Short answer: A dark pattern is a game interface or business flow designed in a way that can obscure cost, steer a decision, or make an unwanted action harder to avoid or reverse. Before you buy currency, open a randomized reward, accept a trial, or approve a child’s purchase, check the real-money price, the odds and material terms, the separation between play and payment, and whether declining, canceling, or changing settings is just as clear as accepting.
The U.S. Federal Trade Commission (FTC) describes dark patterns as digital interfaces that can “obscure, subvert, or impair consumer autonomy, decision-making, or choice.” That description identifies a risk, not an automatic legal violation; the facts and the law in your jurisdiction determine whether conduct is unlawful. What makes a game interface a dark pattern?
Games are allowed to persuade you. A colorful store, a reminder that an event is ending, or a recommendation for an upgrade is not automatically deceptive. The useful question is whether the design gives you enough clear information and control to make a voluntary, informed choice.

The FTC’s workshop used “dark patterns” for “a range of potentially manipulative user interface designs used on websites and mobile apps,” including game-related flows.

Why the label is not a legal verdict
Calling something a dark pattern is a practical warning to slow down. It does not prove that a developer broke a specific law. Regulators examine the complete flow, what a reasonable user would understand, disclosures, age and vulnerability of the audience, and the available remedies. The examples below use careful language because some FTC announcements described allegations or proposed settlements rather than final findings.
Seven warning signs to look for in games
1. A play control can trigger a purchase
Separate the actions that advance play from the actions that spend money. Look closely at button placement, controller mappings, keyboard shortcuts, and touch targets on loading screens, item previews, character menus, and wake-from-sleep screens. In its December 2022 announcement about Fortnite, the FTC alleged that confusing and inconsistent button layouts could cause charges while players were trying to wake the game, use a loading screen, or preview an item. The announcement described agreements totaling $520 million over separate allegations involving unwanted charges and children’s privacy; it should not be read as a finding that every similar layout is illegal. - Before pressing a familiar button, read the on-screen label rather than relying on muscle memory.
- Check whether a purchase confirmation appears before payment is authorized.
- Be cautious when a single tap, key, or controller button both selects an item and buys it.
2. Virtual currency hides the dollar cost
Write down the price of the currency bundle, the number of units received, and the units required for the item or attempt you want. Then calculate the cost in dollars, including the unused balance left over. A game that requires several exchanges makes this audit more important: dollars to premium currency, premium currency to another token, and finally a loot-box opening or item purchase.

In a January 2025 announcement, the FTC alleged that Genshin Impact used multiple exchanges and unusual denominations that could make total spending harder to track. The agency announced a proposed order and a $20 million penalty to settle allegations about loot-box costs and odds, marketing to children, and children’s privacy; the announcement said court approval was required before the proposed order could take effect. 3. Random rewards are sold without usable odds or terms
Loot boxes and similar systems provide a random virtual item rather than a specified reward. Before paying, find the probability table, the price per opening, any pity or guarantee rule, duplicate handling, event restrictions, and whether the odds differ by banner or item tier. A percentage buried several screens away is harder to evaluate than a clear disclosure beside the purchase button.
The FTC’s 2019 workshop examined loot-box mechanics, marketing, and financial commitments. In the 2025 Genshin Impact announcement, the FTC alleged that event banners and influencer promotion could create misleading impressions about the chance of obtaining promoted prizes. Treat those statements as allegations in that announcement, not as a universal conclusion about all randomized-reward systems.
4. Countdown timers and “limited” offers create pressure without context
A genuine event may have a fixed end time, but urgency is only useful when you can verify what ends, when it ends in your time zone, and whether the offer will return. Ask whether the timer applies to the price, the banner, the item’s availability, or merely a visual promotion. A timer that resets after you decline, or a claim that says “last chance” without a stated schedule, gives pressure without decision-quality information.

Compare the number of taps, screens, and warnings for accepting an offer with the path for closing it, choosing “no,” or continuing without buying. A large, high-contrast purchase button paired with a small text link, repeated warning dialogs, or a guilt-laden message after you decline is a classic asymmetry to document. A reasonable design can highlight an option; it should not make the alternative effectively invisible.
6. Cancellation, refunds, and spending history are difficult to find
Check the store, account, and platform menus before you need them. You should be able to locate transaction history, subscription status, purchase approvals, refund instructions, and account deletion or cancellation controls without guessing. The FTC’s Fortnite announcement alleged that refund and cancellation features were obscured and difficult to find. That allegation illustrates the practical test: stopping a payment relationship should be at least as understandable as starting it.

7. Privacy and communication settings favor disclosure by default
Review voice chat, text chat, friend requests, personalized advertising, contact discovery, and data-sharing settings. Defaults can change after an update or differ by account age, platform, and region, so verify them in the current game and platform menus. The FTC’s Fortnite announcement described alleged child-privacy violations and voice and text communications enabled by default. For a child’s account, do not assume a family setting in the console or app store overrides every in-game control.
A step-by-step pre-purchase audit
Use this process before buying a bundle, subscribing, opening a random reward, or approving a child’s transaction. It is a consumer checklist derived from FTC examples, not a legal test.
- Pause the flow. Do not tap the highlighted button immediately. Read the offer title, subtext, currency symbol, and confirmation language. Take a screenshot if the offer is time-limited or likely to disappear.
- Identify the action. Decide whether you are buying a specified item, buying currency, opening a random reward, starting a subscription, or authorizing a recurring payment. If the screen does not make that plain, stop.
- Translate every amount into money. Record the real-money price of the smallest practical bundle, the amount of currency it grants, and the currency required for the intended action. Include taxes or platform charges if shown and account for leftover units.
- Read random-reward disclosures. Find the odds for the exact banner or box, guarantees, duplicate rules, event dates, and any age or regional restrictions. Do not infer the chance of a featured prize from its position in artwork or from an influencer’s result.
- Test the non-purchase path. Look for “close,” “not now,” “continue without buying,” or an equivalent. If declining requires more steps than accepting, note the screens and wording before deciding.
- Locate the exit controls. In account or platform settings, find purchase history, subscriptions, refund instructions, parental approval, and payment-method removal. If you cannot find them now, do not add a payment method or approve a child’s purchase yet.
- Check privacy and communication defaults. Review voice, text, friend, advertising, and data-sharing controls for the specific account. Set the least permissive option that fits the player’s needs, especially for a child.
- Confirm once, deliberately. Verify the final dollar amount, item or reward type, and whether the authorization is one-time or recurring. Keep the receipt and screenshot.
Questions that expose a hidden cost or choice
- Does this button do only what its label and placement suggest, or can a routine gameplay action trigger a purchase?
- Can I see the real-money price without mental arithmetic across currency bundles or conversion steps?
- Are the odds and material terms for a randomized reward clear enough to understand before paying?
- Is the countdown specific and verifiable, or does it create pressure without useful context?
- Does declining or closing take more effort than accepting?
- Can I find spending history, purchase approval, cancellation, refunds, and privacy controls without a confusing search?
- For a child’s account, are purchase permissions and voice or text settings appropriate for that child?
Several “yes” answers to the risk questions do not establish illegality. They do establish that you should delay the transaction, document the flow, and choose a clearer option where one exists.

How to compare two game purchase flows
If you are deciding between games, compare the interfaces rather than relying on a “free-to-play” or “premium” label. The following axes are practical editorial criteria drawn from FTC examples, not an official rating system.

Extra safeguards for children and teens
Children may not understand that a colorful token represents real money, that a “draw” is random, or that a confirmation can charge a stored payment method. Parents and guardians should make the spending boundary explicit before play begins.
- Use a separate child account where the platform supports it, and require approval for purchases.
- Remove stored payment methods from a child’s account when they are not needed.
- Review the game’s own purchase, voice, text, friend, and advertising settings after updates.
- Explain that virtual currency is paid for with real money and that random rewards do not guarantee a desired item.
- Review receipts and transaction history regularly rather than waiting for a surprise charge.
- Set a family rule that a child must show the full price and odds screen before asking to buy.
Controls change over time and differ by platform, country, account age, and game edition. Verify the current labels directly in the relevant game and platform settings instead of relying on an old screenshot or a general parental-control description.

What prevalence statistics do—and do not—show
There is no reliable statistic in the cited material that says what percentage of mobile or online games use dark patterns. The FTC reported a 2024 International Consumer Protection and Enforcement Network (ICPEN) review of 642 websites and mobile apps offering subscription services across countries and languages. Nearly 76% used at least one possible dark pattern, and nearly 67% used multiple possible patterns. The review was not a game sample, and participants did not determine whether the practices they observed violated law. See the FTC’s ICPEN/GPEN announcement.
The FTC’s 2022 staff report also discussed one experiment in which more than twice as many consumers in a hidden-information group accepted a free trial as in a control group. That result concerns one free-trial disclosure experiment; it is not a general estimate for games or loot boxes. The report’s broader examples include hidden charges, misleading advertising, confusing subscription cancellation, and privacy choices, each with its own factual context.
What the Fortnite and Genshin Impact examples establish
Fortnite and Epic Games announcement
In December 2022, the FTC announced agreements totaling $520 million over separate allegations involving children’s privacy and unwanted charges. The agency alleged that Fortnite’s control layout could cause unintended purchases, that children could buy items without parental involvement, and that refund and cancellation features were difficult to find. Those were allegations described in the announcement and proposed orders at that time, not a blanket rule that every game using similar controls violates the law.
Genshin Impact and HoYoverse announcement
In January 2025, the FTC announced a proposed order and a $20 million penalty to settle allegations about loot-box costs and odds, virtual-currency exchanges, marketing to children, and children’s privacy. The announcement described proposed restrictions and disclosures, including direct real-money purchase options alongside virtual currency, odds and exchange-rate disclosures, and affirmative parental consent for children under 16 to purchase loot boxes. It also stated that court approval was required before the proposed order could take effect. Check the announcement’s current legal status before treating any proposed requirement as operative law or as a guaranteed current game feature.

What to do after an unwanted charge
- Stop further spending. Remove the payment method or disable purchases temporarily, and sign out other devices if the account may be compromised.
- Preserve evidence. Save the receipt, transaction ID, screenshots of the offer and confirmation, the date and time, the account age setting, and the steps that led to the charge.
- Check the correct billing party. A console store, mobile app store, game publisher, or payment provider may handle the transaction. Use the receipt to identify where the refund request belongs.
- Request a refund promptly. Describe the exact interface, whether a child was involved, whether the charge was accidental or unauthorized, and what remedy you are seeking. Keep the request factual and retain the response.
- Secure the account. Change the password, enable multifactor authentication where available, review logged-in devices, and inspect other recent transactions.
- Report a pattern if necessary. If the interface appears designed to obscure cost, misrepresent odds, or block cancellation, contact the relevant consumer-protection authority in your country and include the evidence. A dark-pattern label alone is less useful than a precise timeline and screen-by-screen description.
Bottom line for players and parents
The fastest reliable test is to translate the interface into four concrete questions: What am I authorizing? How much real money is it? What are the odds or other material terms? Can I decline, cancel, refund, and change privacy settings just as easily? If any answer is unclear, stop before confirming, document the screen, and use the game or platform’s spending and family controls. That habit protects your choice without assuming that every persuasive design is unlawful.
