The reliable way to stop confidential data from reaching public AI tools is a layered program: classify information, prohibit sensitive data in public services, provide an approved enterprise AI route, enforce identity and data-loss controls at the point of use, train employees with realistic examples, and make accidental disclosure easy to report. Keep low-risk experimentation available so employees do not bypass controls, but block or require approval for regulated, proprietary, or otherwise restricted information.

Why a public AI prompt is an external disclosure

When an employee pastes an internal email, customer record, source-code fragment, contract, or security finding into a public chatbot, the organization has sent that information to an external service. The fact that the employee is using a familiar browser does not make the destination internal. NIST’s SP 1800-28 (2024) treats confidentiality breaches as “unauthorized exfiltration, leaking, or spills of data to unauthorized parties, including the general public.” A prompt, uploaded file, conversation history, feedback submission, or plug-in request can all be disclosure paths.

The risk is not limited to whether a provider trains a model on the content. Data may be retained in conversation logs, support systems, abuse-monitoring systems, backups, analytics tools, or connected applications. It may also be processed in another country or exposed to provider personnel under circumstances the employee cannot see from the chat window. A tool’s consumer-facing privacy setting is not a substitute for an organization-approved contract and technical configuration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

CMS’s Information Security and Privacy Program states the rule plainly: “Never disclose or input PII, PHI, or any sensitive CMS data (including financial, health, vendor, procurement, evaluations, draft policies, or proprietary/business information) into publicly accessible AI platforms, chatbots, or prompts.” That prohibition is a useful baseline even for organizations outside government; adapt the categories to your own legal, contractual, and operational obligations.

Start with a data classification employees can apply

Employees need a short decision rule and examples, not a policy that depends on interpreting legal definitions while they are trying to finish a task. Define classes in your information-governance standard, then put the same labels in document-management systems, DLP rules, and training exercises.

Class Typical examples Use with public AI Required handling
Public Published webpages, public product documentation, released press statements, and information already approved for public distribution Permitted when no other restriction applies Check that the material is genuinely public and has not been combined with restricted context
Internal Routine working notes, internal process descriptions, non-sensitive meeting agendas, and general operational information Only where the policy explicitly permits the use and the text contains no confidential details Prefer the approved enterprise workspace; remove names, identifiers, links, and hidden metadata
Confidential Customer communications, vendor data, contracts, unreleased financial information, source code, legal advice, security findings, and pre-decisional plans Prohibited in public tools Use an approved service with contractual and technical safeguards, or keep the work in internal systems
Regulated Personally identifiable information (PII), protected health information (PHI), payment information, government identifiers, and data covered by sector or privacy law Prohibited in public tools; approved processing requires a documented legal and security basis Limit access to authorized personnel with a legitimate need to know and use approved secure channels
Restricted Credentials, private keys, secrets, incident-response details, high-impact security research, merger information, and information subject to legal hold Never enter into a public AI service Use the organization’s highest-control environment and follow security, legal, and incident procedures

Give employees an operational test: if they would hesitate to send the material to an external expert by ordinary email, they should not submit it to a public generative-AI platform. CMS recommends the same kind of hesitation test and says sensitive data should be shared only for official purposes, through secure channels, with authorized personnel who have a legitimate need to know.

Allow public information and approved synthetic or fully de-identified examples when the workflow owner confirms that re-identification risk is controlled. “De-identified” is not automatically safe: a rare combination of dates, locations, job titles, quotations, or transaction values can identify a person when joined with other information. Define who can approve a de-identification method and what evidence must be recorded.

Write an acceptable-use rule that answers the prompt-time questions

A policy works only when an employee can apply it in seconds. Keep the employee-facing rule short, then link to the detailed standard and exception process. It should answer these questions:

  • Which AI tools are approved, and where is the authoritative list?
  • Which data classes may be entered, uploaded, or pasted into each tool?
  • Are prompts, files, outputs, feedback, or telemetry retained, and for how long?
  • May the provider use content to train or improve a model?
  • What human review is required before an AI output is sent to a customer, regulator, employee, or production system?
  • Who approves an exception, what evidence is required, and when does the exception expire?
  • How does an employee report an accidental submission or a suspicious response?

State the prohibition in concrete terms. For example: employees may not enter PII, PHI, credentials, confidential customer or vendor information, unreleased financial results, source code, legal advice, contracts, security findings, or pre-decisional plans into publicly accessible AI tools. The rule must cover text, images, audio, files, browser extensions, plug-ins, and API calls, not just a chat box.

Do not make a blanket ban your only control. Federal guidance favors risk-based access when safeguards can support low-risk work. Permit clearly defined uses such as brainstorming with public facts, rewriting an already public announcement, or generating code examples that contain no company logic or secrets. Block high-risk categories, route borderline cases to an approval workflow, and review exceptions through both security and privacy owners.

Explain output obligations as well. An approved tool can produce an inaccurate, biased, copyrighted, or confidential-looking answer. Provide a sanctioned alternative employees will actually use

A prohibition without a practical substitute encourages shadow use. Offer a managed enterprise AI workspace or private deployment for approved workflows. Treat the word “enterprise” as a claim to verify, not as evidence that a product is safe. Review the contract, service configuration, subprocessors, and actual data flows.

Control to verify Questions for procurement, security, and privacy teams
Provider training and retention Is customer content excluded from model training by default? What are the retention periods for prompts, uploads, outputs, abuse logs, backups, and support tickets? Can administrators set shorter limits?
Contractual confidentiality Does the agreement restrict use, onward disclosure, and access by provider personnel? Are subprocessors identified and covered by equivalent obligations?
Deletion and legal holds Can the organization delete content and accounts, verify deletion, and preserve records when a legal hold or investigation requires it?
Identity and roles Does the service support single sign-on, multifactor authentication, automated provisioning and deprovisioning, role-based permissions, and separate administrator duties?
Tenant isolation How is one customer’s data separated from another’s? Which integrations, shared workspaces, or public links could bypass that separation?
Auditability Are prompt, file, policy, administrator, and export events logged? Can authorized investigators export records in a usable format without collecting more content than necessary?
Geographic processing Where are data and backups processed? Can the organization select a region, and do contractual terms match the organization’s privacy obligations?
DLP and API integration Can the service receive classification labels, enforce DLP decisions, integrate with identity providers, and send security events to the organization’s logging platform?
Change and incident notices How are model, feature, subprocessor, and data-use changes announced? What is the notification and cooperation process for a security or privacy incident?
Access-request support Can the organization locate, export, correct, or delete information when privacy law, contract, or an internal records process requires it?

Document the approved configuration, not merely the product name. A safe contract can be undermined by enabling public sharing, optional training, broad plug-ins, long retention, or an administrator role that bypasses DLP. Reassess the service when its model, features, subprocessors, or processing locations change.

Enforce the rule at the point of use

Policy and training establish expectations; technical controls make the safe action the easy action. NIST’s Identify-and-Protect approach calls for discovering affected assets, assessing risk, and implementing protective technologies. Joint CISA guidance frames AI security as protecting, detecting, and responding across AI systems and the data connected to them.

Discover unsanctioned services

Build an inventory from browser and endpoint telemetry, DNS and secure-web-gateway logs, identity-provider records, expense and procurement data, API-key scans, and cloud-access logs. Include consumer chat sites, AI writing and coding services, browser extensions, mobile apps, and direct API endpoints. Domains change, so combine domain lists with application fingerprints and behavior such as large text uploads or repeated calls to model APIs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Apply identity and access controls

Require single sign-on and multifactor authentication for sanctioned workspaces. Use role-based access to separate ordinary users, reviewers, administrators, developers, and investigators. Remove access promptly when a person changes role or leaves. Disable anonymous sharing, public links, unmanaged personal accounts, and personal API keys where the service allows it.

Inspect prompts and files with DLP or an AI gateway

Place inspection where submissions can be evaluated before they leave the organization. Rules can detect structured identifiers, regulated-data patterns, secrets, classification labels, source-code markers, contract terms, and combinations of fields that create a high re-identification risk. The gateway should be able to:

  • warn the user and require an explicit business justification for a permitted exception;
  • block a submission containing prohibited data;
  • redact or tokenize identifiers when the workflow has been approved for that treatment;
  • send a policy event to the security log without retaining the entire prompt unnecessarily; and
  • apply different actions according to the destination, user role, data class, and approved use case.

Test controls against images, spreadsheets, PDFs, screenshots, copied source code, compressed archives, and encoded text. A text-only rule will miss a customer list pasted as an image or a secret embedded in a configuration file.

Control browsers, endpoints, networks, and APIs together

Browser controls can prevent uploads to unapproved destinations and disable risky extensions. Endpoint controls can identify local files, clipboard transfers, and screen captures. Network controls can block known unsanctioned domains and inspect encrypted traffic where lawful and technically appropriate. API controls should require organization-issued credentials, rate-limit access, record the calling application, and prevent developers from embedding secrets in code or sending restricted data directly to a model endpoint.

No single layer is complete. A user may work from a personal device, a mobile application, an alternate domain, or an approved service’s plug-in. Combine controls, document what each layer can and cannot see, and provide a safe fallback when a control blocks a legitimate low-risk task.

Log proportionately and lawfully

Record enough context to investigate: user or service identity, destination, policy rule, action taken, timestamp, data classification signal, and the approved use case or exception. Minimize raw prompt content, restrict investigator access, set retention limits, and explain monitoring in notices and policy. Check privacy law, employment agreements, works-council requirements, and local consultation obligations before inspecting employee content or behavior.

Give employees a safe prompt workflow

Teach a repeatable sequence rather than asking people to memorize every prohibited example.

  1. Identify the destination. Confirm whether the service is on the organization’s approved list and whether the account is managed. If it is a public or personal account, stop before entering any internal information.
  2. Classify the material. Check the document label and consider pasted text, attachments, screenshots, metadata, names, dates, and linked records. Use the highest applicable classification when several types are mixed.
  3. Remove or replace sensitive content. Use synthetic examples or carefully de-identified text approved for the workflow. Replace names, account numbers, exact dates, unique quotations, credentials, tokens, and proprietary logic. Do not assume that changing a name alone prevents re-identification.
  4. Choose the approved control path. Use the managed enterprise workspace, internal retrieval system, or an approved API. Follow the tool’s retention, sharing, and integration settings; do not enable a plug-in merely because it is convenient.
  5. Review the result before use. Verify facts, citations, calculations, code, privacy implications, and unintended disclosure. Treat the output as untrusted until a qualified person checks it.
  6. Report mistakes immediately. Use the organization’s incident channel if restricted material was submitted, a prohibited destination was used, or an output appears to reveal someone else’s data. Immediate reporting gives responders a chance to revoke access, rotate secrets, and preserve evidence.

Use realistic practice questions in training: “Can I paste this customer email?”, “Can I upload this contract?”, and “Can I ask a public chatbot to debug this code?” The correct answer depends on the classification and approved path, not on whether the task feels routine.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Train continuously on decisions, not slogans

Include the policy in onboarding and repeat it through short, practical reminders. CMS calls for continual education and reminders about the risks and consequences of sharing business data with public AI tools. Training should cover:

  • the organization’s data classes and the examples employees encounter in their jobs;
  • how public services differ from the sanctioned workspace;
  • how to redact, tokenize, or create synthetic examples without weakening the task;
  • how to recognize a browser extension, plug-in, API, or mobile app that sends data to an external model;
  • why outputs require human verification and may contain confidential material or errors; and
  • the exact reporting route, including what to do outside normal business hours.

Make managers and high-volume users part of the program. Developers, analysts, recruiters, customer-support staff, legal teams, and researchers encounter different leakage patterns and need examples from their own workflows. Measure completion and investigate repeated blocked attempts as signals that a process, tool, or training example needs improvement—not simply as reasons for punishment.

Detect, respond to, and learn from accidental disclosures

Assume that a mistake will eventually occur. A no-blame reporting path increases the chance that the organization learns about it while containment is still possible. CMS requires reporting of suspected or verified privacy breaches or unintended disclosures; your procedure should make that obligation actionable.

Initial triage

  1. Capture the time, user, destination, account, type of data, approximate volume, and whether the submission included files, images, credentials, or regulated information.
  2. Ask the reporter not to continue the conversation, download additional output, or delete relevant evidence unless instructed by the response team.
  3. Classify the event as a potential security and privacy incident while facts are confirmed. Notify the security, privacy, legal, and business owners required by your incident plan.

Containment

  • Revoke sessions, API keys, shared links, plug-ins, or integrations connected to the exposed account.
  • Rotate passwords, tokens, private keys, and other credentials that appeared in the submission.
  • Use provider deletion or account-administration procedures where available, while recognizing that deletion requests may not remove backups, legal holds, or independent logs.
  • Block the destination or rule pattern if the event reveals a gap in technical enforcement.

Assessment and notification

Determine exactly what was disclosed, to whom, under which contract or law, and whether the provider or another party may have retained or accessed it. Legal and privacy teams should decide notification obligations, affected-person communications, regulator contact, and contractual notices. Do not promise that a provider deleted data or did not use it unless you have evidence from the applicable service terms and records.

Improvement

Record the control that failed: an unclear classification, an unapproved account, a missing DLP detector, a permissive plug-in, inadequate training, or a workflow with no sanctioned alternative. Update the rule, detection logic, tool configuration, and training example. Review repeated warnings and blocked events for patterns, but retain only the prompt content necessary for the stated security purpose.

Compare approved AI options on the controls that reduce leakage

When selecting between two or more services, use the same questions for each option and record the answer for the exact plan, region, and contract under consideration. Vendor terms, retention defaults, model-training policies, and feature availability change; date your assessment and revisit it after material changes.

Comparison area What a strong answer looks like Warning sign
Training use and retention Customer content is excluded by enforceable terms; administrators can configure short retention and obtain deletion evidence A marketing statement without plan-specific settings, or retention that varies by feature without administrative control
Confidentiality and onward disclosure Contract limits provider use, personnel access, and subprocessors, with incident cooperation Broad rights to use content or unclear responsibility for connected services
Identity and role control Single sign-on, multifactor authentication, lifecycle provisioning, least-privilege roles, and administrator separation Shared accounts, personal API keys, anonymous links, or no reliable deprovisioning
Tenant isolation Documented separation of customer data and controls for integrations and shared workspaces Public galleries, default sharing, or unclear cross-tenant processing
Audit logs Exportable records for access, prompts or files where appropriate, policy decisions, administration, and deletion Only usage totals are logged, or logs cannot be retained for investigations
Data residency Processing and backup locations are documented and selectable where needed Undisclosed locations or changes without meaningful notice
DLP and API integration Classification-aware controls, gateway support, organization-managed credentials, and security-event export No inspection point, no policy API, or direct use of personal credentials
Change management Advance notice of model, feature, subprocessor, and data-use changes Material behavior can change without notice or reassessment time
Legal and privacy operations Support for deletion, access requests, legal holds, investigations, and incident notification No documented process or responsibility split among provider, reseller, and integrators

The ICO emphasizes that security measures should match the specific processing risk rather than follow a one-size-fits-all rule. Its guidance page is under review following UK legislative changes, so obtain current jurisdiction-specific legal advice before relying on it for a compliance conclusion.

Common approaches that fail

A policy PDF with no enforcement

Employees cannot follow a rule they never see at the moment of upload, and investigators cannot prove whether a prohibited transfer occurred without logs. Put the rule in onboarding, the AI workspace, browser controls, DLP prompts, and incident procedures.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A total ban with no approved route

People still have legitimate needs for summarization, drafting, coding assistance, and analysis. If the organization blocks every service without providing a managed alternative, users may create personal accounts or move work to unmanaged devices. Permit low-risk uses and make the approved path faster than the workaround.

Trusting a vendor’s “no training” promise

Training use is only one part of confidentiality. Retention, support access, subprocessors, geography, plug-ins, backups, public sharing, and administrator settings can still create exposure. Verify the contract and the deployed configuration.

Relying on a domain block alone

New domains, mobile apps, direct APIs, image uploads, and approved services with unsafe settings can bypass a simple blocklist. Combine discovery, identity, DLP, endpoint, browser, network, and API controls.

Collecting every prompt forever

Over-collection creates a second sensitive repository and may conflict with privacy or employment requirements. Log policy decisions and investigation context, minimize raw content, limit access, and set retention that matches the stated purpose.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Punishing the first reporter

Fear delays notification and makes containment harder. Keep accountability for deliberate misuse, but provide a clear no-blame route for mistakes and reward prompt reporting with fast help.

A practical rollout sequence

  1. Map exposure. Inventory public and sanctioned AI destinations, data flows, browser extensions, API use, identity paths, and existing DLP coverage.
  2. Set the classification boundary. Approve examples for public, internal, confidential, regulated, and restricted data, including rules for synthetic and de-identified content.
  3. Publish the short rule. Name approved tools, prohibited categories, permitted low-risk uses, output review duties, exceptions, monitoring notice, and reporting contacts.
  4. Configure the sanctioned workspace. Enforce SSO, multifactor authentication, roles, tenant isolation, retention, sharing, logging, deletion, and provider-use settings.
  5. Deploy point-of-use controls. Start with high-risk patterns and destinations, then tune warnings, redaction, blocking, and exception workflows using legitimate test cases.
  6. Train and rehearse. Use role-specific examples and practice the six-step prompt workflow, including immediate incident reporting.
  7. Operate and improve. Review alerts, blocked events, exceptions, incidents, provider changes, and user feedback. Adjust policy and controls when the workflow or threat changes.

The objective is not to eliminate useful AI assistance. It is to ensure that an employee can tell what may be shared, has a safe tool for legitimate work, receives a technical warning before a mistake leaves the organization, and knows exactly what to do when an error occurs.
