Download the authoritative public copy, keep it unchanged as a read-only master, and create a separate searchable derivative only when the file lacks a text layer. Test text selection and in-document search first. For an image-only scan, use OCR that adds an invisible text layer without replacing or degrading the page image. Validate every page against the master, record provenance and a file hash, and retain both files together.
What you are preserving
A court PDF can look perfectly normal while containing only page images. In that case, a viewer cannot reliably search names, dates or docket terms. A searchable preservation copy has two layers:
- The original page image, unchanged in content and appearance.
- Embedded OCR text that permits selection, copying and searching.
The OCR layer is a navigation aid, not a replacement for the record. The untouched download remains the authoritative master; the OCR-enabled file is a clearly identified derivative.

Step 1: Acquire the authoritative public copy
Start with the filing court’s public document system or PACER. The U.S. Courts describes PACER as the access point for federal case files, and many federal opinions are available free in text-searchable form. Download the document itself rather than relying on a browser preview or a screenshot of a docket page.
Check public-access limits
- Availability depends on the jurisdiction and the case.
- Sealed documents are not available to the public through PACER.
- Certain personal identifiers are redacted before release. Do not attempt to reconstruct them from other copies.
Save the download as a read-only master
- Create a case folder with a stable name, such as the case number and document number.
- Save the original filename and the exact source URL in a text file.
- Set the downloaded file aside as the master. Do not OCR, rotate, compress, redact, annotate or rename it in a way that obscures its origin.
- Record the court, case number, docket or document number, download date and the person or system that acquired it.
Step 2: Determine whether OCR is needed
Open the master in a PDF viewer and test the file before changing anything.
- Drag across a sentence. If individual characters can be selected, a text layer exists.
- Copy a short passage and paste it into a plain-text editor. Check that words and line order are sensible.
- Use the viewer’s search command for a distinctive name, date and docket term.
If selection and search work, preserve the existing text layer. Re-OCR can introduce character errors, alter reading order and create an unnecessary derivative. If pages behave like photographs and searches return nothing, classify the document as image-only and proceed to OCR.

Step 3: Create a searchable derivative without changing the scan
Use an OCR workflow configured to overlay searchable text on the existing page images. The output should retain the same page dimensions, orientation, visible marks, seals, exhibits, stamps and redactions as the master. Do not use a process that substitutes OCR output for the original image or applies lossy compression.

Recommended OCR controls
- Preserve the original resolution and color information unless a documented preservation profile requires otherwise.
- Place the OCR text behind the image or otherwise make it invisible in normal viewing.
- Keep page order and page count identical to the master.
- Do not “correct” spelling, expand abbreviations or rewrite handwritten annotations in the OCR layer.
- Keep the master and derivative as separate files with unambiguous names, for example
case-document-master.pdfandcase-document-searchable.pdf.
OCR is probabilistic. A clear scan can still produce mistakes in names, citations, columns, footnotes and handwriting. Treat search hits as pointers to the page image, not as proof that the OCR text is exact.
Step 4: Validate the result against the master
Validation is the step that makes a searchable copy defensible for later reference. Guidance from the UK National Archives calls for the full content and context to be captured, all text to be included and legible, the entirety of the record to be visible, and a clear chain of custody.
Page-level checks
- Confirm that the derivative has the same number of pages as the master.
- Compare the first, a middle page and the final page side by side.
- Spot-check pages containing tables, footnotes, exhibits, handwritten marks, stamps, seals and redactions.
- Verify that no page is rotated incorrectly, cropped, blank, duplicated or missing.
- Zoom into fine print and signatures to ensure the visible image has not been softened or replaced.
Search and legibility checks
- Search distinctive names, dates and docket terms.
- Open each hit and compare the selected text with the underlying page image.
- Test text in multi-column sections, headers, footers, tables and footnotes.
- Record known OCR errors in your notes rather than editing the evidence.
If a page fails, return to the master and regenerate the derivative with different OCR settings. Never repair the only copy by editing the page image.

Step 5: Select a preservation format
A normal PDF is appropriate for routine reference when it retains the source image and a searchable text layer. For stronger long-term preservation, use a validated PDF/A profile and keep the original PDF as well.

NARA identifies PDF/A-4f and PDF/A-3 as preferred formats for PDF collections and requires fonts to be embedded in such collections. A file that merely has a “PDF/A” label without validation should not be treated as conforming.
Step 6: Remove access settings that block reference use
Check the document’s security settings. Passwords or permissions must not prevent opening, viewing or printing when the file is being prepared for a permanent-transfer collection. If restrictions are present, document what you changed, preserve the original restricted file, and create a separate derivative rather than silently overwriting the master.
Step 7: Build a provenance package
Keep the files and their history together. A short README beside the PDFs should contain:

- Download date and time, including the time zone when it matters.
- Original filename and file size.
- A cryptographic file hash for the master and for every derivative.
- OCR software name and version, profile or language settings, and the date the derivative was created.
- Any rotation, conversion, PDF/A validation or security-setting change.
- The identity of the person or automated process that performed each step.

Suggested end-to-end procedure
- Locate the public filing-court or PACER copy and download it.
- Record the URL, court, case and document identifiers, date and filename.
- Calculate and record the master’s hash.
- Test selection, copy/paste and search.
- If searchable text already exists, retain the master as the reference copy and validate its pages.
- If the file is image-only, generate an OCR derivative that overlays text while preserving every visible page image.
- Compare page count, orientation, dimensions, seals, exhibits, marks and redactions with the master.
- Search names, dates and docket terms, then inspect each hit against the image.
- Validate PDF/A-4f or PDF/A-3 if your repository requires a preservation profile; ensure fonts are embedded.
- Check that passwords and permissions do not block opening, viewing or printing where permanent-transfer rules apply.
- Hash the derivative, finish the README and store the master, derivative and notes together.
Common failure modes and fixes

Performance, reliability and cost considerations
OCR and validation time grows with page count, image resolution and layout complexity. Preserve the master before starting so a failed conversion never destroys the only copy. For large collections, process in batches but validate each output’s page count and hash, and retain a log that ties every derivative to one source file.
Access conditions and any fees are determined by the court or PACER and vary by jurisdiction and case. Public does not mean unrestricted: sealed material is not publicly available, and released filings may already contain required redactions.
