When an AI service may have exposed data or been compromised, treat it as a live security incident: activate a multidisciplinary response team, contain further access without destroying evidence, determine exactly what data and systems were involved, and involve privacy counsel before making notification decisions. Restore services only after the access route is fixed and the recovery environment is validated.

What counts as an AI data breach or security incident?

An AI incident is any event involving an AI model, provider, application, integration or connected data store that could compromise confidentiality, integrity or availability. Examples include a stolen API key, an exposed prompt or output containing personal information, a compromised model-hosting account, an unsafe connector to a document repository, malicious instructions that cause unauthorized disclosure, or a provider-side outage or intrusion.

Not every security incident is legally a data breach. Whether notification is required depends on the information involved, the organization’s role, the affected jurisdictions, sector-specific rules, contracts and the legal definition that applies. Make that determination with counsel after facts are established; do not label an event a reportable breach—or dismiss it as harmless—before scoping it.

What to do in the first hour

The first decisions should reduce continuing exposure while protecting evidence needed to understand and prove what happened. Use this sequence, adapting it to safety, operational and forensic requirements.

  1. Declare the incident and name an incident lead. Open a controlled incident record with a reliable contact method, current time, decision log and list of participants. Bring in security or IT, privacy and legal, operations, communications and the business owner. For an AI deployment, add the model or vendor relationship owner and the people responsible for identity, API credentials, connected repositories and deployed applications. Consider an independent forensic investigator when internal capacity or independence is insufficient.
  2. Stop the most dangerous ongoing activity. Restrict affected accounts, endpoints, integrations or model routes in a way that matches the threat. If equipment must be isolated, follow the Federal Trade Commission’s guidance to take it offline without turning it off before forensic experts arrive. Do not wipe, reimage, reset or otherwise alter systems simply to make the incident disappear.
  3. Preserve volatile evidence. Protect memory, short-retention logs, identity-provider records, cloud audit trails, provider logs, application telemetry and relevant files. Record who collected each item, when, from which system and by what method. Preserve a copy in a controlled location and document any transformation or export.
  4. Protect credentials without erasing the trail. If a key, token or password is believed stolen, coordinate revocation or rotation with responders. Capture the credential’s identifier, scopes, creation and last-use details, associated accounts and observed activity before changing it where that can be done safely. Update authorized users’ credentials when compromise is indicated.
  5. Set an initial fact-finding window. Record the earliest known suspicious event, latest confirmed activity and systems that may have been touched. Mark assumptions as provisional; scope will change as logs and interviews produce new facts.

The Federal Trade Commission’s Data Breach Response: A Guide for Business states: “Do not destroy evidence.” That instruction applies even when rapid containment is necessary.

How to organize the response team

Assign accountable roles

  • Incident lead: sets priorities, approves containment and maintains the decision log.
  • Security and IT: collect technical evidence, analyze identity and network activity, and implement isolation or access changes.
  • Privacy and legal: classify the data, assess legal and contractual duties, preserve privilege where appropriate and coordinate with authorities.
  • AI and vendor owner: obtains provider cooperation, confirms model, endpoint, retention and access settings, and identifies connected data flows.
  • Business and operations owners: identify safety, service and customer effects and set recovery priorities.
  • Communications: prepares consistent internal, customer, regulator and public messaging through a designated spokesperson.
  • Forensic specialists: independently determine source, persistence, scope and evidence needs when the organization lacks the required expertise.

Establish controlled communications

Use a single incident channel and a separate protected location for sensitive legal or personal information. Require participants to timestamp material decisions and identify the person who made them. Tell employees where to report suspected exposure, prohibit speculation in public channels and route media or customer questions to the communications point person. Preserve relevant messages as part of the incident record.

How to contain an AI incident without losing evidence

Containment is a trade-off, not a single button. The safest action depends on whether access is continuing, how quickly evidence disappears, and what harm or operational disruption an action could cause.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Containment option Evidence considerations Continuing-exposure effect Continuity impact Use when
Disable an exposed integration or connector Capture connector configuration, recent activity and permission history first when feasible Stops the suspected data path Workflows using that connector may stop A specific repository, plug-in or tool is implicated
Restrict a model endpoint or route Preserve request, response, authentication and gateway logs before retention expires Limits new requests through the affected route Applications may need a controlled fallback Exposure is tied to one endpoint, model or deployment
Revoke or rotate credentials Record token identity, scopes and last-use data before change when safe Blocks use of stolen credentials Legitimate automations can fail until new credentials are deployed Keys, service accounts or sessions show suspicious use
Isolate an affected host or workload Follow forensic collection procedures; avoid powering down unless responders direct it Prevents additional host activity Service on the host may be unavailable Malware, persistence or unauthorized host access is suspected
Temporarily suspend the AI feature Preserve configuration, queues and logs before suspension if possible Stops the feature from processing more data Highest user and business disruption Risk is broad, active or not yet bounded

CISA emphasizes preservation of highly volatile evidence, including memory and short-retention logs. Coordinate the order of actions with responders so a containment step does not erase the information needed to identify the attacker or prove what was accessed. Also assess whether data is still flowing to a provider or other third party and whether that flow can be paused safely.

How to investigate scope and impact

Build a fact-based scope statement and update it as evidence changes. CISA’s incident-response playbook calls for scoping, data collection and technical analysis; FTC guidance advises verifying the types of information compromised and the number of people affected.

Identify the incident path

  • Which model, provider, tenant, endpoint, application or local deployment was involved?
  • Was the initial access caused by a stolen credential, excessive permission, vulnerable application, compromised workstation, malicious file, provider incident or configuration error?
  • What persistence or repeat-access method could remain, such as a service account, token, scheduled job, connector or unauthorized administrator?
  • What is the earliest and latest time that access could have occurred, including time-zone assumptions?

Map data that could have been exposed

  • Prompts, conversation history, model outputs, uploaded files, system instructions and evaluation data.
  • Documents, databases, code repositories, ticketing systems or storage locations reachable through tools and connectors.
  • Personal information, credentials, financial records, health information, confidential business material, regulated data or customer content.
  • Metadata such as user identifiers, timestamps, filenames, IP addresses and access permissions.

Do not infer exposure solely because a system was reachable. Distinguish between data that was potentially accessible, data shown in logs as accessed, data confirmed exfiltrated and data whose status remains unknown. Preserve the evidence supporting each category.

Measure operational and human impact

Record which services, customers, employees, partners and business processes were affected. Note downtime, altered outputs, unsafe recommendations, corrupted records, unauthorized actions and any decision made using a potentially manipulated model. Determine whether other organizations’ data was present and whether your organization is a controller, processor, service provider, business associate or another role under an applicable law or contract.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Request provider evidence carefully

Ask the AI provider or hosting partner for the incident window, affected environments, authentication and access logs, retention settings, relevant sub-processors, containment already performed and available forensic artifacts. Preserve the request and response. Provider logs may be incomplete or retained for a short period, so make the request promptly and avoid assuming that every AI system records prompts, outputs or connector activity.

When must you notify people or authorities?

Notification is a legal and factual decision, not an automatic consequence of using AI. Consult counsel on:

  • The exact data elements and whether they meet the applicable definition of personal or regulated information.
  • The jurisdictions of affected individuals, customers, employees and entities.
  • Your organization’s legal role and any obligations imposed by contracts, sector rules or customer agreements.
  • Whether unauthorized access, acquisition, disclosure, loss or use occurred under the relevant law.
  • Required recipients, content, delivery method, regulator reporting and law-enforcement coordination.

The FTC states that all U.S. states, the District of Columbia, Puerto Rico and the U.S. Virgin Islands have breach-notification legislation for security breaches involving personal information, but requirements vary. Check the law for each affected location with counsel; there is no single U.S. deadline that applies to every AI incident.

Health information requires a separate analysis

The FTC’s Health Breach Notification Rule describes notification without unreasonable delay and within 60 calendar days of discovery for certain required notifications by covered entities. That is not a general deadline for all AI incidents. Establish whether the rule covers the organization and event, identify the recipients and coordinate with counsel. HIPAA may also apply to covered entities and business associates, with its own requirements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Coordinate timing and content

Law enforcement may ask an organization to delay notice when immediate disclosure would impede an investigation. Counsel should coordinate timing with the relevant authority and contractual partners. A notification should state what is known, what information was involved when established, what the organization has done, what recipients can do now and how to obtain help. Do not include unverified claims, expose another person’s information or publish technical details that would create additional risk.

How to communicate during the incident

Internal message

Tell staff what systems or features are restricted, how to report suspicious activity, which credentials or devices they must protect, and where official updates will appear. Explain that investigation findings may change and prohibit forwarding unapproved details.

Customer, partner and regulator message

Use plain language and separate confirmed facts from ongoing investigation. Identify the affected service or time period when known, explain practical steps such as password changes or monitoring, provide a support contact and state when the next update will be issued. If a business customer’s data may be involved, coordinate contractual notice and evidence sharing with that customer’s response team.

Public statement

Publish only through the designated communications point person after legal and technical review. Avoid minimizing the event, blaming users before evidence supports that conclusion or promising that no data was accessed when the investigation cannot establish it. Correct material errors promptly and preserve each version of the statement.

How to remediate and recover safely

Fix the access route

  • Remove malicious code, persistence and unauthorized accounts.
  • Patch the vulnerable application, operating system, identity service or connector.
  • Reduce excessive permissions and separate development, test and production AI environments.
  • Revoke exposed API keys, tokens, sessions and service accounts; issue replacements with the minimum required scopes.
  • Review vendor access, data-retention settings, prompt and output handling, logging and cross-tenant controls.
  • Close the monitoring or alerting gap that allowed the activity to continue unnoticed.

These actions should be based on the confirmed or reasonably suspected cause. Rotating a key alone does not remediate an attacker who retains another path or an overprivileged account.

Validate before restoring normal operations

  1. Confirm that the vulnerability or access route is closed and that unauthorized accounts, jobs, connectors and tokens are removed.
  2. Use independent checks, code review, configuration review and targeted testing to verify the fix.
  3. Restore from clean, trusted sources. CISA recommends using offline, encrypted backups according to service priorities and warns against reintroducing compromised systems.
  4. Restore a limited function or isolated environment first and monitor authentication, data movement, prompts, outputs and administrative activity.
  5. Expand service gradually when validation shows that controls hold under normal load.

Do not restore a system merely because it is available. Recovery is complete only when the organization has evidence that the environment is trustworthy enough for the data and service involved.

AI-specific checks after containment

Once immediate risk is controlled, review the AI data path rather than focusing only on the model. Document:

  • Every model, provider, region, endpoint and application involved.
  • Prompt, output, file-upload, retrieval and tool-call pathways.
  • Connected repositories, service accounts, OAuth grants, API keys and permission scopes.
  • Retention, deletion, training-use and administrative-access settings that applied during the incident.
  • Human approval points for actions that can change records, send messages, transfer funds or disclose information.
  • Logging coverage, clock synchronization, retention periods and alert thresholds.
  • Contractual requirements for provider notification, audit support, sub-processors and customer data handling.

Reissue or revoke credentials when the investigation indicates exposure, and record why a credential was retained or replaced. The available general response guidance supports fixing vulnerabilities and restoring safely; it does not establish a universal control set for every AI platform, so validate each control against the deployment and provider contract.

What to document and how to improve the next response

Maintain a final incident record that another qualified responder can understand without relying on memory. Include the timeline, systems and data in scope, evidence inventory and chain of custody, decisions and approvers, containment and recovery actions, notifications, costs, service impact, unresolved uncertainty and the rationale for closing the incident.

Run a post-incident review after operations stabilize. Ask:

  • How was the incident detected, and what signal was missing or delayed?
  • Which identity, connector, provider or application control failed?
  • Did containment preserve the evidence needed to determine scope?
  • Were legal, contractual and customer decisions made with the right facts and timing?
  • Could an attacker or accidental user repeat the same path?
  • Which playbooks, contacts, access reviews, logging settings and exercises need updating?

Assign owners and due dates for corrective actions, then test the changes. Update the AI inventory, data-flow diagrams, vendor records, retention decisions and incident contacts so the next response begins with current information.

Response checklist

  • Incident lead and multidisciplinary team appointed.
  • Decision, contact and evidence logs opened.
  • Ongoing exposure limited with forensic needs considered.
  • Volatile logs, memory and relevant provider records preserved.
  • Credentials, integrations, endpoints and connected stores identified.
  • Incident window, affected data, people, systems and operational effects scoped.
  • Legal, contractual, sector and jurisdictional notification duties assessed with counsel.
  • Communications coordinated through a designated point person.
  • Access route fixed and credentials or permissions reduced where warranted.
  • Clean recovery sources validated before restoration.
  • Post-incident lessons converted into owned, testable improvements.
