Use healthcare AI with patient information only after you have identified the data, limited it to the task, mapped where it goes, confirmed the legal relationship with the provider, and put enforceable security and governance controls around the system. An “AI” or “healthcare” label is not proof that a service may receive protected health information (PHI). In the United States, HIPAA obligations depend on the parties, the information, and the use—not on the marketing description of a tool.
Why healthcare AI creates a privacy decision, not just a technology decision
AI can summarize clinical notes, draft patient communications, transcribe encounters, support coding, search policies, and help analyze operations. Each use can also expose information about a person’s health, care, or payment. Prompts, uploaded files, generated answers, conversation histories, diagnostic images, API payloads, telemetry, and administrator logs may all contain identifying details.
The first question is therefore not “Which model is best?” It is “What information will this particular workflow send, to whom, for what purpose, and under whose control?” A tool can be technically impressive and still be unsuitable for a given patient-data workflow.

The Security Rule focuses on electronic PHI (ePHI) and requires administrative, physical, and technical safeguards. Other federal, state, and local requirements may apply as well, including in situations outside HIPAA’s covered-entity and business-associate scope.

Step 1: Define the use case and classify every data element
Write a short use-case record before a pilot or procurement decision. It should state the task, the people who will use the output, the systems involved, and the decision the AI is allowed to support. “Use AI for clinical work” is too broad to assess; “draft a discharge-instruction summary from the clinician’s approved note, with a clinician reviewing every sentence” is assessable.
Ask whether the input is PHI
PHI can include health, care, or payment information linked to an identifier. Identifiers can be obvious, such as a name or medical-record number, or contextual, such as a rare condition, an exact admission date, a distinctive occupation, or a combination of facts that points to one person. A free-text note can remain identifying even when a name has been removed.
- List fields in the prompt, file, image, audio stream, or API request.
- List identifiers in the source record and identifiers that could be inferred from context.
- Include outputs, saved conversations, prompts, error reports, analytics, backups, and support tickets in the inventory.
- Record whether the system connects to an electronic health record, scheduling platform, identity directory, cloud storage, or device.
Separate the purpose from optional convenience
For each field, ask whether the AI actually needs it to perform the stated task. A model that drafts a generic explanation of a procedure may not need a patient’s full address, employer, or unrelated diagnoses. A model that checks a medication interaction may need drug names and doses but not the patient’s name. Document the rationale for every retained field and remove fields that only make the prompt more convenient.

Define a human decision boundary
State what the AI may do and what remains a human responsibility. For example, it may organize information for a clinician, but a qualified person approves a diagnosis, treatment recommendation, patient message, billing code, or eligibility determination. The boundary belongs in the procedure, user interface, training, and audit record—not only in a policy document.
Step 2: Minimize what leaves your environment
Data minimization is both a privacy control and a way to reduce the impact of an error. Send the smallest useful dataset, for the shortest useful period, to the fewest systems and users.
Use a minimum-necessary design
- Prefer a narrow question over an entire chart upload.
- Use age bands or relative dates when an exact age or date is not needed.
- Replace direct identifiers with task-specific tokens that cannot be reversed by the AI service.
- Exclude unrelated diagnoses, family details, addresses, contact data, and attachments.
- Send a summarized clinical fact set when the task does not require source-document wording.
- Prevent automatic inclusion of hidden metadata in documents, images, and audio files.
Do not confuse redaction with HIPAA de-identification
Removing names alone should not be presented as HIPAA de-identification. HHS describes two methods in its Guidance Regarding Methods for De-identification of Protected Health Information in Accordance with the HIPAA Privacy Rule: Expert Determination and Safe Harbor.
Under Expert Determination, a qualified expert applies generally accepted statistical and scientific principles and methods, determines that the risk of re-identifying an individual is very small, and documents the methods and results. Under Safe Harbor, specified identifiers are removed and the organization must not have actual knowledge that the remaining information could identify an individual. The method chosen, the fields removed, and the decision record should be retained.

De-identification is purpose- and context-sensitive. A dataset that appears safe in isolation may become identifying when combined with a public news report, a small community, a rare disease, or another dataset. If your organization cannot support either HHS method, treat the information as PHI and apply the controls required for that status.
Test prompts before production use
- Create representative examples using synthetic or properly de-identified data.
- Inspect the complete request, including headers, attachments, metadata, and hidden fields.
- Inspect the complete response and every place it is stored or displayed.
- Try unusual dates, rare conditions, free-text identifiers, and copy-and-paste artifacts.
- Verify that blocked fields cannot be reintroduced through a browser extension, plug-in, mobile app, or connected integration.
Step 3: Map the recipient, data flow, and legal relationship
Before sending live information, draw the path from the workforce member to the AI service and back. Include the application, model host, subprocessors, support personnel, logging platform, storage location, backup service, identity provider, and any downstream system receiving the output. Record the country or region in which each component operates when that information is available.
Questions for the AI provider
- What exact data does the service collect from prompts, files, outputs, account details, telemetry, and logs?
- For what purposes may the provider use each category?
- Is customer content used to train, tune, evaluate, or improve a shared model? Can that use be disabled contractually and technically?
- Who can access content, and under what approval, authentication, monitoring, and support procedures?
- How long are inputs, outputs, logs, backups, and abuse-monitoring records retained?
- Can the organization delete content and obtain confirmation that deletion propagated to active systems and backups?
- Which subprocessors receive data, where are they located, and how are changes notified?
- What security incident notice, cooperation, evidence preservation, and remediation commitments apply?
- Can the provider export audit records in a usable format?
- What happens to data when an account is closed, a contract ends, or the provider changes its service?
Determine whether a business-associate arrangement is needed
Whether an AI provider is a HIPAA business associate depends on the actual relationship, services, and data—not on the provider calling itself “HIPAA compliant.” Have privacy counsel or the organization’s HIPAA official analyze whether the provider creates, receives, maintains, or transmits PHI on behalf of a covered entity or another business associate. Where required, use a business associate agreement (BAA) that describes permitted uses, safeguards, subcontractor obligations, breach handling, access and amendment support, return or destruction of PHI, and termination rights.
A BAA does not make an unsafe architecture safe, and its existence does not answer state-law, professional, contractual, or ethical questions. Align the agreement with the technical configuration actually being purchased.
Quick wins for a faster PC:

Ask for current security documentation, independent assessment reports where available, penetration-test summaries, vulnerability-management practices, incident history and notification process, uptime and recovery commitments, and a current subprocessor list. Check that the evidence covers the specific product edition, region, integration, and retention settings your organization will use. A certificate or marketing statement may describe a company or platform generally while excluding the feature that handles patient data.
Step 4: Apply HIPAA Security Rule safeguards
The Security Rule requires administrative, physical, and technical safeguards for ePHI. NIST SP 800-66 Rev. 2, Implementing the HIPAA Security Rule: A Cybersecurity Resource Guide, published February 14, 2024, is an implementation resource for organizations of different sizes. Use it to organize a risk-based program rather than treating compliance as a one-time product check.
Administrative safeguards
- Perform and document a risk analysis covering AI prompts, outputs, integrations, vendors, endpoints, and failure modes.
- Assign an owner for each AI use case and a privacy or security reviewer with authority to stop deployment.
- Define approval, training, acceptable-use, change-management, incident-response, and termination procedures.
- Train the workforce not to paste PHI into unapproved consumer accounts or personal devices.
- Review access, vendor assurances, logs, incidents, and model or configuration changes at defined intervals.
Technical safeguards
- Use unique user accounts, strong authentication, and multifactor authentication for administrative and remote access.
- Apply role-based access so users can reach only the AI features and records needed for their duties.
- Encrypt data in transit and at rest using organizationally approved configurations and key-management practices.
- Separate development, testing, and production environments; prohibit live PHI in testing unless the environment is approved for it.
- Log prompts, files, outputs, administrative actions, exports, and access failures to the extent necessary for security and accountability.
- Protect logs because they may themselves contain PHI; limit access, retention, and export.
- Use network controls, endpoint management, secrets protection, vulnerability remediation, and secure integration patterns.
- Validate output handling so an AI response cannot silently write incorrect or excessive information into a clinical record.
Physical safeguards
Address the facilities and devices that can expose AI-related ePHI: workstations, tablets, microphones, scanners, server rooms, removable media, printed output, and disposal. Use device encryption, screen locking, secure disposal, privacy-aware room placement, and controls for lost or stolen equipment. A cloud service does not eliminate the organization’s responsibility for the endpoint where a worker views or records the information.

- 【Plug and play】: This mouse and keyboard pad is powered by USB, plug and play, no driver required. One button control light modes. Press one time to change the lighting mode, press twice to change the brightness, press and hold about 3 seconds turn ON/OFF.
Step 5: Control access, auditing, and human review
Give access to approved users for an approved purpose, and make the access observable. A shared login or unrestricted browser plug-in makes it difficult to determine who submitted a prompt, what information was disclosed, or whether a policy was violated.
Build an access matrix
| Role | Typical permitted activity | Controls to verify |
|---|---|---|
| Clinician | Use an approved assistant for assigned patients and documented tasks | Role-based scope, patient-context checks, multifactor authentication, output review |
| Clinical support staff | Prepare approved summaries or administrative drafts | Minimum necessary fields, restricted exports, supervisor-defined templates |
| Privacy or security staff | Review configurations, logs, incidents, and vendor evidence | Separate administrative account, immutable or protected audit records |
| Vendor support | Time-limited troubleshooting when authorized | Ticket approval, least privilege, session logging, prompt and file masking |
| Developer or analyst | Work with synthetic or approved de-identified data | Environment separation, data-loss prevention, no production access by default |
Make the audit trail useful
Capture who used the system, when, for which patient or work queue, which data source was accessed, what was submitted, what was returned, what was copied into another system, and which administrator changed a setting. Establish a retention period based on legal, operational, and investigative needs. Review alerts for bulk exports, unusual hours, repeated blocked prompts, access outside a user’s assignment, and sudden changes in data volume.
Require review of consequential outputs
For clinical, billing, eligibility, employment, or patient-communication uses, require a qualified reviewer to verify source facts, uncertainty, omissions, and inappropriate inferences. Record approval where the workflow affects care or a legal right. Do not let a plausible-sounding output bypass ordinary documentation, consent, supervision, or escalation rules.
Step 6: Check federal, state, local, and professional requirements
HIPAA is a floor for covered entities and business associates, not a complete privacy program. The applicable rules depend on your organization, the data, the vendor, the location of processing, the patient’s location, and the purpose of use.
- Check state privacy, medical-record, breach-notification, genetic-information, mental-health, substance-use-disorder, reproductive-health, and biometric requirements where relevant.
- Check local government, public-sector, or facility rules that govern procurement, records, or data residency.
- Review payer, research, accreditation, employment, and professional-licensing obligations.
- Assess consent, notice, disclosure, access, correction, retention, and secondary-use requirements for the specific workflow.
- Coordinate with legal counsel when the service crosses jurisdictions or uses data for research, product improvement, or population analysis.
Telehealth.HHS.gov’s privacy-law guidance and ONC’s provider privacy and security resources can help identify issues, but neither substitutes for a jurisdiction-specific legal assessment. ONC’s HIPAA Basics page was reported as updated April 1, 2026; verify the current version when you rely on it.

Step 7: Put AI governance around the deployment
Privacy controls work best inside a wider accountability program. The World Health Organization’s Ethics and governance of artificial intelligence for health, published June 28, 2021, describes six consensus principles and related recommendations. Use those principles to broaden a narrow security review into a governance decision that considers people affected by the system.
- Protect autonomy: provide meaningful human control, understandable notices, and appropriate choices.
- Promote well-being and safety: test accuracy, harmful omissions, unsafe recommendations, and foreseeable misuse.
- Ensure transparency and explainability: tell users what the system does, what data it uses, and where uncertainty remains.
- Foster responsibility and accountability: name owners, preserve records, and provide an escalation route.
- Ensure inclusiveness and equity: evaluate performance and access across relevant populations and languages.
- Promote AI that is responsive and sustainable: monitor real-world effects, resource use, and changes over time.
For each use case, maintain a model or service card containing the purpose, approved inputs, prohibited inputs, users, human reviewer, known limitations, data-flow diagram, vendor terms, risk assessment, test results, incident contacts, review date, and retirement trigger.

How to compare two AI tools for the same patient-data task
Compare tools only on the same documented use case and data flow. A generic feature checklist can hide a decisive difference in retention, logging, subcontracting, or access.
| Evaluation axis | Evidence to collect | Decision question |
|---|---|---|
| PHI involvement | Field inventory, prompt examples, integrations | Does this workflow handle identifiable health information? |
| Collection and retention | Technical settings, privacy terms, contract, deletion test | What is collected, stored, backed up, and for how long? |
| Access | Role matrix, support process, administrator controls | Who can see inputs, outputs, and logs? |
| Purpose and permissions | Use restrictions, training controls, subprocessor terms | Can content be reused beyond the approved task? |
| Contractual protection | BAA analysis, security addendum, incident clauses | Are required obligations enforceable for this service? |
| Security and auditability | Authentication, encryption, testing, audit exports | Can the organization prevent, detect, and investigate misuse? |
| Deletion and exit | Account-closure procedure, backup policy, export format | Can data be recovered, deleted, and verified at termination? |
| Legal and governance fit | Jurisdiction review, equity testing, human-oversight plan | Does the deployment meet all applicable requirements and ethical duties? |
Record “not established” rather than assuming a favorable answer when a provider will not document a control. A tool that cannot answer basic data-flow and retention questions should not receive live PHI until the uncertainty is resolved.
What to do if someone sends PHI to an unapproved AI tool
- Stop further disclosure. End the session, disable the integration, or revoke the token without destroying evidence.
- Preserve facts. Record the user, time, tool, account, data categories, prompts or files, recipients, and visible retention settings.
- Notify the designated privacy and security contacts. Do not investigate through additional uploads or ask staff to delete evidence.
- Contain access. Change credentials, remove shared links, request provider preservation or deletion through an authorized channel, and check downstream systems.
- Assess the event under the organization’s incident and breach procedures. Consider the information involved, who received it, whether it was viewed or retained, and applicable federal, state, and local rules.
- Remediate the workflow. Block the service technically, update training, revise approved-tool lists, and document the decision.
Do not promise that a provider’s deletion button eliminates every copy until the organization has evaluated logs, backups, subprocessors, and contractual evidence.
Common failure modes and practical fixes
“It is healthcare AI, so it must be safe for PHI.”
Why it fails: Product labels do not establish the recipient, purpose, retention, contract, or safeguards. Fix: perform the data-flow, vendor, legal, and control review for the exact edition and configuration.
“We removed the patient’s name.”
Why it fails: Dates, rare facts, free text, images, and combinations can identify a person. Fix: use HHS’s Expert Determination or Safe Harbor method when relying on HIPAA de-identification, and document the result.
“The vendor signed a BAA, so the project is compliant.”
Why it fails: A contract does not correct excessive collection, open access, unsafe integrations, or missing human review. Fix: test the configured service and align technical safeguards with contractual promises.

Why it fails: Without protected logs, an organization may not know what was disclosed or who accessed it. Fix: enable audit collection before launch and review it during the pilot.
A launch checklist for healthcare providers
- Use case, owner, purpose, and human decision boundary are documented.
- Every input, output, log, integration, and storage location is classified.
- Minimum-necessary fields and prohibited fields are enforced technically where possible.
- De-identification uses HHS Expert Determination or Safe Harbor when claimed.
- Vendor data use, retention, access, subprocessors, deletion, incident handling, and auditability are documented.
- Business-associate status and any BAA requirement have been reviewed by the appropriate privacy or legal authority.
- Administrative, physical, and technical safeguards are implemented and tested.
- Role-based access, multifactor authentication, logging, monitoring, and export controls are active.
- Clinical or otherwise consequential outputs require qualified human review.
- State, local, federal, contractual, professional, and ethical requirements have been assessed.
- Workforce training, incident response, change management, and retirement procedures are ready.
- A pilot with synthetic or properly de-identified data has passed documented tests before live use.
Can I put patient information into an AI tool?
Only after your organization has determined that the specific tool, account, configuration, data flow, contract, safeguards, and use are authorized. An unapproved consumer account or general-purpose chatbot should not be treated as a safe destination for PHI merely because it produces useful answers.
Is this AI tool HIPAA compliant?
That question cannot be answered from a label alone. Evaluate whether HIPAA applies to the parties and information, whether the provider’s relationship requires a BAA, what the service does with data, and whether your configured workflow satisfies the Privacy and Security Rule safeguards. The organization remains responsible for its own access, training, risk analysis, and oversight.
How do I de-identify patient data before using AI?
First decide whether you need de-identified data at all; minimization may be enough for some tasks. If you rely on HIPAA de-identification, use HHS’s Expert Determination or Safe Harbor method, account for indirect identifiers and context, document the method, and test whether the remaining information could identify someone. Deleting names by itself is not a complete method.
What should a healthcare provider check before using generative AI?
Check the purpose and minimum data set; map prompts, outputs, logs, integrations, and subprocessors; review provider access, retention, training use, deletion, security evidence, and incident terms; determine whether a business-associate arrangement is required; implement HIPAA safeguards; assess other applicable law; and require accountable human oversight.
When should an AI project be rejected or paused?
Pause when the organization cannot identify where patient data goes, cannot restrict or audit access, cannot obtain necessary contractual protections, cannot meet retention or deletion requirements, cannot explain who is accountable for consequential decisions, or cannot reduce the data to a justified minimum. Unresolved uncertainty about a core privacy control is a deployment risk, not a reason to proceed by default.
Frequently Asked Questions
Can a de-identified dataset be sent to any AI provider?
No. De-identification addresses whether information is PHI under HIPAA; it does not remove contractual, state-law, security, confidentiality, intellectual-property, or governance obligations. Review the recipient and purpose for the particular dataset.
Does a business associate agreement cover every AI feature from a vendor?
Not necessarily. Confirm that the agreement and security terms cover the exact product edition, integrations, subprocessors, regions, retention settings, and uses you will enable.
Should AI prompts and outputs be kept in the medical record?
Only when the organization’s clinical, legal, and records policies require it. Decide in advance what becomes part of the record, how it is verified, and how unrelated prompts, drafts, and logs are protected.
