Read a GST demand document in this order: identify whether it is a proposed notice or an adjudication order, confirm the statutory section and tax period, reconcile tax, interest, penalty and other amounts with the detailed annexures, then follow the response, hearing or appeal instruction printed on the operative document. GST rules do not create one reply deadline that safely applies to every kind of demand. Preserve the filed response and portal acknowledgement, and obtain advice from a GST practitioner or lawyer when the amount or allegation is disputed.
Identify the document before you decide what to do
A form number alone does not tell you whether the liability is final. Begin with the heading, form number, issuing authority, date of issue or service, tax period, and the provision cited. The same case can generate several electronic summaries as it moves from an ascertained amount to a notice, an order or recovery.
What the common DRC forms mean
| Form or document | What it represents | Action to consider |
|---|---|---|
| DRC-01 | An electronic summary accompanying a specified demand notice. | Read the full notice and annexures, then prepare the response required for that notice. |
| DRC-02 | A statement summary issued with a statement under section 73(3) or 74(3). | Match the summary to the statement, period and computation before responding. |
| DRC-06 | The reply or representation form for notices covered by Rule 142. | File the point-by-point reply in the prescribed manner and retain proof of filing. |
| DRC-07 | A summary of an adjudication order. | Treat the order as operative for recovery purposes and check appeal options immediately. |
| DRC-01A | A pre-notice communication in situations covered by Rule 142, with Part A for the officer’s ascertained amount and Part B for a submission or partial payment. | Use the opportunity only after checking the calculation and legal basis; its presence does not by itself make the liability final. |
| DRC-03 | An intimation of payment in the early-payment situations covered by the rule. | Keep the payment reference and connect it to the relevant notice or communication. |
| DRC-04 | An acknowledgement of a payment intimated in DRC-03. | Check that the acknowledgement reflects the correct amount and case. |
| DRC-05 | An order concluding proceedings in the specified early-payment situation. | Confirm what proceedings it closes and retain the order with your records. |
Rule 142 also provides for a DRC-01 summary with specified notices and a DRC-02 summary with the specified statements. For an order, the rule states: "The order referred to in sub-rule (5) shall be treated as the notice for recovery." That is why a DRC-07-linked order must not be handled like an initial proposal.

| Question | Proposed demand or notice | Adjudication order or DRC-07 |
|---|---|---|
| Status of liability | The department is proposing a demand or setting out allegations for response. | The proper officer has adjudicated the matter and recorded a demand. |
| Immediate objective | Answer the allegations, correct errors and use any hearing opportunity. | Protect appeal rights, examine recovery consequences and decide whether further relief is needed. |
| Key document | The complete notice, its DRC summary and annexures. | The signed order, DRC-07 summary and the provisions governing appeal and recovery. |
| Deadline basis | The response and hearing dates printed in the notice and applicable procedural rule. | The appeal period and requirements stated in or applicable to the order and current law. |
Do not infer finality, validity or invalidity from a summary screen. The detailed notice or order, the cited section, the service or communication record and the evidence in the file control the next step.

Reconcile every component of the amount
A summary amount is an administrative snapshot, not proof that the demand is correct. Create a reconciliation before drafting a reply. Download every annexure, spreadsheet and computation attached to the notice, and compare the figures with your returns, ledgers and payment records for the exact tax period.
| Amount or field | Checks to perform |
|---|---|
| Tax | Identify the tax period and tax head, then determine whether the allegation is short payment, wrongly availed or utilised credit, an ineligible refund, or another stated basis. Reperform the officer’s arithmetic from the underlying transactions. |
| Interest | Check the principal on which interest is calculated, the start and end dates, the rate or legal basis cited, and whether payments already made have been credited. |
| Penalty | Identify the exact provision, the conduct alleged and the procedural section used. A penalty line should not be treated as additional tax without reading the reasoning. |
| Other amount | Find out whether the item is a fee, recovery cost or another amount expressly stated in the order. Do not fold it into tax merely because it appears in the total. |
| Total | Add the components yourself and compare the result with the DRC summary, the detailed notice and each annexure. Record every difference in a schedule. |
Build a working reconciliation sheet
- Copy the department’s references. Enter the notice or order number, issue and service dates, tax period, GST identification details and cited sections exactly as shown.
- Make one row per allegation. Separate each invoice group, return period, credit mismatch, refund issue or other ground rather than combining unrelated figures.
- Show three figures for each row. Record the amount alleged, the amount supported by your records and the difference you dispute or cannot yet verify.
- Trace the source record. Link each figure in your worksheet to a return, invoice register, electronic liability or credit ledger entry, payment challan, bank record or earlier correspondence.
- Check the roll-up. Recalculate tax, interest, penalty and other amounts separately and then total them. Preserve the worksheet as an attachment or internal working paper.
If the notice relies on an annexure that is missing, unreadable or mathematically inconsistent, state that precisely in the response and request the material needed to answer. Do not assume that an unexplained total is accepted merely because it appears on the portal.
Find the operative date and response instructions
There is no reliable single reply period for every GST demand notice. The safe date is the response or hearing date printed in the actual notice, read with the section cited, the tax period and the manner in which the document was served. A notice may contain separate dates for a written reply and a personal hearing.

- Record the service evidence. Save the portal notification, email, physical delivery record or other communication showing when the document reached the taxpayer. Keep the downloaded PDF with its file name and timestamp.
- Locate the operative instruction. Identify the paragraph that specifies the reply method, form, hearing date, address or portal action. Do not rely on a date shown only in a dashboard summary if the full notice states a different date.
- Check the statutory route. Note whether the notice refers to section 73, section 74, section 74A or another provision. The section and period determine which procedural rules and reliefs may be relevant.
- Plan internal review time. Allow time to obtain return data, reconcile invoices, obtain authorisations and have a professional review a contested or high-value allegation.
- Submit through the required channel. For notices covered by Rule 142, use DRC-06 or the other method specified in the notice, upload the indexed evidence and complete any verification step.
- Preserve proof immediately. Download the acknowledgement, reference number, filed form and attachments. Store them with the notice and a copy of the exact submission.
If the notice does not clearly state how or when to respond, seek clarification from the issuing authority and professional advice without waiting for an assumed deadline. Silence can remove opportunities to correct a factual error or request a hearing.

Prepare a reply that answers each allegation
A useful response lets the officer match every assertion to a fact, document and legal position. Use headings that mirror the notice rather than sending a general narrative.
Recommended point-by-point structure
- Identification. State the notice number, date, taxpayer details, tax period and provisions cited.
- Position on each ground. Mark each allegation as admitted, partly disputed or denied. If a figure is accepted only after correction, state the corrected amount and why.
- Factual reconciliation. Explain the return, invoice, ledger, payment or credit record that supports your position. Refer to annexure numbers and page numbers.
- Legal basis. Set out the provision, notification or rule on which you rely and explain how it applies to the facts. Address the officer’s stated reasoning directly.
- Calculation schedule. Present your tax, interest and penalty position in a table that can be compared with the department’s computation.
- Procedural requests. Ask for a personal hearing where the notice or circumstances make one appropriate, and identify missing documents or defects that prevent a complete response.
- Relief sought. State the specific outcome requested, such as dropping an allegation, correcting an amount, giving credit for payment or accepting the enclosed explanation.
- Verification and attachments. Sign or verify as required, attach an index and preserve the filed copy exactly as submitted.
Evidence to assemble
- Relevant GST returns and reconciliations for each disputed period.
- Invoice registers, purchase and sales invoices, credit or debit notes and transport or delivery records where the allegation concerns transactions.
- Electronic liability, cash and credit ledger extracts and payment challans.
- Bank statements or accounting ledgers supporting payment, reversal or receipt.
- Contracts, correspondence, credit notes, refund applications or prior replies connected with the issue.
- Authorisations, statements and technical explanations needed to explain a system or classification error.
- A chronology showing notices, payments, earlier submissions and communications.
Number the files consistently, redact unrelated personal data where appropriate and make the index understandable to someone who did not prepare the accounts. Keep the original records even when only PDFs are uploaded.
When payment, DRC-03 or a pre-notice communication appears
Some cases begin with DRC-01A rather than a formal notice. Rule 142 provides for Part A to communicate an amount ascertained by the officer and Part B for a submission or partial payment in the covered situation. If payment is made in the circumstances addressed by the rule, DRC-03 is used to intimate it, DRC-04 acknowledges that intimation and DRC-05 can conclude the specified proceedings.

A payment reference should identify the period, tax head and allegation to which it relates, and the acknowledgement should be checked against the amount actually remitted. Do not assume that the existence of DRC-01A, a DRC-03 or a DRC-04 proves that all liability has been settled; the legal effect depends on the situation and the rule invoked. Likewise, do not treat a DRC-05 as closing issues outside the proceedings it expressly concludes.

If the document is an order or DRC-07
An adjudication order requires a different workflow from a proposed notice. Read the findings, not just the amount in the DRC-07 summary. Identify which allegations were confirmed, which were dropped, how payments were credited and how interest and penalty were calculated. Check whether the order addresses your written reply and any hearing request.
Urgent order review
- Record the date and method by which the order was communicated.
- Identify the appeal forum, statutory provision and filing requirements that apply to this exact order.
- Confirm the applicable appeal period and any pre-deposit or other condition from the current law and the order; do not use a generic number.
- Calculate the exposure if recovery proceeds, including amounts already paid and amounts still shown as outstanding.
- Obtain professional advice promptly if the order is adverse, because an appeal strategy and a recovery response may need to be coordinated.
Because the Rule 142 text treats the order referred to in sub-rule (5) as the notice for recovery, a DRC-07-linked order should not be left unattended while you continue negotiating the original allegation.
Check whether the cited law fits the tax period
The India Code record reflects a 2024 amendment introducing section 74A of the CGST Act. Older explanations that discuss only sections 73 and 74 may not automatically describe every later period. Compare the section in the notice with the tax period, commencement date and any transition rules. Ask the officer or your adviser to explain the basis if the provision appears inconsistent with the period under review.
Do not change the legal section in your reply merely because another section is more familiar. State the discrepancy, preserve the notice wording and explain why the cited provision does or does not apply to the facts and period.

Limited relief under section 128A
CBIC Circular 238/32/2024-GST describes a section 128A route for eligible legacy demands under section 73. The circular discusses applications in SPL-01 or SPL-02 for specified case stages and refers to a filing window measured from a notified date, including 31 March 2025 for the cases it addresses.
This is not a blanket waiver of GST demands. Eligibility depends on the type and period of demand, the procedural stage, payment and other conditions set out in the law and circular. Before relying on it, verify whether the application window remains open, whether the taxpayer and order meet every condition, which form applies and how any tax already paid is treated. Keep a copy of the application and acknowledgement alongside the demand file.
Common mistakes and how to recover
Replying to the summary instead of the notice
A DRC summary may omit the factual narrative, calculations or annexures that support the allegation. Download and read the complete notice or order. If an attachment is absent, request it and explain why the omission prevents a meaningful response.

Assuming a familiar deadline
Deadlines vary with the document and statutory route. Use the date and instruction in the operative notice or order, and verify the current law rather than copying a period from another case.
Submitting without an acknowledgement
A browser confirmation or draft is not a reliable record. Download the filed form, acknowledgement number, attachments and payment references immediately after submission.
Paying before understanding the allegation
Payment may be appropriate in a particular statutory situation, but an unexplained payment can be misapplied or fail to resolve a disputed issue. Obtain advice on the legal effect, identify the period and tax head, and retain the DRC-03 and DRC-04 records where used.
Ignoring an order while preparing a reply
Once an order and DRC-07 are issued, focus on appeal and recovery consequences as well as the merits. A later explanation does not automatically extend an appeal period.
A practical file checklist
- Complete notice or order, DRC summary and every annexure.
- Proof of service or portal communication date.
- Tax period, tax head, GST identification details and cited sections.
- Reconciliation of tax, interest, penalty, other amount and total.
- Returns, invoices, ledgers, challans, bank records and prior correspondence.
- Draft reply with allegation-by-allegation positions and indexed evidence.
- Hearing request and authorisation, if applicable.
- Filed DRC-06 or other prescribed submission, acknowledgement and payment references.
- For an order, appeal forum, current deadline, pre-deposit requirement and recovery status verified from the applicable law.
- Any section 128A eligibility analysis and SPL-01 or SPL-02 records, if that limited relief route is relevant.
The safest reading habit is to treat the form as a signpost, not the whole case. The operative notice or order, its statutory section, the exact tax period, the service record and the evidence supporting each calculation determine what you must do next.
