Make a written, case-specific request to the adjudicating authority as early as possible—and before the hearing or final order. Identify the show-cause notice, each witness statement actually relied upon, the allegation it supports, and the factual dispute that questioning could test. Ask for cross-examination at a specified hearing, copies of any missing relied-upon material, and a reasoned decision if the request is refused.
Section 75(4) of the Central Goods and Services Tax Act, 2017 (CGST Act) supports an opportunity of hearing when the person chargeable with tax or penalty makes a written request or when an adverse decision is contemplated. Section 75(5) permits adjournment for sufficient cause, requires reasons to be recorded and limits a person to three adjournments during the proceedings. The individual notice still controls the response date and hearing mechanics.
What a cross-examination request should achieve
Cross-examination is a way to test a witness statement that the department proposes to use against you. It is not a general demand to question every person connected with an investigation. Your request should show three things: the statement is relied upon, a material factual assertion is disputed, and questioning the maker could realistically test the assertion’s accuracy, source of knowledge, consistency or credibility.
Send the request to the adjudicating authority named in the show-cause notice. File it before the scheduled hearing and, in any event, before the authority passes the order. A late request can still be important, but you should explain the timing and ask that no adverse finding based on the statement be made until the request is decided.
#1 Best Overall
Keep the request separate from broad discovery demands
Ask for cross-examination of identified makers of relied-upon statements. Separately list documents and statements that were relied upon but not supplied. If you want replies filed by co-noticees or other persons, identify those as a document request rather than describing every co-noticee as a witness for cross-examination. The Kerala High Court’s 2025 decision in The Joint Commissioner v. Nishad K.U. treated that distinction as significant.
Statutory basis under the CGST Act
Section 75(4): written request and contemplated adverse decision
Section 75(4) provides an opportunity of hearing where the person chargeable with tax or penalty makes a written request, or where the proper officer contemplates an adverse decision. Your written application should therefore expressly request a hearing on the cross-examination issue and on the proposed tax, interest or penalty findings.
The Delhi High Court, in a 2025 GST matter (W.P.(C) 4853/2025, 2025:DHC:6181-DB, decided 29 July 2025), connected the ability to test a third-party statement with this statutory hearing requirement. In the factual setting before it, the court stated: “This requirement flows from the opportunity of hearing required to be given as per section 75(4) of the CGST Act.” The ruling concerns an adverse decision based on a third-party statement; it does not turn every GST proceeding into an automatic right to question every person.
Section 75(5): adjournment for sufficient cause
If you need time to obtain the statement, study newly supplied records or prepare questions, make a separate adjournment request. State the sufficient cause, identify the period sought and ask the officer to record reasons for allowing or refusing it. Section 75(5) says no more than three adjournments may be granted to a person during the proceedings. Do not assume that filing a cross-examination request automatically extends the reply period or hearing date.
When cross-examination is most defensible
The decisions reviewed treat the issue as fact-sensitive. Use the following screening questions for every statement:
| Question | What to show in the application |
|---|---|
| Is the statement actually relied upon? | Quote or identify the paragraph, page or annexure cited in the notice or relied-upon order. |
| Is a material assertion disputed? | State the precise fact you deny, qualify or cannot admit, rather than alleging generally that the statement is unreliable. |
| Could questions test the disputed point? | Explain whether the maker had personal knowledge, how records were created, or why the account conflicts with documents. |
| Were the underlying materials supplied? | List each missing statement, record or annexure and explain why it is needed to answer the allegation. |
| Is the application timely and specific? | Refer to the notice date, reply due date and hearing date; explain any reason for filing after an earlier stage. |
A request that simply says “cross-examine all witnesses” gives the authority a reason to treat it as overbroad. A witness whose statement is not used to support any proposed finding ordinarily has no identified evidentiary role for cross-examination in that proceeding.
Step-by-step procedure
1. Read the complete notice and annexures
Download and preserve the full show-cause notice, every annexure and any document available through the GST portal or served separately. A portal summary may omit the statement, page reference or relied-upon record that defines the allegation. Note the tax period, charging provision (for example, a proceeding under Section 74), registration details, notice number, issuing authority, reply date and hearing date.

2. Build an evidence and issue map
Create a working table connecting each challenged statement to the allegation and your rebuttal. Mark the exact page or paragraph in the notice, the maker and date of the statement, the department’s proposition and the record that supports your contrary position. This map prevents a generic request and helps the officer schedule only genuinely relevant witnesses.
3. Identify the proper recipient
Address the application to the adjudicating authority named in the notice, using the designation and office address shown there. If a notice identifies a particular jurisdictional officer or division, do not send the original request only to an unrelated help desk. Follow the submission channel stated in the notice or applicable rules. The sources considered do not establish one filing channel that applies to every State or Union Territory GST proceeding.
4. Request the missing relied-upon material
Before explaining why questioning is necessary, list the material you have not received. Name each item: for example, “statement of [maker], dated [date], referred to at paragraph 8 of the notice,” or “document described as Annexure R-3.” State how the omission affects your ability to answer the allegation and ask for a legible copy, including annexures and readable pages.
5. Explain the factual dispute witness by witness
For each person, identify the statement and the finding it is used to support. Then describe the contradiction or gap. Useful, concrete reasons include:
- The maker attributes a transaction to you but does not identify a personal observation, contemporaneous record or source for that conclusion.
- The statement conflicts with invoices, e-way bills, payment records, ledgers or correspondence already supplied.
- The maker’s date, quantity, description or knowledge of the transaction differs from the department’s relied-upon documents.
- The statement appears to repeat information received from another person, while the notice treats it as first-hand evidence.
Explain how questions could test that point. Do not attach a proposed cross-examination transcript unless it helps clarify a narrow issue; a concise issue list is usually easier for the authority to evaluate.
6. Ask for a scheduled opportunity
Request that the authority permit cross-examination at the hearing or at a separate, reasonable date and time. Ask for advance notice of the witness’s availability and the order in which witnesses will be examined if several are involved. State that the request concerns only the identified statements and issues, so it cannot be mistaken for an unlimited examination of every person connected with the case.
7. Preserve the consequence of refusal
Include an alternative request: if cross-examination is refused, ask the authority to communicate the reasons in writing and not rely on the untested statement for an adverse finding. This preserves the objection for the record. It does not guarantee that the officer must accept your position; it ensures that the decision and its evidentiary basis are identifiable.
8. Make a separate adjournment application if needed
If documents arrive shortly before the hearing or the witness schedule makes preparation impossible, request an adjournment in a separate paragraph or letter. State the sufficient cause, the exact additional time required and the date by which you can proceed. Remember the statutory limit of three adjournments to a person in the proceedings and ask for recorded reasons if the request is denied.
9. File through the specified channel and keep proof
Use the electronic portal, official email, physical filing counter or other method specified in the notice or governing procedure. Preserve the acknowledgement number, submission receipt, email delivery record, stamped copy or other proof showing what was filed and when. Keep the exact version of every attachment. If you hand-deliver a paper application, obtain a dated receiving stamp on your copy.

10. Attend and renew the request on the record
At the hearing, refer to the written application and its acknowledgement. If the officer has not ruled on it, request a clear direction before the merits are decided. If the authority proceeds without addressing the application, state your objection briefly and ask that it be recorded in the hearing minutes or order. Continue to comply with other directions and deadlines; a procedural objection does not suspend the substantive reply unless the authority grants that relief.
Documents to assemble before filing
- The complete show-cause notice, annexures and any corrigendum.
- Every relied-upon witness statement or record already supplied, with the passages marked.
- A list of relied-upon items not supplied, with dates, makers, page references and a short explanation of relevance.
- Earlier replies, written submissions, hearing notices and proof of filing or service.
- Documents that expose the disputed fact, such as invoices, contracts, transport records, payment evidence, account extracts or correspondence, arranged by issue.
- A one-page issue map linking each statement to the allegation and your proposed rebuttal.
- Authority letters or identity documents required by the notice if a representative will attend.
The Madhya Pradesh High Court has emphasized that certified copies of relied-upon documents may be needed to prepare a defence. In a 2024 GST matter, it also directed access to seized non-relied-upon originals and cross-examination of witnesses relied upon in the notices on the facts before it. Those directions were case-specific; they do not establish a universal right to every seized or non-relied-upon document in every adjudication.

Date, signature, address, GSTIN and contact details
List of annexures and proof of service
Replace every bracketed item with case-specific information before filing. Do not leave a broad phrase such as “all witnesses” where the notice identifies only two relied-upon makers.
Deadlines: what is known and what is not
Use the notice’s reply date
There is no single cross-examination-request deadline or universal reply period established for every GST demand by the material considered here. The applicable charging section, the date and version of the notice, amendments to the Act and the directions of the adjudicating authority can affect procedure. Treat the reply date and hearing details printed in your notice as controlling unless the authority formally changes them.
File early, even while seeking documents
If the deadline is near, submit the cross-examination and document request immediately rather than waiting for a complete evidentiary file. Explain what is missing and, if necessary, seek an adjournment for sufficient cause. A pending request is not a reason to ignore the substantive reply deadline; address the allegations as far as the available material permits and ask for permission to supplement after disclosure.
Do not assume “30 days”
A 30-day period is not a universal GST adjudication reply rule on the evidence addressed here. Quote the date in your own notice, identify the provision invoked and obtain case-specific advice promptly if service or the response period is disputed.
What the principal GST decisions indicate
Delhi High Court: third-party statement and hearing
In W.P.(C) 4853/2025, reported as 2025:DHC:6181-DB and decided on 29 July 2025, the Delhi High Court addressed a person facing an adverse decision based on a third-party statement. It linked the opportunity to cross-examine the maker to the hearing required by Section 75(4). Apply the reasoning to the factual role of the statement in your notice: identify the adverse finding it supports and why testing the maker matters.

Kerala High Court: Nishad K.U.
In the 2025 decision The Joint Commissioner v. Nishad K.U., the Kerala High Court held that, in appropriate Section 74 proceedings, cross-examination of witnesses whose statements form the basis of the case can be integral to natural justice. The court also cautioned against treating a request as covering all witnesses. It rejected the request as framed for co-noticees and indicated that copies of their replies could instead be sought. This supports a focused witness request plus a separate, specific request for co-noticee replies.
Madhya Pradesh High Court: relied-upon and seized material
A 2024 Madhya Pradesh High Court GST matter recognized the need for certified copies of relied-upon documents to prepare a defence. On the circumstances before it, the court directed access to seized non-relied-upon originals and cross-examination of witnesses relied upon in the notices. Because those directions turned on the record in that case, cite the decision cautiously and explain why your own missing material and witness evidence create a comparable preparation problem.
Andaman Timber Industries: background, not a GST holding
The Supreme Court’s Andaman Timber Industries judgment concerned excise adjudication, not GST. It is background authority on natural justice where statements are used as evidence. Do not present it as a GST-specific ruling or as proof of an automatic cross-examination right in every GST notice.

Common mistakes and practical fixes
“Cross-examine everyone”
Problem: The application names investigators, co-noticees, transporters and departmental officers without connecting them to a relied-upon factual assertion.
Fix: Create one subsection per relied-upon maker, cite the page or paragraph and explain the disputed point and proposed test.
Relying on a portal summary
Problem: A summary may not show the statement, annexure or page reference used in the notice.
Fix: Obtain the complete notice and annexures, preserve the download and request any referenced item that was not served.

Problem: A blanket request may obscure the relied-upon material needed for the immediate defence.
Fix: First identify relied-upon documents and certified copies. Then explain, item by item, why a particular non-relied-upon original is necessary in the circumstances of your case.
Ignoring contradictions in your own records
Problem: The request asserts that a statement is false without addressing invoices, ledgers or admissions that appear to support it.
Fix: State the contradiction precisely and attach or cite the record that allows the officer to see why questioning could resolve it.

Waiting until after the order
Problem: A first request made only after an adverse order may be harder to use as a procedural objection.
Fix: File before the hearing or final order, renew the request at the hearing and preserve proof of every submission.
Assuming the request suspends other obligations
Problem: The notice reply date passes while the taxpayer waits for a decision on cross-examination.
Fix: File the substantive reply on time as far as possible, identify missing material and request a reasoned adjournment or permission to supplement.

- Check the portal, official email and service address used in the notice for an order on your request or a revised hearing notice.
- Compare any supplied statement or document with the list in your application and record what remains missing.
- Prepare a short question plan for each permitted witness, limited to the disputed allegation and the source or reliability of the statement.
- Carry the acknowledgement, notice, annexures, prior submissions and an indexed evidence file to the hearing.
- After the hearing, review the minutes or order for whether the request, ruling and any refusal reasons are recorded accurately; promptly submit a factual correction if the procedure permits.
If the authority relies on an untested statement despite a timely, specific request, preserve that issue with the relevant pages, acknowledgements and order. Whether it warrants a further challenge depends on the statute, record and forum, so obtain advice on the particular proceeding rather than assuming that any omission automatically nullifies the demand.
