Institutional crypto funds stay accessible during a lost device, absent signer, or provider outage only when the fund has a documented, tested recovery design. A spare hardware wallet is not enough. The plan must specify who can approve a transfer, which independent approvals remain mandatory, how keys or signing shares are recovered, what happens when an outsourced custodian is offline, and how quickly essential operations must resume.

The right design depends on the fund’s legal structure, jurisdiction, custody contract, blockchain networks, and authorization model. The framework below helps an investment firm, treasury, family office, or other institutional holder build availability without turning recovery into an uncontrolled bypass of its security policy.

Availability is a governance problem, not just a device problem

A hardware wallet can fail, be lost, become inaccessible because of a damaged PIN process, or be held by an employee who is ill, travelling, suspended, or unreachable. The same interruption can occur at a custodian, multiparty-computation (MPC) provider, cloud service, identity-verification service, or communications channel. In each case, the operational question is not merely “Where is the backup device?” It is “Can the institution still complete an authorized transaction while preserving segregation of duties, evidence, and security?”

NIST Special Publication 800-57 Part 1 Revision 5, published in May 2020, provides general cryptographic key-management guidance. NIST Special Publication 800-57 Part 2 Revision 1, dated May 2019 and listed as under review, addresses institutional key-management planning and documentation, including policy and practice statements. NIST’s key-management project has also reported an initial public draft of Revision 6 in late 2025 or early 2026; treat Revision 5 as the cited published edition and check NIST’s publication page for any final revision before relying on a “current” designation.

These publications do not prescribe one wallet architecture. They support a written system that defines key-management responsibilities, protection requirements, recovery actions, and records. A device replacement that is not connected to those controls can create either an availability failure or an unauthorized-transfer path.

Start with an inventory of what must remain accessible

Document the assets, wallets, networks, and business functions covered by the continuity plan. Do not assume that all assets can be recovered through the same procedure: a Bitcoin UTXO wallet, an Ethereum contract position, a staking account, and a token held through a regulated custodian may have different signing and operational requirements.

Record each wallet and asset scope

  • Wallet or custody-account identifier, blockchain network, asset types, and whether the account can stake, lend, bridge, vote, or interact with contracts.
  • Current authorization threshold, number of required approvals, and the identities or roles eligible to approve.
  • Location and form of each key, seed, signing share, device, backup, or recovery credential. Record the control owner, not sensitive secret material in a general-access register.
  • Transaction limits, whitelisted destinations, cooling-off periods, and emergency restrictions that must remain in force during recovery.
  • Dependencies such as a custodian portal, MPC coordinator, hardware-security module, identity provider, secure communications channel, or blockchain node service.

Map people and segregation of duties

For every critical action, identify the primary role, alternate role, verifier, and escalation owner. Separate transaction initiation, approval, release, and reconciliation where the fund’s policy requires it. A person who can restore a signer should not automatically be able to approve and release a large transfer without an independent check.

Keep an authoritative roster with start and end dates for authority, contact methods, jurisdiction, time-zone coverage, and an out-of-band method for confirming a person’s identity. Remove leavers promptly and review the roster after reorganizations, provider changes, and changes in signing thresholds.

Eliminate single-person and single-provider bottlenecks

A continuity design fails when one person, one device, or one vendor is the only route to authorization. Test the design against realistic absences: the primary signer is unreachable, the backup signer has lost a device, the operations lead is suspected of compromise, and the custodian’s portal is unavailable at the same time.

For covered crypto-asset service providers, Commission Delegated Regulation (EU) 2025/299 Article 4 requires business-continuity plans to address adverse scenarios including unavailable staff and disruption of outsourced critical or important functions. The regulation states: “The business continuity plans shall contain procedures to address any disruptions of outsourced critical or important functions, including where those critical or important functions become unavailable.” This obligation is specific to entities and jurisdictions within the regulation; it is not a universal duty imposed on every crypto fund.

Use independent recovery participants

Choose alternates who can act without relying on the unavailable person. Independence should be meaningful: two people who share the same device, office, password manager, administrator account, or family recovery location are not two independent paths. Document how each alternate is authenticated and how the institution confirms that an emergency request is genuine.

Control provider concentration

List every external service needed to sign, verify, broadcast, reconcile, or report a transaction. For each provider, record the contractual service level, support escalation, geographic and legal entity, data-export capability, termination process, and procedure for operating if the service is unavailable. A second vendor is not automatically a usable fallback if keys cannot be migrated or the alternative does not support the required network and transaction type.

Compare custody architectures by recoverability and security

No architecture is a universal winner. Compare the design actually available to the institution using the same questions: how many independent approvals are required, how a signer or share is recovered, what happens if a provider is unavailable, how collusion or compromise is contained, which networks and operations are supported, and how recovery is evidenced for auditors and regulators.

Architecture How authorization works Availability questions Security and governance questions
Multisignature wallet Several distinct keys sign the same transaction; a threshold such as two of three or three of five is enforced by the wallet or network. Can the threshold still be met when one signer, device, or location is unavailable? Can a replacement key be added without moving funds through an unsafe interim wallet? Are keys genuinely independent? How are signer replacement, address changes, policy changes, and emergency transfers approved and logged?
MPC wallet A signing operation is produced from distributed key shares without assembling a conventional complete private key. How many shares or service components must be online? What is the recovery procedure if a share holder, coordinator, identity service, or vendor is unavailable? Who controls the technology and administrative plane? Can the institution export or recover its position if the provider fails, is compromised, or becomes legally unavailable?
Qualified or regulated custodian The custodian holds or administers keys under a contract and releases transactions according to agreed instructions and controls. What are the custodian’s outage, insolvency, disaster-recovery, withdrawal, and service-transfer procedures? Can the fund obtain timely records and move assets if the custodian is unavailable? Review segregation, audit rights, authorization evidence, insurance wording, subcontractors, governing law, and client-asset treatment rather than relying on a “regulated” label alone.
Hybrid arrangement Assets or approval paths are divided between self-custody, a custodian, and possibly separate signing technologies. Does the fallback path depend on the same identity, network, personnel, or provider as the primary path? Can operations continue if one component fails? More components can improve resilience but also create more configuration, reconciliation, and change-control failure points.

A Federal Register item published October 6, 2026, discussing proposed U.S. adviser self-custody safeguards, describes joint authorization by two or more designated persons and mentions MPC or multisignature wallets as possible approaches. It is proposed rulemaking, not a final rule and not a general requirement for every fund. Use it as an example of the policy direction under discussion, not as a substitute for advice on the law that applies to a particular entity.

Write the recovery runbook before an incident

The runbook should be usable by an alternate team under pressure. Store an operational copy where authorized responders can reach it during a wallet, network, or identity-provider outage, and protect the copy from unauthorized changes. Keep sensitive key material separate from procedural instructions unless the custody design explicitly requires otherwise.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Declare the event. The incident owner records whether the trigger is an absent person, lost or damaged device, suspected compromise, provider outage, or legal restriction. Freeze nonessential transfers while facts are established.
  2. Confirm authority. Two designated people, or the threshold required by the policy, verify the incident through independent channels. Confirm the requester’s identity, current role, and authority. Do not accept a new destination address or emergency override solely from an email or chat message.
  3. Classify the affected path. Determine whether the failure concerns a signing device, a key share, a credential, an approval person, a custodian, a communications service, a blockchain network, or several dependencies. Record what remains available.
  4. Apply the alternate authorization route. Use the preapproved alternate signer, replacement share process, or custodian escalation. Preserve the normal threshold and independent approvals unless the governing policy contains a separately approved emergency procedure.
  5. Validate the transaction. Independently check chain, asset, amount, destination, fees, contract call, nonce or UTXO selection, sanctions or screening requirements, and any dual-control limits. Use a small test transaction only when the policy permits it and the network and asset make that test meaningful.
  6. Release and monitor. Record each approval, device or service used, timestamp, transaction identifier, and person who released it. Monitor confirmation, balances, staking state, and downstream accounting.
  7. Restore the normal state. Revoke lost credentials, rotate compromised shares, replace damaged devices, remove temporary access, reconcile records, and obtain independent sign-off that the emergency condition has ended.
  8. Review and improve. Preserve evidence, identify the first failed control, and update the roster, provider contacts, recovery objective, or technical configuration. A recovery process that was never revised after a failed exercise is not a reliable control.

Define recovery objectives

Set a maximum resumption time for each critical function: viewing balances, approving a transfer, releasing a transfer, and completing reconciliation are not necessarily the same objective. Define a recovery point objective (RPO) for critical data such as transaction queues, policy versions, whitelists, and audit records: specify how much recent data the institution can afford to lose or reconstruct. The target must be achievable with the available people, backups, provider contracts, and network access.

Protect backups and policy records

Back up critical business data, configuration, approved addresses, role assignments, and audit records according to the custody policy. Keep at least one recovery copy independent of the primary office, identity system, and provider. Encrypt backups, restrict restoration rights, test that they can actually be read, and record the policy version used for each recovery event. A seed phrase or key share should never be copied into an ordinary shared drive or sent through an unverified support ticket.

Handle an unavailable hardware wallet safely

Lost or damaged device with no sign of compromise

Do not immediately import a seed into an unknown device or browser extension. Confirm whether the device is merely inaccessible, whether a duplicate approved signer exists, and whether the wallet policy supports adding a replacement key. If the recovery design requires restoring a seed, perform the operation in the controlled environment specified by the institution, with independent observation and a documented chain of custody. After restoration, verify addresses and policy settings before authorizing funds.

Device suspected stolen or tampered with

Treat the event as a potential key compromise, not a simple replacement. Suspend the affected signer, preserve forensic information, and use the preapproved threshold to move assets to a verified destination if policy and risk assessment require it. Rotate credentials and shares, remove the old signer, and review transactions and administrative logs for unauthorized activity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Signer unavailable but device is intact

Do not bypass the absent person by sharing their PIN, seed, or account. Activate the documented alternate signer or recovery authority. If the institution cannot meet its threshold without the person, the correct response may be to wait, invoke an approved emergency clause, or use a custodian’s formal escalation—not to improvise a unilateral transfer.

Plan for a custodian or technology provider outage

Ask providers for written procedures covering service unavailability, disaster recovery, key-share or account recovery, data export, client-asset segregation, incident notification, subcontractor failure, termination, and insolvency. FINMA’s January 12, 2026 announcement highlights technology-related custody risks and the need for expertise and robust technical infrastructure. It also warns that custody abroad can create complex legal issues, particularly if a custodian becomes insolvent.

Map the legal entity that actually holds or controls the assets, not merely the name on a dashboard. Determine governing law, insolvency treatment, access to records, withdrawal restrictions, and whether the fund can appoint a replacement provider. A technically elegant fallback may be unusable if the contract or local law does not permit transfer or if the new provider cannot support the fund’s assets.

Use an outage decision tree

  • Short, confirmed service interruption: pause nonessential activity, obtain the provider’s incident reference, monitor the contractual restoration target, and keep independent records of pending instructions.
  • Unclear or prolonged interruption: escalate through named executive, compliance, legal, and provider contacts; verify whether balances and transaction history remain independently observable; prepare the contractual transfer or withdrawal route.
  • Suspected provider compromise: stop new instructions, preserve logs, seek independent legal and security advice, and use the preapproved containment or migration procedure.
  • Provider insolvency or legal seizure risk: follow the jurisdiction-specific custody and insolvency plan. Do not assume that possession of a recovery phrase, API credential, or account statement establishes immediate legal control of assets.

Regulatory and oversight considerations

Requirements vary by fund legal form, adviser status, custody model, and jurisdiction. The July 14, 2025 joint statement from the Federal Reserve, FDIC, and OCC said existing risk-management principles apply to banks’ crypto-asset safekeeping activities and that the statement created no new supervisory expectations. It should not be read as a blanket approval or as a new rule for all nonbank funds.

For an entity within the scope of EU Delegated Regulation 2025/299, Article 4 calls for continuity plans that identify recovery measures and deadlines, state RPOs and maximum resumption times, arrange backups of critical business data, and provide communications procedures. Other entities may have different obligations, contractual duties, or fiduciary standards. Have counsel map the applicable requirements instead of copying a regulation designed for another category of firm.

Exercise the plan and measure what failed

Run tabletop and technical exercises using the actual roster, devices, provider contacts, and communications channels. Scenarios should include an unavailable primary signer, simultaneous loss of a device and identity provider, a custodian outage, a suspected compromise, and a network or contract-call failure. The sources cited here do not prescribe a universal exercise frequency, so set a cadence based on risk and change: exercise after major wallet, provider, personnel, jurisdiction, or policy changes and at a recurring interval approved by the governing body.

Measure elapsed time from incident declaration to verified authorization, release, confirmation, and reconciliation. Record whether the threshold was met without an undocumented bypass; whether contact details and backups worked; whether the alternate signer had the required permissions; whether provider support met its commitment; and whether audit evidence was complete. Correct the specific failure, then repeat the scenario.

Common failure modes and fixes

  • “We have a spare device.” A spare device does not supply an authorized signer, seed or share recovery, network support, or an approval record. Add those elements to the runbook and test them together.
  • One executive is the only approver. Add independent alternates and a documented threshold. Ensure alternates are not all exposed to the same location, account, or provider failure.
  • Emergency access becomes permanent. Time-limit emergency credentials, require dual approval, log every use, and revoke them during restoration.
  • Provider redundancy is assumed. Verify data portability, contract rights, network coverage, support escalation, and legal ability to move assets. A second dashboard is not a recovery path.
  • Backups exist but have never been restored. Perform a controlled restoration test and verify that policy versions, addresses, transaction history, and audit records are usable.
  • A proposed rule is treated as final law. Label the October 6, 2026 U.S. Federal Register item as proposed and obtain advice for the fund’s actual status and jurisdiction.

A practical design review checklist

  • Every covered wallet, asset, network, and critical operation has an identified owner and alternate.
  • No single person, device, location, identity provider, or outsourced service is the only authorization path.
  • Required independent approvals remain in force during recovery.
  • Replacement, rotation, revocation, and compromise procedures are written separately from ordinary transaction instructions.
  • RTOs, RPOs, restoration deadlines, communications, and escalation contacts are explicit and achievable.
  • Backups of critical data are encrypted, access-controlled, geographically independent where appropriate, and restoration-tested.
  • Custody contracts address outage, insolvency, subcontractor failure, records, migration, and governing law.
  • Exercises use real roles and realistic absences, and observed failures result in tracked corrective actions.
  • Legal, compliance, security, operations, and accounting teams agree on what constitutes an emergency transfer and who can declare one.

The most resilient arrangement is the one the institution can operate under stress without lowering its authorization standard. Design the alternate path, document it in operational detail, and prove through exercises that an absent key holder or unavailable provider creates a controlled delay or recovery event—not an irreversible loss of access.
