Preserve Slack evidence as soon as a dispute is reasonably anticipated: involve counsel and the workspace owner or administrator, identify custodians, conversations, dates and files, check retention and export permissions, and use an Enterprise legal hold or an authorized export route. A hold protects qualifying data inside Slack; it does not automatically give you a downloadable case file, and plan limits and exclusions can leave gaps.
What “preserving Slack” actually involves
Preservation and collection are separate jobs. Preservation keeps potentially relevant electronically stored information (ESI) from being lost through retention rules, edits, deletions or account changes. Collection creates a copy that counsel or an eDiscovery team can review, analyze and, if required, produce. Exporting a public-channel archive is collection; it is not proof that every private conversation, direct message or file was preserved.
Slack’s native Legal Holds feature is an Enterprise capability. A user with the Legal Holds Admin role can place a hold on selected custodians and conversations. Covered messages and files remain saved despite applicable retention settings or later edits and deletions. The hold itself is not a viewing portal: Slack identifies JSON export and the Discovery API as routes for accessing held material. See Slack’s legal-holds documentation.

This is operational guidance, not a determination of what any person or organization must preserve. The legal duty, scope, timing, privacy obligations and employment-law constraints depend on the facts and the governing jurisdiction. Have counsel define the hold and collection scope.

Take these actions first
- Contact counsel and the workspace owner or administrator. The owner or administrator controls retention settings, exports and administrative roles. Tell counsel when the dispute became reasonably foreseeable and provide the relevant workspace and account details.
- Stop relying on ordinary retention. Ask the administrator to identify policies that remove messages, files, edits or deletions. Do not casually change settings, delete channels or move conversations; an uncoordinated change can affect evidence and unrelated employee or personal data.
- Define the initial scope. List likely custodians, channels, direct messages, group messages, date ranges, file types, connected workspaces and relevant projects or incidents. Counsel can narrow or expand that list after interviews and proportionality review.
- Secure access without altering content. Preserve administrator audit information and account permissions as your organization’s security policy allows. Do not ask employees to forward or “clean up” conversations as a substitute for an authorized collection.
- Open a preservation record. Note who authorized the action, when it began, which settings were reviewed, what was included or excluded, and where resulting exports or collection artifacts are stored.
Map custodians, conversations and dates
A useful scope description is specific enough for an administrator to implement and for counsel to defend later. For each person or account, record the name, role, relevant dates, channels and direct-message participants. Include service accounts or project channels that may contain automated notices or file links.

Ask counsel whether a connected workspace is controlled by another organization. Do not assume your administrator can preserve or export another organization’s content.
Check retention settings and plan eligibility
Retention is a prerequisite question, not a detail to investigate after an export fails. Slack documents different defaults for free and paid plans and allows workspace owners to configure retention, including how edits and deletions are treated. Data that a customer’s settings no longer retain may be removed immediately. Review the current configuration with the owner and preserve a dated record of what you found. Slack’s Privacy FAQs and Data Management information describe these controls.

Confirm the plan actually assigned to the workspace or organization; a team may believe it has Enterprise features when a particular workspace or account does not. Keep the approval emails, role assignments and export authorization with the case record.

Place a Slack legal hold when the feature and scope fit
Prerequisites
Legal Holds is an Enterprise feature administered by users with the Legal Holds Admin role. Counsel should decide the custodians, conversations and optional date range. Slack’s documentation states a limit of 1,000 custodians per legal hold; larger matters need a coordinated design rather than an assumption that one hold can cover everyone.
Creation workflow
- Have an authorized administrator assign or verify the Legal Holds Admin role.
- Open the legal-holds administration area and create a new hold.
- Select the relevant custodians and conversations. Add the date range counsel approved; leaving it broad can preserve more unrelated information.
- Review the summary for omitted participants, channels, DMs and dates before saving.
- Record the hold identifier, authorization, selected scope and creation time in the case file.
- Coordinate an authorized JSON export or Discovery API collection when counsel needs to review the held data.
Slack describes the result this way: With a hold in place, messages and files sent by all members in a conversation will be saved regardless of retention settings or if members edit or delete any content.
That statement concerns covered conversations and custodians; it is not a promise that every Slack data type is included.
Know what a legal hold does not cover
Slack lists several boundaries that should be written into the preservation plan:

Coordinate with the other organization and counsel about an appropriate request or collection.
- Deleted channels: If a channel included in a hold is deleted, Slack says its message and file data will not be saved by the hold. Do not delete a covered channel while a dispute is active.
- Reactions: Emoji reactions are excluded.
- Snippet version history: Earlier versions of snippets are excluded.
- Slack Sales Home notifications: These notifications are not included in the hold scope described by Slack.
Because of these exclusions, a legal hold is not an all-purpose Slack backup. Ask counsel whether each excluded source is material and assign a separate owner and method for preserving it.

Separate preservation from export and eDiscovery collection
A hold protects data in Slack; an export or API collection moves a copy into a review or archive environment. The administrator should not promise that a standard export contains every file body, edit, reaction, thread or metadata field unless the current Slack documentation and the selected collection workflow say so.
Native exports
Public-channel export is available to owners and administrators on all plans. For Business+, workspace owners can apply for an export that includes public and private channels. Enterprise organization owners can apply for broader self-service exports. Plan eligibility, approval, jurisdiction and organizational permissions can change the result, so confirm access before setting a production deadline.
Legal-hold access
Slack identifies JSON export and the Discovery API as access routes for held data. A JSON result may require normalization before review, and the Discovery API may require an approved application or integration. Treat the output as an evidence artifact: preserve the original response, document the request parameters and make working copies for processing.
Discovery API and managed workflows
Eligible Enterprise customers can connect third-party applications to the Discovery API to export, retain or archive messages and files, as described in Slack’s Legal Holds API documentation. Evaluate any managed workflow against your actual custodians, conversation types, file handling, authentication, retention and audit requirements. Do not assume that a tool covers excluded content or is legally sufficient merely because it connects to the API.

Preserve files as well as message text
Slack messages often contain links rather than an attached copy. During scoping, identify whether the relevant file was uploaded to Slack, linked from another service, replaced, edited or removed. Ask the administrator or eDiscovery lead to verify that the collection method captures file content and the associated message context where available. If a link points outside Slack, the owner of that external system may need a separate preservation notice.
Keep the original export or API response unchanged. Store working conversions separately, restrict access to authorized reviewers, and record transfers between systems. Counsel or the organization’s eDiscovery lead should choose the review format, validation method, access controls and any production format; Slack’s documentation does not prescribe a universal chain-of-custody procedure.

This log is process guidance, not a Slack-mandated form. Have counsel decide what must be retained and how the organization will demonstrate completeness or explain a gap.

How Rule 37(e) frames lost Slack ESI in federal civil cases
For U.S. federal civil litigation, Federal Rule of Civil Procedure 37(e) addresses ESI that should have been preserved, was lost because reasonable steps were not taken, and cannot be restored or replaced through additional discovery. The official December 1, 2024 rule text begins:
“If electronically stored information that should have been preserved in the anticipation or conduct of litigation is lost because a party failed to take reasonable steps to preserve it, and it cannot be restored or replaced through additional discovery, the court:”
The rule distinguishes measures for prejudice from the more serious measures available when a party acted with intent to deprive another party of the information’s use in litigation. Loss of a message does not automatically produce sanctions; the court examines preservation duties, reasonable steps, prejudice, restorability and intent. Read the official Federal Rules of Civil Procedure text. The U.S. Courts current-rule page reports amendments in 2025, so verify the version and local requirements that apply when your matter is filed.
Why sending a subpoena to Slack may not solve the problem
Slack says third parties seeking workspace data should contact the workspace owner. It also explains that the Stored Communications Act restricts a provider such as Slack from disclosing communication contents to a third party based solely on a civil subpoena or civil court order. Therefore, do not plan on obtaining message contents simply by serving Slack. Follow counsel’s process, which may involve the workspace owner, party discovery, an authorized export or another legally available route. Slack’s Data Request Overview describes the provider’s position.
Practical playbooks for common situations
Enterprise workspace, dispute anticipated
- Ask counsel to define custodians, conversations and dates.
- Have a Legal Holds Admin create and review the hold before routine retention removes anything.
- Record exclusions such as Slack Connect and deleted-channel risk.
- Use JSON export or the Discovery API through an authorized workflow for review.
Free or paid non-Enterprise workspace
- Document the current retention and edit/deletion settings immediately.
- Use the permitted public-channel export while counsel seeks any additional plan approval.
- Ask each relevant owner or administrator about private channels and DMs; do not represent that a public export covers them.
- Preserve linked files and external systems under their own procedures.
A relevant channel was deleted
- Tell counsel and the administrator exactly when and how the deletion occurred.
- Preserve remaining exports, notifications, linked files and participant devices through authorized discovery.
- Record why the channel cannot be recovered and whether another source can restore or replace the information.
- Do not speculate that a legal hold recovered the deleted channel; Slack states that held data from a deleted covered channel will not be saved.
The evidence is in Slack Connect
- Identify the other organization and the participants who control the conversation.
- Ask counsel to coordinate preservation notices or discovery requests with that organization.
- Keep your own workspace’s copies, links and notifications, while labeling their limits.
Common failure modes and fixes

Final preservation checklist
- Counsel and the workspace owner or administrator are involved.
- Custodians, channels, DMs, dates, files and connected workspaces are listed.
- Plan, retention, edit and deletion settings are recorded.
- Enterprise eligibility and the Legal Holds Admin role are confirmed where relevant.
- The 1,000-custodian limit is addressed in the hold design.
- Slack Connect, deleted channels, reactions, snippet version history and Sales Home notifications are assessed.
- Preservation is distinguished from JSON, API or other collection.
- Exports, original responses, transfers and access controls are logged.
- Missing or unrecoverable data is reported to counsel with dates and possible replacement sources.
- Current federal and local rules are checked for the proceeding’s jurisdiction.
The safest approach is coordinated and documented: preserve the right custodians and conversations before retention removes them, then collect through the plan-authorized route that matches counsel’s scope and the evidence you must prove.
