Act immediately, preserve the service timeline, answer every allegation with documents, request the statutory hearing, and verify the penalty calculation before choosing payment or security. A detention under section 129 of the Central Goods and Services Tax Act, 2017 (CGST Act) concerns goods or a conveyance in transit where the officer alleges a contravention of the Act or rules. The notice, its service date, the applicable state or Union Territory law, and the underlying transport records determine what response is possible. This guide explains how to handle a GST detention notice, including GST MOV-07, and how to appeal an adverse order without treating a general explanation as case-specific legal advice.

A section 129 detention is not the same thing as a final penalty order. The officer must identify the alleged contravention, issue the statutory notice, provide an opportunity of hearing, and then determine the amount by order. Your first task is therefore to control the record and the dates, not to make an immediate unsupported admission.

How to respond to a GST detention notice in the first 24 hours

  1. Secure every document. Download or scan the detention or seizure order, GST MOV-07 or other notice, inspection report, e-way bill and validity history, invoice, delivery challan, transport receipt, vehicle and driver records, registration certificates, correspondence, payment challans, security documents, and any release or final order. Keep the original files and a read-only copy.
  2. Create a dated chronology. Record the detention or seizure date, notice issue date, actual service date, proposed hearing date, hearing attendance, order date, and the date the order was communicated. Section 129 states that the notice is to be issued within seven days of detention or seizure and that the order is to be passed within seven days from service of the notice. Do not substitute an internal forwarding date for the statutory service date.
  3. Identify the correct parties. Determine whether the goods owner, transporter, consignee, consignor, or an authorised representative is responding. Confirm the GST registrations, the state or Union Territory jurisdiction, and who is legally able to furnish security or make payment.
  4. Prevent further movement of the goods. Tell the driver, warehouse, consignee, and logistics team not to move or dispose of the detained goods or conveyance without written release instructions.

These steps protect evidence while you obtain advice from a qualified GST professional where the amount, goods, or business interruption makes the decision material.

What section 129 covers

Section 129 applies when goods transported or stored while in transit are alleged to be in contravention of the CGST Act or rules. The notice should therefore be read as a specific allegation about a particular movement, document, data entry, or other fact. A missing or mismatched document is not automatically harmless, and a clerical explanation is not automatically sufficient. The outcome turns on the notice, contemporaneous evidence, the applicable law, and the officer’s recorded findings.

State and Union Territory GST laws and local enforcement practice can affect the file. Confirm which authority issued the notice, whether the relevant state or Union Territory enactment is cited, and whether any amendment applies on the detention date. Do not rely on an old form, a forwarded message, or a summary of section 129 when the actual notice is available.

What should I do after receiving GST MOV-07?

MOV-07 is commonly used as the notice stage in the detention process. Treat the document you received as the controlling record: check its document number, issue date, service method, alleged contravention, goods and conveyance details, proposed amount, hearing date, and the officer’s contact or filing instructions. The GST Portal’s published FAQ identifies enforcement orders, including section 129 orders, as appealable, but the available FAQ material does not establish a complete universal online reply workflow for every MOV-07 case. Follow the instructions on your notice and the current portal workflow for your jurisdiction.

A notice proposing an amount is different from an order determining that amount. The right to be heard applies before the penalty is determined under section 129(3) and (4). Preserve the notice separately from any later order so that you can prove which document was served and when.

Build the factual response before writing

Match the goods to the records

Compare the description, quantity, unit, value, HSN or other classification information, consignor, consignee, delivery address, and vehicle details across the invoice, e-way bill, transport receipt, purchase or sales order, packing list, and accounting records. Explain any difference with dated source documents. If the goods were trans-shipped, rerouted, returned, or divided into consignments, create a short movement schedule showing each vehicle and location.

Check the e-way bill and invoice history

Save the e-way bill as it appeared on the relevant date, including its validity period, extension history, rejection or cancellation entries, and the person who generated it. Check whether the invoice number, date, taxable value, tax amounts, vehicle number, and party GSTIN were entered correctly. A later corrected document does not by itself prove what was available during transit; explain the timing and preserve system records.

Test the conveyance and route allegation

Collect the vehicle registration, lorry receipt, driver authorisation, toll or GPS records if available, loading documents, and route explanation. If the officer alleges that the vehicle was not the one declared, show when the vehicle changed and why. If the vehicle was stopped outside the expected route, provide delivery schedules or operational records rather than a bare denial.

Separate evidence from argument

Make an index with exhibit numbers and a one-line purpose for each document. Mark documents that are originals, portal downloads, or copies. Avoid sending irrelevant files that obscure the answer. Keep a complete submission package, including the covering letter and proof of filing.

How to file the written reply and request the hearing

  1. Address each ground separately. Reproduce or identify the allegation, state whether you admit, dispute, or cannot verify it, and cite the attached document that supports your position.
  2. Explain dates and causation. If a data entry was corrected, say when it was discovered, who made the correction, and whether the physical goods and tax invoice remained identifiable throughout transit. Do not describe a lapse as merely clerical without evidence of what actually happened.
  3. Challenge unsupported assumptions. Ask the officer to identify the statutory provision and facts relied upon for any allegation not stated clearly in the notice. Point out contradictions between the inspection report, e-way bill, invoice, and proposed calculation.
  4. Request the hearing expressly. Section 129(4) states: “No penalty shall be determined under sub-section (3) without giving the person concerned an opportunity of being heard.” State the preferred hearing date or request reasonable notice, identify the authorised representative, and ask that oral submissions and documents be taken on record.
  5. File and prove service. Use the channel specified by the notice or the jurisdiction’s current portal procedure. Obtain an acknowledgement, ARN, email delivery record, stamped copy, or other proof. If a portal fails, take screenshots, note the time, and use the alternative channel permitted by the officer or local instructions.

Bring the same indexed bundle to the hearing. Ask for a copy of any statement, inspection record, or calculation relied upon but not previously supplied, and request time to answer genuinely new material.

Check the section 129 amount yourself

Do not accept the proposed figure merely because it appears on MOV-07. Section 129(1) uses different routes depending on whether the owner comes forward, and it distinguishes taxable from exempt goods. The currently displayed CBIC Act text states the following framework:

Situation Statutory calculation described in the CBIC text What to verify
Taxable goods; owner comes forward Penalty of 200% of the tax payable Taxable value, classification, applicable rate, tax computation, and evidence that the owner came forward
Taxable goods; owner does not come forward Higher of 50% of the value of the goods or 200% of the tax payable Value adopted by the officer, tax amount, owner-status finding, and the clause used
Exempt goods Separate percentage and value caps apply under the statute; the exact applicable cap must be read from the current provision Exemption entry, value basis, amendments effective on the relevant date, and the officer’s formula

The table is a framework, not a substitute for checking the current Act and the notice. Confirm whether the goods are taxable or exempt, whether the owner has come forward in the legally relevant sense, whether the officer used the correct value and tax rate, and whether an amendment changed the rule on the detention date. Ask for the arithmetic in a line-by-line schedule if the notice gives only a total.

Choose between payment, security, and contesting

Section 129 permits release on payment of the applicable amount and also permits release on security equivalent to the amount payable in the prescribed form and manner. The practical choice depends on urgency, cash flow, documentary strength, the cost of delay, and advice on the merits.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Payment

Payment can secure release where the statutory and portal requirements are met. Section 129(5) states: “On payment of amount referred in sub-section (1), all proceedings in respect of the notice specified in sub-section (3) shall be deemed to be concluded.” Treat that language seriously when deciding whether to pay while disputing the notice. Obtain the challan, payment reference, officer’s acknowledgement, release order, and any communication showing what was released and on what date.

Equivalent security

Security may preserve working capital, but it must be in the prescribed form and manner and for the amount required. Confirm the acceptable instrument, issuing institution, validity, renewal terms, beneficiary, and submission process with the proper authority. Keep a copy of the instrument and proof of acceptance. Security is not the same as winning the dispute; it is a route to release subject to the statutory process.

Continue the merits response

If you contest the allegation, file the factual and legal response even when commercial urgency leads to payment or security. Do not assume that a release order resolves every issue in the file. Maintain separate folders for the notice, hearing record, payment or security, release, and final order.

What records prove release and conclusion?

A release order following payment or security should be preserved separately from the notice and any final adjudication order. The Supreme Court material discussing an MOV-07 demand and subsequent release illustrates why the sequence matters, but the facts of that case should not be treated as a universal result for every detention.

Do not ignore the 15-day disposal consequence

Section 129(6) describes potential sale or other disposal of detained goods or the conveyance when the amount remains unpaid, after 15 days from receipt of the subsection (3) order, subject to the prescribed manner and time. If goods remain detained, calculate that period from provable receipt of the order, ask the authority what disposal step is contemplated, and escalate immediately. Do not wait for an informal assurance from a driver or warehouse employee.

How do I contest a GST Section 129 penalty?

If the officer issues an adverse order, the first appeal route described in the Act is section 107. The general time limit is three months from communication of the order. Section 107(4) allows a further month where sufficient cause prevented filing within the normal period. Treat the communication date as a controlled deadline: save the portal download, email, or other service record and calendar the last day immediately.

Check what the order demands

Determine whether the order demands only a penalty or also tax and other amounts. Separate the admitted amount from the disputed amount. The currently displayed CBIC text states that, for an order demanding penalty without tax, the pre-deposit is 10% of the penalty; the amendment note on that page states that this proviso took effect on 1 October 2025. Verify the current statutory wording, the classification of your order, and the filing facts before calculating the deposit.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Prepare the section 107 filing

  1. Identify the order number, issuing authority, date, and communication date.
  2. State the grounds of appeal in numbered form, linking each ground to the notice, evidence, hearing record, or calculation error.
  3. Pay any admitted amount and the applicable statutory pre-deposit through the permitted process.
  4. Upload the order, statement of facts, grounds, evidence index, authorisation, and payment proof in the required format.
  5. Submit using the available digital signature certificate or electronic verification code method and save the acknowledgement.

The GST Portal FAQ says that section 129 enforcement orders are appealable and that an online appeal may be filed using DSC or EVC. Portal labels and document limits can change, so follow the current screen and local instructions rather than an old screenshot.

Appeal grounds that depend on the file

Potential grounds must be tied to evidence, not copied from a template. Examples include failure to identify a specific contravention, a calculation based on the wrong tax rate or value, an incorrect finding that the owner did not come forward, reliance on material never supplied for response, denial of the statutory hearing, a notice or order outside the stated statutory time, or a mismatch between the goods inspected and the goods described in the order. Whether any ground succeeds depends on the facts, the applicable state or Union Territory law, amendments, and the complete record.

Ask the appellate authority to examine the exact relief sought: release, cancellation or reduction of penalty, correction of the calculation, refund or adjustment consequences where legally available, or another order permitted by the statute. Do not assume that filing an appeal alone automatically releases goods or suspends every recovery step; check the order and procedural directions.

Common mistakes and how to correct them

Missing the service date

Problem: The business counts from the day an employee forwards the notice internally. Correction: preserve the actual portal, email, or physical-service evidence and calculate the statutory period from the legally relevant event.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Sending a generic “clerical error” reply

Problem: The response labels the discrepancy without proving the physical movement, identity of goods, or correction history. Correction: provide a dated explanation and the document that proves each factual step.

Ignoring owner status

Problem: The business accepts the higher calculation without checking how the notice decided that the owner did not come forward. Correction: state who owns the goods, who appeared, when representations were made, and which records establish that position.

Confusing release with adjudication

Problem: Staff file the release order and discard the notice or payment record. Correction: keep a complete chronological file and identify the separate order, if any, that determines penalty.

Waiting to appeal

Problem: The appeal deadline is calculated from a later internal review. Correction: calendar three months from communication immediately, track the possible one-month sufficient-cause extension, and verify the pre-deposit before filing.

A practical decision checklist

  • Have you saved the notice, inspection report, and proof of service?
  • Can you prove the detention date and the seven-day notice and order intervals?
  • Does the notice identify the precise Act or rule contravention?
  • Do the invoice, e-way bill, vehicle, route, and goods records tell one consistent story?
  • Have you requested the hearing and preserved proof of submission?
  • Is the owner-coming-forward status supported by the record?
  • Is the taxable or exempt classification and penalty arithmetic correct?
  • Are payment, security, release, and final-order records stored separately?
  • If the amount remains unpaid, have you assessed the section 129(6) disposal risk?
  • If an adverse order was communicated, have you calculated the section 107 deadline and pre-deposit under the current text?

Bottom line for a detained consignment

Respond to the actual notice, not a summary of it. Lock down the dates, prove the movement and documents, demand the hearing required by section 129, test the owner-status and goods-based calculation, and make a deliberate payment-or-security decision. If the final order is adverse, preserve its communication date and use the section 107 appeal process within the statutory window after checking the current pre-deposit rule. Because state or Union Territory law, amendments, service facts, and the evidence can change the result, obtain advice on the complete file before making an irreversible payment or allowing the disposal period to run.
