Protect borrower data by controlling the entire AI lifecycle: identify the fields an AI use case needs, keep those fields in an approved environment, restrict access, encrypt and log transfers, contractually limit provider use, preserve records for every material decision, validate the model, and delete copies on a defined schedule. Do not paste borrower information into an unapproved public AI account. Whether a particular workflow is permitted depends on the lender’s regulator, state law, product, data, vendor arrangement, and AI purpose.
This guide is an operational framework for U.S. mortgage lenders and the privacy, security, compliance, model-risk, and technology teams supporting them. It is not a substitute for institution-specific legal advice or a current review of applicable rules.
What borrower-data protection means across the AI lifecycle
AI risk does not begin when a model returns a score. It begins when a borrower document is collected and continues through every copy, prompt, output, log, backup, decision record, vendor handoff, and deletion event.
| Lifecycle point | Control question | Practical evidence |
|---|---|---|
| Collection | What information is being collected, and is each field necessary? | Data inventory, purpose statement, field-level classification, privacy notice analysis |
| Transfer into AI | Which approved system receives the information, through what connection, and under whose identity? | Approved-tool register, access logs, encryption settings, identity records |
| Processing | Can the provider or model reuse prompts, files, or outputs for training or another customer? | Contract terms, configuration screenshots, provider attestations, technical tests |
| Retention | How long are source files, prompts, outputs, logs, and backups retained? | Retention schedule, legal-hold procedure, deletion reports |
| Decision use | Which inputs and model version affected a credit or valuation decision? | Immutable decision record, model version, input snapshot, human-review record, reason codes |
| Sharing | Who can access the information, including subcontractors and support personnel? | Role matrix, subprocessor list, privileged-access reviews, audit logs |
| Deletion and incidents | Can the lender stop access, remove copies, and respond quickly if information is exposed? | Offboarding checklist, deletion confirmation, incident-response plan, exercise records |
Start with this map for every use case, even an apparently low-risk use such as summarizing an income document. A summary can contain nonpublic personal information, become part of a loan file, and influence a later decision.

Can I put borrower information into ChatGPT?
Not unless the specific account, configuration, contract, and workflow have been approved by your institution. A consumer or employee account that is convenient for drafting text is not automatically suitable for borrower files. The Federal Trade Commission’s Safeguards Rule guidance tells covered institutions to know what information they hold and where it is stored, assess foreseeable risks, evaluate applications that store, access, or transmit customer information, and periodically review access controls. That is a practical reason to keep borrower data out of unapproved AI systems; it is not a blanket statement that every public AI tool is unlawful for every lender.
Use this decision sequence before sending any data:
- Define the purpose. State the business task, the intended output, and whether the output can affect eligibility, pricing, valuation, servicing, or a customer communication.
- Minimize the input. Remove fields that the task does not require. A name, address, account number, Social Security number, exact income, or detailed credit history should not be included merely because it is present in a document.
- Check the environment. Confirm that the account is institution-managed, uses approved identity controls, restricts retention and reuse as required, and records administrative and user activity.
- Confirm the legal and contractual basis. Review privacy-notice, disclosure, redisclosure, reuse, records, fair-lending, and security implications before production use.
- Test the output. Verify that the system does not invent facts, expose another borrower’s information, or produce a recommendation that staff treat as a credit decision without approved controls.
For development and demonstrations, use synthetic or de-identified information where feasible. Removing a name alone does not make a mortgage document anonymous: a property address, dates, employer, loan amount, rare transaction, or document combination may identify a person.

Map, classify, and minimize every AI data flow
Create a use-case inventory
For each AI application, record the source systems, fields, file types, users, interfaces, model or provider, geographic storage locations, logs, backups, subprocessors, outputs, and deletion events. Include informal paths such as browser uploads, copied text, email plug-ins, developer notebooks, and support tickets. The inventory should show whether information is identifiable, financial, credit-related, property-related, biometric, employment-related, or otherwise sensitive.
Separate data by purpose
Do not let a model approved to classify documents automatically gain access to underwriting notes or servicing records. Create purpose-specific datasets and permissions. A test environment should not connect to production borrower files. If a use case needs only document type and extracted dates, do not provide full account numbers and narrative notes.

Assess re-identification risk
For de-identified or synthetic data, document what was removed, what remains, who could combine it with other information, and how the result was tested. Tokenization and masking reduce exposure but do not eliminate obligations if the lender can reverse the process or link the records.
Keep an accountable record
The FTC’s Safeguards Rule guidance calls for an inventory of information and systems and a written risk assessment for covered institutions. Treat the inventory as a living control: update it when a model, connector, prompt workflow, provider, subprocessor, or retention setting changes.

Which U.S. rules matter?
Requirements differ by charter, regulator, state, product, and use case. The following distinctions prevent teams from treating voluntary guidance as law or applying a rule outside its scope.
| Authority or rule | What it addresses | How it affects an AI workflow |
|---|---|---|
| GLBA and Regulation P | Privacy notices and limits on disclosure, redisclosure, and reuse of nonpublic personal information | A nonaffiliated AI provider may require institution-specific analysis of notice language, exceptions, contractual purpose limits, and state requirements. Nonbank mortgage lenders, brokers, and servicers may be covered, but coverage is not identical for every institution. |
| FTC Safeguards Rule | A written information-security program for financial institutions subject to FTC jurisdiction and not subject to another regulator’s GLBA section 505 enforcement authority | Covered firms need risk assessment, access controls, encryption, multifactor authentication, secure disposal, monitoring and testing, training, provider oversight, and a written incident-response plan. Banks, credit unions, and other lenders may have a different primary regulator. |
| ECOA and Regulation B | Accurate, specific principal reasons for adverse action | Complexity or opacity of an algorithm is not a defense. The lender must be able to identify the actual principal reasons for the decision. |
| FCRA | Additional disclosures when credit-score information is used in an adverse action | Coordinate model reason codes with the applicable credit-score disclosures and retain the evidence needed to support them. |
| AVM final rule | Quality controls for covered automated valuation models used in certain mortgage credit decisions or securitization determinations | Controls must address confidence in estimates, data manipulation, conflicts of interest, random sample testing and review, and nondiscrimination. The CFPB compliance guide states that compliance began October 1, 2025. |
| NIST AI Risk Management Framework | Voluntary structure for organizing AI risk and trustworthiness work | Use it as an implementation aid, not as a mortgage-specific legal mandate or certification. NIST says version 1.0 is being revised; its Generative AI Profile was released July 26, 2024. |
Before production deployment, compliance and counsel should verify current statutory and regulatory text, agency interpretations, court developments, state privacy and fair-lending requirements, and the institution’s regulator-specific expectations.
Build the security program around borrower information
Control identity and access
- Use role-based access and least privilege for prompts, source documents, outputs, administration, and logs.
- Require strong authentication and multifactor authentication for people who access customer information where the applicable Safeguards Rule requires it, subject to that rule’s stated exception.
- Separate production, testing, and personal accounts. Prohibit forwarding files to personal email or uploading them through unsanctioned browser extensions.
- Review access periodically and revoke it when an employee, contractor, application, or provider no longer needs it.
- Log administrative actions, downloads, bulk searches, prompt submissions, model changes, and permission changes. Protect logs from alteration because they may be evidence in an investigation.
Encrypt data and protect keys
Use appropriate encryption for information in transit and at rest, protect key material separately, restrict key access, and test recovery. The FTC guidance describes encryption in transit and at rest; an alternative control should be used only when encryption is not feasible and is approved by the qualified individual under the rule. A product label that says “encrypted” does not prove that every connector, temporary file, backup, or support channel is protected.

Harden prompts and outputs
Do not place secrets in system prompts. Treat generated text as untrusted until a qualified employee verifies it. Apply output filtering for account numbers, Social Security numbers, addresses, and other identifiers before displaying or exporting results. Prevent a model from retrieving records outside the user’s authorization, and test for prompt injection in uploaded documents that attempt to override instructions or exfiltrate data.
Monitor and test
Use vulnerability management, endpoint protection, configuration reviews, penetration testing where appropriate, and alerting for unusual downloads or prompt volume. Train staff on approved tools, prohibited data, phishing, prompt injection, incident reporting, and how to verify AI-generated content. Covered institutions remain accountable for oversight even when a provider performs security work.
What should lenders ask an AI vendor about customer data?
Vendor diligence should produce evidence, not a generic promise that a service is “secure.” Obtain answers for the exact service tier, region, connector, and subcontractor chain that will process borrower information.
| Due-diligence area | Questions to ask | Evidence to retain |
|---|---|---|
| Purpose and use | What may the provider do with prompts, files, outputs, and metadata? Are they used to train, tune, benchmark, or support another customer? | Data-use terms, configuration, product documentation, change-notice process |
| Retention and deletion | How long are live data, caches, logs, backups, and support copies retained? Can the lender delete them and receive confirmation? | Retention schedule, deletion procedure, certificate or report, legal-hold process |
| Location and access | Where are data and keys stored? Which employees, support teams, and subprocessors can access them? | Regions, access model, privileged-access controls, current subprocessor list |
| Security | How are data encrypted, authenticated, monitored, tested, and recovered? How are vulnerabilities disclosed? | Independent assessment or audit report, test summary, incident history, recovery objectives |
| Decision support | Can the service preserve inputs, model versions, confidence information, and the factors that actually drove an output? | Versioning design, audit-log samples, explanation documentation, validation results |
| Change management | How much notice is provided for model, data-use, subprocessor, or hosting changes? Can the lender pause or terminate processing? | Contract language, service-change policy, exit plan |
| Incident response | When and how will the provider notify the lender, contain an event, support forensics, and cooperate with regulators and affected customers? | Incident clause, contact tree, exercise results, evidence-preservation process |
| Audit and remedies | Can the lender assess controls, obtain records, require remediation, and recover costs or terminate for a material breach? | Audit rights, corrective-action terms, insurance and liability provisions reviewed by counsel |
The FTC guidance calls for suitable provider selection, contractual security expectations, monitoring, and periodic reassessment. Specific clauses about training, deletion, audit, notice, and remedies are implementation details that should be negotiated for the lender’s risk and legal obligations. Reassess a provider after material changes, not only at renewal.
Keep credit decisions explainable
AI does not remove notice duties. CFPB Circular 2022-03 states that ECOA and Regulation B require accurate and specific principal reasons for adverse action, regardless of the technology used. As the circular puts it: “A creditor cannot justify noncompliance with ECOA and Regulation B’s requirements based on the mere fact that the technology it employs to evaluate applications is too complicated or opaque to understand.”

For every material credit decision, preserve:
- the input values actually supplied to the model, including the source and date;
- the model, rules, prompt template, retrieval index, and configuration versions;
- the output, score, recommendation, confidence or uncertainty information, and any human override;
- the factors that drove the outcome and the mapping to approved adverse-action reason codes;
- the reviewer, review time, exception decision, and evidence used to correct an error.
Test explanation methods against known cases. A generic reason such as “the application did not meet criteria” or a nearest-match reason code is not adequate if it was not a principal cause of the decision. If the lender cannot reliably produce specific reasons, it should not use that opaque system for a decision that requires them. When credit-score information triggers an adverse action, coordinate the explanation with applicable FCRA disclosures.

General AI and machine-learning controls
Before use, evaluate data quality, security, performance, error patterns, drift, accessibility, and fair-lending risk. Define acceptance thresholds, prohibited uses, escalation owners, and a rollback method. After deployment, monitor outcome distributions, overrides, complaint patterns, missing or manipulated inputs, latency, and performance by relevant populations and property or product segments. Revalidate after a material model, prompt, data, provider, or workflow change.
Additional controls for covered AVMs
The AVM rule is not a general AI privacy rule. It applies to covered automated valuation models used in specified mortgage credit decisions or securitization determinations. Its quality-control policies and systems address confidence in estimates, protection against data manipulation, conflicts of interest, random sample testing and review, and compliance with nondiscrimination laws. A lender may work with an AVM provider, but the CFPB guide says it cannot simply rely on the provider’s statement that testing or validation is sufficient. The lender must assess whether the evidence fits its size, complexity, risk profile, and use.
For an AVM review, retain the model and data versions, sample-selection method, error and confidence analysis, conflict review, manipulation tests, fair-lending analysis, remediation decisions, and approval record. Do not extend AVM-specific obligations to unrelated document, chatbot, or workflow tools without a separate legal analysis.
Use NIST as a organizing framework, not a legal shortcut
NIST AI RMF 1.0 can help teams assign governance, map context, measure performance and harms, and manage risks. It is voluntary, not a mortgage-specific mandate or certification. NIST reports that the framework is being revised, and its Generative AI Profile was released on July 26, 2024. Record the version and profile used so a future update does not silently change the control baseline.

Set retention, deletion, and incident procedures
Define what must be retained
Create separate retention rules for source documents, extracted fields, prompts, outputs, model inputs, decision records, audit logs, backups, and support tickets. Align them with applicable records requirements, legal holds, servicing and investor obligations, privacy commitments, and business need. A provider’s default retention period is not the lender’s policy.
Delete securely when permitted
When the retention period ends and no legal hold or other exception applies, delete production copies, indexes, caches, temporary files, exports, and provider-held data. Confirm that deletion covers backups according to the documented backup cycle. The FTC guidance requires secure disposal for covered institutions subject to stated exceptions.
Prepare for a security event
A written incident-response plan should assign decision authority and cover detection, containment, evidence preservation, investigation, customer and regulator communications, remediation, and post-incident review. Exercise the plan with a scenario involving a prompt upload, compromised service account, exposed log, or provider breach.
For an FTC-regulated covered institution, the FTC guidance says the firm must notify the FTC as soon as possible and no later than 30 days after discovery of a notification event involving unauthorized acquisition of at least 500 consumers’ unencrypted information. Confirm that the institution is subject to that rule, determine whether the data and event meet its definition, and check other federal, state, contractual, and law-enforcement reporting duties before applying that deadline.
Lender-managed model or third-party AI service?
Neither architecture is automatically safer. Compare the complete control environment rather than the model label.
| Decision factor | Lender-managed model | Third-party AI service |
|---|---|---|
| Data residency and access | More direct control over hosting, network paths, keys, and administrator access, with greater responsibility for operating them | Potentially faster deployment, but residency, support access, subprocessors, and jurisdiction must be verified contractually and technically |
| Retention and reuse | Policy can be implemented directly in storage and application layers | Must be confirmed for prompts, outputs, logs, backups, and training or reuse settings |
| Identity and logging | Can integrate with existing workforce identity, security monitoring, and records systems | Depends on available single sign-on, role controls, exportable logs, and API behavior |
| Explainability | May allow deeper access to features, rules, and version history | Requires provider documentation, stable versioning, reason support, and validation evidence |
| Change management | Lender controls release timing but must test patches and maintain expertise | Provider may change models or behavior; contract for notice, testing, rollback, and termination |
| Incident response | Direct containment, with internal staffing and recovery obligations | Requires rapid notification, forensic cooperation, deletion, and evidence commitments |
| Integration | More customization, cost, and operational burden | Quicker integration, but connectors can create untracked copies and permissions |
For either option, make the same approval decision: is the use case necessary, the data minimized, the environment controlled, the output explainable where required, and the evidence sufficient for the lender’s regulator and risk profile?
Quick Recap
A practical implementation sequence
- Appoint accountable owners. Include privacy, information security, compliance, model risk, technology, lending operations, records management, and procurement. Give one person authority to stop an unsafe deployment.
- Inventory use cases and data flows. Rank them by sensitivity and effect on borrowers. Identify shadow use of consumer accounts, browser tools, spreadsheets, and plug-ins.
- Set a data-classification and approved-tool policy. Define prohibited fields, permitted environments, approved purposes, testing rules, and escalation paths.
- Implement technical guardrails. Enforce identity, multifactor authentication, least privilege, encryption, network controls, logging, output filtering, and separation of production from experiments.
- Complete provider and model review. Obtain security, retention, subprocessor, validation, change-management, incident, deletion, and audit evidence. Document unresolved risks and compensating controls.
- Run a controlled pilot. Use synthetic or minimized data, predefined success and failure criteria, human review, and a rollback plan. Test prompt injection, leakage, hallucination, unfair outcomes, and explanation accuracy.
- Approve production use with conditions. Record the purpose, data fields, model and provider versions, owners, retention, monitoring thresholds, prohibited uses, and review date.
- Operate and reassess. Monitor access, outcomes, drift, complaints, incidents, provider changes, and deletion. Reapprove after a material change and retire the use case when its purpose ends.
Common failure modes and fixes
- “It is only a summary.” Fix: classify the source and output, restrict fields, and test whether staff use the summary in a credit decision.
- “The vendor is compliant.” Fix: evaluate the exact service, contract for permitted use and evidence, and monitor it. Responsibility does not transfer simply because processing is outsourced.
- “We removed the borrower’s name.” Fix: assess combinations of address, dates, employer, property, loan amount, and other quasi-identifiers.
- “The model is too complex to explain.” Fix: require decision records and accurate principal reasons; replace or constrain the model if those reasons cannot be produced.
- “The AVM vendor tested it.” Fix: evaluate whether the testing covers confidence, manipulation, conflicts, random review, nondiscrimination, and the lender’s own risk profile.
- “The default deletion setting is fine.” Fix: map every copy and backup, set a lender-defined schedule, and obtain deletion evidence.
- “One framework solves compliance.” Fix: use NIST AI RMF as a voluntary organizing aid while separately meeting binding privacy, security, credit, valuation, records, and incident obligations.
