An H-1B “transfer” is generally a new employer’s Form I-129 petition requesting to employ a worker who is already in H-1B classification. In qualifying cases, AC21 portability can allow the worker to begin with the new employer when that employer files a nonfrivolous petition, before USCIS approves it. Portability is conditional, not automatic: lawful admission, timely filing before the authorized stay ends, and no unauthorized employment in the relevant period are among the conditions USCIS identifies. The employer’s immigration team should verify the facts, select the correct filing basis, coordinate the start date, and preserve the receipt notice.
What an H-1B employer change actually is
“H-1B transfer” is common shorthand, but the legal action is normally a new employer filing Form I-129, Petition for a Nonimmigrant Worker, for the proposed employment. The petition asks USCIS to classify or continue the beneficiary in H-1B status for that employer’s job. The worker does not move a petition from one company to another by personal request; the prospective employer files the petition.
The filing basis must match the arrangement. USCIS’s Form I-129 and its instructions distinguish a change of employer from new employment, concurrent employment, continuation of previously approved employment, and an amended petition. Calling every job change a “transfer” can therefore lead to the wrong selection or an incomplete case strategy.

AC21 portability can permit certain H-1B workers to begin working for the new employer after the new employer files a qualifying, nonfrivolous Form I-129 petition, rather than waiting for an approval notice. USCIS describes a nonfrivolous filing as one with an arguable basis in law and fact that was not filed for an improper purpose.

USCIS’s employer guidance identifies these conditions for the portability situation described there:
- The worker was lawfully admitted to the United States.
- The new employer files the petition before the worker’s authorized stay expires.
- The worker has not engaged in unauthorized employment since admission and before the petition is filed.
These are fact-dependent eligibility conditions, not a blanket rule for everyone who has ever held H-1B status. The employer and immigration counsel should confirm the worker’s admission history, current status, authorized-stay dates, and employment record before setting a start date under portability.
Prepare the case in the right order
1. Have the new employer assess the worker’s immigration record
Start with the employer’s immigration team or authorized counsel. They should review the current H-1B approval and admission history, the expiration date of the authorized stay, the worker’s status at the time of filing, and every period of employment since admission. Ask specifically whether any work occurred outside the authorization shown by the worker’s H-1B documents or without the required petition coverage.

This review is what determines whether portability can be relied on. A job offer by itself is not work authorization, and a pending petition does not erase a prior status problem. Give counsel complete information, including short-term jobs, overlapping employment, unpaid or volunteer work that may have involved services for an employer, status changes, and periods outside the United States.
2. Identify the correct Form I-129 basis
The employer should select the filing basis that describes the actual employment plan:

| Change of employer | A new employer seeks to employ a beneficiary already in the requested H-1B classification. | The new employer files the petition. Portability may be available only if its statutory and USCIS-described conditions are satisfied. |
| Concurrent employment | An additional employer seeks to employ the worker while the existing H-1B employment continues. | This is not automatically a transfer. The employer and counsel must use the separate concurrent-employment basis and plan for both jobs. |
| Amended petition | The existing employer reports a material change in employment terms or eligibility. | This is distinct from changing employers. Whether a proposed change is material requires case-specific analysis. |
| New employment or another I-129 category | The facts do not fit a beneficiary already in the requested classification changing employers. | Do not force the case into “change of employer.” Follow the current I-129 form and instructions for the actual request. |
The employer’s counsel should also confirm whether the proposed position and work location fit the underlying H-1B requirements and whether any other filing or labor-condition step is required. Current USCIS and Department of Labor instructions control; this guide does not establish a complete labor-condition application sequence or a universal supporting-document checklist.
3. Match the filing and start date
Before anyone starts work, document which rule authorizes the start. If the case depends on portability, the employer must have filed the qualifying petition and the worker must meet the applicable conditions. Coordinate the intended first day with counsel so it is not based merely on the date an offer was signed, a draft petition was prepared, or a package was shipped.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteKeep a record of when the petition was delivered or accepted, how the employer verified filing, and what documents support the worker’s status. If USCIS later questions eligibility, the employer should be able to show the filing event and the factual basis for the proposed start date.
4. Preserve the receipt and monitor the case
USCIS sends a receipt notice describing case processing and providing the case receipt number. Keep the original notice, a secure scan, and the envelope or delivery record if available. Give copies to the worker, human-resources contact, and immigration team according to the employer’s security policy.
USCIS Case Status Online accepts a 13-character receipt number made up of three letters and 10 numbers. Enter the number exactly as shown; do not substitute a tracking number, invoice number, or attorney matter number. A receipt number confirms that USCIS created a case record, but it is not an approval and does not by itself establish that every portability condition is met.

USCIS office-location guidance says a mailed receipt is sent within 30 days after receipt. Treat that as agency process guidance rather than a guaranteed adjudication schedule. If the notice does not arrive, ask the filing team to verify the delivery address, filing evidence, and whether a USCIS inquiry is appropriate.
A practical preparation workflow
- Set a status deadline. Record the expiration date of the worker’s current authorized stay from the controlling immigration document. Build the filing plan around that date rather than around an informal company start date.
- Collect the existing case history. Provide the new employer’s immigration team with prior H-1B approval notices, admission records, passport biographical pages, current status documentation, and a complete employment chronology. Counsel will determine what is relevant and what must be submitted.
- Describe the proposed job accurately. Give the employer and counsel the job title, duties, worksite information, expected start date, and reporting arrangement as they actually will be. Do not ask counsel to prepare a petition from a generic job description if the day-to-day work will differ.
- Disclose overlapping or unusual facts. Identify any second employer, recent termination, unpaid period, travel, change of status, remote or third-party worksite, or possible unauthorized employment. These facts can affect the filing basis or portability analysis.
- Choose the I-129 basis. The employer, not the worker acting alone, should identify change of employer, concurrent employment, amended petition, continuation, or another applicable basis using the current form and instructions.
- Confirm the filing event. Obtain evidence that USCIS received the petition. If the intended start relies on portability, counsel should confirm that the filing is nonfrivolous and that the worker satisfies the conditions being relied on.
- Set the first day consistently. Align the employment agreement, payroll onboarding, internal HR record, and actual work start with the advice given for the filed case. Do not perform productive work for the new employer while waiting for an uncertain filing event.
- Store and track the receipt. Save the receipt notice and its 13-character number, check Case Status Online, and route every USCIS notice to the immigration team promptly.
- Escalate changes immediately. Tell counsel if the job, worksite, duties, employer structure, start date, travel plans, or existing employment changes after filing. A new fact may require a different filing or amended analysis.
Documents and facts to organize without treating a checklist as universal
There is no single publicly established checklist that applies to every H-1B employer change. The required evidence depends on the filing basis and the worker’s history. Organize the following information so counsel can decide what belongs in the petition:
- Current and prior H-1B approval notices and related USCIS correspondence.
- Passport, visa, admission, and current authorized-stay information.
- A dated list of employers, positions, work locations, and periods of employment since the relevant admission.
- The new employer’s legal name, contact information, proposed role, duties, worksite, and expected start date.
- Any facts involving concurrent jobs, layoffs, gaps, travel, status changes, or suspected unauthorized work.
- Copies of the petition receipt and every later USCIS notice.
Use current USCIS and Department of Labor instructions for the documents and labor-condition steps that apply to the specific case. Do not assume that another worker’s packet, a prior employer’s checklist, or an internet template is complete or current.
Common mistakes and how to prevent them
Starting on an offer letter alone
An offer, signed employment agreement, or internal approval does not substitute for the employer’s Form I-129 filing. If portability is the intended basis for starting before approval, verify the filing and the worker’s eligibility first.
Using “transfer” for concurrent employment
Keeping the current job while adding a second employer is a different I-129 scenario. Tell counsel about both jobs so the petition can be evaluated as concurrent employment rather than an ordinary change of employer.

Ignoring the authorized-stay date
Portability guidance depends on timely filing before the authorized stay ends. Calculate the deadline from the controlling immigration record and allow time for the employer and counsel to prepare and submit the petition.
Omitting a prior work problem
Unauthorized employment or an unexplained gap can change the analysis. Concealing it can create a larger problem than disclosing it early. Provide a complete chronology and let authorized counsel determine its effect.
Confusing a receipt with approval
The receipt number lets you track a case; it does not mean USCIS has approved the petition. Keep responding to requests and follow counsel’s instructions while the case remains pending.
Relying on an old form or old instructions
Use the current Form I-129 edition and USCIS instructions at the time of filing. Filing bases, addresses, and submission procedures can change, so do not reuse a prior packet without a fresh review.
Failing to report post-filing changes
A materially different role, worksite, employer entity, or schedule may require a new analysis. Notify the immigration team before implementing the change, not after payroll or work assignments have already changed.

How to handle uncertainty
Ask for individualized immigration advice when the worker’s status dates are unclear, admission records conflict, employment overlapped, there was travel near a filing, more than one employer is involved, or any work may have been unauthorized. USCIS advises people who are unsure which forms to submit to seek immigration legal advice from an authorized service provider.
An employer should identify who is responsible for each decision: the business owner for the job and start date, the immigration team for the filing strategy, and authorized counsel for legal interpretation. Keep written confirmation of the advice used to set the start date and escalate new facts rather than improvising.
Questions to ask the employer’s immigration team
- Are we filing a change-of-employer petition, concurrent-employment petition, amended petition, or another I-129 basis?
- What is the worker’s exact authorized-stay deadline, and will the petition be filed before it?
- Does the worker meet the lawful-admission and employment-history conditions for portability?
- What event confirms that USCIS received the petition?
- May the worker begin on the proposed date, and what documents support that conclusion?
- What should the worker do if the receipt is delayed, a notice requests evidence, or the job changes after filing?
- Which current USCIS and Department of Labor instructions govern the evidence and labor-condition steps for this case?
What the worker should retain personally
Maintain a private, organized copy of the petition receipt, approval or other USCIS notices, current status documents, passport and admission records, employment agreements, and a dated list of work performed for each employer. Keep the immigration team’s contact details and report address, duty, employer, or start-date changes promptly. Do not send sensitive identity documents through an unverified channel; use the secure process supplied by the employer or counsel.
Bottom line for a planned move
Prepare an H-1B employer change as a coordinated employer filing, not as a simple job-transfer form. The new employer files Form I-129, the filing basis must match the actual arrangement, and portability can permit an eligible worker to start after filing but before approval only when USCIS’s conditions are satisfied. Verify the status history and deadline, document the filing, keep the receipt number, and obtain authorized advice whenever the facts are uncertain.
