Start with the public agency that operated the camera, not the camera vendor. Send that agency’s records custodian a narrow written request identifying your plate, the issuing state, the date and location window, and the records you want. If the read is wrong, file a separate correction or complaint with the agency and preserve evidence. If you want deletion, ask for the agency’s retention rule and any evidence hold; a request does not override statutory or case-related retention.
There is no nationwide U.S. procedure that guarantees access, correction, or deletion of an automated license plate reader (ALPR) record. State and local law controls, and the answer depends on where the camera operated, which agency controls the system, whether a private operator is involved, and whether the record is connected to an investigation, citation, claim, or lawsuit.
What an ALPR record can contain
An automated license plate reader captures a vehicle as it passes a camera and converts the image into searchable data. A record can include:
- The plate characters as interpreted by the system and the issuing state or province.
- A photograph of the vehicle and, sometimes, part of the surrounding area.
- The capture date and time.
- The camera’s location or a location identifier.
- A designation showing whether the system generated a possible “hit” against a list.
- Audit information showing who accessed or queried the system.
Both hit and non-hit captures may be retained, depending on the agency’s policy, contract, and law. Virginia Beach explains that a read generally does not identify the driver or passengers, although the image can include the vehicle and nearby surroundings. An alert is not proof that the vehicle or person is wanted: the agency’s procedures should require an officer to verify the image, plate, vehicle, and circumstances before taking enforcement action.

ALPR data is different from a complete travel history. A camera only records a vehicle when it passes a participating camera, and the system may misread a character, capture another vehicle’s plate, or associate a correct read with an incorrect location or time.
First identify who controls the record
Find the entity responsible for the camera’s location before sending a request. In most public-road situations, that is a city or county police department, sheriff’s office, state police agency, transportation authority, or another public body. A vendor may host or process the information, but the agency’s policy, contract, and local law usually determine who controls it and what can be released.
Search the agency’s public information
On the agency website, search for “ALPR,” “LPR,” “automated license plate reader,” “license plate recognition,” “surveillance technology,” or the system’s name. Look for:

- The records-request portal and designated public-records custodian.
- A privacy officer, professional-standards unit, or complaint process.
- The retention schedule and any evidence-preservation rules.
- Vendor contracts, data-sharing agreements, and access-control rules.
California’s SB 34 requires a public ALPR usage and privacy policy. That policy should address authorized uses, access, sharing, safeguards, monitoring, retention, and the custodian responsible for the system.
When a private operator owns the camera
A camera may be operated by a residential community, campus, parking operator, shopping center, or business. Identify that operator as well as any public agency receiving the data. Do not assume a consumer privacy portal can retrieve law-enforcement customer data, or that the technology vendor is the records owner. Flock states that its customer agency controls customer ALPR data, and its disclosure guidance does not create enforceable rights against the company. The controlling agency or private operator must be addressed under the law that applies to that entity.

What you can request
Ask for existing records and give the narrowest practical time and location window. A public-records law generally does not require an agency to create a new report, conduct a new analysis, or compile information it does not normally maintain. California Secretary of State guidance, for example, says an office need not create a record or compile information that is not maintained in its normal business. That is California guidance, not a universal rule for every state.
Useful categories of existing records
- Responsive plate-read records and associated vehicle images.
- Capture timestamps and camera locations.
- The agency’s current and historical ALPR policy.
- The retention schedule and purge procedure.
- Access, query, or audit logs for the relevant record, where those logs are maintained and legally disclosable.
- Sharing or dissemination logs, memoranda, and agreements.
- The vendor contract, service agreement, and data-processing terms.
- Aggregate statistics or reports that the agency already publishes or maintains.
If individual reads are exempt, the policy, contract, retention schedule, aggregate reports, or sharing agreements may still be obtainable. Ask the agency to release any reasonably segregable or redacted portion rather than withholding an entire document.
How to submit a focused records request
Use the applicable state or local public-records law and send the request to the agency’s designated custodian. Keep a copy of the exact request, attachments, delivery confirmation, and every response.
- Identify the vehicle. State the complete plate number and issuing state or province. If the vehicle has had another plate during the period, list that plate separately.
- Set the date and time window. Give a specific date range and, when possible, a narrow time window. A request for one crossing or a few hours is easier to search than an open-ended request for every record.
- Identify likely locations. Name the road, intersection, parking facility, neighborhood, or route. If you do not know the camera location, say which route and direction the vehicle traveled.
- Name the records. Request the responsive plate reads, images, timestamps, locations, and any associated hit or alert information. Separately request the policy, retention schedule, access or audit logs, sharing records, and contract if you need those categories.
- Request the existing electronic format. Ask for electronic copies in the format the agency normally maintains, where the applicable law permits that format.
- Ask for a withholding explanation. Request the specific statutory exemption or policy basis for each withheld item, and ask for any redacted or segregable portion.
- Ask about fees and timing. Request an estimate before substantial search or duplication charges, if the jurisdiction’s rules provide for one.
Sample request language
Under the applicable public-records law, I request existing records concerning plate [PLATE], issued by [STATE/PROVINCE], captured between [DATE/TIME] and [DATE/TIME] near [LOCATION]. Please provide responsive plate-read data, images, timestamps, camera locations, and any associated alert or hit records.Please also provide the ALPR policy, retention schedule, access or audit rules, sharing agreements, and vendor contract in effect during that period. If any material is withheld, identify the specific legal basis and release all reasonably segregable portions. Please provide electronic records in the format ordinarily maintained.Do not ask the custodian to create a new travel-history report unless the jurisdiction specifically requires that work. Describe the existing records that would answer your question.
Request preservation before data disappears
ALPR data can be purged quickly. If a read may matter to a criminal investigation, traffic or civil matter, insurance claim, administrative complaint, or lawsuit, include a preservation request in the same submission and send it promptly. Provide the case, citation, incident, or claim number when one exists. Identify the precise plate, date range, locations, and record types that must be preserved.

Do not assume that a preservation request automatically suspends the ordinary retention schedule. Virginia law creates exceptions for data connected to an ongoing investigation, prosecution, or civil action, but another state may use a different rule or require a formal litigation hold. If a court case or prosecution is involved, ask qualified local counsel about discovery and preservation deadlines; a public-records request is not a substitute for legal discovery.

How to challenge a wrong plate read or resulting action
Use a separate correction or complaint submission rather than burying the dispute inside a broad records request. Send it to the ALPR program custodian, agency privacy officer, professional-standards unit, or other complaint contact named in the policy.
Explain the precise error
- A character was misread, such as confusing “O” and “0” or “B” and “8.”
- The image shows a different vehicle, plate design, or state.
- The recorded time or location is impossible for your vehicle.
- An alert was treated as confirmed without checking the original image.
- An incorrect read was linked to a citation, stop, investigation, or other action.
Attach concise corroboration
Provide only material that helps resolve the specific read: a registration record, dated photograph, repair or work record, toll or parking receipt, travel record, or case document. Explain what each attachment proves and identify the record at issue by date, time, location, and plate.
Ask for a documented review
Request that the agency:
- Review the original image rather than relying only on the character string.
- Check the audit trail and any officer verification notes.
- Explain whether the read contributed to a stop, citation, investigation, or other action.
- Correct inaccurate annotations or linked records where legally possible.
- Record your dispute and confirm the outcome in writing.
Virginia law limits ALPR use to specified purposes, including defined criminal investigations, missing or endangered-person and trafficking investigations, and certain notifications. It also requires confirmation of an alert before a vehicle stop under the statute’s conditions. Virginia Beach describes hits as alerts requiring officer verification. Those rules support asking the agency to examine an unverified or misapplied alert; they do not establish a nationwide individual right to amend every ALPR database.
How to request deletion
Address a deletion request to the agency or operator that controls the system. Ask it to state, in writing:

- The retention period for the specific record type.
- The normal purge schedule and the date the record is scheduled for deletion.
- Whether an investigation, prosecution, civil action, complaint, or evidence hold prevents deletion.
- The legal or policy basis for retaining the record.
- Whether inaccurate annotations or linked records can be corrected even if the underlying image must be retained.
A deletion request does not override a statutory retention duty, a court order, or an evidence-preservation requirement. Conversely, an agency should be able to identify the rule it relies on rather than treating indefinite retention as automatic.
Virginia’s statutory example
Virginia Code § 2.2-5517(E) states: “System data shall be purged after 21 days of the date of its capture in such a manner that such data is destroyed and not recoverable by either the vendor or the law-enforcement agency.” The same subsection provides exceptions for data connected to an ongoing investigation, prosecution, or civil action, which is retained through the statute’s specified disposition milestones.
Virginia also sets a two-year period for audit-trail data, subject to the statute’s exceptions. Virginia Beach says its non-hit data is retained for 21 days unless flagged as part of an active investigation, and that stored-data access is limited to department personnel with a documented investigative purpose. That is the city’s implementation detail, not a rule for every Virginia agency or every state.
Vendor retention is not a universal limit
Flock’s current policy states a seven-day default retention period for LPR data, while allowing a longer period when law or the customer agreement requires it and describing extended retention under specified customer approval. The policy says the customer agency controls its data and that the guidelines are informational rather than enforceable rights against Flock. A vendor default therefore cannot be treated as the legal retention period for every agency using that service.
What access laws may allow or forbid
Public-records access is not guaranteed merely because the record concerns your vehicle. Agencies may withhold system data, audit trails, investigative material, personal information, security-sensitive details, or records covered by another exemption. Ask for the exact basis and for partial release.

Virginia
Virginia Code § 2.2-5517(F) states: “System data and audit trail data shall not be subject to disclosure under the Virginia Freedom of Information Act (§ 2.2-3700 et seq.).” The statute nevertheless allows specified disclosures, including certain criminal discovery and court orders. It limits law-enforcement ALPR use to defined purposes, sets a 21-day routine system-data purge and a two-year audit-trail period, and preserves qualifying data tied to an ongoing investigation, prosecution, or civil action.
California
California SB 34 requires a public ALPR usage and privacy policy and restricts sale, sharing, or transfer except as otherwise permitted by law. California Department of Justice guidance advises agencies to evaluate privileges and exemptions when responding to records requests or litigation process. The guidance also states that California law-enforcement agencies may not share ALPR information with private entities or out-of-state or federal agencies, subject to the law’s provisions.
Do not promise that a California resident can obtain an individual image or search record under the California Public Records Act. Request the policy, retention rules, custodian information, contract, and other potentially disclosable records, and ask for the written exemption basis if an individual read is withheld.
How to respond to a denial or incomplete answer
- Ask the agency to identify the exact statute, regulation, privilege, or policy provision supporting each withholding.
- Ask whether redaction or segregation would permit partial release.
- Ask for the agency’s administrative appeal, review, ombuds, or complaint procedure and its deadline.
- Preserve the original request, proof of delivery, response, withheld-record description, and any case documents.
- If the record is needed for a citation, prosecution, civil claim, or lawsuit, use the applicable discovery, subpoena, or court process with qualified local legal advice.
An agency may lawfully deny the individual read while releasing a policy, retention schedule, contract, aggregate report, or other non-exempt material. A denial should identify what was withheld and why; a vague “confidential” response is a reason to request the specific legal basis and available review route.

Context for California system scale
A California State Auditor finding, reported in a California Department of Justice draft-report section, said 230 police and sheriff agencies in California used ALPR systems and another 36 planned to begin. The same passage reported that roughly 84 percent of California agencies operating ALPR systems shared their images. Those are historical statewide findings quoted through a draft government report section; the underlying survey year for the 84 percent figure is not stated there, and neither number should be treated as a current camera count.
