Protecting privacy with an AI medical scribe requires treating it as part of your clinical information system, not as a standalone transcription app. Map every movement of identifiable audio, transcripts, prompts, metadata and generated notes; determine which parties handle protected health information (PHI); put the right contract in place; configure access, retention and deletion; and give patients a clear way to understand and decline the workflow where applicable.
HIPAA obligations depend on the parties and the actual data flow. A business associate agreement (BAA) may be required when a vendor creates, receives, maintains or transmits electronic PHI on behalf of a covered entity or business associate, but a BAA does not replace your own risk analysis or safeguards. State recording laws, other privacy laws and local clinical policies can add requirements.
Start by mapping what the scribe actually does
“AI medical scribe” can describe materially different products. Some capture ambient audio and send it to a cloud service; others accept a clinician’s dictated text; some retain recordings, while others claim to delete audio after transcription. You cannot assess privacy from the product name or a marketing label. Document the workflow from the first microphone capture to final deletion.

Use a stage-by-stage data map
| Stage | Information that may exist | Questions to answer | Control to document |
|---|---|---|---|
| Conversation and capture | Patient and clinician voices, names, symptoms, identifiers and background speech | Is audio recorded continuously, only after activation, or not at all? Which devices and rooms can capture it? | Activation policy, room signage, device settings and a procedure for stopping capture |
| Upload and processing | Audio, timestamps, device identifiers, account data and network metadata | Where is data sent? Which cloud regions and subprocessors handle it? Is it encrypted in transit and at rest? | Approved data locations, vendor security responsibilities and a current subprocessor list |
| Transcription and model generation | Raw transcript, prompts, model outputs and intermediate files | Are intermediate files retained? Are inputs or outputs used to train a general model or for product analytics? | Contractual limits on uses and disclosures, retention settings and access logs |
| Note review | Draft assessment, plan, medications, diagnoses and corrections | Who can open the draft? Can a user export it to the wrong chart or share it outside the EHR? | Role-based access, patient matching and a mandatory clinician review step |
| EHR insertion | Signed clinical note and audit history | Which account posts the note? Is the AI output distinguishable from the clinician’s final documentation? | Authenticated integration, audit trail and correction procedure |
| Retention and disposal | Audio, transcripts, drafts, backups and support copies | How long does each copy remain? What happens when an account or contract ends? | Written retention schedule, deletion evidence and end-of-service obligations |
HHS advises organizations using a cloud provider for electronic PHI to understand the service and conduct their own risk analysis. The HHS/OCR cloud-computing guidance applies that principle even when a vendor presents the product as an AI assistant.

Record every party that can see the data
List your practice, health system, clinicians, the scribe provider, hosting provider, transcription or model providers, support personnel, EHR vendor and any other subprocessor. For each party, state what it receives, why it receives it, where it processes it and when access ends. If the vendor cannot explain a transfer or subprocessor, treat that gap as unresolved risk rather than assuming the data stays inside the advertised product.
Determine whether HIPAA and a BAA apply
HIPAA applies to covered entities and business associates as defined by law; health information alone does not make every app or vendor subject to HIPAA. The key question is whether the scribe provider creates, receives, maintains or transmits electronic PHI on behalf of your covered entity or business associate. If it does, HIPAA generally requires an appropriate BAA for that workflow.
What the BAA should cover
Use the agreement to define permitted and required uses and disclosures, safeguard duties, access and correction responsibilities, incident handling, subcontractor obligations and what happens when the relationship ends. HHS explains that a BAA must require safeguards for PHI and may require return or destruction of PHI at termination where feasible. Ask the vendor to identify every subprocessor that performs a business-associate function and how those parties are bound.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteDo not accept a BAA as a compliance certificate. HHS’s cloud guidance makes clear that the customer still has to understand the service and perform its own risk analysis. Review the agreement together with product configuration, workforce procedures and technical controls. If the vendor offers only a generic terms-of-service document, have privacy or legal counsel determine whether it addresses the actual PHI workflow.
When a BAA is not the whole answer
A vendor’s willingness to sign a BAA does not establish that every feature is appropriate, and a vendor’s refusal does not by itself resolve the legal classification. A direct-to-consumer wellness app, a clinician’s separate personal account and a contracted service processing PHI for a health system can have different obligations. Document the parties and purpose for your specific arrangement, then obtain local privacy or legal review when the classification is uncertain.

Evaluate the service on the same privacy dimensions
Compare candidate services against one workflow, not against slogans such as “secure” or “HIPAA ready.” The following questions turn the risk analysis into a procurement record.
| Dimension | Questions for the vendor | Evidence to retain |
|---|---|---|
| Raw audio | Is audio captured? Is it optional? Is it retained after transcription, and can an administrator verify deletion? | Product settings, retention description and deletion process |
| Location and transfers | Which countries, cloud regions and subprocessors process audio, transcripts and notes? | Current data-flow diagram and subprocessor list |
| Secondary uses | Can the provider use inputs, outputs or metadata for model training, analytics, advertising or human review? | Contract clauses and configuration choices |
| BAA and role | Will the provider sign a BAA for the exact service and identify its business-associate subprocessors? | Executed BAA and responsibility matrix |
| Access and auditability | Are accounts role-based? Can administrators remove access promptly and review logs? | Access-control documentation, audit-log capability and support procedures |
| Retention and deletion | What is retained by default, for how long, in backups and support systems, and after cancellation? | Retention schedule, deletion terms and end-of-contract statement |
| EHR integration | How is the patient matched? Which identity posts the note? Can drafts be quarantined until signed? | Integration design, test results and downtime procedure |
| Patient communication | What does the organization tell patients, and can the workflow record a refusal or preference? | Approved notice, script and preference-recording field |
HHS notes that customers may seek additional assurances, such as safeguard documentation or audits, as part of risk management. Request the evidence needed to evaluate your particular deployment; do not treat an audit report or badge as a substitute for examining the data flow.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteConfigure layered safeguards before the first encounter
Administrative safeguards
- Assign an owner for the scribe workflow and a reviewer for vendor and subprocessor changes.
- Limit use to approved locations, clinicians and encounter types. Train staff not to paste unrelated patient data into prompts or support tickets.
- Define who may activate recording, who may view drafts, who may export notes and who may change retention settings.
- Document incident reporting, downtime, patient refusal and correction procedures, and test them with the clinical team.
Technical safeguards
- Use individual accounts, strong authentication and role-based permissions; remove access promptly when a worker changes role or leaves.
- Enable encryption and audit logging offered by the service, and review logs for unusual access or exports.
- Separate testing from production. Use synthetic or de-identified encounters for demonstrations unless the production workflow and agreements cover PHI.
- Require a clinician to confirm the patient identity and review the generated note before it is signed or inserted into the legal record.
Physical and environmental safeguards
- Control microphones, phones and workstations in shared rooms. Prevent a nearby conversation from being captured without the intended patient’s knowledge.
- Use privacy screens and secure storage for any local device that temporarily caches audio or drafts.
- Provide a clear way to pause or stop capture when a patient asks, when a sensitive discussion is off the record, or when the clinician is uncertain which encounter is active.
These measures implement the administrative, technical and physical protection approach described in the HHS/OCR privacy standards. Select controls that match the risks you documented; no single setting protects every deployment.
Set retention and deletion for each copy
Ask separately about audio, transcript, draft note, final EHR note, backups, logs and support tickets. “Deleted” may mean removed from the user interface while a backup or support copy remains. Require the provider to state the default period, the administrator’s available options, the process for an early deletion request and the evidence supplied after deletion.
There is no universal AI-scribe retention period established by the cited guidance. The appropriate period can differ for a temporary draft, a legally required clinical record and an operational audit log. Keep the final clinical record according to your organization’s records policy, while minimizing or deleting transient audio and drafts when they are no longer needed.

At contract termination, confirm which information can be returned, which must be destroyed and what remains because destruction is not feasible. HHS describes return-or-destroy obligations for PHI in a BAA where feasible. Obtain a written completion statement and restrict access during the transition to another system.
The Tool Desk
Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Explain the scribe to patients and honor preferences
Tell the patient, in plain language, that an AI tool may listen to the encounter, produce a draft and be reviewed by the clinician. Explain whether audio is retained, who can access the draft, how the final note enters the record and how the patient can ask questions. Point patients to the organization’s privacy notice; NHS England’s guidance on using AI-enabled ambient scribing products emphasizes clear information-governance communication.
Do not claim that one script or one consent method works everywhere. Recording-consent statutes and privacy requirements vary by jurisdiction and context. The Telehealth.HHS.gov privacy and security strategy guidance recommends informed consent and documentation of privacy preferences, but it does not establish a single nationwide AI-scribe script.
A practical conversation
“I use an AI documentation assistant to help draft your note. It may process the conversation so I can review the draft; I remain responsible for the medical record. Our policy explains what is retained and who can access it. Would you like to continue with the assistant, or would you prefer that I document without it?”
Adapt this language to local law and policy. Record the patient’s preference in the approved field, not in an unstructured note that future staff may miss. If the patient declines, pause capture and use the documented non-AI workflow without making the patient repeat the request.

Keep the clinician in control of the medical record
An AI-generated note is a draft, not an independent clinical decision. Require the clinician to check patient identity, dates, medications, allergies, diagnoses, negations and follow-up instructions before signing. Correct omissions and hallucinated statements in the EHR’s normal correction process. Do not allow an unreviewed draft to become visible to downstream teams or to trigger orders automatically.
Define what happens when the tool is unavailable, captures the wrong encounter or produces an unsafe draft. The fallback should be ordinary clinician documentation, with a way to quarantine and delete the erroneous audio or draft and to report the event to the workflow owner.

HIPAA guidance from the United States Department of Health and Human Services does not decide every state recording rule, employment arrangement, specialty policy or international transfer question. Audio capture can implicate consent laws in the patient’s, clinician’s or service provider’s location. Check the jurisdictions involved in your actual workflow and obtain local legal or privacy review for uncertain cases.
For audio-only telehealth, consult the HHS HIPAA guidance for audio-only telehealth alongside your organization’s telehealth policy. NHS England’s guidance on AI-enabled ambient scribing is a useful health-system example, not a replacement for U.S. requirements.

Implement the workflow in eight steps
- Inventory the information. Record whether the encounter is audio-captured, what transcripts and metadata are created, which notes are stored and every system or person that can access them.
- Draw the data flow. Mark device, network, cloud region, subprocessors, EHR and deletion points. Flag any unexplained transfer or retained copy.
- Classify the parties. Decide whether your organization is a covered entity or business associate for this workflow and whether the provider performs business-associate functions. Document the reasoning.
- Perform and approve the risk analysis. Evaluate confidentiality, integrity and availability risks, including wrong-patient matching, background capture, unauthorized access and residual backups.
- Negotiate the contract. Obtain a workflow-specific BAA when required. Set permitted uses, safeguards, subprocessors, incident duties, retention, deletion and termination handling.
- Configure least privilege and minimization. Turn off optional retention or secondary uses where possible, limit roles, enable logging and separate test data from production PHI.
- Train and test. Rehearse patient explanation, refusal, pause, downtime, wrong-encounter quarantine, note correction and access removal. Test with a non-production encounter before go-live.
- Monitor and reassess. Review access logs, vendor notices, subprocessor changes, deletion evidence and patient complaints. Reapprove the workflow after material changes.
Keep the resulting map, contract, configuration record, training evidence and review date together. That package lets a privacy officer or auditor see not only what the vendor promises, but how the clinical team actually uses the tool.
Troubleshoot common privacy failures
The vendor will not sign a BAA
Stop the PHI workflow until the organization determines whether a BAA is required. Ask whether the proposed service can operate without identifiable data; do not remove identifiers casually if the conversation itself remains identifiable. Escalate the role and contract analysis to privacy or legal counsel.
A patient refuses or asks to stop
Stop capture, acknowledge the preference and switch to the documented manual workflow. Record the preference in the approved location and ensure no draft or audio from the declined encounter remains in the scribe account unless your retention and legal policy requires otherwise.
Audio remains after the note is complete
Check whether the copy is in the product, an integration queue, a backup or a support ticket. Compare the observed behavior with the contract and configured retention. Ask the vendor for a deletion explanation and evidence; if the behavior is inconsistent with the agreement, suspend capture while the incident is assessed.
The draft is attached to the wrong patient
Quarantine the draft, prevent signing or downstream display, notify the designated privacy contact and follow the organization’s incident process. Correct the EHR only through its approved audit-preserving procedure. Review patient matching, account permissions and the activation workflow before resuming.
A vendor announces a new model or subprocessor
Re-run the data-flow and risk review. Confirm whether the change affects audio, training uses, location, retention, access or the BAA. Update patient notices, configuration and contracts before enabling the changed service if the impact is material.
