A founder’s detention does not automatically move, freeze, or unlock cryptocurrency. Control follows the signing keys and the custody design: you may still be able to transact from a self-custody wallet, while an exchange account, project server, multisig treasury, or founder-held administrator key can create very different limits. First identify who or what can authorize a transaction, then preserve records and act only within applicable orders, freezes, sanctions, and ownership rules.
Start by identifying the real control point
Do not begin by trying random wallet apps or contacting anonymous “recovery” agents. Map every asset to the mechanism that can actually authorize a transfer. A project website, mobile interface, RPC endpoint, validator, exchange login, signing bot, or founder’s laptop may be only an access layer; the blockchain responds to valid signatures and protocol rules.
| Arrangement | Who controls the signing authority | What detention can change | Typical lawful next step |
|---|---|---|---|
| Self-custody wallet | The person or people holding the private key or recovery material | An interface, domain, device, or service may disappear while the key remains usable | Use a known-good wallet, verify the address on the signing device, and transact only if no legal restriction applies |
| Exchange or hosted wallet | The provider’s internal custody system; your login is not the blockchain key | Withdrawals may be paused, records may be subpoenaed, or assets may be frozen, seized, transferred, or distributed in insolvency | Use the provider’s published support and legal channels, preserve records, and obtain jurisdiction-specific advice |
| DAO or company multisig | The signers, subject to the configured M-of-N threshold | One missing signer may be tolerable; losing enough signers to fall below quorum can block spending | Verify the policy and signer identities out of band, use the remaining quorum, and follow the documented replacement process |
| Founder-held admin or upgrade key | The key designated by the protocol or project contract | Pause, upgrade, blacklist, or bridge operations may remain possible, stop, or become legally contested | Read the contract’s authority model and use the project’s governance and emergency procedures |
| Founder-operated interface or server | Usually the underlying user keys or contract permissions, not the web server itself | A seizure or outage can make the normal interface unavailable without changing on-chain ownership | Preserve the original state and use an independent, reputable interface or direct contract interaction only when you can verify what you are signing |
The U.S. Securities and Exchange Commission’s 2025 Crypto Task Force submission describes the regulatory distinction this way: “Self-custody wallets are not considered custodians under U.S. securities law as users retain exclusive control over their private keys and assets.” That is a legal characterization, not a guarantee that every product marketed as non-custodial is safe or that a particular token is outside securities, tax, sanctions, or other rules.

- Genuine Check: confirm your signer is authentic during setup with the Ledger Wallet app.
- Protect your signer: keep it in mint condition at all times with a bespoke Pod or Case to avoid scratches and everyday wear and tear.
- Freeze your own changes while you inventory. List every chain, address, token contract, bridge, exchange, withdrawal whitelist, signer, administrator, bot, backup, and recovery method. Record balances and permissions at a specific time, and export account, governance, and transaction histories.
- Confirm that you possess the signing keys. Open a known-good wallet application and compare the receiving address shown there with the address displayed on your hardware device. Never type a seed phrase into a website, browser pop-up, form, or support chat. A support representative should never need your seed words or private key.
- Move funds only when you are authorized. If you control the keys and no court order, freeze, sanctions restriction, ownership dispute, or other lawful barrier applies, send to a preplanned address or multisig under your control. Verify the complete destination on the signing device, start with a small test when practical, save transaction IDs, and retain the prior state for accounting and legal review.
- Treat custodial balances as a provider and legal issue. If assets are on an exchange, hosted wallet, or project-controlled bridge, use the provider’s published channel. Preserve statements, deposits, withdrawals, identity records, and notices. Ask qualified counsel how a freeze, subpoena, seizure, receiver, insolvency, or bankruptcy process affects withdrawals; do not try to bypass it.
- Stabilize a shared treasury. Convene remaining authorized signers through a pre-established channel. Confirm the multisig threshold, signer list, device fingerprints, and proposed destination independently of the potentially compromised channel. Rotate keys that may be exposed, record quorum or policy changes through the project’s governance process, and test with a small transaction before a large transfer.
- Assume targeted impersonation. Detention news attracts fake investigators, replacement-signature requests, “court-approved” recovery services, and urgent airdrops. Ignore unsolicited offers, verify every person and address through a second channel, and never disclose seed words, private keys, passphrases, or one-time codes.
When you have a self-custody wallet
Separate the wallet from its interface
Self-custody means the signing secret is under your control; it does not mean the website or app will always work. A founder’s domain can be seized, an RPC endpoint can fail, a validator can go offline, or a mobile app can be removed while the same keys remain capable of signing. The 2024 U.S. Department of Justice Samourai case illustrates the distinction: agents arrested the founders and seized the domain, while the announcement described users’ private keys as held in the application rather than shared with employees. The allegations involved more than $2 billion in alleged unlawful transactions and more than $100 million in alleged criminal proceeds; those figures are allegations, not a finding that every user’s funds were illicit.
Use software obtained from a source you can independently verify, restore or pair the wallet without exposing the seed, and check that the derivation path, network, and address match your records. If the original front end is unavailable, do not approve a transaction merely because a replacement site displays a familiar balance. Read the exact contract call, recipient, amount, and fee on the signing device where the device supports that information.
Move assets safely after verification
Prepare a destination before you need it. For a single-owner wallet, that may be a newly generated address whose backup you control. For organizational funds, it may be a multisig with independent signers. Confirm the destination on a trusted screen, send a small amount when the network and asset permit it, wait for the expected confirmation, and then send the remainder. Keep transaction IDs, screenshots of the signed details, and an export of the pre-transfer balances. Those records help with taxes, audits, ownership disputes, and a later legal request.
Hardware wallets and recovery backups
A hardware wallet is a signing device, not a magic vault. Ledger’s documentation says private keys remain in the device’s Secure Element and that transactions are approved on the device screen. That protects the key from many computer compromises, but it cannot protect you from approving a malicious destination or revealing the recovery words.
Trezor’s terms warn that losing both the device and the wallet backup may make funds inaccessible. Keep the seed or wallet backup offline, private, and separated from the device. A durable metal backup can reduce damage from fire or water, but it does not make the seed safe to photograph, email, upload, or store in a password manager that another person can access. Do not make extra copies casually; every copy is another point at which the key can be stolen.

- Write down which wallet standard, account number, network, and derivation path produced each address.
- Store backups in separate secure locations with a documented access plan.
- Test restoration with a spare device or an offline procedure before an emergency, without broadcasting a transaction.
- Record passphrases separately from the seed and make clear which accounts depend on them; a missing passphrase can look like an empty wallet.
- Have a trusted person verify the process without ever seeing the complete seed.
DAO and company treasuries when one signer disappears
Understand the quorum before taking action
An M-of-N multisig requires M valid signatures from N authorized keys. In a 2-of-3 arrangement, one unavailable signer need not stop spending. In a 3-of-5 arrangement, two unavailable signers may still leave a working quorum, while three unavailable signers block ordinary transfers. The exact policy, chain implementation, daily limits, timelocks, and module permissions matter more than the label “multisig.”
Check the signer addresses and threshold from the wallet’s on-chain configuration or a trusted governance record. Verify each proposed signer through an independent channel; an attacker who controls a project chat can post a replacement address that looks official. Compare device-generated addresses, not pasted text, and record the block height or transaction at which the policy was checked.

Use an emergency change process
- Determine whether the detained person’s key is merely unavailable, potentially compromised, or legally prohibited from acting. Do not treat detention alone as proof that the key is compromised.
- Confirm that the remaining signers meet quorum and that no spending limit, timelock, or contract pause prevents the proposed transaction.
- Transfer a small amount to a controlled destination and observe the complete signing and confirmation path.
- Rotate a key only through the multisig’s documented owner-management transaction and the project’s governance process. A hurried signer replacement can permanently lock funds or create an unauthorized control change.
- Publish an auditable record of the policy change, signers, rationale, transaction IDs, and effective time, while withholding private recovery information.
Independent signers should use separate devices, locations, and communication paths. If the remaining group falls below quorum, do not “work around” the contract with an improvised transfer. Follow the entity’s operating agreement, DAO rules, court process, or other lawful mechanism for appointing a replacement.
Exchange, hosted-wallet, and bridge accounts
An exchange balance is a contractual claim against the provider, not proof that you hold the private key. The provider may be able to freeze, seize, transfer, or liquidate assets under its terms or a legal order. SEC custody guidance discusses procedures for lawful seizure or freezing, transfer to a receiver or liquidator, and bankruptcy administration. Those processes can continue even if the founder of a related project is detained.
The CFTC’s 2023 discussion of Celsius reported more than $4.7 billion in customer liabilities against $1.75 billion in digital assets at bankruptcy. The figures show why an account balance is not equivalent to direct, immediately recoverable key control. They do not predict the outcome of another provider’s case.

What to preserve and ask
- Download statements, deposit and withdrawal histories, wallet addresses, identity-verification records, tax forms, and all provider notices.
- Save the provider’s terms in force when you deposited, and note any change that followed the detention.
- Use only the provider’s published website, app, or legal-service address; do not follow links in social-media replies.
- Ask whether withdrawals are open, what verification is required, whether a freeze or subpoena exists, and where claims must be filed if insolvency proceedings begin.
- Give counsel the complete timeline rather than deleting messages or moving disputed assets.
If a withdrawal is available and lawful, verify the destination and document the transaction. If the account is frozen, attempting to evade controls through nominees, mixers, false identity information, or unauthorized access can create additional criminal and civil exposure.

Many tokens and bridges include privileged roles that can pause transfers, mint or burn supply, upgrade code, blacklist addresses, change fee receivers, or replace an oracle. A founder’s detention does not automatically revoke those roles. Conversely, if the only administrator key is inaccessible, an otherwise functioning protocol may be unable to perform an upgrade or unpause operation.
Read the deployed contract’s role assignments, timelocks, pause authority, upgrade proxy, and governance modules from a trusted block explorer or independently verified source. Distinguish an on-chain role from a server credential: seizing a deployment server does not necessarily seize an already deployed key, while seizing a hardware device may. Record the current role holders before any change, and have counsel assess whether an emergency action would violate fiduciary duties, token-holder rights, sanctions, or a court order.

Recovery is easiest when the project’s documents answer the questions that a crisis creates. A succession plan should not put a complete seed in one new person’s hands; it should preserve quorum and create an accountable, tested path.
Minimum continuity record
- Every treasury and operational address, chain, contract, and purpose.
- The multisig threshold, signer legal names or entity roles, public addresses, device assignments, and replacement authority.
- Where offline backups are held, who can access each location, and how access is logged.
- Emergency contacts, a second communication channel, and a rule that address changes require out-of-band confirmation.
- Withdrawal limits, timelocks, whitelists, governance requirements, and the procedure for rotating a suspected key.
- Tax, accounting, insurance, entity, and estate documents that establish ownership and authority.
Inheritance and incapacity
Specialized inheritance software can coordinate a controlled release, but configuration must be completed while the owner is available and competent. Casa’s published examples include 2-of-3 and 3-of-5 setups and a process in which a recipient may receive a hardware wallet and seed phrase under controlled conditions. Treat that as an example of an operational pattern, not a substitute for local legal advice. Your jurisdiction may require a will, trust, corporate resolution, power of attorney, or court appointment, and those documents must match the on-chain permissions.

Run a recovery drill using test funds. Have the intended recipient demonstrate that they can identify the correct wallet, restore it, verify an address, and complete a small transaction without learning more secret material than necessary. Revisit the plan after marriage, divorce, relocation, a signer’s death, a device replacement, or a change in the project entity.
Security threats increase after a high-profile detention
Attackers exploit urgency and uncertainty. Common messages claim to be from law enforcement, a court-appointed receiver, the project’s “new team,” a wallet manufacturer, or a lawyer offering to unlock frozen funds. They may request a seed phrase, remote desktop access, a test transfer, a new browser extension, or a signature that grants token approval.
- Never share seed words, private keys, hardware-wallet PINs, passphrases, or one-time codes.
- Do not install software from a direct message or connect a wallet to a site reached through an unsolicited link.
- Read token approvals and contract permissions, not just the displayed dollar value.
- Confirm a legal representative through a known court filing, the entity’s established counsel, or another independently obtained contact.
- Revoke unnecessary allowances and rotate exposed keys only through a verified process; revocation itself is an on-chain transaction and may require gas.
Legal boundaries and evidence preservation
Detention facts, asset ownership, token classification, entity documents, court orders, and jurisdiction determine what may lawfully be moved. A self-custody key does not authorize you to transfer another person’s property, evade a seizure, violate sanctions, destroy evidence, or obstruct an investigation.
Preserve wallet addresses, transaction IDs, device images where lawful, account statements, contracts, governance votes, emails, and the exact time of each action. Keep an immutable copy for counsel and a working copy for operations. Do not edit screenshots to remove inconvenient transfers. Qualified counsel can coordinate with a receiver, liquidator, trustee, or law-enforcement contact and advise on tax reporting, disclosure, and permissible protective steps.

| What you observe | Most likely control issue | Prudent response |
|---|---|---|
| The project site is offline, but your hardware wallet still derives the expected address | Interface or hosting failure | Use a verified wallet interface, confirm network and contract details on the device, and preserve the original state |
| Your exchange login works, but withdrawals are disabled | Provider or legal restriction | Download records, contact the provider through its published channel, and ask counsel about the applicable process |
| A treasury has four signers in a 3-of-5 policy and one is detained | Quorum may still exist, but signer status and legal authority need verification | Confirm the policy and identities out of band, execute only documented transactions, and record any rotation |
| A 2-of-3 treasury has only one reachable signer | Below quorum | Do not improvise a bypass; follow the governance, entity, or court process for replacement |
| A message promises recovery if you send a seed phrase or “verification” payment | Likely phishing or theft | Stop contact, preserve the message, verify through an independent channel, and report it where appropriate |
| You hold a seed but cannot identify the correct wallet account | Missing derivation, passphrase, or network information | Reconstruct the documented wallet configuration offline; do not upload the seed or guess by signing unknown transactions |
Bottom line
Find the signing authority first. If you hold the keys, a founder’s detention usually affects the interface or legal context rather than the cryptographic ability to sign; if a custodian, multisig quorum, admin role, or court order controls the asset, the remedy is different. Verify every address on a trusted device, keep recovery material offline, preserve an auditable record, and obtain qualified local advice before touching disputed, frozen, seized, or potentially illicit funds.
