Keeping sensitive data in India when using an AI API means checking more than the region where a provider stores customer content. Storage, model inference, logs, application state, and operational metadata can follow different routes. For OpenAI’s documented India API option, storage is available but regional processing is not; selecting it therefore does not establish that prompts are processed in India. Meanwhile, India’s Digital Personal Data Protection framework does not impose blanket localisation for most organisations, according to the Data Security Council of India’s November 2025 FAQ, but other laws and sector rules may impose additional requirements.
The practical approach is to identify the rules for your specific data and sector, minimise what you send, and obtain provider evidence for each data flow and endpoint. Treat “India region” as one configuration detail—not a complete residency guarantee.
What “keep data in India” can mean
A request to keep data in India can refer to several different activities. If your requirement is precise, define which activity must remain within the country before you select an API or make a contractual promise. A region setting can cover some customer content at rest without covering the place where a model processes a request or every system that handles related information.

For each category, record the requirement separately. “Customer prompts are stored in India” and “prompts are processed in India” are different statements and need different evidence.

Does Indian law require all data to stay in India?
Not as a blanket rule under the Digital Personal Data Protection framework, according to the Data Security Council of India’s cross-border FAQ, reported as of November 2025. That secondary guidance says most organisations may store data on global cloud servers unless a region is restricted, while noting that specified transfer restrictions, duties for Significant Data Fiduciaries, and stricter requirements under other Indian laws may still apply. It is general guidance, not a substitute for the statutory text or advice about a particular deployment.
The Government of India said it notified the Digital Personal Data Protection Rules, 2025 on 14 November 2025. A Press Information Bureau backgrounder describes the Act and Rules as a framework for digital personal-data processing and identifies principles including consent and transparency, purpose limitation, data minimisation, accuracy, storage limitation, security safeguards, and accountability. The backgrounder also reports 6,915 consultation inputs during development of the final Rules; that figure measures consultation input, not compliance or adoption.

The answer for a business depends on the data, the organisation, the purpose, the applicable law and regulatory directions, contractual commitments, and relevant commencement or regulatory notifications. Do not turn a general summary of the DPDP framework into a universal legal conclusion about every dataset or sector.

Check sector rules separately
Payment data is one example of why a general data-protection answer may not settle a sector-specific question. A SEBI-hosted report describes a 2019 RBI requirement for payment data to be stored in India and mentions an exception for some foreign-bank cross-border transactions. The report is not the controlling RBI circular, so use the primary RBI instrument and any later direction to establish the exact scope and any exception before relying on that description.

Run a separate requirements check for payments, financial services, government workloads, and any other regulated or contractually restricted use. Where the obligation is unclear, pause the affected data flow for legal and compliance review rather than assuming that a provider’s India setting resolves it.
How the documented OpenAI API controls apply
OpenAI’s API documentation illustrates why storage, processing, training, and retention should be assessed as separate controls. These facts describe the provider documentation available for this article, not a general capability shared by other API providers. They can also depend on eligibility, supported endpoints, and account configuration.

OpenAI’s data-controls documentation states that API data is not used to train or improve its models unless a customer opts in. That training statement is separate from the same documentation’s discussion of abuse-monitoring logs, application state, and retention. For residency decisions, read the data-controls and regional-availability documentation together, then verify the current terms for your actual account and endpoints.

A practical process for routing sensitive data
Use the following process before connecting production data to an external AI API. It is designed to turn a broad residency request into specific requirements, evidence, and configuration checks.

- Classify the information and purpose. List the information the feature could send: personal data, payment information, health or other regulated information, confidential business material, and information that can be omitted. Record why each field is needed for the task. Purpose limitation and data minimisation are among the principles described in the Government of India’s DPDP Rules backgrounder.
- Identify the rules attached to each use. Check applicable Indian laws, sector directions, contracts, internal policies, and any restrictions specific to the organisation or dataset. Write down whether the requirement concerns storage, processing, transfer, access, or some combination. Route uncertain legal questions to the responsible legal or compliance owner.
- Reduce the payload before it leaves your system. Remove direct identifiers and unnecessary context where the task permits. Use synthetic, masked, or aggregated information for development and testing instead of production records. Treat de-identification as a risk-reduction technique, not as automatic proof that legal duties no longer apply.
- Map every data path. For the specific product flow, list the API endpoint, model, account or project, files or other features used, your own application services, and any end-user or support path that may handle information. For each item, ask whether content is processed, stored, logged, or retained and where. If the provider does not state a value for an item, record it as unconfirmed rather than filling the gap with an assumption.
- Ask the provider precise residency questions. Request the documented region for storage at rest and inference separately. Ask about prompts and responses in abuse logs, application state, files, vector stores, caches, backups, deletion, subprocessors, support access, account data, metadata, and usage data. Confirm the answer for the precise endpoint, model, plan, and feature set you intend to use.
- Review retention and training independently. Establish the default training policy, whether any opt-in changes it, the retention period for content-bearing logs, the treatment of application state, deletion behaviour, exceptions, and eligibility for enhanced controls. A training answer alone does not resolve any of the retention questions.
- Configure and test without sensitive payloads. Set the documented endpoint and account or project controls, then validate the route in a non-sensitive environment using synthetic data. Retain the configuration evidence and the provider documentation that supports the intended claim. A hostname alone is not proof of an inference location unless the provider expressly documents that guarantee.
- Update governance records and notices. Document the purpose, provider role, relevant disclosures, safeguards, access controls, retention, and deletion process. Keep the internal record consistent with what the actual provider configuration does; do not promise an India-only flow if metadata, inference, support, or another part of the flow is outside that boundary.
- Recheck changes that could alter the route. Reassess when you add an endpoint or feature, change account eligibility or settings, introduce a new data type, or receive updated provider or regulatory terms. A decision about one API path does not automatically cover a later feature or a separate service.
Use a provider comparison that separates the controls
For two or more providers, compare like with like. A general “data residency” label is too broad to decide whether an API suits a particular workload. Use a table or evidence register with one row per control, and preserve the scope of each answer.

Mark each field as confirmed, not applicable, or unconfirmed; identify the source and its date. “Not stated” is not the same as “no retention” or “India-based.” If the provider cannot substantiate a control your use case requires, choose a different route for that data or keep it out of the API until the requirement is resolved.
Common mistakes that create false confidence
- Equating storage with inference. A regional storage setting can say where content rests without saying where a model processes a live request. Keep those statements separate in design documents and customer-facing claims.
- Equating no-training with no-retention. A provider can exclude API content from model training while retaining content in logs or application state under separate terms. Check each control on its own.
- Assuming the endpoint name is a residency guarantee. A region-specific hostname is useful configuration evidence, but it does not establish inference location unless the provider explicitly says so for the relevant route.
- Assuming one feature inherits every regional control. Files, vector stores, logs, and other features may have separate behaviour or endpoint support. Verify rather than extrapolate from a base text request.
- Applying the general DPDP position to every regulated dataset. Sector rules, contractual promises, and specific transfer restrictions can change the result. The payment-data example is a reason to check the primary instrument, not a complete statement of every payment use case.
- Making an all-data residency promise. Provider system data, customer infrastructure, end-user locations, and support processes may not be covered by a customer-content region. Define the boundary of any claim precisely.
- Sending real records just to test a route. Validate configuration with synthetic, non-sensitive data and retain the resulting evidence. A configuration check should not create a new disclosure of the very data you are trying to protect.
What to document before approval
A concise decision record helps engineering, security, legal, and product teams work from the same assumptions. Include:
- The feature’s purpose and the minimum fields needed to achieve it.
- The data categories involved and the applicable legal, sector, contract, or policy constraints.
- The provider, account or project, model, endpoint, and related features in the request path.
- Separate conclusions for storage, inference, logs, application state, retention, training, and operational data.
- The source and date supporting each provider claim, plus any exclusions, approval requirements, or unanswered questions.
- The controls applied in your own system, including payload minimisation, access, retention, and deletion.
- The test evidence from a non-sensitive environment and the owner responsible for reassessment if the route or requirements change.
This record should distinguish a legal conclusion from a technical configuration fact. For example, provider documentation can establish what a setting is intended to cover; it does not decide whether your organisation is permitted to use that route for a particular dataset.
