Send a written public-records request to the police agency or other government body that controls the automated license plate reader (ALPR) system. Identify the system if known, give a narrow date range, and ask for both the plate-read records and the policies, retention schedules, search logs, audit trails, contracts, and sharing agreements that explain how the data was used. If the agency withholds anything, require it to identify the specific legal exception, release segregable portions with redactions, and follow the review or appeal process in that jurisdiction. Act quickly: agencies may automatically delete ALPR data after a limited period.
What license plate reader data is
Automated license plate readers use cameras and software to record a vehicle’s license plate, an image of the vehicle, and the time and location of the read. The system can compare a read with law-enforcement databases, such as lists of stolen vehicles or vehicles associated with an investigation.
The exact fields depend on the agency, equipment, configuration, and policy. Illinois State Police says its ALPR system does not collect images of drivers or passengers. That description applies to the Illinois system, not necessarily to every agency or vendor.

Underlying read records
These are the individual events generated when a camera reads a plate. Ask for the plate number or other vehicle identifier, the date and time, the location, the camera or device identifier, associated vehicle images, and any match or alert information. If you are requesting data about your own vehicle, state the plate number and the relevant dates, but do not assume the agency must release every field without review.

Records that show how the system operates
A request can also cover the documents needed to interpret or challenge a read:
- ALPR policies, standard operating procedures, and training materials
- Retention, deletion, and preservation schedules
- User, search, access, and audit logs
- Contracts, purchase documents, and vendor agreements
- Data-sharing agreements and lists of receiving agencies
- Audit reports, inspection results, and disciplinary records concerning misuse, when disclosable
The ACLU recommends making use and access logs public after redacting plate numbers and other identifying vehicle details. That is an advocacy position, not a disclosure rule that applies in every state.
First identify who holds the records
Address the request to the government body that controls the ALPR data, not automatically to the camera manufacturer, a state training agency, or a statewide oversight office. A city police department, county sheriff, state police division, transportation agency, or regional task force may be the custodian.

If another public body operates the system, the first agency should identify the correct custodian or transfer the request under local rules.

Texas Commission on Law Enforcement (TCOLE) guidance illustrates the distinction: TCOLE tells requesters to contact the responsible local department for records it does not manage. The same principle applies elsewhere, but the responsible entity and procedure are jurisdiction-specific.
How do I request my license plate reader data?
- Confirm the jurisdiction and records law. Determine whether the agency is covered by a state public-records statute, a local open-records ordinance, or another disclosure process. Read the agency’s current instructions before sending the request.
- Name the custodian and delivery method. Send the request to the records officer or designated portal. Keep the sent message, upload confirmation, and any tracking number.
- Describe the records precisely. Identify the ALPR system or vendor if known, the plate number or vehicle description, the geographic area, and a start and end date. Separate personal plate-read records from system-wide logs, policies, contracts, and sharing records so the agency can process each category.
- Ask for electronic delivery. Request native electronic records or a commonly readable format. Ask the agency to tell you before incurring copying, search, or programming charges and to offer a narrower scope if the request is unusually large.
- Request preservation when deletion is possible. State that you are asking the agency to preserve responsive records while it processes the request, where local law permits or requires such a request. Preservation does not guarantee disclosure or stop a lawful retention schedule, but it creates a clear record of when you sought the information.
- Track the response deadline. Calendar the date the agency received the request, every clarification request, fee estimate, partial production, and final decision. Deadlines differ by jurisdiction and may be extended for clarification, unusual volume, or legal review.
Request language you can adapt
Subject: Public-records request for automated license plate reader recordsI request records held by [agency] concerning its automated license plate reader system for [start date] through [end date], including:1. Plate-read records associated with vehicle/plate [identifier], including date, time, location, image, camera identifier, and alert or match information, if maintained;2. Search, user-access, and audit logs for those records;3. Current and historical ALPR policies, retention and deletion schedules, and training materials;4. Contracts or agreements governing the system and data sharing; and5. Records identifying agencies or entities with which the requested data was shared.Please provide electronic copies. Why you should request records quickly
ALPR data is often kept for a finite period. The Illinois State Police transparency FAQ states that its data is automatically deleted after a maximum of 90 days, while it permanently logs system activity and conducts monthly audits. That is an Illinois State Police practice, not a national limit. Other agencies may keep data for shorter or longer periods, apply investigative-record exceptions, or preserve particular records after a case-related request.
Ask for the agency’s retention and deletion policy in the same request as the reads. If the data may be evidence in a pending matter, tell the agency and any attorney involved immediately; a public-records request is not a substitute for a litigation hold, subpoena, discovery request, or criminal-case procedure.

They may be able to withhold all or part of a response under a state-law exemption. Common grounds can include active investigations, confidential law-enforcement techniques, personal privacy, security information, or records held by another entity. Whether an exemption applies depends on the jurisdiction and the facts; an agency should not simply label an entire database exempt without identifying the legal basis required by its law.

Ask for a specific explanation
In a denial or partial denial, request:
- The exact statute, regulation, or ordinance section relied on
- A description of the records or portions withheld
- The date of the decision and the name or office responsible
- Whether the agency can release segregable portions after redaction
- Whether the records can be released after an investigation closes or another condition ends
Keep the original request, acknowledgement, clarification messages, fee estimates, productions, and denial letter. These documents establish the timeline for any review.
Challenge redactions or an overbroad denial
Reply in writing and narrow the dispute. For example, you might accept redaction of plate numbers in a public system-wide log while challenging the withholding of the policy, retention schedule, or non-identifying audit fields. Ask the agency to explain why each disputed category is exempt and to release factual portions that can be separated from protected material.
The ACLU’s proposed approach is to disclose system use and access logs with vehicle-identifying information removed, while protecting active investigations when existing law allows. Treat that as a model for a reasoned request, not as a guaranteed right.
How do I challenge an agency’s denial?
- Read the appeal instructions. The denial should identify an internal review officer, administrative appeal, state public-records ombudsman, attorney-general process, or court route. Deadlines can be short.
- File the review on time. Attach the request, proof of receipt, denial, and a focused explanation of why the cited exception does not cover the requested material or why redaction would resolve the concern.
- Ask for an index or description. Where available, request a record-by-record description of withheld material so the reviewer can evaluate the claim.
- Preserve privacy while appealing. If you are asking for your own vehicle’s history, explain ownership or lawful access only as much as the local process requires. Do not publish unredacted plate data while disputing a denial.
- Consider legal advice for a court challenge. Court procedures, filing deadlines, fee-shifting rules, and remedies vary widely. A lawyer or local public-records organization can evaluate the statute and the agency’s exemption claim.
Texas process example
TCOLE’s Public Information Act guidance describes a Texas-specific procedure: when a governmental body seeks to withhold requested information, it must ask the Texas Attorney General for a decision within 10 business days and submit its arguments and the requested records within 15 business days. Those are Texas deadlines under the process described by TCOLE; they do not apply nationally or automatically to every Texas request.

What California’s ALPR litigation shows
ACLU SoCal reports that in 2017 the California Supreme Court held that indiscriminately collected plate data was not automatically an investigative record exempt from disclosure. The case returned for consideration of redaction or anonymization. The ruling is a California example, not a rule controlling agencies in other states, and the current opinion and local law should be checked before relying on it.
California law also imposes ALPR policy and access-log duties. California Department of Justice materials describe restrictions on sharing certain California ALPR data with federal and out-of-state law-enforcement agencies. In an October 3, 2025 announcement about a lawsuit against El Cajon, Attorney General Rob Bonta said: “When information about Californians leaves the state, we no longer have any say over how it is used or shared.” The statement was part of an announcement of allegations and requested relief, not a final judgment.

Privacy and safety when requesting or publishing data
A plate-read history can reveal where a person lives, works, worships, seeks medical care, or travels. The ACLU warns that unredacted data can expose sensitive movements and recommends redacting plate numbers and identifying vehicle details in public releases.
If you request your own data, explain that the vehicle is yours or that you are authorized to act for the owner when the agency asks. Shared vehicles create a privacy problem: a release about one plate can reveal another driver’s movements. Ask whether the agency can provide records with other people’s identifying details redacted.

Do not post raw plate-read files, screenshots, or location histories online. Store the response securely, limit access to people who need it, and redact unrelated drivers before sharing records with journalists, neighbors, or advocacy groups.
If you suspect an inaccurate read or improper search
Use the records request to obtain the image, timestamp, location, camera identifier, and access history needed to test the error. Compare the read with vehicle maintenance, toll, work, travel, or other records you lawfully possess. A mismatched plate, duplicate character, incorrect camera location, or implausible timestamp may support a correction request or a challenge to an investigative use, but the records law may not provide a separate correction remedy.
Ask the agency to preserve the disputed record and identify the process for correcting inaccurate information or documenting a dispute. If the data is being used in a criminal, civil, immigration, or administrative matter, tell your lawyer promptly; deadlines and evidentiary procedures may be different from public-records deadlines.
