Start with the agency that operates or holds the automated license plate reader (ALPR) system, then request the current policy, retention schedule, audit and sharing records before seeking data about one vehicle. Describe any plate-specific request with the issuing state, dates, approximate locations and record type. Whether police must disclose a scan, image, query log or alert depends on the jurisdiction, the agency’s policy and any investigation-related exemption; there is no universal right to inspect every scan of a vehicle.
Use the process below as a practical framework, not as a promise of access. State and local public-records laws control most police databases. Federal Privacy Act procedures apply only to qualifying federal systems, and California’s detailed ALPR rules are a state example rather than national law.
What automated license plate reader data contains
An automated license plate reader combines a fixed or mobile camera with software that captures and records plate information. A record can include the interpreted plate number, the original image, date and time, location, an alert generated by the system, and information about a user query or later access. A single agency may hold several related records rather than one file.
That distinction matters when you make a request. A policy, contract or audit report describes how the system operates. A scan or image describes a particular observation. A query log identifies an account or user action. A sharing record documents a transfer to another agency. Each category can have different exemptions, retention rules and privacy concerns.

First determine who holds the records and which law applies
Identify the police department, sheriff’s office or other public agency that operates the cameras or controls the database. If several agencies share a system, find the government agency responsible for the database as well as any contractor maintaining it for the agency. Send a public-records request to the agency’s records or public-records unit; sending it only to a technology vendor may not start the legal process.
Before asking for individual scans, determine whether the record is held by a local or state agency, a federal agency, or a private party acting for an agency. Local and state requests follow the applicable state public-records statute and the agency’s procedures. A federal request may use the Freedom of Information Act, while the Privacy Act can provide access or amendment procedures for records about an individual in a covered federal system of records. The federal Privacy Act is not a general route to local police records, and you must confirm that the particular database is covered.
Ask the records unit for the correct submission channel, fee rules, identity or authorization requirements, response method and appeal contact. A city, county and state agency can have different forms and deadlines. Do not assume a timeline or remedy described by one agency applies to another.

The policy tells you what the agency says it collects, who may search it, how long records are retained, when information may be shared and how audits occur. Request the current version and any superseded version that covers your date range. Also request:
- the retention and deletion schedule;
- the system inventory, camera locations or deployment description, if public;
- the vendor contract, amendments and service-level terms;
- data-sharing or interagency agreements;
- access-control and audit procedures;
- training materials and user instructions;
- audit findings, inspection reports and complaint records; and
- public-meeting agendas, staff reports or minutes approving the system or a major expansion.
These are existing records. A public-records law generally requires an agency to search for and disclose existing nonexempt records, not to create a new report or answer a broad questionnaire. Ask for electronic records in the format in which the agency ordinarily keeps them when practical.
California example: policy and public participation
California Civil Code sections 1798.90.5 and following govern ALPR information collected by covered public agencies. California’s SB 34 framework requires an operating public agency to provide an opportunity for public comment at a regularly scheduled governing-body meeting before implementation, and California Department of Justice guidance says agencies must maintain a written use and privacy policy. Those are California requirements; they should not be presented as a rule for every state.
California DOJ’s Information Bulletin 2023-DLE-06 and General Order 2023-05 describe written policies, security safeguards, access records, sharing controls and responses to public-records requests or litigation. A request for the policy, contract, audit or sharing agreement is therefore different from a request for identifiable location or investigative data.

Choose between an oversight request and an individual-data request

Do not combine an oversight request and a highly personal request into one vague demand. Separate letters make it easier for the custodian to search, apply exemptions and explain a partial denial.
How to request records about a particular plate
Specificity is both practical and protective. It helps the agency locate records and gives you a clear basis to challenge an incomplete search. Specificity does not itself create a right to disclosure.
- Name the custodian. Address the police department, sheriff’s office or database-owning agency public-records unit.
- Identify the plate. Give the complete plate number and issuing state. If the vehicle has had more than one plate, list each one and the relevant dates.
- Set a date and time window. Use the narrowest period that could answer your question, and state the time zone if an event occurred near a boundary.
- Describe the place. Provide a street, intersection, facility, patrol area or route. An approximate location is useful when you do not know the camera location.
- Name each record type. Say whether you seek the raw scan, associated image, alert, query history, user-access log, sharing record, related incident report or all of those categories.
- Connect it to an event. Include a citation, incident or report number when one exists, without adding unrelated personal information.
- Ask for format and fees. Request electronic copies in the existing format and ask the agency to tell you before charges exceed the amount allowed by local law or your stated limit.
- Request separable portions. Ask for nonexempt parts if a record contains information the agency says must be withheld.
Sample plate-specific request
Public-records request: ALPR records for PLATE_NUMBER, ISSUING_STATE“Please search records held by AGENCY for PLATE_NUMBER issued by ISSUING_STATE from START_DATE through END_DATE, approximately START_TIME through END_TIME, in or near LOCATION. I request existing electronic records showing (1) plate scans and associated images, (2) alerts or hit notifications, (3) query and user-access history, and (4) sharing or transfer records for those entries. The event may relate to incident or report number REPORT_NUMBER. If any portion is withheld, please identify the specific legal basis and release reasonably separable nonexempt portions. Please advise of any lawful fee before processing.”
Keep proof that you own or are authorized to use the vehicle available. An agency may ask for it, but the request itself does not establish that the agency must disclose the data to you.

How to request system oversight records
An oversight request can reveal how the system is governed even when identifiable scans are exempt. Use a separate date range for each category if necessary. Ask for the policy in force during the period, retention and deletion schedules, access and audit logs in the form the agency ordinarily maintains, findings of internal or external audits, user training, written interagency requests, transfer registers, vendor access terms, complaints and policy revisions.
California City Police Department’s 2024 policy manual is one local example that addresses access logging and written interagency requests. It illustrates the kind of record to look for, not a rule that every California or out-of-state agency follows.
Review the response: complete, partial or denied
When records arrive, preserve the original files, the agency’s cover letter and any metadata. Compare the production with each category in your request. Check whether dates, time zones, locations, plate characters and image quality are consistent. A plate reader’s interpretation can differ from the characters visible in the image, so keep both the machine result and the underlying image when provided.

A partial response should identify what was withheld or redacted and the legal basis. California DOJ’s public-records guidance says the department provides public records unless a legal exemption applies and generally releases the remainder after redaction. That guidance governs California DOJ’s process; it does not set the deadline or exemption analysis for every city, county or state agency.

Reply promptly and request, for each withheld category:
- the specific statutory exemption or other legal basis;
- whether the agency searched all identified custodians and systems;
- whether reasonably separable nonexempt portions can be released;
- whether the record is being withheld because of an active investigation, privacy concern, security issue or another stated reason; and
- the agency’s administrative review or appeal procedure and deadline.
Keep a calendar of the date you received the response. The applicable appeal or court deadline depends on the governing law; verify it in the statute, agency rules or advice from a qualified lawyer in the relevant jurisdiction. Do not rely on a California DOJ timeline for a different agency.
Can I find out whether police scanned my license plate?
You can ask, but a request does not guarantee disclosure. Use the plate-specific method above and distinguish a scan from a query. An agency may hold a scan without anyone later searching it, or a query log without releasing the underlying image. An active investigation, privacy exemption, security concern or other law may limit access.
If the agency cannot locate records, ask whether it searched the system that actually holds the data, whether the requested dates fall outside its retention period and whether another participating agency is the custodian. Ask for a written description of the search rather than assuming that “no records” means no camera observed the vehicle.
How long does police keep ALPR data?
There is no single retention period established for all police systems. The answer is usually in the agency’s written ALPR policy, records-retention schedule, contract or a related state rule. Request those documents and ask whether they distinguish between unconnected scans, alerts, records attached to an incident and audit logs.
A retention schedule can also explain deletion events and legal holds. A scan may have been deleted under the ordinary schedule while an incident-linked copy remains in a case file. Do not infer a nationwide period from another agency’s policy.

Can I see who searched or shared my plate data?
Ask specifically for user-access logs, audit reports and sharing or transfer records, identifying the plate and date range. The agency may redact user identities, investigative details or security information, and a public-records request does not necessarily reveal the identity of every officer or other person who queried the system.
Request the governing data-sharing agreements as a separate oversight category. They can show which agencies are authorized to receive information, the purpose and method of a transfer, and audit obligations even when a particular transfer record is withheld.

California sharing rules and the El Cajon matter
California DOJ guidance interprets the state’s ALPR restrictions as not permitting local agencies to share ALPR information with federal or out-of-state agencies, including law-enforcement agencies, and advises agencies to review vendor access arrangements. That is California DOJ’s interpretation of California law, not a national rule.
In a January 21, 2026 announcement, California Attorney General Rob Bonta described ongoing litigation over the City of El Cajon’s sharing practices and requested relief. The announcement states the Attorney General’s position in a pending matter; it is not a final court ruling. If your request concerns California sharing, ask for the relevant agreements, transfer records, audit findings and policy in force during the dates at issue.
What to do if an ALPR hit is wrong
Treat an incorrect match as a safety and record-integrity issue. Preserve the alert, image, report number, date, location and any notice of a stop, citation or other enforcement action. Write down exactly what is wrong: a character misread, a different vehicle, an expired plate, an impossible location or an event that did not occur.
- Contact the ALPR administrator, records custodian or agency supervisor identified in the policy.
- Request review of the underlying image, the system’s query and access logs, the alert record and any associated report.
- State the correction you seek and attach documents that support it, such as registration or time-stamped location evidence, while removing unnecessary personal information.
- Ask the agency to preserve relevant records while the complaint or case is pending.
- Request a written outcome and ask where to pursue an administrative complaint, review or court challenge if the agency does not correct the record.
California Department of Corrections and Rehabilitation’s Article 32 ALPR policy provides an example of an agency procedure: operators should visually verify a match and report invalid matches internally. The policy is agency-specific and does not establish a public correction right everywhere. You can read that policy at CDCR’s Article 32 ALPR system usage and privacy policy.
Disclosure and preservation are different requests
A public-records request seeks existing records for inspection or copying. A preservation request asks the agency not to delete relevant material while a complaint, investigation or case is pending. Send the preservation request to the records custodian and the investigator or legal contact identified in the agency’s response, describe the plate and date range, and identify the alert, report or query at issue.

Preservation does not automatically require disclosure, and whether an agency must preserve material depends on applicable law and the circumstances. Make the two requests separately so the agency cannot mistake a request to retain records for a request to release them.
Federal Privacy Act requests: when they fit
The U.S. Department of Justice explains that an individual may request access to records about that person in a covered federal system of records and may request amendment or correction, subject to statutory exceptions. Follow the federal agency’s instructions for identity verification, system identification and amendment documentation.
This route is appropriate only when a federal agency holds the database and the system is subject to the Privacy Act. It does not convert a city police ALPR database into a federal record system and does not replace the state or local public-records process.
California’s framework in practical terms
California’s Civil Code provisions, DOJ Information Bulletin 2023-DLE-06 and General Order 2023-05 illustrate why a request should separate system records from identifiable data. Policies must address use and privacy, agencies must protect the information and maintain access records, and sharing is restricted under the state’s framework. California DOJ says it will consider applicable privileges and exemptions when responding to a California Public Records Act request or litigation process involving ALPR information.
The California Attorney General’s October 30, 2023 announcement included this position from Rob Bonta: “While this technology may be a helpful investigative tool, Californians must be able to trust that their information is being kept safe.” That is the Attorney General’s stated view, not evidence that every ALPR system is secure.
Common mistakes and how to avoid them
- Writing to the vendor only: Send the request to the public agency that controls the records, and copy the vendor only when the agency directs you to do so.
- Requesting “everything”: Give categories, dates, plate jurisdiction, locations and an incident number.
- Asking questions instead of records: Request existing logs, policies and reports; ask explanatory questions separately.
- Assuming a scan proves an identification: Request the original image and the alert or report, then compare the characters and vehicle.
- Confusing a denial with deletion: Ask whether the agency searched the correct system and whether the records were withheld, redacted or no longer retained.
- Missing a challenge deadline: Record the response date and verify the local administrative or court deadline immediately.
- Treating one state’s rule as universal: Label California requirements as California-specific and check the law where the system operates.
- Failing to preserve evidence: Save the alert, correspondence and original files, and make a separate preservation request when a dispute is active.
A practical decision path
- Need to understand the system? Request the policy, retention schedule, contract, audit materials, training and sharing agreements.
- Need to know about one vehicle? Submit a narrow plate-specific request with the issuing state, dates, locations and record types.
- Received a partial production? Compare it with your categories, request separable portions and obtain the exemption for each withholding.
- Believe the result is inaccurate? Preserve the evidence, request administrator review and ask for the underlying image, logs and report.
- Suspect unauthorized access or sharing? Request audit findings, user-access logs, transfer records and the governing agreements.
- Denied or ignored? Use the agency’s stated review, administrative appeal or court process and verify the deadline under the applicable law.
The most reliable strategy is to identify the real custodian, separate oversight records from identifiable scan data, describe the search narrowly and keep disclosure, correction and preservation requests distinct. The governing jurisdiction—not a generic ALPR rule—determines what the agency must provide and how you can challenge its response.
