Retirement plans handle sensitive personal information and account records, and their security depends partly on the companies that administer those records. That creates real exposure to phishing, unauthorized access, identity theft, and privacy breaches—but it does not mean every plan is unsafe or that any particular participant’s information has been exposed. The U.S. Department of Labor (DOL) recommends layered protections: sponsors should oversee service providers, providers should maintain effective security programs, and participants should protect their own sign-in accounts.
Why retirement-plan administration creates security exposure
ERISA-covered pension and health and welfare plans store or transfer participants’ personally identifiable information. Plan sponsors often depend on service providers to maintain records and accounts, keep data confidential, and protect account access. Information therefore moves through a chain of organizations and systems, each of which can affect security. DOL identifies these risks and recommends controls; its guidance is not evidence that every plan has been breached. DOL cybersecurity guidance
DOL clarified in September 2024 that its cybersecurity guidance applies to all ERISA-covered employee benefit plans, including employee pension benefit plans and health and welfare plans. DOL’s September 6, 2024 clarification

The historical scale helps explain why the issue matters, but it should not be mistaken for a current estimate. In a 2021 announcement, DOL cited 2018 estimates of 34 million defined-benefit and 106 million defined-contribution participants in private pension plans, covering an estimated $9.3 trillion in assets. What plan sponsors should check when selecting and monitoring providers
DOL advises plan fiduciaries to evaluate a provider’s security practices before hiring it and to monitor them over time. A provider’s assurances are not a substitute for evidence about how its controls work or how incidents are handled. DOL’s cybersecurity best practices
- Security program and evidence: Ask for the provider’s security standards and policies, audit results, and an explanation of how its practices are validated.
- Track record: Review relevant security incidents or prior breaches and how the provider responded and addressed the causes.
- Insurance: Understand any applicable cyber, privacy-breach, liability, or crime coverage, including its scope and limits. Insurance is not a guarantee that losses will be covered.
- Contract terms: Confirm that the agreement addresses applicable privacy and security requirements, how quickly the provider must report incidents, and how it will cooperate with investigation and remediation.
- Systems and subcontractors: Ask how the provider oversees cloud services and other third parties that may handle plan data or support plan accounts.
What an effective security program includes
DOL’s recommendations describe an organization-wide program rather than a single product that can make a plan secure. The measures below are intended to work together; sponsors should assess whether providers have appropriate controls for the data and services they handle.

- Governance and risk review: Document security policies and responsibilities, assign qualified security roles, and conduct a risk assessment at least annually.
- Independent review: Use independent third-party audits and act on findings; assess relevant cloud and other third-party systems as part of oversight.
- Access protections: Restrict access according to job roles, review access rights, and use multifactor authentication (MFA) wherever possible. DOL recommends phishing-resistant MFA if possible.
- Data safeguards: Encrypt sensitive information both at rest and in transit, and use technical controls and timely patching to reduce vulnerabilities.
- People and software: Train employees to recognize security threats and use secure development practices for systems that handle plan information.
- Response and recovery: Maintain business-continuity and incident-response plans, and remediate weaknesses or problems identified in prior incidents.
How participants can reduce risk to their accounts
Participants cannot control a plan provider’s systems, but they can make account takeover harder and avoid handing credentials to a scammer. DOL specifically recommends strong, unique passwords and warns that phishing messages may try to obtain passwords, account numbers, or other sensitive information. DOL’s online security tips
- Use a strong password that is not reused on email, shopping, or other accounts.
- Turn on the sign-in protections the plan provider offers, including MFA when available. If considering a hardware security key, first ask the provider whether it supports that sign-in method.
- Be wary of unexpected messages or calls asking you to sign in, share a password, provide an account number, or disclose sensitive information. Navigate to the provider using a trusted route rather than a link in a suspicious message.
- If a message or account activity looks suspicious, contact the provider through a trusted channel and ask it to review the account.
What should happen after a suspected breach
DOL’s best-practices guidance describes a response that can include investigating the incident, contacting law enforcement and the appropriate insurer, notifying affected participants when personal information has been acquired without authorization, helping affected plans and participants prevent or reduce injury, and fixing the underlying problem. Providers and plan fiduciaries should also honor applicable legal and contractual notification duties.

There is no single notification deadline that can be inferred for every incident from this guidance. The obligations depend on the facts and the laws and contracts that apply. DOL’s recommended approach is to notify without unreasonable delay when that standard applies, while meeting any other governing requirements.

The guidance identifies security risks and recommends practices for plans, fiduciaries, and service providers. It does not establish that a particular plan has suffered a breach, that any participant’s data is exposed, or that one consumer device or security product can eliminate the risk. Its practical message is layered protection: thoughtful provider oversight, organizational security controls, and careful account habits by participants.
