, enforcement or investment claim. Give counsel the asset record, source files, terms, similarity findings, planned territories, platforms and marketing context.

The available U.S. and Steam materials do not determine the copyright treatment of a named asset, any provider’s current license, whether a particular training set was authorized, or the rules of other countries and storefronts. They also do not establish that all AI outputs are uncopyrightable, safe to use or acceptable merely because they were disclosed.

The U.S. Copyright Office’s AI study page reports that it received more than 10,000 comments by the December 2023 deadline. That number measures participation in the study; it is not an infringement rate, an AI-asset usage rate or evidence of consensus.

For a U.S. Steam release, the defensible practice is therefore specific and document-driven: identify the human expression, verify the rights chain, screen for third-party material, disclose the actual AI implementation and keep the final build and marketing promises aligned. Expand the review with jurisdiction- and platform-specific primary sources before selling elsewhere.
