To request records about a county employee misconduct investigation, send a written request under your state’s public-records law to the county public-records officer and every office likely to hold responsive files. Identify the employee, department, allegation, date range and case number; ask for existing investigative and disciplinary records, all reasonably segregable nonexempt portions, the specific legal basis for every withholding, an estimated completion date and any fees before chargeable work begins.
County personnel and investigative records are not governed by one national rule. Whether you receive a complaint, report, witness names or disciplinary findings depends on your state, whether the investigation is active or closed, which office possesses the record and the exemption the county can legally apply.
Start with the state law, not the federal FOIA
County records are generally governed by the public-records statute of the state where the county is located. The federal Freedom of Information Act is not the default route for a county employee file. Before writing, find the state statute, the county’s official public-records page and any request portal or form. Record the law’s definitions of “public record,” personnel privacy, active investigations, attorney-client material, draft documents and segregability.
Do not assume that a county’s label—“personnel file,” “internal investigation” or “confidential”—settles the question. The agency must apply the exemption that actually covers each withheld portion, and state laws differ sharply on when an exemption applies and how long it lasts.

Identify every likely records custodian
A misconduct investigation can generate separate records in several offices. Send the request to the county’s public-records officer or clerk and name the departments that may possess the material. If the county routes requests through a portal, use it and keep the confirmation number.

Ask the public-records officer to forward the request if another custodian is responsible, and name each office in the request so the search is not limited to one inbox or database.
Request existing records with a searchable scope
Public-records laws generally require production of existing records, not a new narrative or summary. Ask for the documents and data that already exist. A useful request identifies:

- the subject of the alleged misconduct and the incident location;
- the relevant start and end dates;
- the complaint, incident, case or tracking number, if known;
- the investigator, unit or outside agency, if known;
- the custodians, systems or departments to search; and
- distinct search terms, including the employee’s name, case number and allegation keywords.
County guidance commonly emphasizes dates, departments, record locations and keywords because those details let staff locate records without an open-ended search. If you know only an approximate date, state the basis for the range and use a reasonable window rather than omitting dates entirely.
Ask for the complete record set by category
List each category separately so the county cannot treat a broad request for “the file” as unclear. Request, where they exist:

- the complaint, tip, intake form and initial allegation;
- the case number, assignment, investigative plan or scope memo;
- interview notices, interview records, transcripts, statements and evidence or exhibit logs;
- the investigative report, factual findings and conclusions;
- the final disposition, discipline or corrective-action decision;
- appeal, grievance, arbitration or review outcomes;
- policies, procedures and directives in effect during the relevant period; and
- reasonably identifiable communications, calendars, routing records or logs concerning the investigation.
“Existing records” includes electronic files and existing exports. It does not require the county to create a new chronology, answer questions or calculate a statistic that is not already recorded.
Choose electronic delivery and preserve an inspection option
Request native electronic files or commonly used formats when available, and ask for an inspection appointment if copying costs are substantial or the county disputes the scope. Inspection can help you identify a report, exhibit or log that was omitted from an initial production, but it does not eliminate lawful redactions.
Protect privacy without surrendering access
State that you seek all reasonably segregable nonexempt portions and agree that legally protected personal identifiers may be redacted. This signals that you are not demanding home addresses, personal phone numbers, medical details or other protected data, while preserving access to factual findings and administrative decisions.
Ask the county to segregate and release the remainder instead of withholding an entire document. For a report containing a protected witness address and unprotected factual findings, for example, the agency should explain why the address is redacted and provide the findings if the state law requires segregation.
Do not promise that complainant, accuser or witness names will be released. Their disclosure can depend on the statute, the person’s role, safety concerns and whether the investigation is active. Ask for names only to the extent the law permits and request anonymized or redacted versions when it does not.

Adapt the following template to your state statute and facts. Keep the variable fields inside the code block and replace them before sending.

Pursuant to {{state_public_records_statute}}, I request electronic copies of existing records concerning the county’s investigation of alleged misconduct by {{employee_name}}, {{job_title}}, in {{department}}, during {{start_date}} through {{end_date}}. Please search records held by {{departments_or_custodians}} using {{case_number}}, {{incident_date}}, and the keywords {{search_terms}}.Please include the complaint or intake; investigation assignment or plan; interview and evidence logs; investigative report and factual findings; final disposition; discipline or corrective-action decision; appeal or grievance outcome; and policies in effect during the relevant period. What the county may withhold or redact
Common categories include personnel privacy information, medical information, home addresses and personal contact data, confidential legal advice, draft material, litigation-related records and active investigative material. The presence of one protected item does not automatically make every page exempt; the county should identify the exemption and release nonexempt portions when the state law requires segregation.
Active investigations
An active case is often treated differently from a closed case. Washington guidance states that some employment-law investigations may be exempt in full while active and may later be released with complainant, accuser and witness names redacted. That is a state-specific rule, not a national standard. Ask the county to state whether it considers the investigation active, what event will end that status and whether older portions can be released now.
Personnel and privacy exemptions
A personnel-file label does not itself answer whether a report is public. California Department of Justice materials identify personnel, investigative, litigation, draft and confidential-legal-advice exemptions among the categories agencies may apply. The county must still connect the claimed exemption to the particular record and disclose any portion that remains legally segregable.

Temporary investigation exceptions
Georgia describes a temporary exception for records obtained in investigations concerning suspension, firing or complaints against public officers or employees. If you are requesting records in Georgia, ask whether the temporary period has ended and whether final disposition records are treated differently from investigative material.
Misconduct and disciplinary records after disposition
Wisconsin’s June 2025 guide explains that misconduct and disciplinary records are not categorically excluded. The applicable investigation exception depends on the statute and on when the investigation reaches disposition. In that state, ask separately for the final disposition and discipline decision rather than treating the entire file as one exempt object.
Open-records policy does not erase specific exemptions
Florida Statutes §119.01 states: “It is the policy of this state that all state, county, and municipal records are open for personal inspection and copying by any person.” The policy supports access, but Florida agencies still apply specific statutory exemptions to protected material. Contra Costa County similarly states: “Anyone may make a request to inspect or obtain a copy of a public record.” Neither statement guarantees release of every personnel or investigative page.

Set expectations for timing, installments and fees
Do not insert a nationwide response deadline into your request. Response timing, extensions, installment practices and fee rules are set by the applicable state law and sometimes by county procedures. Ask for an acknowledgment, an anticipated completion date and production in installments when some records are ready before the entire search is complete.

Narrowing a date range or requesting electronic delivery may reduce copying costs, but do not assume that search time is free or billable; verify the rule in your jurisdiction.

If the county says more time is required, ask which custodians remain outstanding, what date range is being searched and when the next installment will arrive. Keep the request open rather than submitting duplicative requests that restart the process.
Read the county’s response critically
When records are produced
Check that the production includes each requested category, attachments, referenced exhibits and the final disposition. Compare filenames and dates with the case number, policy period and custodians listed in your request. If a report refers to an omitted attachment or log, make a focused follow-up request for that existing record.
When pages are redacted
Look for a redaction code, exemption citation or withholding index. If the response gives only a general reference to “personnel” or “confidential,” ask for the exact statutory subsection, the record category, the portion withheld and the reason segregation is not possible. Ask whether less-redacted versions, anonymized copies or older closed-case portions are available.

When the county withholds the entire file
Request an itemized description of each withheld record and a segregation review. Ask the agency to identify whether the case is active, whether litigation or legal advice is involved and whether the same information exists in a final disposition or policy record that can be released independently.
Challenge a denial or excessive redaction
- Make a written reconsideration request. Quote the county’s exemption language, explain why the record appears to be outside it or partly segregable, and request a revised production.
- Ask for administrative review. Depending on the state, this may be handled by the county’s records supervisor, an ombudsman, a public-records mediator or an attorney general. Use the procedure and deadline stated in the state law or county response.
- Preserve the record. Keep the original request, acknowledgment, fee estimate, productions, redacted pages, exemption index and every communication. Note the date of each denial and the date you requested review.
- Consider the state-law court remedy. Some states allow a court action to compel production and may award costs or attorney fees when the agency improperly withheld records. Filing deadlines, exhaustion requirements and fee-shifting rules are jurisdiction-specific, so verify them before filing.
A challenge should target the legal basis and the specific records, not demand that the county create a new investigative summary. You can ask for the existing report, findings, disposition and policies even when a new narrative would be easier for the agency to produce.

- Confirm the county and state public-records statute.
- Find the county’s official request channel and records officer.
- List the employee, title, department, allegation, location and date range.
- Add the case number, investigator and search terms if known.
- Name HR, the department, internal investigators and any law-enforcement or prosecutor office that may hold records.
- Request each record category separately, including complaint, assignment, interviews, evidence logs, report, findings, disposition, discipline, appeals and policies.
- Request electronic copies, inspection as an alternative and all segregable nonexempt portions.
- Ask for an exemption-by-exemption explanation, fee estimate, anticipated completion date and installment production.
- Save the submitted request and confirmation.
