Protecting privacy in brain-imaging sharing is a planning and governance task, not a file-scrubbing step. Decide the sharing pathway before collecting data, obtain consent that addresses future uses, de-identify every part of the data package, evaluate residual identification and inference risks, and select open or controlled access that matches those risks. Record your methods and give recipients enforceable rules; de-identification alone does not make unrestricted release appropriate.
Why brain images can remain identifying
Removing a name, medical-record number, or email address does not necessarily make a brain-imaging dataset anonymous. An image can contain distinctive anatomy, dates, acquisition details, free-text descriptions, or links to other files. A recipient may combine those elements with public information, another dataset, or knowledge about a rare condition to identify a person or infer sensitive facts about them.
Magnetic-resonance images deserve particular care. Structural scans may retain facial or other distinctive features, and even when those features are altered, the remaining anatomy and study context can support linkage. Associated behavioral, clinical, genetic, or demographic files can increase what someone can infer. The relevant question is not only “Can a name be read from this file?” but also “What could a reasonably capable recipient learn by combining this package with information already available?”
NIH’s privacy best-practices guidance says: “Researchers and institutions should proactively assess the protections needed for sharing scientific data from participants, including determining whether sharing should be restricted through controlled access, regardless of whether the data meet technical and/or legal definitions of ‘de-identified’ and can legally be shared without additional protections.” Treat that as the governing principle for a release decision.

Plan the sharing pathway before collecting data
Decisions made at recruitment determine what you can lawfully and ethically do later. Write a data-sharing plan before acquisition and make it part of the study protocol, consent materials, privacy review, and repository plan.
Define the intended pathway
- List the data elements you expect to share: raw images, derived maps, quality-control files, clinical variables, questionnaires, code, and documentation.
- Describe the future uses you anticipate, such as replication, algorithm development, secondary clinical research, or educational use.
- Identify who may receive the data: the public, qualified academic investigators, commercial researchers, a named collaboration, or only your institution.
- Specify conditions for access, including review, authentication, approved purposes, retention limits, and bans on onward sharing.
Build privacy into operations
Your plan should cover secure acquisition, transfer, storage, backup, analysis workstations, repository upload, and eventual deletion or archival. Assign responsibility for each stage and document which system holds the subject key that links a study code to a person. Keep that key separate from the research files, restrict access to the smallest necessary group, and log access where your institution supports it.
Privacy review is required even when a dataset appears to satisfy a technical or legal definition of de-identification. NIH’s 2022 supplemental guidance emphasizes that the protections needed depend on the actual project, participants, organization, consent, recipient, and data context.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Use consent to establish realistic sharing conditions
Consent should tell participants what may happen to their data after the primary study. Explain the categories of future use, who may receive the information, whether data could be placed in a public repository, what controls will apply, and what limits cannot be guaranteed. Use plain language rather than relying on a generic statement that data may be “shared with researchers.”

Include meaningful limits
- State whether raw images, processed images, and linked clinical information will be shared separately or together.
- Explain that removing obvious identifiers reduces risk but cannot guarantee that nobody will identify a participant or infer a characteristic.
- Describe whether recipients may be located outside your country or institution and whether data may be combined with other datasets.
- Tell participants how requests, withdrawals, corrections, and security incidents will be handled, to the extent your design permits.
Consent establishes sharing conditions; it does not eliminate privacy risk. Before release, compare the proposed use and recipient with the wording participants accepted and with the determination of your institutional review body. If a planned release exceeds those terms, pause and obtain the required review or additional consent rather than treating a study code as permission.
De-identify the complete data package
Review every representation of the participant, not only the image filename. The MIDI Task Group’s recommendations for public release of medical images provide technical detail for DICOM and related data, but they must be applied to your actual formats and local process.
Audit headers and metadata
- Inspect DICOM headers and equivalent metadata for names, initials, record numbers, accession numbers, dates of birth, addresses, institution names, operator names, and free-text comments.
- Check private vendor tags, embedded identifiers, transfer syntax information, and fields copied into derived files.
- Decide whether exact dates are scientifically necessary. If not, remove them or apply a documented, consistent transformation that preserves only the temporal resolution your analysis needs.
- Replace subject identifiers with random study codes and keep the re-identification key in a separate, access-controlled system.
Inspect pixels, overlays, and text
- Look for burned-in names, dates, accession numbers, scanner-console annotations, and screenshots embedded in image pixels.
- Remove or redact overlays and localizer views that expose identifiers or unnecessary anatomy.
- For structural MRI, evaluate whether facial geometry or other distinctive features remain. Apply a validated defacing or related method when appropriate, then verify that the procedure did not introduce unacceptable scientific distortion.
- Review masks, segmentations, surface files, registration outputs, thumbnails, and quality-control screenshots; these can recreate identifying anatomy even when the original series is protected.
Review linked files and text
Subject keys can reconnect an apparently anonymous image to a clinical table, consent record, phenotype description, genetic file, or investigator note. Search free-text fields for rare diagnoses, locations, occupations, dates, or narrative details. Remove columns and files that are not justified by the approved scientific purpose. Retain utility only where the privacy review can explain why the element is needed.

Assess linkage and inference risk after de-identification
Risk assessment is collection-specific. Removing direct identifiers is only the first pass; evaluate how a recipient could combine the release with information already available.
Test plausible linkage routes
- Rare combinations of age range, location, diagnosis, treatment, scan date, and study participation can act like a fingerprint.
- Public trial registries, publications, social-media posts, obituaries, or local news may reveal who underwent an unusual procedure at a particular time.
- Another dataset may contain the same study code, acquisition date, phenotype, or image-derived measure and provide the missing link.
- High-resolution anatomy or derived features may permit identity-related inferences even when a person cannot be named.
Consider inference about traits and groups
Privacy harm is not limited to naming an individual. A recipient might infer a diagnosis, neurological condition, treatment history, cognitive characteristic, or membership in a small community. Consider whether a release could stigmatize a person or expose a group, especially when demographic categories are small or the condition is rare.
Document the assumptions behind your assessment: what information a recipient is expected to have, what technical capability is realistic, and which combinations were tested. Revisit the assessment when new external datasets, analytic methods, or image-reconstruction technologies change the risk. A conclusion that was reasonable at release is not permanently valid.
Choose open or controlled access deliberately
Open access maximizes discoverability and reuse, but it leaves less ability to verify users or enforce limits. Controlled access adds review and administrative work while reducing exposure when residual risk or consent restrictions warrant it. Neither label is automatically correct for every de-identified dataset.

| Decision factor | Open access may fit when | Controlled access is more appropriate when |
|---|---|---|
| Consent and future use | Participants explicitly agreed to broad release, or an institutional review finds the proposed release consistent with consent. | Consent limits recipients, purposes, geography, or onward sharing, or the original wording is ambiguous. |
| Residual identification or inference risk | Assessment finds very low residual risk and no practical identity-related inference of concern. | Linkage, distinctive anatomy, rare traits, or sensitive inferences remain possible. |
| Scientific utility | Required detail can be released without retaining unnecessary identifiers or sensitive linked variables. | Useful data require elements whose combination materially increases risk; review can authorize qualified projects. |
| Potential harm | Misuse would be unlikely to cause significant individual or group harm. | Exposure could affect health, employment, insurance, safety, dignity, or a small community. |
| Enforcement feasibility | The project can tolerate unrestricted copying and redistribution. | You need requester identity checks, purpose review, security requirements, or limits on onward sharing. |
What controlled access can require
- Account registration with institutional affiliation and verified identity.
- A description of the proposed analysis and confirmation that it is compatible with participant consent.
- Approval by a data-access committee or designated institutional reviewer.
- Security controls, named users, retention and deletion dates, and incident-reporting duties.
- Prohibitions on re-identification, recontact, and attempts to connect records to outside identities unless expressly authorized.
Set enforceable conditions for recipients
Use a data-sharing or data-use agreement for controlled releases and for any collaboration where responsibilities need to be explicit. The agreement should identify the dataset, approved purpose, permitted users, security standard, duration, and process for ending access.
Include these terms
- Use only for the approved research question and no attempt to identify participants.
- No recontacting participants, matching against external identity databases, or contacting relatives unless the agreement and consent expressly permit it.
- No onward transfer, sublicensing, publication of identifying details, or release of row-level data without written approval.
- Requirements for encryption in transit and at rest, least-privilege access, secure deletion, and prompt incident notification.
- A duty to flow the same restrictions to authorized staff, contractors, and downstream analysts.
- Return or destruction of data when the project ends, plus a certification if your policy requires one.
Give recipients the de-identification description and the residual-risk assessment. They need to understand what was removed, what remains, which inferences are plausible, and why the restrictions exist. NIH guidance specifically recommends communicating methods and risk assessments to downstream users.
Secure acquisition, transfer, storage, and release
Neural data should be treated as private, sensitive information. NIH BRAIN Initiative neuroethics guidance states: “Neural data should be treated as private, sensitive information; its collection, transmission, and storage should adhere to best practices for security and encryption.” Apply that principle throughout the data life cycle.
- Acquire: Use institution-managed systems, authenticated accounts, and approved devices. Avoid copying identifiable scans to personal drives or unencrypted removable media.
- Stage: Move files into a restricted project area, separate the subject key, and record who performed the transfer.
- Process: Run de-identification in a controlled environment. Preserve an immutable audit record of input, output, tool version, and quality checks without retaining unnecessary identifiable copies.
- Validate: Sample headers, pixels, overlays, derived files, and linked tables. Confirm that the released package opens correctly and that transformations did not remove required scientific information.
- Transfer: Use an approved encrypted channel and verify the recipient or repository endpoint before upload. Do not send sensitive files as ordinary email attachments.
- Store and monitor: Enforce least privilege, multifactor authentication where available, encryption at rest, backups with equivalent protection, and logs reviewed for unusual access.
- Release: Publish only the approved subset, documentation, and access terms. Keep the key and any excluded identifiable material out of the repository.
Determine which rules apply to your project
Legal and policy obligations can arise under federal, Tribal, state, local, and institutional rules. Applicability depends on the research, participants, organization, consent language, data type, and recipient. Do not assume that HIPAA, the Common Rule, GDPR, or another named regime automatically governs every brain-imaging dataset, and do not assume that a de-identified definition resolves all ethical or contractual duties.

Ask the responsible privacy, security, and research-compliance offices to assess the actual facts. Confirm repository terms, cross-border transfers, contractual promises to participants, retention requirements, and whether a new use requires institutional review. NIH supplemental guidance informs decisions but does not replace binding law or your institution’s determinations.
A release checklist you can use
- Sharing purpose, recipient class, and access level were defined before collection.
- Consent addresses the proposed future use and the practical limits of privacy protection.
- Institutional review confirms that the release is consistent with consent and policy.
- DICOM or equivalent headers, private tags, filenames, pixels, overlays, and screenshots were inspected.
- MRI facial or distinctive anatomy was assessed and processed when justified.
- Clinical, demographic, narrative, genetic, and derived files were reviewed for direct and indirect identifiers.
- The subject key is separated, access-controlled, and excluded from the release.
- Linkage and inference scenarios were documented, including information a recipient could already obtain.
- Residual risk was balanced against scientific utility, and the assessment has an owner and review date.
- Open or controlled access was selected using consent, risk, sensitivity, utility, and enforcement feasibility.
- Recipient terms prohibit unauthorized identification, recontact, and onward sharing.
- Encryption, authentication, logging, incident response, retention, and deletion procedures are operational.
- All methods, tool versions, transformations, exceptions, and recipient instructions are documented.
What to do when circumstances change
Pause distribution if a validation check finds an identifier, a repository changes its access model, a new linkage source appears, or a recipient requests a use outside the approved purpose. Quarantine the affected files, notify the privacy or compliance lead, determine who received them, and preserve relevant logs. Correct the package and reassess consent, access level, and agreements before resuming. If data were already downloaded, follow the incident and recall provisions in the applicable agreement and institutional policy.
Review the release periodically rather than treating publication as the end of governance. New external datasets and analytic techniques can change what can be inferred from an image. A controlled-access decision can be tightened, or an open release reconsidered, when the risk profile changes.

The practical standard
A defensible brain-imaging release shows a continuous chain from participant permission to recipient behavior: the future use was explained, the full data package was examined, residual risks were assessed, access was matched to those risks, and technical and contractual safeguards were put into operation. If any link is missing, delay release until the responsible institutional reviewers can resolve it. The goal is not to claim that identification is impossible; it is to make sharing proportionate, transparent, and accountable to the people whose neural data make the research possible.
