Report a suspected attack in parallel, not as a single form-filing exercise. Start the firm’s incident-response plan, preserve logs and other evidence, and involve privacy and data-security counsel. For a cyber-enabled crime, the FBI says victims should file with the Internet Crime Complaint Center (IC3) as soon as possible. Use the FBI’s local field office or tips.fbi.gov instead when a crime is ongoing or there is a threat to life or national security. If ransomware is involved, add the reporting and assistance channels identified by the Cybersecurity and Infrastructure Security Agency (CISA).
Client notification, regulatory breach notices, and law-enforcement reports are separate decisions. What the firm may disclose about a client matter depends on professional-conduct rules, confidentiality duties, contracts, the data involved, and the jurisdictions of affected people. The steps below are a U.S.-centered incident-response map, not a determination of what any particular firm must disclose.
What to do in the first hour
The first objective is to stop continuing access without destroying evidence that can show what happened. Assign one incident lead and keep a written, time-stamped record from the moment the suspected theft is discovered.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors- Activate the incident-response team. Include the managing partner or designated executive, information-technology staff, an incident lead, privacy and data-security counsel, and the firm’s insurer or breach-response coordinator if the policy requires prompt notice.
- Record the known facts. Note the detection time, systems and accounts involved, suspected unauthorized access, files or databases that may have been copied, signs of exfiltration, operational effects, and every containment action taken. Mark unverified items as hypotheses rather than facts.
- Contain carefully. The technical team can disable compromised credentials, isolate affected devices, block malicious connections, and preserve volatile data. Avoid wiping, rebuilding, or casually rebooting systems before forensic personnel advise you; those actions can erase evidence.
- Preserve logs and forensic material. Keep relevant authentication, endpoint, email, cloud, firewall, backup, and data-loss-prevention logs in their original form, with access restricted and chain-of-custody information recorded.
- Engage qualified counsel and forensics. Counsel should coordinate the legal analysis, while an independent forensic investigator can identify the intrusion source, create forensic images, analyze evidence, estimate scope, and recommend remediation. The Federal Trade Commission (FTC) specifically recommends considering independent forensic investigators for these tasks.
- Protect communications. Use a dedicated channel and limit sensitive discussions to people who need the information. Do not email stolen client files around the firm as an informal way to investigate them.
These actions do not replace reporting. They make later reports more accurate and reduce the risk that the response itself compromises evidence or confidentiality.

Choose the right reporting channel
Use the incident’s urgency, type, and affected data to decide where to report. More than one channel may apply.
| Situation | Primary channel | Purpose and caution |
|---|---|---|
| Cyber-enabled crime or fraud, including a completed intrusion | FBI Internet Crime Complaint Center (IC3) | Submit as soon as possible. Include a factual timeline, indicators, financial impact, and suspected actors without guessing beyond the evidence. |
| Ongoing crime, immediate danger, or national-security threat | FBI local field office or tips.fbi.gov | Use an urgent route rather than waiting for an IC3 submission to be processed. |
| Ransomware or extortion | CISA, the local FBI field office, IC3, and, where appropriate, the U.S. Secret Service | CISA’s StopRansomware guidance identifies these channels and stresses preserving incident information and checking notification obligations. |
| Personal information exposed | State, territorial, federal, or sector regulator identified by the applicable law | Recipient, timing, content, and whether notice is required depend on the affected data and each person’s location. |
| Data held for a business client | The client or business data owner, under the engagement and applicable law | Notify the business promptly enough for it to meet its own legal and contractual duties; coordinate who contacts individuals and regulators. |
Before sending any report, have counsel decide what client-confidential facts can lawfully be included. An agency report is not a blanket permission to disclose an entire matter file.
How to report to the FBI
IC3 for cyber-enabled crime
The FBI’s public instruction is direct: “If you are the victim of a cyber-enabled crime or fraud, file a report with the Internet Crime Complaint Center (IC3) as soon as possible.” The firm should identify itself, provide reliable contact details, describe the intrusion and suspected theft, and attach or preserve supporting information in the format the reporting process accepts.
A useful submission is chronological and specific:
- When the firm first detected suspicious activity and when access may have begun.
- Domains, IP addresses, email addresses, cryptocurrency wallets, malware names, ransom notes, or other indicators, if known.
- Systems, repositories, client matters, and categories of data potentially accessed or copied.
- Evidence of persistence, credential theft, lateral movement, encryption, or extortion.
- Business interruption, ransom demands, funds transferred, and any fraudulent transactions.
- Containment steps, outside investigators, insurer involvement, and other agencies already contacted.
Do not delay a report solely because the forensic investigation is incomplete. State what is confirmed, what is suspected, and what remains unknown. Update the investigators if the scope changes.
Urgent FBI contact
If the attacker is still active, threatens a person, or presents a national-security concern, contact the local FBI field office or use tips.fbi.gov. Tell the recipient that the event is ongoing and identify any immediate safety, operational, or evidence-preservation concern. An IC3 filing can still be appropriate, but it should not substitute for an urgent call.

Ransomware: add CISA and preserve negotiation evidence
CISA’s StopRansomware guidance lists CISA, the local FBI field office, IC3, and the U.S. Secret Service as reporting and assistance options. Follow the current contact paths in that guidance, because addresses and intake procedures can change.
Preserve the ransom note, chat transcripts, payment instructions, wallet addresses, malware samples, affected host list, and timestamps. Do not destroy encrypted originals while testing backups. Counsel should coordinate any negotiation or payment decision with the insurer, investigators, sanctions-screening advisers, and law enforcement. Keep records of who authorized an action and why.

Ransomware reporting does not eliminate other notices. Determine whether personal information was accessed, whether a client’s systems or data were affected, and whether a sector rule or contract requires additional reporting.
Preserve evidence without worsening the breach
Evidence preservation is both a technical and legal task. Ask the forensic team to document collection methods and maintain hashes or other integrity checks where appropriate. Restrict administrative access, preserve relevant cloud audit logs before retention windows expire, and suspend routine log rotation for affected systems when feasible.
Evidence checklist
- Identity and access-management logs, multifactor-authentication events, and password-reset history.
- Email headers, mailbox audit records, forwarding rules, and suspicious OAuth or application grants.
- Endpoint detection records, memory captures where advised, disk images, and malware samples.
- Firewall, VPN, proxy, DNS, cloud-storage, backup, and data-loss-prevention logs.
- File-access records showing which client repositories were opened, downloaded, compressed, or deleted.
- Ransom notes, attacker messages, call recordings, payment records, and screenshots.
- A chain-of-custody log identifying the collector, date, time, source, storage location, and every transfer.
Keep the investigation separate from ordinary document handling. Do not alter original evidence to make a report easier to read; create a working copy and identify any redactions.

Bring in counsel early: confidentiality, privilege, and conflicts
Engage counsel with privacy and data-security experience promptly. Counsel can map state and federal requirements, interpret engagement and vendor contracts, coordinate insurer notice, assess privilege, and decide whether a proposed disclosure is permitted.
Law-firm incidents have an additional professional-duty question: the firm may be both the victim and the custodian of a client’s confidential information. ABA Formal Opinion 483, summarized in an ABA analysis published in November 2020, treats a breach as an episode in which material client confidential information is misappropriated, destroyed, or otherwise compromised, or the lawyer’s ability to provide contracted legal services is significantly impaired. The analysis also explains that not every cyber episode requires notice; material information actually or reasonably suspected to have been accessed, disclosed, or lost can trigger disclosure under the governing rules.
State ethics opinions control the practical answer. New York City Bar Formal Opinion 2024-3, dated July 18, 2024, says that under New York Rule 1.4 a lawyer may have an ethical obligation to promptly notify a current client when an incident compromises the confidentiality or availability of client information or the firm is likely unable to meet material obligations. That is a New York opinion, not a nationwide rule.
The same New York opinion cautions that disclosure of client-confidential information to law enforcement or in a government investigation is permissible only when Rules 1.6, 1.9, or 1.18 allow it. It also advises considering the risks to the client of communicating with government officials. Counsel should therefore prepare an agency summary that is useful but does not reflexively attach stolen pleadings, transaction documents, medical records, or other matter details.
Check conflicts before the firm advises an affected client. A conflict may prevent the firm from advising that client about the incident, and a malpractice claim can require withdrawal. Arrange independent advice for the client when the firm’s interests and the client’s interests diverge.

Decide who must be notified
Build a data-and-location matrix rather than relying on the firm’s headquarters alone. List every affected client and business data owner, the people whose personal information may be involved, each person’s state or territory, the data category, and the firm’s contractual role.
| Question | Why it changes the notice decision |
|---|---|
| Where does the affected individual live? | Notification statutes generally follow the affected person’s jurisdiction and can differ in definition, timing, exemptions, and regulator notice. |
| What information was taken? | Names alone may be treated differently from Social Security numbers, account credentials, health information, or combinations that create a realistic misuse risk. |
| Was the firm a service provider or data owner? | An engagement may require the firm to notify the business client quickly so that client can make the statutory notice. |
| Was access confirmed or only suspected? | Some rules turn on acquisition, while others consider a reasonable risk of harm or a reasonable suspicion of access. |
| Did the incident impair legal services? | Professional-conduct duties can arise even when a conventional consumer breach statute does not. |
| Does a sector rule apply? | Health, financial, government, or other regulated data can trigger additional agencies, content, or media requirements. |
The FTC states that all states, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands have legislation requiring notification of security breaches involving personal information. The exact recipients, timing, and contents depend on the particular law and the facts. Review the current law for every affected location instead of applying one nationwide deadline.

Notify business clients and data owners
When the firm holds information for a corporation, government body, or other client, notify the data owner under the engagement and applicable law. Give it the facts needed to meet its own duties: the known timeline, affected systems, data categories, containment status, forensic plan, and a contact who can answer technical questions. Agree on who will notify individuals, regulators, customers, and employees, and document that allocation.
Notify individuals when required or warranted
For individual notices, coordinate timing with law enforcement so a notice does not impede an investigation. FTC guidance recommends naming a communications point person, explaining what happened and what information was involved, describing the response, and giving current contact and recovery information. The decision to notify can also consider the nature of the compromise, the likelihood of misuse, and the potential harm, subject to the applicable statute.

A clear notice should avoid speculation. Separate confirmed facts from ongoing analysis, tell recipients what the firm is doing now, and provide practical steps that match the data involved. If Social Security numbers were exposed, the FTC discusses fraud alerts and credit freezes as protective options. Do not promise that those steps eliminate risk.

Health information and possible federal rules
If electronic health records or other health information were exposed, ask counsel to determine whether the FTC Health Breach Notification Rule or HIPAA applies. Depending on coverage, reporting to the FTC or the Department of Health and Human Services, and possible media notice, may be required. The firm’s role as lawyer, business associate, or another service provider can affect the answer.
Regulator and media coordination
Use the regulator and timing specified by each applicable jurisdiction. Keep one approved set of facts so the IC3 report, client notice, regulator filing, and any media statement do not contradict one another. A communications lead should handle inquiries; lawyers and investigators should not provide ad hoc statements that reveal client matters.
Do not assume every firm has a 72-hour or 24-hour deadline
The 2024 U.S. Code text of 6 U.S.C. § 681b describes a 72-hour reporting period after a covered entity reasonably believes a covered cyber incident occurred and a 24-hour period after a covered entity makes a ransomware payment. The same text says those statutory paragraphs take effect on dates prescribed in a final rule.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →Those figures are not a universal deadline for law firms. Before relying on them, confirm the current implementing rule, its effective date, whether the firm is a covered entity, and whether an exception applies. Separately check state breach laws, contracts, insurance requirements, professional-conduct rules, and sector regulations; those may impose different clocks.
Common reporting mistakes and the safer alternative
- Waiting for perfect certainty. File an initial, qualified report with known facts and update it as forensics establish scope.
- Sending the entire stolen file to an agency. Provide indicators and relevant evidence after counsel determines what confidentiality rules permit.
- Using one notice for every audience. Tailor the IC3 submission, client communication, regulator filing, and individual notice to each recipient’s purpose.
- Ignoring clients whose data the firm stores. Review every engagement and notify the business data owner promptly enough for it to act.
- Treating a ransomware payment as the only reportable event. Preserve evidence and assess personal-data, contractual, professional, and sector obligations independently.
- Overlooking conflicts. Obtain independent advice when the firm may face a malpractice claim or cannot objectively advise the affected client.
- Applying the 72-hour number automatically. Verify covered-entity status and rule effectiveness before using any federal cyber-incident deadline.
- Letting messages drift. Assign one communications point person and maintain an approved fact sheet with version dates.
A practical decision sequence
- Stabilize and preserve: contain active access, preserve logs and images, and start the incident record.
- Escalate internally: appoint the incident lead, counsel, forensic investigator, insurer contact, and communications lead.
- Classify the event: determine whether it is cyber-enabled crime, ransomware, personal-data exposure, service interruption, or a combination.
- Make urgent reports: contact the FBI field office or tips.fbi.gov for an ongoing crime or immediate threat; file with IC3 for cyber-enabled crime or fraud.
- Add ransomware channels: use CISA, IC3, the local FBI field office, and, where appropriate, the U.S. Secret Service.
- Map affected people and data: identify clients, business data owners, individuals, locations, categories, and contractual roles.
- Apply legal and ethical rules: review state statutes, federal or sector rules, contracts, insurance terms, and professional-conduct requirements; check conflicts.
- Coordinate notices: agree with clients and law enforcement on timing, decide what can be disclosed, and prepare recipient-specific communications.
- Update and remediate: supplement reports as facts change, preserve a final evidence record, fix the access path, and document lessons and required client follow-up.
What a complete incident file should contain
At the end of the response, retain a controlled file containing the detection and decision timeline, evidence inventory, forensic findings, reports and confirmation numbers, counsel’s legal analysis, conflict checks, client and regulator notices, communications approvals, insurer correspondence, remediation actions, and unresolved questions. Record why the firm chose to notify or not notify each audience and who approved the decision.
This documentation helps the firm demonstrate that it acted promptly, preserved evidence, considered client confidentiality, and evaluated each jurisdiction and data category rather than relying on a generic breach script.
