Protecting employee privacy with an AI wellbeing tool starts before procurement: define a specific purpose, collect the least information that can achieve it, complete a data protection impact assessment (DPIA), establish both UK GDPR legal conditions, and explain the arrangement clearly to workers. Treat health-related entries, measurements and AI-generated inferences as potentially special category data, then restrict access, retention and secondary use.
This guide applies to employers and people teams operating in the UK. The Information Commissioner’s Office (ICO) guidance on UK GDPR and the Data Protection Act 2018 is the main legal reference; the ICO says its monitoring-workers guidance is under review following changes made by the Data (Use and Access) Act, so check the current wording before launch.
What employee information can an AI wellbeing tool process?
A wellbeing product may ask workers to complete a mood check-in, collect information from a wearable, analyse communications or activity, or generate a score that predicts stress, fatigue or another condition. The fact that software produced the result does not make it ordinary HR analytics.

Under UK GDPR, information about a person’s physical or mental health is “data concerning health” and is special category data. The category can include information entered directly by a worker and information that reveals health status through measurement or inference. The ICO’s examples include health and fitness apps, wearables that track heartbeat or steps, and AI-enabled worker monitoring. Whether a particular signal is health information depends on what it reveals and how the organisation uses it.

Direct, observed and inferred data
| Data type | Examples | Privacy question |
|---|---|---|
| Directly supplied | A worker reports anxiety, sleep problems, medication effects or a need for support. | Is every requested field necessary for the stated wellbeing purpose? |
| Observed or measured | Heartbeat, step count, sleep duration, survey responses, location or device activity. | Can the same objective be met without collecting individual-level measurements? |
| Inferred | An algorithm labels a worker “at risk”, estimates mood, or predicts burnout from several signals. | Does the inference reveal physical or mental health, and who can see or act on it? |
Inference is especially important. A model’s label may be wrong, but it can still be sensitive personal data if it relates to a person’s health. Document the input, output, confidence information (if supplied), and the consequences of displaying the result.
Define a narrow purpose and prove that monitoring is necessary
Write the intended outcome in one sentence before selecting a supplier. “Improve wellbeing” is too broad to test. A usable purpose identifies the problem, the people affected, the information needed, who will receive results, and what actions may follow—for example, offering an optional support route after an anonymous workforce survey.
The ICO’s instruction is direct: “You must first consider what you are trying to achieve and whether there is a less privacy intrusive way to do this.” It also says, “You must be clear about your purpose and select the least intrusive means to achieve it.” Availability of a sophisticated tool is not evidence that monitoring is appropriate.

- Describe the outcome. State the safety, support or workplace-improvement result sought, not a general desire to gather more data.
- Identify the minimum information. Explain why each field, sensor, inference and period of collection is needed.
- Consider less intrusive routes. Test an aggregate survey, voluntary employee-assistance route, manager training, workload changes or another organisational intervention.
- Record the trade-off. Explain the expected benefit, the privacy impact, who bears that impact and why the chosen approach is proportionate.
- Set decision boundaries. List decisions the data may support and decisions it may never support without a new assessment.
A tool that requires continuous individual tracking may be disproportionate where an anonymous, periodic measurement would answer the same question. Conversely, a narrowly defined occupational-safety use may need more detail than a general engagement survey. The justification must fit the actual deployment.
Complete the DPIA and identify both UK GDPR legal conditions
For UK worker-health monitoring, complete a DPIA before processing starts. Involve workers or their representatives where appropriate, document alternatives and risks, and obtain advice for the specific deployment. The DPIA should cover the complete data flow rather than only the vendor’s dashboard.

Map the processing
- What workers type, upload or answer.
- What the product collects passively from phones, computers, wearables or other devices.
- What the model derives, including risk labels, mood estimates or recommendations.
- Whether processing occurs on the device, in the employer’s systems or in a supplier’s environment.
- Where data and backups are stored, including any international transfer.
- Which named roles can view raw data, scores, reports or audit logs.
- Which systems receive outputs and whether a person or an automated rule acts on them.
Choose the legal basis and special category condition
Health processing requires an Article 6 lawful basis and an Article 9 special category condition. The correct combination depends on the purpose, employment context, statutory duties and the way participation works; neither a single lawful basis nor a single Article 9 condition is universal. Record the reasoning before collection and make sure the privacy information matches it.
Do not assume that “consent” solves the problem. The ICO says consent is not usually appropriate in employment because workers may feel they have no real choice. If consent is relied on in a particular design, it must be genuinely voluntary, specific, informed and withdrawable without detriment; obtain legal advice on whether the employment relationship permits that conclusion.
Check automated-decision restrictions
If the system makes a solely automated decision with legal or similarly significant effects, assess the additional UK GDPR Article 22 restrictions. The ICO states that worker health information cannot be used for such automated decision-making unless the relevant explicit-consent or substantial-public-interest route applies. A human clicking “approve” after accepting a model’s result may not amount to meaningful human involvement. Define what review, challenge and override actually occur.
Give workers a clear explanation before collection
Provide accessible privacy information before a worker is asked to participate and, where useful, at the point of collection. Explain the arrangement in ordinary language, not only in a supplier’s technical notice.
Include these facts in the worker notice
- The precise purpose and expected benefit.
- Every category collected, including passive signals and inferred health or emotional states.
- Whether participation is voluntary, what happens if someone declines, and how withdrawal works.
- Who can see identifiable entries, raw measurements, inferences and aggregate reports.
- Whether line managers, occupational-health staff, HR, security teams or external providers receive access.
- Any decision that may follow and the safeguards for human review and challenge.
- The retention period or the criteria used to set it.
- The supplier’s role, relevant subprocessors and any transfer outside the UK.
- How workers can exercise their rights or raise a concern with the organisation.
Tell workers if managers will see individual results. A statement that data is “anonymous” is misleading if a small team, unique identifier or re-identification key makes a person recognisable. Covertly gathering worker health information is unlikely to be justifiable under the ICO’s guidance.

Control access, retention and secondary use
Design the system so that the default view is the least identifiable one. Use aggregate reporting where individual records are not needed, and separate health information from routine personnel records where that reduces exposure.
Access controls
- Assign access by role and purpose, not by seniority.
- Keep a current list of people who can view identifiable data and review it when roles change.
- Use strong authentication, secure transmission and storage, and logs that show access and exports.
- Prevent a manager from browsing raw wellbeing entries when only an aggregate team trend is necessary.
- Give occupational-health or support professionals only the information required for their function.
Retention and deletion
Set a retention period for each data type and purpose. A raw sensor stream, a worker’s check-in, an intervention record and an aggregate report may need different periods. Document the rationale, review it, and erase or irreversibly anonymise information when it is no longer necessary, subject to any applicable legal recordkeeping duty. Ensure deletion also covers supplier systems, backups and derived profiles where the contract and architecture allow it.
Prevent incompatible reuse
Do not quietly turn a support tool into a performance-monitoring system. Using wellbeing information for promotion, discipline, absence scoring, redundancy selection or job-security decisions is a new and more intrusive use. It requires a compatible purpose and an appropriate legal basis; specific consent or a clear legal obligation or function may be relevant in some contexts. If the proposed use changes, pause, reassess the DPIA and update worker information before collecting or using the data for that purpose.
Make the vendor accountable in the contract
The employer normally remains the controller when it decides why and how worker monitoring takes place. A supplier acting only on the employer’s documented instructions may be a processor. Determine the roles before processing begins; a label in a sales proposal does not decide the legal relationship.
Questions for procurement and privacy teams
| Area | Questions to put to the supplier |
|---|---|
| Data and model | What inputs are required? What is inferred? Can optional fields, continuous collection or high-sensitivity features be disabled? How are model changes communicated? |
| Access | Can the supplier, its support staff or subprocessors view identifiable records? Are customer, manager and worker permissions separate? Are access events logged? |
| Retention | What are the default and configurable retention periods? How are deletion requests propagated to derived data, backups and test environments? |
| Security | What technical and organisational safeguards protect the service, administrative accounts, interfaces and exports? How are incidents reported? |
| Rights and transparency | Can the employer obtain, correct, restrict, delete or export records and explain the processing to workers? |
| Subprocessors and transfers | Who else handles the data, where are they located, and how will the employer be notified of changes? |
| Decisions | Does the product rank, flag or recommend action about a person? What explanation, human review and challenge path are available? |
Put responsibilities in a written contract or service agreement, including instructions, confidentiality, security, assistance with rights requests and incidents, deletion or return at termination, audit information and subprocessor controls. Obtain enough information to perform the employer’s own DPIA and accountability duties. Procurement does not transfer those duties to the vendor.

Keep wellbeing support separate from employment scoring
Trust can collapse when a system introduced to help workers later influences performance reviews or job security. State at launch whether identifiable outputs can be seen by managers and whether any employment decision follows. If the answer changes, treat that as a material change requiring a new necessity, proportionality and legal assessment.
The International Labour Organization’s 30 April 2026 analysis links intrusive surveillance, work intensification, reduced autonomy and privacy concerns with potential psychosocial risks. This is contextual evidence, not a UK legal rule, but it is a reason to assess the human impact alongside data-protection compliance. A technically secure system can still harm workers if it pressures participation or creates constant observation.
Use this tool-comparison framework
When comparing two or more products, score the actual configuration you intend to deploy rather than the vendor’s most privacy-preserving option. The following questions synthesise ICO duties and practical procurement concerns; they are not an ICO-published scoring scheme.
| Comparison axis | Prefer the option that… |
|---|---|
| Data minimisation | Achieves the defined purpose with fewer fields, shorter collection windows and less individual-level data. |
| Inference sensitivity | Produces fewer or less intrusive health inferences, documents limitations and allows unnecessary inferences to be disabled. |
| Participation | Provides a genuine choice, explains consequences of declining and avoids pressure from managers. |
| Identifiable access | Keeps managers and general administrators from seeing raw results unless their role requires it. |
| Purpose controls | Can technically block exports, profiling or reuse for performance and disciplinary decisions. |
| Retention | Offers configurable, purpose-specific deletion and evidence that deletion reaches derived records. |
| Security | Supports strong authentication, least-privilege access, logging and secure handling of exports. |
| Supplier governance | Clearly identifies controller or processor roles, subprocessors, locations, transfers and contractual duties. |
| Explainability and review | Shows relevant inputs and limitations and supports meaningful human review where an output matters. |
| Less intrusive alternatives | Can meet the same objective through aggregate reporting or another lower-impact configuration. |
An implementation sequence for HR and privacy teams
- Write the use case. Name the workplace problem, desired outcome, affected population, proposed users and prohibited uses.
- Inventory the data flow. Capture direct entries, passive collection, inferences, devices, locations, recipients, storage and downstream systems.
- Test alternatives. Compare the proposed tool with an aggregate survey, voluntary support route, workplace intervention or other lower-impact method.
- Complete the DPIA. Record necessity, proportionality, worker impact, security, discrimination or accuracy concerns, mitigations and residual risk. Invite representative input where appropriate.
- Document Article 6 and Article 9 decisions. Obtain advice for the particular purpose and employment setting; do not copy a generic legal-basis statement.
- Configure privacy controls. Disable unnecessary sensors and inferences, set role-based access, choose retention periods and block unauthorised exports or reuse.
- Contract and test the supplier. Confirm roles, instructions, subprocessors, transfers, security, rights assistance, incident handling and deletion. Test the worker and manager experiences before launch.
- Publish the worker notice and support route. Explain participation, access, retention, vendors, rights and decisions in clear language, then provide a way to ask questions or challenge an output.
- Monitor after launch. Review access logs, complaints, opt-out patterns, model changes, false or harmful flags, supplier changes and whether the original purpose still exists.
- Reassess material changes. A new data source, model capability, recipient, retention period or employment use should trigger a DPIA and transparency review before activation.
Common deployment mistakes and the corrective action
“It is only a wellbeing score, so it is not health data”
Corrective action: examine what the score reveals, how it was calculated and what decisions it enables. Treat a health-related inference as potentially special category data and include it in the DPIA and worker notice.
Recommended Free Tools
“Everyone has to use the app”
Corrective action: establish whether compulsion is necessary and proportionate, identify the legal conditions, and consider a non-tracking alternative. Do not describe participation as voluntary if refusal affects work opportunities or treatment.

“The vendor is compliant, so our obligations are covered”
Corrective action: establish controller or processor status, obtain evidence needed for the employer’s assessment and put operational responsibilities in a contract. The employer remains accountable for its own purpose and decisions.
“We can use the data later if it proves useful”
Corrective action: define permitted and prohibited uses at launch. For a new use, test compatibility, legal conditions, necessity and transparency before processing; do not rely on an old notice.
“Managers need the raw feed to support their teams”
Corrective action: start with aggregate or worker-controlled support signals. Give identifiable access only where a documented role and purpose require it, and record who can access what.
What broader AI-ethics guidance adds
The World Health Organization’s 2021 guidance on ethics and governance of artificial intelligence for health says AI technologies “must put ethics and human rights at the heart of its design, deployment, and use.” That is international ethics framing, not employment-law advice, but it reinforces the need to consider autonomy, fairness, explainability and human oversight alongside UK GDPR duties.
For UK employers, the practical standard is therefore dual: satisfy the legal requirements for health information and design a system that workers can understand, question and use without undue pressure.
