Protecting patient privacy starts before a dataset leaves your team: define the public-health or research purpose, collect and share only what that purpose requires, assess identifiability in context, and select access controls that match the remaining risk. De-identification is essential, but it is not a guarantee of anonymity. A defensible sharing plan also covers consent, institutional review, recipient obligations, onward-use restrictions, and a final check of every table or file released.

Start with purpose, necessity and proportionality

Write down the objective, the intended recipient, the variables requested and whether the recipient may share the data onward. The Centers for Disease Control and Prevention (CDC) says public-health data should be acquired, used, disclosed and stored for legitimate public-health purposes. Its Data Sharing and Collection Principles and Standards also calls for specifying the purpose, collecting personally identifiable information only when necessary and using nonidentifiable data whenever possible.

Use that statement as a decision test rather than as boilerplate. For each field, ask what decision, analysis or safety action it enables. Remove fields that do not serve the stated purpose, reduce precision where the analysis allows it, and avoid collecting identifiers merely because they may be useful later. If a recipient needs only a count by week and region, a line-list with exact dates, addresses and rare diagnoses is disproportionate.

  • Purpose: State the scientific or public-health question, the population and the period covered.
  • Recipient: Name the organization, roles or eligibility criteria for people who will access the data.
  • Variables: List requested fields and explain why each is needed.
  • Future use: Say whether analyses, linkage or onward sharing are expected.
  • Minimum necessary: Prefer aggregate or nonidentifiable data when they answer the question.

Keep confidential or identifiable data limited to people with a justifiable need. CDC advises assessing the risks and benefits of secondary use before disclosure, not treating every scientifically interesting request as sufficient justification.

Understand what “de-identified” means in context

NIH recommends de-identifying data to the greatest degree compatible with scientific utility. That is a balancing exercise: removing or generalizing information can reduce risk while also limiting the analyses a dataset supports. The appropriate method depends on the data, the anticipated recipient and the legal framework.

For protected health information (PHI) covered by the U.S. HIPAA Privacy Rule, the U.S. Department of Health and Human Services (HHS) Office for Civil Rights describes two routes: Safe Harbor, which removes specified identifiers and applies the rule’s required transformations, and Expert Determination, in which a qualified expert assesses whether the risk of identification is very small for the anticipated recipient, considering reasonably available information. HHS does not set one universal numerical threshold for Expert Determination.

Neither route means that identity inference is impossible. HHS cautions: “Although the risk is very small, it is not zero, and there is a possibility that de-identified data could be linked back to the identity of the patient to which it corresponds.” NIH likewise warns that combinations of individually nonidentifying facts can permit inferences, especially in qualitative material or datasets that can be combined with other information. Read the full HHS de-identification guidance and NIH’s privacy supplement with the proposed recipient and release environment in mind.

A practical privacy-preserving sharing workflow

1. Record the sharing scenario

Create a short data-sharing brief containing the purpose, recipient, proposed fields, geography, time period, linkage plans and onward-sharing expectations. Identify whether the file will be public, available to an approved community or kept in a controlled environment. This record becomes the reference point for later review and for explaining why a field or restriction is necessary.

2. Check consent, authority and review requirements

Read the consent language that applies to the participants. NIH’s Principles and Best Practices for Protecting Participant Privacy recommends clear explanations of future sharing and use, along with appropriate institutional review of the conditions and risks. If the planned use exceeds the consent or an approved protocol, pause and obtain the required amendment, waiver or re-consent rather than relying on de-identification alone.

Document the approvals that apply to your project: institutional review, data-owner authorization, public-health authority, contracts and any cross-border or cross-jurisdiction review. NIH’s Data Sharing Approaches guidance describes justified limitations that should be recorded in a Data Management and Sharing Plan.

3. Assess identifiability for the actual recipient

Inventory direct identifiers, quasi-identifiers and distinctive content. Direct identifiers include names, contact details and record numbers. Quasi-identifiers can include combinations such as an unusual age, a narrow location, a rare infection, an exact event date or a distinctive occupation. Consider what the recipient can reasonably obtain from public records, other studies, outbreak reports or its own files. The same file can have a different risk profile for a local health authority than for an unrelated public audience.

For HIPAA PHI, select Safe Harbor or obtain an Expert Determination when that standard applies. For non-HIPAA data, use a documented contextual assessment rather than assuming that removing names is enough. Qualitative interviews, free-text notes, genomic or highly granular location data may contain unique details that survive simple masking.

4. Transform only what you can justify

Choose transformations that address the identified risks while preserving the required utility. Depending on the analysis, this can mean aggregating counts, using broader age bands, coarsening geography, shifting or grouping dates, suppressing rare categories, removing free text, or replacing a direct identifier with a project-specific code. Keep the re-identification key separate, restrict it to an authorized custodian and do not send it with the analytical file.

Record the fields changed, the method used, who approved it and the analyses that may no longer be valid. Do not describe a transformed file as “anonymous” when a key, linkage source or unusual combination could still permit identification.

5. Select an access tier

NIH recommends proactively considering controlled access even when a dataset meets a technical or legal definition of de-identified. Match the tier to residual risk, scientific utility, consent and enforceability of restrictions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Sharing tier When it fits Controls and trade-offs
Open, suitably de-identified release The context supports very low identification risk, the consent and policy permit broad reuse, and the file contains no sensitive combinations that require supervision. Maximizes accessibility and reproducibility, but recipient identity and onward use are difficult to control. Recheck aggregate outputs and unusual combinations before publication.
Controlled access Researchers need record-level detail, or linkage and rare characteristics create meaningful contextual risk. Require an application, eligibility review, approved purpose, user authentication, logging and a data-use agreement. Access can preserve more utility while limiting the audience.
Restricted enclave or supervised analysis The dataset contains highly sensitive, granular or potentially identifying information, or consent and law require tight handling. Keep data in an environment operated by the data holder; provide only approved queries or outputs. This offers stronger control but adds operational cost and can limit exploratory work.

There is no universal best tier. NIH’s best-practice guidance emphasizes matching controls to residual risk and communicating limitations and conditions to repositories and downstream users.

6. Put obligations in writing before transfer

Use a data-sharing or data-use agreement that states the approved purpose, permitted variables, prohibited uses, security expectations, retention period, breach notification path, publication or output-review rules, access termination and limits on onward transfer. Assign responsibility for approving users, monitoring compliance and handling incidents. NIH recommends agreements that establish oversight, recipient responsibilities and restrictions. For certain shared public-health data, CDC calls for partner security standards equivalent to its own.

Give the recipient a data dictionary that explains transformations, missingness, suppression and known limitations. State explicitly whether attempts to re-identify participants are prohibited and what the recipient must do if an identity is inferred accidentally.

7. Review every release output

Privacy review applies to tables, charts, dashboards, codebooks and narrative examples, not just the underlying file. Check small cells, rare combinations, outlier records, exact dates, detailed locations, free-text quotations and join keys. CDC’s standards call for preventing public access to raw data or tables that could contain indirectly identifying information and for checking data quality before dissemination.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use a documented release checklist and have someone independent of the analysis inspect the final package. If a proposed table exposes a small group, suppress or aggregate it, combine categories, widen the time or geographic window, or move the result to a controlled channel.

HIPAA, public-health disclosures and other rules

HIPAA is not a universal privacy law for every researcher or every health dataset. HHS says the Privacy Rule generally protects individually identifiable health information held or transmitted by HIPAA covered entities and business associates. A university researcher who is not acting through a covered entity or business associate may be subject to other rules instead, while a covered entity may have HIPAA duties for the same project.

The HIPAA Rule includes a public-health disclosure permission for a covered entity when the recipient is a public-health authority authorized by law for specified activities. That permission is not a blanket authorization for research sharing. Determine whether the recipient, purpose and data flow fit the applicable pathway, and obtain project-specific privacy and legal review.

For work conducted under WHO technical programmes, the WHO policy Sharing and reuse of health-related data for research purposes: WHO policy and implementation guidance (April 6, 2022) addresses reuse and onward sharing in emergency and non-emergency contexts. It is an international policy reference, not a substitute for national law, local ethics review or institutional requirements.

Special issues in infectious-disease datasets

Outbreak data can become identifying through timing and rarity even after obvious identifiers are removed. A single case in a small community, an unusual pathogen, a narrow exposure window or a detailed travel history may point to a person when combined with news reports or local knowledge. Granular line lists can also reveal household or workplace relationships.

  • Time: Consider weekly or broader intervals when exact dates are not necessary, especially during a live event.
  • Place: Use a geographic level that supports the analysis without exposing a household, facility or tiny community.
  • Rarity: Suppress or combine rare diagnoses, occupations, exposures and demographic categories.
  • Relationships: Check whether household, contact-tracing or cluster variables reveal identities indirectly.
  • Free text: Remove narrative details, quotations and investigator notes that contain names or distinctive events.
  • Genomic and laboratory data: Evaluate whether sequence, specimen, collection-site or timestamp combinations could single out a person or household.

These adjustments can reduce scientific resolution. Record the trade-off and, where finer detail is essential, use controlled access rather than publishing the granular fields openly.

What to tell repositories and downstream users

Provide a plain-language description of the permitted population, variables, transformations, known gaps and remaining privacy risks. Explain which analyses are appropriate and which inferences are not supported. NIH recommends conveying limitations and conditions to repositories and downstream users so that a de-identified file is not treated as risk-free or reused outside its consent and governance context.

Frequently asked questions

Can a dataset be legally de-identified but still risky?

Yes. HHS describes the HIPAA risk after de-identification as very small but not zero, and NIH notes that combining fields or external information can support identity inferences. Legal status should therefore inform, not replace, contextual risk assessment and access controls.

Is Safe Harbor required for every infectious-disease research dataset?

No. Safe Harbor is one HIPAA method for covered PHI. Expert Determination is the other HIPAA method, and datasets outside HIPAA require analysis under the laws, policies, consent terms and agreements that actually govern them.

When should a de-identified file use controlled access instead of an open release?

Use controlled access when recipient eligibility, rare characteristics, linkage possibilities, consent limits or onward-use concerns make open distribution inappropriate. NIH recommends considering controlled access proactively rather than assuming a de-identification label settles the decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a public-health disclosure automatically permit research reuse?

No. The HIPAA public-health permission concerns specified disclosures by covered entities to authorized public-health authorities. Research reuse, secondary analysis and onward sharing still require checking the applicable authority, consent, review and institutional requirements.
