Preserve the record as soon as a dispute is filed or reasonably anticipated. Save the complete notice and its surrounding portal context, linked documents, bids, evaluations and communications in their native formats; create a readable PDF or image for review; record the UTC capture time; hash the files; and keep an untouched, access-controlled master with a documented chain of custody. A screenshot by itself is only evidence of what someone saw on a screen, not proof that the page was complete, authentic or legally admissible.
Retention and disclosure duties depend on the governing jurisdiction, contract and tribunal. For example, UK Procurement Act guidance describes a three-year baseline for specified records, while a cited US federal statute requires five years for specified above-threshold procurement computer files. A litigation hold or another records law can require longer. Counsel should map your preservation package to the applicable statute, contract, records schedule and procedural rules.
When to start preserving a tender record
Do not wait for a portal administrator to investigate or for a challenge deadline to approach. Issue a written preservation or litigation hold when a challenge, appeal, claim or investigation is filed or reasonably anticipated. The hold should identify custodians, systems and date ranges, and instruct people to stop alteration, overwriting, deletion or destruction of potentially relevant information.

That instruction covers more than the public notice. It includes the procurement portal, shared drives, email, chat, document-management systems, personal working folders, supplier correspondence and records held by another organizational unit. GSA contracting guidance says that, when an appeal is filed, the contracting officer must ensure that evidence in their control related to the dispute is preserved. A federal contract clause similarly requires preservation of electronically stored information (ESI) in native form so creation and modification metadata remains available.

Define the record you need to prove
Write a short scope statement before collecting files. Identify the procurement, the disputed decision, the relevant dates and the questions the evidence must answer: what was published, when it changed, who communicated what, how bids were assessed and which approvals led to the award or termination.
Public notice and portal context
- Full URL, including query string, and the portal or digital-platform name.
- Procurement, notice, framework, contract and lot identifiers.
- Page title, visible publication and revision dates, closing date and status.
- UTC time of each capture, the operator and the account or public-access route used.
- Portal search results, navigation path and the contracting-authority or supplier pages that provide context.
- Login, paywall, certificate, geolocation or other access conditions, plus anything that could not be captured.
Documents and transaction data
- Invitation or tender notice, specifications, schedules, amendments, clarifications, questions and answers.
- Every linked attachment and download, including spreadsheets, forms, drawings and revised versions.
- Tender submissions and portal exports in the native format offered by the system.
- Assessment summaries, evaluator worksheets, scoring models, moderation notes and governance records.
- Award, unsuccessful-offeror and debriefing notices, termination notices, approvals and legal-review evidence.
- Bid, performance and payment bond documents where applicable.
- Supplier emails, portal messages, letters, challenge notices, meeting minutes and attachments.
UK transparency guidance lists notices and associated procurement documents, tender submissions, assessment summaries, evaluation notes, governance records and supplier correspondence. It warns that publication alone is not a complete record: an authority must keep its own records instead of relying on a notice on the central platform.
Capture the live page without changing it
- Open the notice in a clean session. Note the browser, operating system, account used and timezone. Do not edit fields, accept terms that change the page, or upload anything. If the portal shows a consent dialog, record that it was present and how it was handled.
- Record identifying details first. Copy the exact URL, page title, procurement and notice numbers, visible dates, and the UTC time from a synchronized clock. Save a text note or screen recording showing the address bar and status.
- Save a human-readable rendition. Use the browser’s print dialog to create a PDF with headers and footers disabled only if that is necessary to avoid adding misleading content; otherwise retain the default settings and note them. Also take a full-page PNG or JPEG when layout, charts or visual status indicators matter.
- Save native content. Use “Save page” or the portal export to retain HTML, JSON, XML, CSV or other native files. Where available, create a standards-based web-archive package. Keep the original response files, not only a re-rendered PDF.
- Follow every relevant link. Download attachments, amendments, clarification pages and award or termination notices. Record each source URL and capture time. If a link redirects, preserve both the original and final URLs.
- Capture surrounding context. Save portal search results, breadcrumb or navigation pages, supplier and authority pages, visible revision history and access conditions. Context can show how the notice was found and whether another version was available.
- Document omissions. List blocked scripts, inaccessible attachments, login failures, expired links, CAPTCHA pages, blank sections and content that loaded only after interaction. An explicit limitation is more credible than an unexplained gap.
Preserve bids, evaluations and communications
Public-page capture cannot replace the transaction record. Export submissions, scoring sheets and workflow history from the portal in the system’s native format. Preserve evaluator comments, approvals, meeting minutes, supplier questions and answers, challenge letters, debriefings, emails and attachments in a way that keeps sender, recipient, date, time zone, message ID and attachment relationships.

For mail and collaboration systems, use the platform’s legal hold or export function rather than printing messages. Keep the original message container and headers; a PDF is a review copy. If a portal provides an audit log, export it with its time zone and schema documentation. Record the export account, filters and date range so another person can reproduce the selection.

case-2026-001/ master/ portal/ bids/ evaluations/ mail/ web-archives/ manifest.csv chain-of-custody.log review/ redacted/The master contains the first acquired bytes. Reviewers work from copies. Never overwrite a master after conversion, redaction or annotation.
Your manifest should contain at least:

Use a current cryptographic hash such as SHA-256. Hash the file after acquisition and again whenever a copy is transferred. Matching values show that the offered file is the same byte sequence as the preserved file; they do not prove who authored the page or that the page was complete.
Chain of custody
Maintain a chronological log for every transfer, access, conversion, redaction and export. Include date and UTC time, person, action, source and destination, tool and version, reason, resulting hash and any exception. A redacted or converted exhibit must have a new filename and hash while the unredacted original remains in the master set.
Protect the master
Store the master read-only or in a controlled repository with role-based access, audit logging and backups. A UK digital-investigation procedure describes a documented, sealed Master Copy stored to prevent alteration or accidental erasure and available for court examination. Test that backups can be restored without changing the original hashes, and record each restoration test.
What a screenshot can—and cannot—establish
A screenshot can show what the operator saw at a particular moment, but it may omit scripts, linked files, hidden fields, metadata and the page’s relationship to the procurement. Its value depends on the capture process, witness and surrounding records. Preserve the underlying HTML or web archive and linked documents so a reviewer can inspect more than the pixels.

An electronic timestamp and its certification may help establish that data existed at the stamped time. A hash helps demonstrate that a presented copy matches the preserved file. Neither alone proves authorship, completeness, the truth of a statement or admissibility. Authentication, hearsay, relevance, privacy and redaction remain separate issues. Courts or tribunals may require a custodian, competent witness, certificate, native-format production or other foundation. Ask counsel which affidavit, certificate and exhibit conventions apply in the deciding forum.

Do not apply a single “web retention” number to every procurement. Compare the governing procurement law, contract, records schedule, litigation hold and tribunal order. The following figures are examples from the authorities cited for this subject, not universal deadlines.

Set a review date before the shortest possible deadline, then extend or suspend disposition while a hold, audit, appeal or disclosure obligation remains active. Have counsel confirm whether a contract clause, privacy rule, public-records law or protective order changes the schedule.
Privacy, access and redaction
Tender files often contain personal data, bank details, signatures, security credentials or commercially sensitive pricing. Limit access to the case team, encrypt transfers and document the legal basis for sharing. Redact only a working or production copy; preserve the unredacted master and record the tool, version, operator, reason and date. Verify that a PDF redaction removes the underlying text and metadata rather than merely placing a black rectangle over it.
Performance and reliability practices
- Capture immediately, then repeat at material changes such as an addendum, deadline extension or award.
- Use UTC consistently and synchronize the acquisition workstation’s clock.
- For dynamic sites, wait until the notice, attachments and revision history are visibly loaded; record the wait condition and delay.
- Capture from more than one permitted access route when a page differs for logged-in and public users, clearly labeling each session.
- Keep native exports alongside PDFs and images so searches and metadata survive.
- Verify every downloaded file opens, compare its hash after transfer and investigate any size or hash change.
- Back up the master in a separate controlled location, but never “clean up” duplicate files by deleting them before deduplication is documented.

For a portal that requires authentication, use only credentials and access permitted by the contracting authority and your counsel. Keep the request parameters, response headers and API job identifiers in the manifest. A screenshot service cannot prove that an unseen attachment, bid submission or internal evaluation record did not exist.

The notice is blank or times out
First save the error page, URL, UTC time and browser console or response status. Retry once from the same permitted route after recording whether scripts, authentication or a network proxy failed. The portal requires login or shows different versions
Capture the login route, account role, visible version and access time without recording passwords or tokens. Export the authenticated native record through the portal’s approved process. If public and authenticated views differ, keep both and explain the difference in the manifest.

Hashes do not match after transfer
Stop using the destination file, re-copy from the sealed master, verify the transfer tool and recalculate the hash. Add the failed transfer and corrective action to the custody log; never replace the original silently.
A PDF contains sensitive hidden data
Return to the unredacted master, use a verified redaction workflow, remove hidden layers and metadata, hash the resulting production copy and document the tool and reviewer. Do not edit the master.
Practical handoff to counsel
Deliver a read-only master, manifest, custody log, index of custodians and systems, retention or hold notice, and a short limitations memo. The memo should identify inaccessible pages, dynamic content, failed captures, time-zone assumptions, redactions and the relationship between each screenshot, native file and procurement event. Ask counsel whether the forum requires a witness statement, electronic-record certificate, translated exhibit, native production or a particular numbering convention.
FAQ
Is a screenshot enough to challenge an award?
Usually it is safer as corroboration than as the entire record. Pair it with native HTML or an archive, linked documents, portal exports, timestamps, hashes and a witness who can explain the capture.

No. Preserve each material version, addendum, clarification and visible revision history with its own URL, UTC time and hash so the sequence of changes can be reconstructed.
Can a hash prove that a tender notice was written by the authority?
No. It verifies the identity of the preserved bytes. Authorship, completeness and the truth of the content require separate evidence and foundation.
What if the portal operator has already deleted the page?
Preserve cached copies, emails, downloads, audit logs and contemporaneous screenshots, and request the operator’s system records through the applicable process. Record exactly what is unavailable rather than recreating it.
