If your technology job may end, build a complete, private immigration file before your last day. Start by identifying your current category, the legally effective employment end date, your I-94 and petition expiration dates, and any separate work-authorization deadline. Then preserve status records, employment evidence, and layoff communications in a secure digital folder and contact the right adviser quickly. A grace period may provide time for an eligible filing, but it does not automatically authorize new work and does not apply identically to every immigration category.

Start with a status-and-deadline sheet

Do this before collecting anything else. Immigration consequences turn on the category you hold and the date employment actually ceases, not simply on the date a manager announces a reduction in force. Create a one-page sheet and verify every entry against your official notices and online records.

Field What to record Why it matters
Current immigration category For example, an employment-based nonimmigrant category or F-1 with post-completion OPT The rules, reporting duties, and possible filings differ by category.
Employer and position Legal employer name, job title, worksite, and petitioning entity if different These details help counsel evaluate whether a potential next employer or filing fits your history.
Effective employment end date The date shown in the written termination or layoff notice For covered employment-based categories, a grace-period calculation generally starts when employment ceases.
I-94 expiration Admit-until date and class of admission A period of authorized stay can end before another document’s printed expiration date.
Petition or status expiration Dates on the latest I-797 approval notice and related approval documents The applicable period may end at the earlier of a regulatory grace period or authorized validity.
Work-authorization expiration EAD category and expiration date, if you have an EAD An EAD expiration is a separate work-authorization issue.
Pending matters Receipt numbers, filing dates, biometrics or interview notices, and attorney contact information A layoff can affect strategy for a pending filing, but the effect depends on the case.
Family records Dependent categories, I-94 dates, approval notices, and EADs where applicable Dependents may have different dates and consequences from the principal worker.

Keep the sheet dated. If a separation package lists a paid notice period, garden leave, or severance, preserve the wording but do not assume a later payment proves that immigration employment continued. When the effective date is ambiguous, ask qualified immigration counsel before relying on a particular day.

Build a complete digital file

Use a folder structure that lets an adviser understand your status without searching through hundreds of unrelated files. Save readable, complete pages rather than cropped screenshots. Keep the originals and a backup in a secure account protected by a strong password and multifactor authentication.

Identity and admission records

  • Passport biographical page and every page containing a U.S. visa, admission stamp, or immigration notation.
  • Your most recent Form I-94 record, including the admission class and admit-until date.
  • All relevant Form I-797 approval and receipt notices, including notices for extensions, amendments, transfers, or changes of status.
  • Copies of petition forms and supporting documents that your employer or counsel can lawfully provide to you.

Do not discard an expired passport if it contains the visa used for entry. Keep it with the current passport so the entry history is understandable.

Work-authorization records

  • Both sides of any Employment Authorization Document and notices connected to it.
  • For F-1 OPT, every current Form I-20, including the page showing the OPT recommendation or endorsement and any later update.
  • Employment authorization approval notices, if separate from the card.

A pending application receipt is evidence that a filing was received; it is not, by itself, proof that you may begin a new job. Preserve the receipt so counsel can determine what effect, if any, the filing has.

Employment and compensation evidence

  • Offer letters, employment agreements, job descriptions, and verification letters.
  • Job title, duties, worksite or remote-work arrangement, start date, and the entity that paid you.
  • Recent pay statements, W-2 forms, and relevant tax records.
  • Performance or project records that help establish the work actually performed, while excluding confidential company source code or trade secrets.

USCIS form instructions commonly identify pay stubs, W-2s, tax records, employer letters, a passport, and an I-94 as examples of evidence. Those examples come from particular applications; they are not a universal layoff checklist. Save only records you are permitted to retain under your employer’s policies.

Layoff and separation communications

  • The written layoff or termination notice, including the stated effective date.
  • Severance, release, or separation agreements and any amendment to them.
  • Final pay statements, benefits-end notices, and correspondence confirming the last day worked or employed.
  • Messages that clarify whether notice, paid leave, or garden leave changes the official employment date.

Export important messages to a durable format and preserve the original email headers when possible. Do not alter dates or merge separate communications into one file.

Protect the file without losing access

Immigration records contain passport numbers, dates of birth, addresses, and sometimes financial information. Keep a primary encrypted folder and a second backup in a different secure location. Test that you can open the backup before your company account closes.

  • Use a personal account that you control, not an employer-managed drive that may be disabled on the last day.
  • Do not place identity documents in an unsecured shared folder or send them through a public link.
  • Restrict access to your lawyer, authorized representative, school official, or another person who genuinely needs the file.
  • Retain paper originals. An accordion organizer can help with physical copies, but no particular organizer is required by USCIS.
  • Keep a simple index listing the document name, date, and whether it is an original, scan, or copy.

Before copying files from a work device, follow company policy and remove confidential business material. Your immigration file should document your status and employment, not duplicate an employer’s proprietary data.

Understand the dates after employment ends

Employment-based nonimmigrant workers

The regulation cited in USCIS nonimmigrant employment materials, 8 CFR 214.1(l)(2), provides up to 60 consecutive days after cessation of employment, or until the end of the authorized validity period if that comes sooner, for specified covered categories. It is not a universal rule for every person who holds an immigration document. Your status sheet should therefore show both the calculated 60-day date and the earlier I-94 or status-expiration date.

Count from the legally effective cessation date, not automatically from the day you receive severance. If the notice says employment ends on a future date, that date may be the relevant starting point; if the documents conflict, obtain individual advice. A grace period is time to pursue an eligible solution, not an independent employment authorization.

“The 60-day grace period not only gives nonimmigrant workers time to find new employment, but also permits them the option to change their status to another nonimmigrant status, among other options, in the event their employment search takes longer than 60 days.”

USCIS Director Ur M. Jaddou, letter to Representative Anna G. Eshoo, January 25, 2023

The statement describes possibilities, not an approval guarantee. Eligibility, filing timing, maintenance of status, and the effect of a particular petition must be evaluated against your record.

F-1 students on post-completion OPT

If you are on F-1 OPT, contact your designated school official (DSO) promptly. ICE and SEVP practical-training guidance says specified changes, including loss of employment, must be reported to the DSO within 10 days. Ask the DSO how to update the Student and Exchange Visitor Information System record and what evidence the school needs.

The F-1 60-day period after program completion or post-completion OPT serves a separate departure or new-program purpose. Do not substitute that period for the employment-based cessation-of-employment grace period, and do not assume that one category’s deadline extends the other. Record the program end date, OPT dates, unemployment accounting information maintained by your school, and the reporting deadline on a separate F-1 section of your sheet.

Map possible next steps before choosing one

Ask counsel to compare routes using the same five questions: Do you qualify? What must be filed or reported and by when? What happens to your current status or authorized stay? Does the action itself authorize work, and when? What are the effects on dependents and international travel?

Possible route Who might consider it Timing and status questions Work-authorization caution
New employer petition Some workers whose category permits a new employer to file Confirm the prospective employer, position, filing window, and whether the petition must be received before a grace or validity deadline. Do not start based only on a job offer or an unreviewed filing receipt; ask when work may lawfully begin.
Change of nonimmigrant status A person eligible to move to another nonimmigrant classification Determine the requested status, required evidence, and whether filing before the current authorized period ends preserves a lawful period while the case is pending. A pending change-of-status filing does not automatically authorize employment in the new activity.
Adjustment of status A person who independently meets the requirements for permanent residence in the United States Eligibility, visa availability, filing effects, and travel rules are highly fact-specific. Employment authorization may require a separate filing and approval; do not infer permission from the adjustment filing alone.
Compelling-circumstances EAD Certain high-skilled nonimmigrants who meet USCIS requirements and face qualifying circumstances Review the narrow eligibility criteria, evidence, validity period, and relationship to your underlying status before relying on it. An EAD application is not an automatic bridge to work. Wait for the applicable authorization and follow its limits.
Departure or another school-based option People who cannot or do not choose an in-country filing, including some F-1 students Coordinate departure, transfer, or a new program with the DSO or counsel and track every admission and program date. Future employment authorization depends on the new status and its own rules.

USCIS describes these kinds of options for some recently unemployed nonimmigrant workers, but the agency does not promise that every option is available in every case. A lawyer or authorized representative can identify which facts control your case; a DSO is the right first contact for the F-1 reporting record.

Prepare a counsel-ready packet

Send a concise index rather than an unorganized archive. Put the status-and-deadline sheet first, followed by identity records, the newest notices, employment evidence, and layoff documents. Include a short chronology with entry dates, petition approvals, job changes, and the exact employment end date.

  1. Write down your question in one sentence, such as whether a particular filing can be submitted before the earlier of two dates.
  2. List every trip outside the United States, status change, employer change, and prior immigration filing that could affect the analysis.
  3. Identify dependents and attach their separate expiration dates and notices.
  4. Mark uncertain facts, such as conflicting termination letters, instead of silently choosing one.
  5. Ask for written confirmation of what you may do while a filing is pending, especially work and international travel.

For F-1 OPT, give the DSO the employment-loss date and follow the school’s reporting procedure within the 10-day window. For an employment-based category, contact qualified immigration counsel as soon as a layoff is announced so there is time to evaluate a filing before the applicable period ends.

A practical timeline

Before the last day

  • Download personal immigration and payroll records you are entitled to keep.
  • Ask human resources for a letter stating the effective employment date, title, worksite, and final-pay information.
  • Confirm that your personal email and phone number are listed with counsel, the DSO, and any pending-case provider.

Within the first 48 hours

  • Complete the status-and-deadline sheet and calculate the possible 60-day date alongside the I-94 or status expiration date.
  • Secure the digital backup and preserve the original layoff communications.
  • Contact counsel or, for F-1 OPT, the DSO; do not wait until the last week to learn which documents are missing.

By the relevant reporting deadline

  • F-1 OPT students should report the employment loss to the DSO within 10 days under ICE/SEVP guidance.
  • Other workers should follow the filing or notification schedule counsel identifies for their category; there is no single reporting deadline that covers everyone.

While evaluating a filing

  • Track the status of every receipt, request for evidence, biometrics notice, and approval.
  • Do not begin a new job, change duties, or travel internationally on the assumption that a pending application grants permission.
  • Update the chronology if a new employer, amended offer, or changed end date appears.

Common mistakes and how to correct them

Relying on the severance check

Severance may be paid after the job ends. It is not, by itself, proof that immigration employment continues. Use the written effective date and ask for advice when the separation agreement uses different terminology.

Treating every 60-day period as the same

The employment-based regulation and the F-1 post-program or OPT period arise in different contexts. Label the source and purpose of each date on your worksheet instead of writing a generic “60-day grace period.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assuming a receipt equals work permission

A receipt confirms that an agency received a filing. It does not automatically authorize a new job or new duties. Obtain a category-specific answer before working.

Saving incomplete scans

A cropped I-797, missing reverse side of an EAD, or absent I-94 admission class can make a file difficult to interpret. Scan every page, preserve dates, and compare the copy with the original.

Leaving records in a company account

An employer account may close immediately. Move only your personal immigration and employment records that you are allowed to retain to a secure personal location before access ends.

Ignoring dependents

Family members can have different I-94, approval, and EAD expiration dates. Add each person to the deadline sheet and ask how a proposed filing or travel plan affects them.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Final file checklist

  • Status category, employer, position, and effective employment end date.
  • I-94, passport and visa pages, I-797 notices, petition copies, EAD, and I-20/OPT records where relevant.
  • Offer and verification letters, job and worksite details, pay statements, W-2s, and relevant tax evidence.
  • Layoff, severance, final-pay, and date-confirmation communications.
  • Dependent records and all pending-case receipts.
  • Encrypted primary folder, tested backup, paper originals, and a document index.
  • Written questions for counsel or the DSO, including work and travel restrictions while a filing is pending.

A well-organized file cannot create eligibility, extend an I-94, or authorize employment. It does give the qualified adviser a reliable timeline and the evidence needed to act before a controlling deadline. Recheck current USCIS and ICE/SEVP procedures and form instructions when preparing an actual filing, because agency processes and forms can change.

Frequently Asked Questions

Does receiving severance mean I am still employed for immigration purposes?

Not necessarily. Severance payments can continue after the effective employment date. Use the written separation terms and obtain individualized advice if the date is unclear.

Can I use a pending petition or change-of-status application to start a new tech job?

Do not assume so. A pending filing may affect status or authorized stay without granting employment authorization for the proposed job. Confirm the work start date and conditions with qualified counsel.

What should an F-1 OPT student do first after a layoff?

Notify the designated school official and follow the school’s procedure for reporting loss of employment within 10 days under ICE/SEVP practical-training guidance, while preserving the termination notice and OPT records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Should I keep immigration records for my dependents separately?

Keep them in the same secure system but maintain a separate index for each dependent’s category, I-94, approval notice, and EAD dates so different deadlines are not overlooked.
