EU data residency is only one control. To keep European research data private on a cloud AI platform, your institution must establish a lawful purpose, minimise and classify data before upload, control every processing location and subprocessor, prohibit unauthorised model training, protect prompts and outputs, document security and transfer safeguards, and maintain a tested exit path. The institution remains accountable even when a cloud provider operates the infrastructure.

What “private” must mean for research data

Privacy is not achieved merely because a service offers an EU or EEA region. A research workload can leave that region through backups, disaster-recovery replicas, control-plane metadata, telemetry, support tickets, subcontractors or remote administration. A provider may also expose information through retained prompts, diagnostic traces, abuse monitoring or model-improvement pipelines.

For an institution, privacy therefore means being able to show, for each dataset and AI task:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • why the processing is lawful and scientifically necessary;
  • which people, organisations or other entities the data describes;
  • where raw data, derived data, logs, keys and backups are processed;
  • who can access them and under what approval;
  • that the provider cannot use them for unrelated model training;
  • how incidents, deletion and data-subject requests will be handled; and
  • how the institution can retrieve its data and models if the service is changed or terminated.

The European Data Protection Supervisor’s cloud guidance, published on 16 March 2018 for EU institutions, states that an institution remains fully responsible for its data-protection obligations when it uses cloud services and should demand a protection level equivalent to its other IT infrastructure. The same accountability principle is a sound baseline for universities, hospitals, laboratories and publicly funded research groups.

Begin with purpose, data classification and a legal basis

Do not start by choosing a model. Start by recording the research question, the intended AI operation, the retention period and the permitted outputs. The European Data Protection Board says an organisation must identify a GDPR legal basis before processing personal data. If the dataset contains health, genetic, biometric or another special category, an additional Article 9 condition and any required ethics approval must also be documented.

Make a dataset register

For every proposed upload, record the source, data subjects, fields, purpose, expected volume, retention, jurisdictions, recipients and acceptable outputs. Include intermediate files, embeddings, labels, checkpoints, evaluation sets and generated reports; they can still reveal personal or confidential information.

Classification Examples Minimum decision before cloud processing
Personal data Names, email addresses, device identifiers, coded participant records and free-text notes that identify a person Document the GDPR legal basis, purpose limitation, retention and access roles.
Special-category data Health, genetic, biometric, political, religious or similar sensitive information Document the Article 9 condition, ethics approval where applicable, necessity and additional safeguards. Do not upload merely because a model is convenient.
Confidential institutional data Unpublished results, partner information, grant material, laboratory methods and internal correspondence Check confidentiality obligations, intellectual-property terms and whether provider personnel or subprocessors can access content.
Regulated or contract-restricted data Data subject to clinical, export-control, national-security or funder rules Map the specific rule to storage, support-access and transfer requirements before selecting a service.
Non-personal research data Truly anonymised measurements, public-domain corpora and aggregated statistics Confirm that re-identification is not reasonably possible and still protect proprietary value, integrity and availability.
Derived data and models Embeddings, feature stores, fine-tuned weights, prompts, evaluation traces and generated summaries Classify according to what they can reveal. Pseudonymisation or aggregation does not automatically make derivatives non-personal.

Separate pseudonymisation from anonymisation

Remove direct identifiers and reduce fields before transmission. Aggregate where that remains scientifically valid, and keep re-identification keys in a separately governed environment. Pseudonymised data is still personal data when a person can be re-identified with reasonably available information; it therefore keeps the GDPR obligations attached to the original records. Claim anonymisation only when the identification risk has been assessed and is genuinely remote for the intended context.

Minimise data before it reaches a model

Use the smallest dataset and the narrowest fields that answer the research question. A language model that classifies adverse-event descriptions may need the clinical text and a study code, but not a participant’s name, full address or exact appointment history. A computer-vision model may need cropped, de-identified regions rather than complete documents.

  1. Define the output first. Specify the prediction, summary or statistic the model must produce and the fields needed to produce it.
  2. Remove direct identifiers. Strip names, addresses, account numbers, email addresses, faces, voice identifiers and free-text signatures where they are not necessary.
  3. Reduce precision. Generalise dates, locations, ages or rare categories when the scientific design permits it.
  4. Tokenise or pseudonymise. Replace identifiers with study-specific codes and keep the mapping key outside the cloud AI environment.
  5. Filter prompts and files. Scan for identifiers, secrets, credentials and accidental attachments before an API call or notebook upload.
  6. Limit retention. Set deletion dates for raw uploads, temporary objects, logs, checkpoints and generated files rather than relying on a default policy.
  7. Test the transformation. Measure whether the model still meets the research objective and assess whether rare combinations can re-identify participants.

Minimisation is not a one-time import step. Recheck it when the model, prompt template, feature set, research purpose or recipient changes.

Is EU data residency enough?

No. A region selector addresses one part of the data path, not the whole processing operation. Require the provider to document the locations and access routes for the following components:

Component to verify Questions for the provider Evidence to retain
Primary processing Are the selected AI endpoints, storage volumes and accelerators physically and logically restricted to the EU/EEA? Service-region terms, architecture description and account configuration export.
Backups and disaster recovery Where are replicas, snapshots and recovery images stored, and can they be forced into the same jurisdiction? Backup-location statement, retention schedule and recovery design.
Control-plane metadata Do resource names, prompts, usage records, telemetry or billing data leave the selected region? Data-flow diagram and metadata-retention terms.
Support and remote administration Can personnel in a third country view content, logs or keys? Is just-in-time access recorded and approved? Support-access policy, role model, access logs and remote-session controls.
Subprocessors Which companies process data, in which countries, for what purpose, and how will you object to a change? Current subprocessor list, notification process and objection deadline.
Government requests How are requests from authorities outside the EU handled, challenged and disclosed to the customer? Request-handling procedure, transparency commitments and legal escalation contacts.

The EU Data Act includes safeguards concerning foreign-government access to EU-held non-personal data and requires providers to publish reasonable security measures. Those provisions do not eliminate the need to assess personal-data transfers, remote access or the provider’s actual technical configuration.

Can a US-based cloud AI service process European research data?

There is no blanket rule that makes every US service unusable, nor does an EU-branded region make every service compliant. The decision depends on the data, the provider’s role, the transfer path and the safeguards that your institution can verify.

For personal data, document the GDPR legal basis and the applicable transfer mechanism or other lawful route before processing leaves the European Economic Area. Perform a transfer-risk assessment that considers the provider’s ownership, support locations, subprocessors, government-access exposure, encryption and ability to challenge requests. If those risks cannot be reduced to an acceptable level, keep the workload in an environment that your institution can govern directly or redesign it so that raw data does not leave the controlled environment.

For non-personal data, contractual confidentiality, intellectual-property, export-control and funder rules may still prohibit a particular destination. Treat those obligations separately from GDPR analysis.

Put non-negotiable terms in the data-processing agreement

A click-through privacy statement is not a substitute for a negotiated data-processing agreement (DPA) and service terms that match the research risk. The DPA should identify the institution and provider, the documented instructions, categories of data and subjects, processing purposes, duration, security measures, subprocessors and assistance duties.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Purpose limitation: prompts, training data, embeddings, logs and outputs may be processed only to provide the contracted service and documented support.
  • No unauthorised training: prohibit use of customer content to train, fine-tune or improve shared models unless the institution gives a separate, informed and revocable instruction that its governance process permits.
  • Retention and deletion: specify default and maximum retention for content, backups, logs, caches and support copies; require deletion or return at termination and provide deletion evidence.
  • Subprocessor control: require advance notice, a usable objection process and equivalent obligations for every subprocessor.
  • Access control: limit provider personnel to least-privilege, time-bound access; require confidentiality duties, approval records and audit logs.
  • Security details: state encryption in transit and at rest, key-management responsibilities, vulnerability handling, segregation and recovery objectives.
  • Incident response: define notification timing, information to be supplied, cooperation, containment and evidence preservation.
  • Audit evidence: provide current independent audit reports, certifications, penetration-test summaries or other evidence appropriate to the risk, with a path for supplementary audits.
  • Data-subject and regulator assistance: require help with access, correction, deletion, restriction, objection, breach assessment and regulator inquiries.
  • Transfer terms: identify processing countries, transfer instruments where relevant and the provider’s handling of government demands.
  • Portability and exit: commit to machine-readable export of data and relevant metadata, documented interfaces, transition support, deletion certificates and transparent switching charges.

Have the data-protection officer, research-ethics lead, information-security team and procurement counsel approve the DPA for high-risk projects. A contract that says “we do not train on your data” but permits indefinite diagnostic retention or unrestricted support access still leaves material exposure.

Build a security architecture around the data

Identity and network controls

  • Use institutional identity federation, phishing-resistant multifactor authentication and separate administrator accounts.
  • Apply least privilege to datasets, notebooks, model registries, secrets and export functions; review access at each project milestone.
  • Use private networking, service endpoints and egress controls where available. Block direct internet access from processing jobs unless it is required and monitored.
  • Separate development, evaluation and production projects so that a test prompt cannot reach the live participant dataset.

Encryption and keys

Require modern transport encryption for every client-to-service and service-to-service connection, encryption at rest for object storage, databases, disks and backups, and documented key rotation. Prefer hardware-backed protection and customer-controlled or customer-held keys when feasible. Separate duties so that a single operator cannot both approve access and retrieve protected content. Test recovery after key loss or revocation; encryption that cannot be recovered safely can become an availability failure.

Logging and monitoring

Collect immutable records of sign-ins, privilege changes, dataset reads, exports, prompt submissions, model downloads, key use and administrative support sessions. Keep security logs separate from application logs, restrict who can view them and set a retention period that supports investigations without creating an unnecessary second copy of sensitive content. Alert on bulk downloads, unusual geographies, disabled safeguards, repeated failed access and attempts to send secrets in prompts.

Protect prompts, outputs and model artefacts

AI services can retain more than the file you deliberately upload. Prompts, conversation history, tool calls, traces, error messages, token counts, embeddings and generated outputs may be recorded for abuse prevention, debugging or analytics. Before production use:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Disable provider retention and model-training reuse wherever the contract and service configuration allow it.
  2. Redact names, study codes, credentials, access tokens and rare combinations from prompts and tool results.
  3. Turn off verbose tracing and content capture in development tools unless a controlled test requires it.
  4. Classify generated text, images, embeddings and fine-tuned weights; they may contain memorised or inferable personal information.
  5. Restrict who can view evaluation conversations and prevent outputs from being copied into less-controlled collaboration tools.
  6. Scan exports for personal data and secrets before publication, sharing or transfer to another service.

Ask the provider exactly what “not used for training” covers. A commitment may apply to API content but not to prompts sent through a separate console, human support case, safety review or optional telemetry feature.

Use privacy-enhancing designs for high-risk workloads

Technical architecture can reduce exposure, but it does not replace a legal basis, a processor contract or a transfer assessment.

Bring the algorithm to the data

Run the model or analysis inside the institution’s controlled environment and export only aggregate statistics or approved predictions. This design avoids copying raw or structured records to a provider and is specifically identified as a privacy measure in the AI Act’s Recital 69.

Federated analysis

Keep records at several institutions and exchange model updates or aggregate results rather than raw rows. Define protections against reconstruction from updates, secure aggregation and a governance process for cross-site outputs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Confidential computing and secure enclaves

Use hardware-isolated execution when the provider must process sensitive data but should not be able to inspect it during execution. Verify the attestation process, supported accelerators, key release policy, patch responsibilities and what remains visible to the control plane.

Differential privacy

Add mathematically controlled noise to statistics or training outputs to reduce disclosure from individual records. Set and monitor a privacy budget, account for repeated queries and confirm that the resulting accuracy still supports the research.

Synthetic data

Generate artificial records for development, demonstrations and some testing stages. Validate that synthetic data does not reproduce rare individuals or confidential combinations and do not assume it is automatically anonymous.

The AI Act states in Recital 69 that “The right to privacy and to protection of personal data must be guaranteed throughout the entire lifecycle of the AI system.” Apply that principle to collection, labelling, training, evaluation, deployment, monitoring, updates and retirement.

Complete the governance record before production

For a high-risk project, maintain a processing record and a data-protection impact assessment (DPIA) where required. The DPIA should explain necessity, proportionality, re-identification risk, transfer exposure, bias and security controls, as well as residual risk and approval conditions. Link the assessment to ethics approvals, consent or other participant documentation, model cards, dataset provenance and human-review procedures.

Define who can approve a new purpose, add a subprocessor, change a region, enable a logging feature, download a model or release an output. Review access and provider evidence periodically rather than only at contract renewal. Run deletion tests, restore tests and incident exercises; retain the results so the institution can demonstrate that controls work in practice.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

Compare cloud AI platforms on evidence, not slogans

Use a weighted assessment that reflects the dataset and the scientific workflow. A platform with excellent accelerator availability is not a good fit if it cannot provide export or reliable support-access records.

Assessment axis What to verify Decision signal
Jurisdiction and data paths EU/EEA processing, backup and recovery locations, control-plane metadata, support access, subprocessors and government-request handling Choose only when every material path is documented and acceptable.
Contractual use limits Retention and reuse of prompts, training data, embeddings, logs and outputs; deletion and return terms Reject ambiguous training or indefinite retention language for sensitive work.
Security architecture Encryption scope, customer key options, confidential computing, identity federation, private networking, logging and incident notification Match controls to the threat model and require evidence, not marketing claims.
Compliance evidence DPA, transfer documentation where relevant, audit reports, certifications and DPIA assistance Record document versions and expiry dates; escalate gaps before approval.
Research governance Support for special-category data, ethics controls, human review, reproducibility and provenance Prefer workflows that preserve scientific traceability without exposing raw records.
Portability and lock-in Export formats, APIs, model and metadata portability, switching support, egress pricing and deletion proof Require a practical exit test using a representative workload.
Operational fit Performance, accelerator availability, quota, support service levels, cost predictability and ability to run the workload in a sovereign or on-premises environment Confirm that privacy controls do not make the study infeasible or irreproducible.

Design an exit before you upload

Portability is a privacy control: it prevents a provider from becoming the only place where sensitive datasets, labels and models can be governed. Require exports in documented, machine-readable formats for raw and transformed data, schemas, labels, prompts, evaluation sets, model weights where legally and technically possible, feature definitions, metadata, access policies and audit records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Identify every asset that must move, including object versions, databases, notebooks, container images, secrets references and model registries.
  2. Run a trial export and import into an independent environment. Compare row counts, hashes, schemas, model behaviour and provenance.
  3. Document API dependencies, proprietary operators, accelerator assumptions and any conversion loss.
  4. Set a transition window, named technical contacts and a method for securely transferring keys and credentials.
  5. Obtain a deletion certificate after validation, covering primary storage, replicas, caches, logs and support copies.

The Data Act includes switching and export support requirements. Your Europe guidance says that moving data out of a cloud service and switching are scheduled to become completely free from January 2027. Until that date, check the contract’s current egress charges, notice periods and assistance fees; do not assume the future rule removes today’s commercial or technical obstacles.

What to do when a control fails

The provider cannot confirm backup or support locations

Pause the upload, classify the uncertainty as a transfer and confidentiality risk, and request a written data-flow diagram and current subprocessor list. If the provider cannot supply them, use a different architecture or keep the data in an environment you control.

A prompt or file containing identifiers was submitted

Revoke exposed credentials, preserve relevant logs, ask the provider to delete the content and associated traces, assess whether personal data was disclosed, and involve the data-protection officer and incident team. Do not assume that deleting the visible conversation removes backups or support copies; obtain written confirmation of the scope.

The provider changes a subprocessor or region

Check the contractual notice and objection period, assess the new data path and transfer implications, and suspend affected processing if the change is unacceptable. Record the decision and update the processing register and DPIA.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Exports are incomplete or the model cannot be reproduced

Use the exit test to identify proprietary formats, missing metadata, unavailable weights or hidden preprocessing. Escalate under the portability clause, preserve a local copy of critical artefacts and redesign the pipeline so that future runs produce open, versioned outputs.

An access log shows unusual downloads

Disable the account or token, preserve immutable logs, determine which datasets and outputs were accessed, and follow the institution’s breach-assessment and notification procedure. Review whether least privilege, multifactor authentication and export controls were correctly configured.

A practical approval sequence

  1. Scope the study: define purpose, outputs, data subjects, retention and scientific necessity.
  2. Classify and minimise: remove identifiers, separate keys and document why each remaining field is needed.
  3. Complete legal and ethics review: record the GDPR basis, any Article 9 condition, transfer assessment and required approvals.
  4. Map the platform: verify processing, backups, metadata, support, subprocessors and government-request handling.
  5. Negotiate the DPA: include no-training, retention, deletion, incident, audit, transfer and exit terms.
  6. Configure safeguards: federated identity, least privilege, private networking, encryption, customer-controlled keys where feasible, logging and retention limits.
  7. Test with non-sensitive data: validate prompts, outputs, traces, exports, restore and deletion before production.
  8. Operate and review: monitor access, reassess changes, rotate keys, review provider evidence and repeat the DPIA when the purpose or model changes.
  9. Exercise exit: export a representative project, verify it elsewhere and retain the results as governance evidence.
