Read the consent form as a data-use agreement, not merely a scan appointment. Before you enroll, ask what images and accompanying information will be collected, whether the files can still identify you, who can access each version, how data are secured and shared, whether future research is covered, and what happens if the scan shows an unexpected finding. Brain images can remain identifying after names and other direct identifiers are removed, and confidentiality can never be guaranteed absolutely. Your practical protection is to understand the study’s specific safeguards and choices before you consent.

Start with the study’s data lifecycle

Privacy is not decided at the scanner. It is affected at every stage: scheduling and collection, transfer from the scanner, storage, quality control, analysis, publication, sharing with other investigators and eventual archiving or deletion. A study may protect one stage well and expose information at another, so ask the team to describe the whole path.

Ask what will be collected with the images

An MRI or functional MRI file may be accompanied by your name, contact details, date of birth, medical history, medications, behavioral questionnaires, genetic or laboratory results, appointment records and information about the study visit. Even when the image itself is coded, combinations of these fields can make a person recognizable. Ask the team to list every category of information collected and to explain which fields are direct identifiers, indirect identifiers or sensitive clinical information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Identify every organization that handles the data

Your data may pass from the research site to a university repository, a cloud or institutional server, a laboratory, a statistical analyst, a collaborating hospital or an outside research group. Ask who collects, uploads, stores, analyzes and receives the files. If an outside company provides storage or analysis, ask what contractual restrictions apply and whether its staff can see identifiable information.

Read the consent choices line by line

Consent language should distinguish the current study from later uses. Look for separate choices about participation, storage for future research, sharing with other researchers, contact for additional studies and use of coded or identifiable information. Some protocols allow you to decline optional future use while joining the main project; others make data storage or sharing part of the only available consent route. The form, not a general promise from a recruiter, determines your options.

Can someone identify you from a brain scan?

Potentially, yes. Structural MRI can capture facial anatomy. A scan that includes enough of the head and face may contain information that distinguishes you, even if your name is removed. Researchers have also discussed re-identification from patterns in defaced images and from combinations of imaging, biomedical and clinical information. De-identification reduces some risks; it does not make every file anonymous in every setting.

Direct identifiers and coded data are different

Removing your name and replacing it with a study code is useful, but the research team normally keeps a key that links the code to you. Anyone who can access that key, or who can combine the coded file with other information, may be able to identify you. Ask where the key is stored, which role can use it, and whether analysts receive only coded files or can request the link.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Re-identification can use more than the face

Identification risk is not limited to visible facial features. Rare medical histories, scan dates, demographic combinations, distinctive anatomy and linked clinical records can narrow the possibilities. A dataset released without names may therefore remain identifiable to a person who has auxiliary information. The NIH BRAIN Initiative’s neuroethics guidance expressly warns that participant confidentiality cannot be guaranteed because unauthorized release and re-identification are possible.

Ask about the study’s risk assessment

A responsible team should be able to explain what makes its images sensitive, what information is removed, who could realistically combine the files with other data and what controls address that risk. NIH privacy principles recommend assessing protections for each project rather than assuming that a technical or legal label such as “de-identified” settles the question.

De-identification, coding and facial masking

These terms describe different operations. Coding replaces direct identifiers with a code. De-identification removes or transforms information that could identify a person, but the resulting risk depends on the data and the possibility of linkage. Defacing or facial masking modifies image voxels around the face to reduce face-based recognition. Ask which operations are actually used; a study may use one, two or none of them.

Data treatment What it does Questions to ask
Identifiable file Contains direct identifiers or a readily available link to them. Who can access it, and why is identifiable access necessary?
Coded or de-identified file Direct identifiers are removed or replaced, while residual linkage or re-identification risk may remain. Who holds the code key? What other data travel with the file?
Defaced or masked image Removes or alters facial information to reduce face-based identification. Which image regions are changed, and could that affect the research measurements?
Openly available dataset Shared broadly under the study’s release terms. Can recipients combine it with other data, and is onward sharing allowed?
Controlled-access dataset Requesters are reviewed and must satisfy access conditions before receiving files. What identity checks, research-use review and data-use agreement apply?

Facial masking has a scientific cost

Defacing can reduce the information available for facial identification, but it can also remove or distort voxels that a project needs. The Open Brain Consent discussion describes this as a privacy–utility tradeoff: stronger masking may protect the face while damaging portions of the image or limiting future analyses. Ask whether masking is applied before sharing, whether an unmasked copy remains inside the institution, which analyses were validated after masking and whether you may choose a masked-only sharing option.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not accept “anonymous” without an explanation

Ask the team to describe the residual risk in plain language. A useful answer identifies what was removed, what remains, what a motivated recipient could infer and what contractual or technical controls reduce that possibility. If staff simply say that the scan is anonymous because your name is absent, ask for clarification before signing.

Who will see your MRI data?

The answer should cover identifiable data, coded working files, derived measurements and shared repositories. Different people may receive different versions. Ask for a role-based list rather than a general statement that “the research team” has access.

Open sharing versus controlled access

Open sharing can make data available to a wide community with minimal screening. Controlled access requires a requester to establish identity, describe the proposed research and accept conditions before receiving files. NIH recommends considering controlled access for sensitive participant data even when the files satisfy technical or legal definitions of de-identification.

Sharing model Participant should clarify Privacy trade-off
Open access Where the files will be posted, what fields are included and whether recipients may redistribute them. Broad availability increases the number of people who could attempt linkage or reuse.
Controlled access Who approves requests, what evidence requesters provide, how long approval lasts and what happens after a violation. Screening and conditions reduce exposure but do not eliminate unauthorized release or re-identification.

Ask about outside researchers and commercial recipients

Some studies share data with collaborators, public repositories, contract analysts or commercial research partners. Ask whether those recipients may receive identifiable, coded or derived data; whether they can combine the files with their own datasets; and whether they may share the files onward. A 2024 consensus article on portable MRI recommends data-use agreements that prohibit attempts to re-identify participants and unapproved further sharing. Those recommendations are specific to portable-MRI work, but the questions apply to other imaging studies as well.

Find out what is published

Publications usually report group results, but images, case descriptions or unusual findings can sometimes be recognizable. Ask whether representative scans, individual-level measurements or supplementary files will be posted, and whether the consent form covers those releases.

Check security across collection, transfer and storage

Security should apply before, during and after analysis. Ask the team to describe controls in terms you can understand, and ask how an incident would be handled.

  1. Collection: Ask whether the scanner workstation and intake systems restrict access to authorized staff and whether paper or electronic forms are kept with the image files.
  2. Transfer: Ask how files move from the scanner to institutional storage or a collaborator, whether the transfer is encrypted and whether removable media are used.
  3. Storage: Ask where identifiable files, code keys, backups and working copies reside, who administers permissions and whether access is logged.
  4. Analysis: Ask whether analysts receive the minimum fields needed, whether exports are monitored and whether temporary copies are deleted.
  5. Sharing: Ask what approval and data-use agreement a recipient must complete, whether onward sharing is prohibited and how violations are addressed.
  6. Retention: Ask how long each version is kept, whether backups follow a different schedule and what happens when the study closes.
  7. Incident response: Ask whom you will be notified by if data are lost, hacked or released improperly, and what assistance or reporting process exists.

No security control is perfect. The goal is to learn whether safeguards match the sensitivity of the data and whether the team has a clear response if a control fails.

Can you opt out of data sharing or future research?

Possibly, but only the protocol and consent form can answer for a particular study. Some forms offer separate checkboxes for the current project, storage for future studies and sharing with other investigators. Others make broad future use part of the main consent. Ask before enrollment:

  • Can I join the imaging study while declining optional future research?
  • Can I permit use inside the institution but decline external sharing?
  • Can I choose controlled access instead of open release?
  • Can I withdraw permission for future uses later, and how do I submit that request?
  • What happens to copies already distributed, analyses already completed or results already published?

Withdrawal generally cannot recall data that have already been shared or incorporated into completed analyses. Ask the team to state the practical boundary: which stored files can be deleted, which recipients will be contacted, and which records must be retained for regulatory or scientific reasons.

Will the scan tell you if something is wrong?

A research MRI is not automatically a diagnostic examination. Some protocols use sequences for a scientific question without providing a clinical interpretation. Others arrange review by a clinician qualified to interpret the images. The consent materials should say which situation applies.

Ask whether a qualified clinician reviews the images

Find out whether every scan receives a clinical review, only scans that meet a trigger for review, or no clinical review at all. Ask what qualifications the reviewer has, whether the review is part of the study budget and whether the scan is suitable for making a medical diagnosis. Do not treat a technically clear research image as a substitute for care ordered by your clinician.

Understand the incidental-finding plan

An incidental finding is an unexpected feature that may require medical attention but is not the study’s main target. Ask who decides that a finding is potentially concerning, who contacts you, how quickly contact occurs, whether a radiology report is provided and what follow-up or referral is available. Also ask whether you would be responsible for the cost of confirmatory clinical tests.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Put the plan in writing

NIMH MRI safety and ethics guidance says protocols should distinguish research from clinical scans, state whether qualified clinicians review images and describe the response to incidental findings. NIH’s consent-language library, Version 18 dated February 5, 2026, contains separate material on MRI and fMRI risks, confidentiality and incidental findings. Compare those sections with your own consent form; general NIH language does not guarantee that every study offers the same review or follow-up.

Interpret the older survey statistic correctly

Illes and colleagues reported that 54 of 66 respondents (82%) to a 2005 survey item said they had discovered incidental findings in MRI studies. The 74 investigators surveyed were not a random sample of all studies, the data are old, and the result is not a universal current rate for participants. The paper also found substantial variation in how findings were handled and communicated. Use the statistic as evidence that practices vary, not as a prediction of what will happen in your scan.

Questions to take to the research team

Bring these questions to the consent discussion and write down the answers. If the team cannot answer a question, ask whether the principal investigator, privacy officer or ethics-board contact can clarify it.

  • What information will you collect alongside my brain images, and which fields could identify me?
  • Will you remove names and direct identifiers? Will images be coded, defaced or masked?
  • What useful image information could masking remove or distort?
  • Who can see identifiable data, coded data and shared research files?
  • Will outside researchers or commercial entities receive any version of the data?
  • Is sharing open or controlled? What must a recipient agree to, and can data be shared onward?
  • How are files protected during scanning, transfer, storage, backup and analysis?
  • How long will each version and the code key be retained?
  • Does my consent cover future research beyond this project?
  • Can I decline future use or external sharing while participating in the main study?
  • What happens to data already distributed if I withdraw?
  • Is this scan intended to diagnose a condition?
  • Will a qualified clinician review it?
  • If an incidental finding appears, who contacts me, on what timetable and with what follow-up?

Warning signs that require clarification

  • The recruiter calls the scan “anonymous” but cannot explain facial masking, coding or linkage risk.
  • The consent form says data may be shared broadly but does not identify recipients, access conditions or onward-sharing rules.
  • No one can tell you whether a code key exists or who controls it.
  • The study promises that a scan will reveal health problems without identifying a qualified clinical reviewer or a follow-up process.
  • Future research is described as automatic, with no explanation of whether you can decline it.
  • The team cannot describe retention, deletion or breach-notification procedures.

These signs do not prove that a study is unsafe. They indicate that you need a more specific answer before deciding. You can ask for revised explanations, contact the institutional ethics or privacy office and take time to review the form rather than consenting immediately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Special questions for portable or mobile MRI studies

Portable MRI can introduce additional devices, transmission paths and operating locations. The 2024 portable-MRI consensus recommends protections across the full data pipeline, clear consent descriptions of risks and safeguards, and data-use agreements that prohibit re-identification attempts and unapproved further sharing. Ask where the scanner stores data while in the field, how files are transferred after a session, whether the device is reused at multiple sites and which institution is responsible for security and incident response. These questions supplement, rather than replace, the privacy terms in your own protocol.

Make a decision you can defend later

After the consent conversation, summarize the study in six lines for yourself: what is collected; how images are coded or masked; who can access each version; whether sharing is open or controlled; whether future use is allowed; and how incidental findings are handled. Compare that summary with your personal priorities. You might accept coded, controlled-access sharing for a narrowly defined project while declining open release or broad future use. Another participant may prefer maximum scientific reuse and accept the residual risk. Neither choice is universal; the important point is that your decision matches the actual protocol rather than an assumption that de-identification means anonymity.

If you are uncomfortable with the answers, you can decline participation or ask whether a different consent option exists. A research team should respect a decision not to enroll and should not present ordinary privacy questions as unreasonable.

The bottom line

Protecting privacy in brain-imaging research means evaluating the entire data lifecycle. Brain images can contain identifying anatomy, and coded or defaced files can still carry residual re-identification risk. Ask for concrete details about collection, access, security, sharing, future use, withdrawal and incidental findings; prefer controlled access when the study offers it and when the data are sensitive; and remember that a research scan is not automatically a clinical diagnosis. The consent form and the study team’s answers are the only reliable guide to the choices available in that particular project.
