To determine whether a Georgia data center is allowed, trace two separate approval tracks: the host city or county’s zoning entitlement and the Georgia Environmental Protection Division (EPD) permits for air, water, land disturbance, stormwater and related impacts. Start with the exact parcel, then verify the local use category, notice record, permit applications and final conditions. A zoning approval does not replace an environmental permit, and a public notice does not prove that a permit was issued.
Start with the exact parcel and jurisdiction
“Georgia data center” is not a single statewide land-use category. Zoning is administered locally. Georgia’s Department of Community Affairs explains that the Zoning Procedures Law gives local governments authority to use zoning to manage development activities. That means the first question is not whether data centers are generally legal in Georgia; it is whether this specific parcel may host the proposed use under the city or county’s current rules.
Collect the parcel address, parcel identification number, municipality or unincorporated county, current zoning district, comprehensive-plan designation and any overlay district. A county’s parcel viewer can help identify the district, but the authoritative answer comes from the adopted zoning ordinance, map and official confirmation from the local planning or zoning department.
- Record the parcel boundaries and the government that has land-use authority.
- Download the current zoning map and the district’s written use table.
- Check overlay districts, special planning areas, airport or watershed protections, setbacks, height limits, buffers, parking rules and access standards.
- Note whether the project includes substations, fuel storage, cooling equipment, transmission lines, water tanks or other components that may have separate land-use treatment.
Do not rely on a real-estate listing, a conceptual site plan or a zoning label alone. A parcel may have an industrial designation yet still require a conditional use, special-use permit, variance or rezoning for a high-load computing facility, large generator yard or utility installation.

Determine the zoning entitlement path
Read the use table for the words the ordinance actually uses. A jurisdiction may list “data center,” “computer center,” “cloud-computing facility,” “industrial use,” “telecommunications facility” or another category. The classification controls the approval path.
By-right use
A by-right use is allowed in the district without a discretionary rezoning decision, although the project still must satisfy site-plan, building, fire, stormwater and other requirements. “By right” does not mean construction can begin immediately. Confirm whether an administrative site plan, development permit, land-disturbance permit or certificate of occupancy is required.
Conditional or special use
A conditional or special use is allowed only after the applicant proves compliance with criteria in the ordinance. Conditions can address setbacks, landscaping, noise, lighting, traffic, emergency access, generator operation, screening and hours of testing. Obtain the complete staff report, hearing exhibits and signed order; a meeting presentation or agenda entry is not the approval itself.
Rezoning
Rezoning changes the district applied to the parcel. It is a legislative decision by the local governing body and commonly requires a pre-application meeting, application, staff review, public hearing and an ordinance or resolution. Read the conditions attached to the adopted rezoning because they may narrow the project beyond the base district’s rules.
Variance
A variance generally addresses a dimensional hardship, such as a setback or lot-width requirement. It is not a substitute for a prohibited use. If the ordinance does not allow a data center in the district, a setback variance will not ordinarily legalize the use itself.
Read Georgia’s rezoning notice record
For an applicant-initiated rezoning, Georgia law establishes a baseline notice window of 15 to 45 days before the hearing. The notice identifies the property and its current and proposed zoning. An on-site sign must be posted at least 15 days before the hearing. These figures come from the Georgia General Assembly’s 2022 signed H.B. 1405. Local ordinances may require additional mailed notices, newspaper publication, signs, neighborhood meetings or longer lead times.
| Notice item | State-law baseline | How to verify it |
|---|---|---|
| Published hearing notice | 15 to 45 days before the hearing | Find the publication, date, property description and current/proposed zoning in the clerk or planning file. |
| On-site sign | At least 15 days before the hearing | Check staff photographs, affidavits or inspection records when the local file provides them. |
Build a dated timeline from the first filing through the final vote. Compare the hearing date with each publication and sign date, then check the local ordinance for extra requirements. Missing or defective notice can affect the validity of a decision, but the remedy and deadlines depend on Georgia law and the local record; treat that issue as a matter for qualified land-use counsel.

Get written zoning confirmation
Ask the local authority for a written zoning confirmation that names the parcel, district, proposed use and required approvals. DeKalb County’s published application guidance illustrates the level of documentation jurisdictions may expect: an applicant supplies zoning confirmation and, when rezoning or a special-use permit is necessary, evidence that the process is active or complete.
A useful confirmation request asks the planner to identify:
- Whether the data center use is permitted by right, conditional, special or prohibited.
- Whether a rezoning, special-use permit, variance or development-of-regional-impact review is triggered.
- Which site-plan, subdivision, access, tree, landscape, parking and utility approvals apply.
- Whether generator compounds, substations, fuel tanks, cooling towers and water or sewer facilities are treated as accessory or separate uses.
- Which department issues each approval and whether approvals expire if construction does not begin.
Keep the response with the parcel record. A verbal statement at a counter or in an email that does not identify the parcel and proposed intensity is difficult to rely on later.
Separate zoning from Georgia environmental permitting
Land-use entitlement and environmental authorization are different tracks. Georgia EPD organizes its work through air, land and watershed branches and provides GEOS for electronic applications and reports. A local approval does not authorize emissions, wastewater discharge, stormwater coverage or land disturbance, and an EPD permit does not grant permission to use the parcel.
Create a permit matrix before evaluating the project. Assign each item an owner, application date, public-notice date, decision date, expiration or renewal date and the final conditions that affect design.
| Impact or activity | Approval trail to investigate | Design facts to reconcile |
|---|---|---|
| Stationary combustion and other air sources | Air construction and operating permits; PSD review for qualifying large construction or expansion | Generator count, fuel, engine ratings, operating hours, emissions limits and controls |
| Emergency generators | Air permit provisions and any associated operating conditions | Testing schedule, non-emergency operation, fuel type, stack parameters and monitoring |
| Land disturbance | Erosion and sediment-control approval and land-disturbance authorization | Clearing limits, phasing, buffers, drainage and inspection obligations |
| Industrial stormwater | Industrial stormwater NPDES coverage and site-specific plans | Exposed materials, outfalls, sampling, benchmark limits and corrective actions |
| Wastewater | Discharge permit or land-application authorization; new-facility submittal where required | Flow, treatment, discharge point, pollutants, cooling-water blowdown and backup systems |
| Water supply | Water-supply, withdrawal or service-capacity documentation, as applicable | Source, peak demand, storage, drought restrictions and connection capacity |
| Wetlands and streams | Applicable federal or state impact authorization | Fill, crossings, buffer impacts, mitigation and construction limits |
Read an EPD air permit correctly
Understand PSD as a pre-construction decision
EPD describes Prevention of Significant Deterioration permits as pre-construction permits for large construction or expansion projects in Georgia. For a greenfield project, EPD directs applicants to State Implementation Plan forms. A modification at a Title V site uses GEOS Title V modification procedures. The permit type tells you what review occurred; it does not by itself tell you how many generators the final design contains.
Read the application, draft permit, final permit and later modifications together. Confirm that the final permit covers the equipment shown on the current site plan. A permit for an earlier phase may not authorize additional engines, different fuel, changed stack parameters or new operating hours.
Match equipment to enforceable limits
Make a line-by-line inventory of every combustion source: emergency engines, prime-power engines, fire pumps, boilers, heaters and backup fuel systems. Compare the inventory with permit conditions for:

Do not treat a project announcement’s “megawatts” or a generator vendor’s specification as a permit authorization. The enforceable limits are in the issued permit and its incorporated documents.
Distinguish draft, final and enforcement records
EPD records may include an application, a draft permit, a final permit, a modification, inspection or monitoring records and an enforcement action. A public advisory announcing a comment period means that a draft or proposed action is open for review; it is not proof that a final permit was issued. Verify issuance in EPD’s issued-air-permit search and retain the permit number, effective date and revision history.
Trace water, wastewater and cooling systems
Cooling design determines which water approvals matter. A closed-loop system, evaporative cooling system and air-cooled design can create different withdrawal, blowdown, chemical and wastewater profiles. Draw a simple water balance from source to discharge before reading the permit file.

EPD states that a new wastewater facility must submit a new-facility form before the GEOS permit application. Keep that preliminary submittal with the later application so the sequence is clear. Determine whether wastewater goes to a publicly owned treatment works, an on-site treatment system, direct surface-water discharge or land application.
Discharge and land application
For a discharge permit, identify the receiving water, outfall, permitted flow, pollutant limits, sampling points and reporting schedule. For land application, identify the receiving property, loading limits, soils, setbacks, storage and weather restrictions. Cooling-tower blowdown, water-treatment residuals and equipment-wash water may be regulated even when sanitary sewage is sent to a municipal system.
Water supply and capacity
Check the source and the legal evidence of capacity: utility commitment, withdrawal authorization, well documentation, storage and peak-demand calculations. Ask whether drought or seasonal restrictions affect the proposed operation. A utility letter for ordinary office use may not establish capacity for a large evaporative-cooling load.
Check land disturbance, erosion and stormwater
Large campuses can disturb hundreds of acres in phases. Review the approved limits of disturbance, construction sequencing, drainage plans, sediment basins, stream buffers, inspections and stabilization deadlines. Compare the permit boundary with the current grading and utility plans; transmission corridors, substations and temporary laydown areas may be part of the disturbance even when they are outside the main building fence.

Industrial stormwater review focuses on where rain can contact exposed industrial materials and flow to an outfall. Locate fuel tanks, chemical storage, waste containers, maintenance areas, loading docks, cooling equipment and generator yards. Then read the stormwater plan for outfall maps, benchmark or monitoring requirements, corrective actions and reporting. A site can have stormwater obligations after construction is complete if industrial materials remain exposed.

Keep erosion-control approval separate from stormwater coverage in the file. They may involve related plans but are not interchangeable approvals.
Use the public records tools in the right order
EPD identifies GEOS, its issued-air-permit search, GOMAS water-quality data and EPA ECHO compliance history as research tools. Use them as a chain of evidence rather than as isolated searches.
- Search the parcel and operator name. Try the legal entity, facility name, street address and county. Record permit numbers and facility identifiers.
- Download the application set. Save the submitted forms, attachments, engineering calculations and later revisions. The newest application may supersede an earlier design.
- Separate proposed from issued documents. Label each file application, draft, final, modification, monitoring report, inspection or enforcement record.
- Read public notices and comment deadlines. Save the notice, draft permit, comment instructions and any hearing information. Calendar the deadline shown in the notice.
- Verify the final permit. Use EPD’s issued-permit search to confirm issuance, effective date, expiration or renewal status and incorporated conditions.
- Check compliance history. Use EPA ECHO to review inspections, violations, enforcement and reported compliance information, then read the underlying records rather than relying on a summary indicator.
- Cross-check water data. Use GOMAS where the project affects monitored waters, but do not treat ambient water-quality data as proof that a particular discharge permit exists.
Preserve downloaded records with the retrieval date and original filename. Permit portals change, and a later modification can make an earlier document incomplete without deleting it from the project history.
Evaluate public participation and regional review
Public involvement can occur in several places: local zoning hearings, EPD draft-permit comment periods, environmental impact reviews and meetings required by a local ordinance. The decision-maker and legal standard differ for each process. Read the notice to determine what is being decided, where comments go and whether a hearing is scheduled.
Developments of Regional Impact (DRIs) are large-scale developments likely to have regional effects beyond the local government where they are located. DRI review improves communication about those effects, but the host local government keeps final decision authority. Ask the planning department whether the project’s size, traffic, utility demand or location triggers the applicable DRI threshold, and save the DRI report and comments with the zoning record.
Apply statewide building and fire requirements
Even after zoning and environmental approvals, the building must satisfy Georgia’s mandatory statewide codes. The required code set includes building, fire, plumbing, mechanical, fuel-gas, electrical and energy codes. Local building and fire departments administer permits and inspections under those codes.
For a data center, coordinate code review for high-voltage rooms, battery or energy-storage systems, fire suppression, hazardous or flammable materials, fuel tanks, emergency power, structural loading, smoke control, egress and equipment clearances. A zoning condition may require a particular setback, while the fire code may impose a separate access lane or separation distance. Design teams should track both instead of assuming one approval incorporates the other.

A practical document-review workflow
- Make a parcel sheet. Enter the address, parcel ID, jurisdiction, zoning, comprehensive-plan designation, overlays and project phases.
- Build the local entitlement file. Add the use-table excerpt, zoning confirmation, applications, notices, staff reports, hearing minutes, adopted conditions and later amendments.
- Map every physical component. Include buildings, generators, fuel, substations, cooling equipment, water lines, sewer lines, outfalls, access roads and transmission work.
- Create the environmental matrix. Assign air, wastewater, water supply, land disturbance, stormwater, wetlands or stream, and code approvals to responsible agencies.
- Reconcile the design with permits. Compare equipment counts, fuels, operating hours, emissions, flows, outfalls, setbacks, noise measures and mitigation commitments.
- Check status and dates. Mark each item as application, draft, final, modification, renewal, inspection or enforcement record; capture effective dates and comment deadlines.
- Review regional and code triggers. Confirm DRI applicability and building, fire, electrical, mechanical and energy-code permits.
- Record unresolved questions. Send written, parcel-specific questions to the responsible department and retain the response in the file.
Common reading mistakes
Treating a zoning label as a permit
An industrial district does not automatically authorize every industrial activity. Read the use table and conditions, then obtain written confirmation.
Assuming a public notice means approval
A notice may announce a proposed action or comment period. Confirm the final permit and effective date in the issuing agency’s records.
Counting only the main building
Generators, fuel, substations, cooling systems, utility corridors and temporary construction areas can create separate zoning or environmental obligations.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsUsing an old permit for a new phase
Check modifications and phase limits. A final permit may authorize only the equipment and capacity described in that phase.
Ignoring local additions to state notice rules
The 15-to-45-day publication window and 15-day sign baseline do not eliminate stricter local procedures. Read the adopted ordinance and the actual docket.
Relying on an unverified 2026 restriction
A 2026 legislative PDF identified as H.B. 1012 contains language defining “data center” and proposing a temporary restriction on local permits. The available record does not establish a signed enactment and effective date. Do not treat that text as operative law; verify the current Georgia Code and signed-legislation record before relying on a moratorium or permit restriction.
What a defensible conclusion looks like
You can say a proposed Georgia data center is plausibly authorized only when the parcel’s zoning path is documented, required local decisions are final or clearly pending, environmental applications and issued permits match the design, and building, fire, water, stormwater and regional-review obligations have identified owners and dates. If any link is missing, describe the status precisely—such as “rezoning pending,” “draft air permit open for comment” or “wastewater pathway not yet documented”—rather than calling the project approved.
