Do not ignore a Section 74 notice or answer it with a generic denial. First preserve the notice and proof of service, identify every tax, refund or input-tax-credit allegation and its period, reconcile the proposed figures with your records, and prepare a point-by-point factual and legal response. Where Rule 142 applies, the electronic reply is generally filed in FORM GST DRC-06 when the notice summary was uploaded in FORM GST DRC-01. Check the notice, current GST portal instructions, applicable State GST provisions and the live law before filing or paying. A chartered accountant or tax lawyer should review a contested or high-value case.
What a Section 74 notice alleges
Section 74 of the Central Goods and Services Tax Act, 2017 (CGST Act) is the fraud-related route for recovering:
- tax that was not paid or was short paid;
- an erroneous refund; or
- input tax credit that was wrongly availed or utilised.
The allegation must also involve fraud, wilful misstatement, or suppression of facts to evade tax. A notice that shows only a numerical difference does not, by itself, establish that separate Section 74 ground. The proper officer’s notice asks the recipient to show cause “requiring him to show cause as to why he should not pay the amount specified in the notice” (CGST Act, section 74(1)). It normally proposes tax, interest under section 50 and a penalty.

Your reply should deal with both. The notice may also invoke corresponding provisions of a State GST law; check the exact statute and authority named in the document.

First 24 hours: preserve the record and calculate the real deadline
Save every version of the notice
Download the PDF from the GST portal and save the portal message, email or other service record, annexures, relied-upon documents, and any earlier communication such as FORM GST DRC-01A. Keep the original file names and timestamps. If the notice was served by more than one method, record each date; do not assume that the date you opened the document is the legal date of service.
Read the response instruction, not a generic calendar
There is no safe universal response period that can be printed for every notice. The operative date, filing method, hearing information and annexure requirements come from the notice, the applicable rules and the current portal. Calculate the due date from the actual notice and service facts, then have a professional check the calculation if limitation or an extension may matter. A portal outage, amendment, court order or notified extension can change the practical filing position.
Protect the portal account and evidence
Restrict editing access to the GST records used for the response. Export relevant return data and ledgers, and keep a read-only copy of every document ultimately uploaded. If another person prepares the filing, record who approved the factual statements and calculations.
Build an allegation-and-evidence map
Before drafting prose, convert the notice into a working schedule. Make one row for each distinct allegation, period and calculation rather than one row for the entire demand.
| Column | What to record |
|---|---|
| Issue | Tax short payment, erroneous refund, or wrongly availed/utilised credit |
| Tax period | Financial year, return period, invoice dates and any erroneous-refund date stated |
| Amount | Tax, interest, proposed penalty and the officer’s calculation |
| Legal basis | Section 74 provision, relevant charging or credit rule, and any State GST counterpart |
| Evidence cited | Invoices, return comparisons, statements, inspection material or third-party data listed by the officer |
| Your position | Admitted, disputed, partly admitted, not traceable, or incorrectly described |
| Supporting record | Specific file name, page number and an explanation of what it proves |
This schedule prevents a common failure: answering the arithmetic while never addressing why section 74, rather than an ordinary short-payment provision, is said to apply. It also exposes whether the notice has omitted a period, double-counted an invoice, used the wrong rate, or attributed another taxpayer’s transaction to you.

Reconcile the demand with your books and returns
For output-tax allegations
Compare the officer’s transaction list with sales registers, tax invoices, credit and debit notes, e-invoice data where applicable, e-way bills, GSTR-1, GSTR-3B, annual returns, payment challans and the general ledger. Tie each disputed invoice to the return period in which tax was declared or should have been declared. Check amendments and credit notes separately; a document appearing in a later period may explain an apparent earlier mismatch.
For input-tax-credit allegations
Reconcile the claimed credit to purchase invoices, goods-receipt records, contracts, payment evidence, accounting entries, GSTR-2B or other matching data used for the relevant period, and reversals or re-availments. Separate an ineligible category of credit from a timing or matching difference. If credit was reversed voluntarily, show the return, ledger entry and interest calculation rather than merely asserting that it was corrected.

Reconstruct the refund application, statement of invoices, export or supply documents, bank-realisation or other eligibility records, calculation of the claim, sanction order and subsequent adjustments. Identify whether the alleged error is eligibility, computation, duplicate claim or documentary deficiency. Do not claim a document exists until you have located it.
Test the officer’s arithmetic
Recalculate taxable value, rate, cess, interest period, credit utilisation and any offsetting payments. Note whether the notice treats tax as unpaid even though it was paid under another head or period, and whether interest is calculated on the legally relevant amount and dates. Put your reconciliation in a schedule that lets the officer follow every figure back to a source record.
Address the Section 74 fraud-related ground separately
Use a dedicated heading for “fraud, wilful misstatement or suppression of facts.” For each factual assertion in the notice, state what is accepted, what is denied and what evidence supports your position. Explain why a classification mistake, clerical error, delayed reporting, bona fide interpretation or data mismatch does not establish an intent to evade tax when that is the position supported by your records.

Do not simply write that there was “no fraud.” Identify the specific disclosure, return, invoice, correspondence or departmental interaction that put the relevant facts on record, or explain why the alleged fact was not material to the tax outcome. Conversely, if records show an error, quantify it accurately and distinguish an admitted tax correction from an unsupported inference about intent. A credible reply can concede an amount while contesting the section 74 characterization, or dispute both, provided the positions are clearly separated.
Draft the reply in a point-by-point format
A practical structure is:
- Case identification: GSTIN, notice number and date, tax periods, authority and the date and mode of service.
- Preliminary issues: limitation, jurisdiction, missing annexures, incorrect taxpayer details or an inability to understand a calculation. Ask for relied-upon material that was not supplied.
- Issue-wise response: reproduce a short description of each allegation, then give the facts, calculation, legal submission and document references.
- Section 74 ground: respond to each alleged act of fraud, wilful misstatement or suppression and explain why the statutory test is or is not met.
- Amount schedule: show the proposed tax, your accepted or disputed amount, payments already made, interest position and penalty position.
- Relief requested: ask for the demand to be dropped or corrected, records to be considered, and a personal hearing before an adverse order.
- Verification and annexure index: sign through the authorised person and list every attachment with page ranges.
Use plain headings that match the notice. A long narrative without cross-references makes it difficult to see which allegation each document answers. Number pages, bookmark a PDF if possible, and ensure scans are legible and within the portal’s file-size limits.
File the response through the prescribed route
FORM GST DRC-06
Rule 142(4) provides that the representation or reply to a notice whose summary has been uploaded electronically in FORM GST DRC-01 is furnished in FORM GST DRC-06. Confirm that the notice in your case was issued and summarised in that manner, then follow the current portal path and any instructions printed in the notice. Portal labels and validation requirements can change.
Submission checklist
- Enter the notice reference and period exactly as shown.
- Upload the signed reply and an indexed set of annexures in readable formats.
- Describe any payment already made and attach the relevant challan or acknowledgement.
- Submit using the authorised signatory or permitted electronic verification method.
- Download the acknowledgement, ARN or filing receipt and the final uploaded files.
Keep proof of a successful submission. A draft saved in the portal, an email to an officer or a payment challan alone is not a substitute for the prescribed reply. If technical failure prevents filing, capture screenshots and error messages, notify the authority through the channel stated in the notice, and seek a documented extension or alternative filing direction rather than waiting silently.
Ask for a personal hearing
Section 75 contains hearing safeguards. Make a written request in the DRC-06 reply or in a separate submission, identify the issues on which oral clarification is needed, and retain evidence that the request was received. A hearing is especially important where the officer relies on third-party data, proposes an adverse inference about intent, rejects a reconciliation, or changes the calculation after your reply.

Prepare a short hearing brief with the allegation schedule, disputed figures, key documents and the exact relief sought. After the hearing, record any undertaking or document requested by the officer and submit it through a traceable channel. The eventual order should state the relevant facts and the basis for the decision; compare it line by line with the notice and your submissions.
Should you pay, contest, or use both routes?
Payment can reduce exposure, but it can also affect the practical strategy in a disputed case. Decide only after comparing liability, the section 74 evidence, limitation and the statutory consequence of the chosen route.
| Route | Timing and legal effect | Questions to check |
|---|---|---|
| Self-ascertainment before service | Section 74(5) permits payment of tax with applicable interest on self-ascertainment or the officer’s ascertainment before service of the notice, with intimation to the proper officer. | Is the amount correct? Does payment address the underlying allegation, and is the payment properly intimated? |
| Payment after notice | Under section 74(8), paying the specified tax and interest within 30 days of issue of the show-cause notice means no penalty is payable and proceedings in respect of that notice are deemed concluded. | Does the 30-day period run from the date stated in this notice? Is the specified amount complete, and is this outcome acceptable? |
| Contest through reply and hearing | The officer determines tax, interest and penalty after considering the representation. Section 74(9) provides for a penalty equivalent to the tax where the case is determined under that provision. | Can the demand, the section 74 ground, or both be disproved? Are limitation and procedure preserved? |
| Part payment with a continuing dispute | A payment may be reported through the applicable GST process, including DRC-03 where permitted, but its effect depends on the notice, current rules and the wording of the submission. | Will the payment be treated as admission, and how will the disputed balance and penalty be recorded? |
Rule 142 discusses DRC-03 for intimating payments and related acknowledgement or order forms. The CBIC-hosted rules text commonly consulted for these forms is amended through 1 January 2022, so verify later amendments and the current portal workflow before relying on a form sequence. Do not pay merely to obtain a nominal closure if the amount, period or statutory basis is wrong; obtain case-specific advice on whether a protective or partial payment is legally available.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Check limitation and what happens if Section 74 fails
Section 75(2) provides that when an appellate authority, tribunal or court concludes that the fraud, wilful-misstatement or suppression ground is not established, the tax is to be determined as if the notice had been issued under section 73. That conversion is not an automatic cure for a late notice.
CBIC Circular 185 discusses situations in which the original section 74 notice was beyond the applicable section 73 notice deadline. It refers, for the situations described there, to a notice period of two years and nine months. That figure is not a universal deadline for every section 74 case. Examine the relevant financial year or erroneous-refund date, statutory extensions, issuance and service dates, court stays, amendments and any special notification. Raise a limitation objection explicitly and preserve it in the reply; do not assume the officer will apply it without a submission.

Section 128A: a narrow, conditional relief provision
Section 128A and Rule 164 concern conditional waiver of interest or penalty, or both, for specified section 73 demands. CBIC Circular 238/32/2024-GST describes coverage for section 73 demands relating to financial years 2017-18, 2018-19 and 2019-20 and discusses 31 March 2025 as the notified full-payment date for the cases covered there.
This is not a blanket waiver for a demand that remains under section 74. If an order is changed or redetermined under section 73, eligibility still requires separate analysis under the current Act, rules, notifications and circulars. Do not claim relief until the exact order, period, payment date and statutory conditions have been checked.
After filing: monitor the order and next deadline
Keep a calendar entry for the expected order, hearing date, requested documents and any payment or appeal deadline. Review the order immediately on the portal and download the complete document. Check whether it:

Quick Recap
Common mistakes that weaken a response
- One-line denial: It leaves the calculation and each alleged act unanswered.
- Ignoring intent: Contesting tax alone does not answer why section 74 is invoked.
- Unindexed attachments: The officer cannot reliably connect a document to an invoice or allegation.
- Unverified data: A taxpayer should not assert that an invoice, payment or reconciliation exists without checking the underlying record.
- Missing the filing receipt: Without the acknowledgement and final uploaded copy, proving a timely reply is harder.
- Assuming a payment ends everything: The amount, date and statutory route determine the consequence.
- Using an old form instruction: Rules and portal screens change; confirm the current process.
- Leaving limitation until appeal: A limitation objection should be raised and supported in the original response.
