Protect customer data by treating every hosted AI prompt, upload, output and log as a transfer to another processor. Before anyone uses a service, minimize or pseudonymize the data, approve the exact product and configuration, verify retention and secondary-use terms, restrict access, document the data flow and privacy assessment, and delete copies when the purpose ends.
“Not used for training” is only one answer. You must also establish who can access the data, how long prompts and files remain, which subprocessors handle them, where processing occurs, how deletion works, and what happens after a security incident. Legal requirements depend on your jurisdiction, data type and use, so have qualified privacy or legal professionals validate the deployment.
Why a third-party AI service changes your data risk
A hosted model is operated by a separate company. When an employee sends a customer email, support transcript, account record or uploaded document, that material leaves your direct environment and is processed under the provider’s systems and contracts. The Federal Trade Commission describes model-as-a-service submissions as potentially sensitive business and customer information and warns that providers must honor the privacy and confidentiality commitments they make to business customers. Read the FTC’s guidance on AI companies and privacy commitments.
There are several different risks, and one control does not solve all of them:

- Confidentiality: an unauthorized employee, subcontractor or attacker might see prompts, files or outputs.
- Privacy: personal data may be processed for a purpose or retention period that customers did not expect.
- Secondary use: data may be used for model improvement, abuse monitoring or another purpose unless the contract and settings prohibit it.
- Lifecycle risk: copies can remain in logs, exports, backups, temporary files or support systems after the original task is complete.
- Decision risk: an output can be wrong or unfair, and sensitive information may have been included merely to make a response more convenient.
“Model-as-a-service companies must also abide by their commitments to customers regardless of how or where the commitment was made.” — Federal Trade Commission, January 2024.
A privacy promise in a sales page, marketplace listing, contract, API document or product setting should therefore be checked against the exact service your organization will use. The FTC says undisclosed secondary use can create legal risk; the current contract and configuration remain the controlling documents.
Map the data flow before approving a service
Do not begin with a vendor name. Begin with the business task and the information it would expose. Create a short record that follows data from collection through deletion.
1. Describe the task and users
Record the use case, business owner, intended users, expected volume, human review points and whether the output affects a customer decision or communication. “Summarize support tickets” and “decide whether to reject a loan application” have very different consequences and review requirements.
2. Inventory every input and output
List direct identifiers (such as names, email addresses and account numbers), indirect identifiers, payment or authentication data, health or other sensitive information, confidential business material, free-form customer messages, attachments, generated outputs and feedback sent to the service. Include data copied into a prompt manually as well as data sent through an integration.
3. Draw the movement and storage points
Show the source system, extraction or redaction step, AI endpoint, provider storage, subprocessors, logs, administrator consoles, exported outputs and your own backups. The ICO recommends documenting how personal data moves through and is stored in AI systems and removing unneeded intermediate copies. Its guidance is available in How should we assess security and data minimisation in AI?.

| Flow stage | Questions to record | Control decision |
|---|---|---|
| Source system | What fields are collected, for what original purpose, and who can export them? | Limit the export to fields needed for the AI task. |
| Preparation | Where are redaction, tokenization or aggregation performed? Are temporary files created? | Use an approved preparation environment and set deletion times. |
| AI request | Which plan, API, feature and region receive the request? Are prompts or files logged? | Approve the exact configuration, not a generic product name. |
| Provider operations | Which personnel and subprocessors can access data? How are backups handled? | Obtain contractual and security evidence and define incident duties. |
| Output and archive | Where are results stored, shared or used in decisions? | Apply access, retention and human-review rules to outputs too. |
4. Identify your legal role and jurisdictions
Determine whether your organization is a controller, processor or another role under each applicable law, and whether the AI provider is permitted to process the information for the selected purpose. A UK deployment, a US health service and a multinational support platform may have different obligations. Do not treat guidance written for one jurisdiction as a universal rule.

Data minimization is the most reliable control because it reduces what can be exposed, retained or misused. The FTC’s Protecting Personal Information: A Guide for Business recommends collecting and retaining only what is needed, applying least privilege and disposing of information securely.
Remove fields the task does not require
A prompt asking for a tone-neutral summary normally needs the message text, not the customer’s name, phone number, address, account number or payment details. Delete those fields before transmission. If a model needs a date or product category, send that field alone rather than the complete customer record.
Use structured redaction and replacement tokens
Replace identifiers with stable tokens such as CUSTOMER_1042 or ORDER_7781 when the workflow must connect several messages. Keep the re-identification key in a separate, access-controlled system that is not sent to the provider. Test redaction for identifiers hidden in free text, filenames, image metadata, spreadsheet comments and document revisions.
Pseudonymization lowers exposure but does not make information anonymous. If your organization can link a token back to a person, the data can still be personal data. The ICO discusses this distinction and related AI risks in its data-minimization guidance.
Prefer aggregation, summaries or synthetic examples
For trend analysis, send counts or grouped statistics instead of individual records. For prompt development, use synthetic or fully de-identified examples that cannot reasonably be linked to a person. Validate that a supposedly anonymous dataset cannot be re-identified by combining rare dates, locations, diagnoses, job titles or other attributes.

Apply least privilege to people and systems
Give the AI integration access only to the tables, folders, fields and actions required for its approved purpose. Separate an analyst who can prepare redacted text from an administrator who can retrieve the re-identification key. Use role-based access, strong authentication and reviewable service accounts; do not rely on a shared personal login.
Example: rewrite a support reply
| Unsafe request | Minimized request | Why it is better |
|---|---|---|
| “Rewrite this complaint for our customer, Jane Smith, account 483921, at jane@example.com: [full message and order history].” | “Rewrite this complaint in a calm, concise tone. Customer token: CUSTOMER_1042. Product: delayed delivery. Complaint text: [redacted message].” |
The model receives the language problem and relevant context without direct contact or account identifiers. |
| Upload a complete spreadsheet containing names, addresses, balances and notes to find common issues. | Send an aggregated table of issue category, month, product and count. | Aggregation removes records that are not needed for trend detection. |
Vet the provider, contract and exact configuration
Obtain written answers and retain them with your approval record. A public statement about a company’s general AI products may not apply to your API tier, regional endpoint, plug-in, workspace or future model.
| Assessment area | Questions to ask | Evidence to retain |
|---|---|---|
| Data use | Are prompts, uploads, outputs, feedback or logs used for training, service improvement, abuse monitoring or another secondary purpose? Can the setting or contract change that use? | Current terms, data-processing agreement and captured configuration. |
| Retention and deletion | What are the default and configurable retention periods? When are prompts, files, outputs, logs and backups deleted? Does deletion cover derived copies? | Retention schedule, deletion procedure, test result or provider commitment. |
| Access | Which provider employees, support teams and subprocessors can access content? What authentication, authorization, segregation and audit controls apply? | Role descriptions, access-control documentation and audit reports where available. |
| Location and transfers | Where are data and backups processed and stored? Which cross-border transfer mechanism applies? | Region list, subprocessor list and transfer terms. |
| Security | What encryption, key management, vulnerability management and monitoring protect the service? What customer-side settings are required? | Security documentation and your configuration checklist. |
| Incidents | When and how will the provider notify you? Who investigates, preserves evidence, answers customer questions and pays or performs required remediation? | Incident clause, contact route and escalation plan. |
| Governance fit | Can the service support access, correction, deletion, objection, records, audits and other rights relevant to your processing? | Rights-handling procedure and responsibility matrix. |
Check that every promise applies to the exact plan, API, feature and configuration. The FTC cautions that commitments made in terms, promotional material or marketplaces still bind a model-as-a-service provider; that warning is not a substitute for reading the current agreement.

Configure approved accounts and guardrails
Where the service supports these controls, configure them before production use. If a control is unavailable, record the gap and decide whether the task can be redesigned or must be prohibited.
- Use an organization-owned workspace or API account; prohibit personal accounts for customer data.
- Require strong authentication and, where available, single sign-on and multi-factor authentication.
- Assign separate roles for users, application integrations, reviewers and administrators.
- Disable provider training or improvement use when the contract and product actually offer that setting, then verify the setting remains enabled.
- Choose the permitted processing and storage region and document any transfer basis.
- Set the shortest practical prompt, file and log retention period. Do not assume a user-visible deletion button removes backups or security logs.
- Restrict plug-ins, connectors, browsing, code execution and external actions unless each is separately approved.
- Log account, configuration and administrative changes without copying customer content into a second unnecessary log.
- Apply data-loss-prevention rules or gateway redaction to block account numbers, payment data and other prohibited patterns.
Use a controlled day-to-day workflow
- Check the task. Confirm that the purpose, user and service are on the approved register. If the task has changed, stop and request a new review.
- Prepare the smallest input. Remove direct identifiers, unnecessary fields, hidden metadata, comments, tracked changes and unrelated pages. Replace identifiers with tokens when continuity is required.
- Inspect the attachment. Open the final file, confirm that redaction is irreversible, and check that filenames and embedded images do not reveal customer information.
- Send through the approved account. Do not paste the data into a personal account, an unapproved plug-in or a browser extension. Use the documented endpoint and settings.
- Review the response. A human should verify accuracy, confidentiality, bias and appropriateness before an output reaches a customer or affects eligibility, pricing, access or another consequential decision.
- Store only the needed result. Put the approved output in the designated system with its access and retention controls. Do not keep a convenience copy in downloads, chat history or a personal notebook.
- Delete temporary material. Remove staging files, local exports and intermediate redacted copies when the task no longer needs them, subject to legal holds and documented retention duties.
- Record the transaction when required. Note the service and configuration, data category, purpose, reviewer and deletion outcome without creating an unnecessary duplicate of the customer content.
Set retention and disposal rules for every copy
Define separate retention periods for source records, prompts, uploaded files, outputs, audit logs, support tickets and backups. The business need to retain an approved customer response may be different from the need to retain the prompt that produced it.
Ask the provider how deletion propagates through active systems, replicated storage, disaster-recovery copies and abuse-monitoring logs. If the provider cannot explain the lifecycle, do not send data whose retention you cannot justify. Apply the same discipline internally: delete temporary exports and intermediate files, and securely dispose of printed records when the retention period ends. A cross-cut paper shredder can address a printed customer record; it does not protect information already submitted electronically to an AI service.
Rank #4
- Cross-cut paper and credit card shredder cuts material into approximate 0.2 x 1.2 inches (5 x 30 mm) pieces; meets security level P-3 standards

- 9 minute runtime and 30 minute cool down; if unit goes over max run time, it automatically shuts off to prevent overheating
- 4 mode control switch (auto/on, off, reverse, forward) and LED status indicators for power on, overheat and overload; 5 gallon bin reduces empty frequency

Meet privacy and accountability obligations
Document a privacy risk assessment
Record the purpose, data categories, necessity and proportionality analysis, risks to customers, safeguards, residual risk, owner, approval date and review trigger. Include the data-flow map, provider assessment, configuration evidence, retention decision and incident contacts.
Establish a lawful basis where required
For UK processing, the ICO states that an appropriate lawful basis is required and should be reflected alongside the purposes in the privacy notice. See How do we ensure lawfulness in AI?, whose page lists a latest update of 28 October 2024. The ICO says its AI guidance is under review following UK legislative changes, so confirm the current position before relying on it.
Other jurisdictions may require different notices, contracts, impact assessments, consent conditions, sector safeguards or cross-border mechanisms. Obtain advice for the countries and data categories involved rather than copying the UK approach.
Handle customer rights and human review
Know how your organization will locate AI-related copies if a customer requests access or deletion, correct inaccurate source data, honor an objection, or asks how an automated decision was made. Keep a human accountable for consequential decisions and provide a route to challenge an outcome where applicable.
Use specialized standards only in their scope
NIST Special Publication 800-63A includes privacy-risk documentation and reassessment requirements for covered identity-proofing and identity-service providers. It is not a universal rule for every AI deployment. If your service performs identity proofing, consult NIST SP 800-63A and map its applicable requirements; otherwise, use it only as a reference rather than claiming its identity-service obligations apply automatically.

Mark an item “not established” rather than guessing when the provider has not supplied an answer. Escalate unresolved high-risk questions to the privacy, security and legal owners before approval.
Common failure modes and fixes
“The provider does not train on my prompts, so we are safe.”
Training is only one data-use question. Obtain separate answers about retention, support access, logs, subprocessors, deletion, backups, abuse monitoring and incident handling.
“We removed names, so the data is anonymous.”
Rare combinations of dates, locations, job titles or case details can identify a person. Treat pseudonymized or linkable data as personal data and protect the re-identification key separately.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problems“The tool is free, so employees can try it.”
Free access does not establish acceptable terms, retention or security. Route all customer-data use through an approved organizational account and prohibit experiments with live records.
“The integration sends the whole record because that is easiest.”
Redesign the integration to select required fields, redact before transmission and block prohibited patterns. Convenience is not a business purpose for exposing extra data.
“Deleting the chat removes everything.”
Confirm how provider logs, exports, backups and support copies are handled, and remove your own temporary files. If the lifecycle is unclear, limit the data or choose another configuration.
“The model wrote the response, so no review is needed.”
Check facts, confidentiality, tone, unsupported inferences and discriminatory effects before using an output in a customer communication or decision. Keep responsibility with a named human owner.
“The service changed without affecting privacy.”
Reassess when the provider, model, product settings, endpoint, purpose, data type or workflow changes. For covered identity-service providers, NIST SP 800-63A specifically calls for reassessing privacy risks when service changes affect personal-information processing.
Approval and operating checklist
Before approval
- Business purpose, users and workflow are documented.
- Data categories, jurisdictions and organizational roles are identified.
- A less-data, redacted, aggregated, synthetic or internally approved alternative was considered.
- Provider data-use, retention, access, subprocessor, location, security, deletion and incident terms are documented for the exact plan and feature.
- Privacy assessment, lawful-basis analysis and customer-notice implications are complete.
- Approved accounts, roles, regions, retention and redaction settings are configured and tested.
- Output review, rights handling, incident escalation and deletion owners are named.
During operation
- Staff use only approved accounts and prohibit listed sensitive inputs.
- Prompts and attachments contain the minimum necessary information.
- Outputs are reviewed before customer use or consequential decisions.
- Temporary files, exports and intermediate copies are deleted on schedule.
- Access, configuration changes and exceptions are logged.
- Incidents and suspected misdirected disclosures are reported through the defined route immediately.
At every material change
- Recheck provider terms, settings, subprocessors and processing locations.
- Repeat the privacy and security assessment for new data types or purposes.
- Test redaction, retention and deletion again.
- Update notices, contracts, staff guidance and the data-flow record.
The defensible standard is simple to state but demanding to operate: send less data, to fewer approved places, for a documented purpose, under enforceable terms, for no longer than necessary, with a human accountable for the result.
