Yes, you may be able to change employers while an employment-based green card case is pending. The main portability route generally requires your Form I-485 adjustment application to have been pending for at least 180 days, a qualifying employment-based Form I-140 petition, and a new permanent job offer in the same or a similar occupational classification as the job in the original petition. You notify U.S. Citizenship and Immigration Services (USCIS) through Form I-485 Supplement J when the portability rules apply.

The 180-day period is measured from the I-485 receipt date, not from the I-140 filing date or the date you started looking for another job. Category, petition status, job duties, any transfer of the I-485 basis, and USCIS notices can change the analysis, so use the steps below to keep the case documented and moving without assuming that a job-title match is enough.

What the 180-day job-portability rule actually does

The American Competitiveness in the Twenty-First Century Act (AC21) portability provisions allow certain employment-based adjustment applicants to change jobs or employers without automatically abandoning the green card case. USCIS describes the route for qualifying applicants in the employment-based first, second, and third preference categories when the adjustment application has been pending for 180 days or more and the new offer is in the same or a similar occupational classification as the original job.

This is not an automatic transfer of a case to any new position. You still need to establish that the underlying petition and category qualify, that the I-485 reached the 180-day threshold, and that the new offer is permanent, bona fide, and occupationally comparable. The comparison is based on the work itself, not simply the names of the employers.

The clock starts with the I-485 receipt date

Use the “Received Date” on your I-485 receipt notice and count 180 calendar days from that date. An I-140 filing date, priority date, labor-certification date, employment start date, or the day you began a job search does not substitute for the I-485 receipt date. USCIS Form I-485 Supplement J instructions say not to file a portability Supplement J before the I-485 has been pending for at least 180 days.

The 180 days do not guarantee approval

Reaching 180 days makes a portability request potentially available; it does not decide whether the I-140 is valid, whether the new job is in a same or similar classification, or whether other adjustment requirements are satisfied. USCIS can request evidence of the continuing or new offer and can still deny an I-485 for an unrelated eligibility problem.

First, identify the petition and category supporting your I-485

Before changing jobs, write down exactly which employment-based preference category and I-140 support the pending I-485. The ordinary portability rule is not available to every employment-based applicant. USCIS policy describes it for certain applicants with approved employment-based petitions in the first, second, and third preference categories, subject to the statutory and regulatory conditions.

Checkpoint What to verify Why it matters
Employment-based category Whether the I-485 is based on an employment-based first-, second-, or third-preference classification covered by the portability provisions Category-specific rules and exclusions can change whether AC21 portability is available
I-140 status Whether the petition is approved, pending, withdrawn, or revoked The regulation permits some portability notices with a pending I-140, but later approval and additional conditions are required
I-485 receipt date The date shown on the I-485 receipt notice and the resulting 180-day date The threshold is tied to the pending I-485, not another filing or employment date
Underlying basis Whether the I-485 has been transferred to a different employment-based category USCIS policy states that a transfer can cause the portability period to be measured from the transfer request

Important category exclusions

USCIS identifies exclusions for petitions based on extraordinary ability and for national interest waivers (NIWs), because those classifications do not depend on the ordinary employer job offer and labor-certification structure. Do not assume the standard employer-portability analysis applies to either category.

NIW physicians have separate service obligations and rules governing a change of employer or self-employment. Their ability to move is determined under the physician-NIW requirements rather than by treating the case as an ordinary AC21 portability filing.

Check the I-140 before giving notice or accepting a new role

Review the petition history and every USCIS notice. An approved I-140 is the usual foundation for portability. The regulation also allows an I-140 to be pending when the applicant gives USCIS notice of a new offer after the I-485 has been pending at least 180 days, but the petition must later be approved and the regulation’s other conditions must be met. Supplement J instructions caution that USCIS must adjudicate and approve a pending I-140 before approving portability.

If the I-140 is approved

Confirm the approval notice, the classification, the employer or petitioner, and whether USCIS has issued any later notice affecting the petition. Keep the approval notice with the I-485 receipt and your job-comparison evidence.

If the I-140 is still pending

A pending petition creates additional risk. Even after 180 days, a portability notice does not remove the requirement that the I-140 ultimately be approved. If the petition is denied, the portability theory may fail. Track the petition separately from the I-485 and respond to any request for evidence or notice of intent to deny by its deadline.

If the I-140 was withdrawn or revoked

Do not rely on a general 180-day calculation alone. The effect of a withdrawal or revocation depends on the timing, the reason, and the applicable statutory and regulatory protections. Obtain the actual USCIS notice and evaluate whether the I-485 still has a valid basis before moving employers.

Compare the two jobs by duties, not by title

The new position must be in the “same or similar occupational classification.” The current regulation at 8 CFR 245.25(b) defines a similar occupational classification as an occupation that “shares essential qualities or has a marked resemblance or likeness” to the occupation for which the underlying petition was approved. “Same” is evaluated by resemblance in every relevant respect.

That means the comparison is occupational and fact-specific. A matching title, a similar salary, or employment by a company in the same industry does not by itself establish eligibility. Conversely, different titles do not automatically defeat portability when the essential work remains substantially alike.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use these comparison axes

  • Actual duties: List the principal tasks, deliverables, tools, and responsibilities in each position.
  • Essential occupational qualities: Identify the knowledge, skills, credentials, supervisory scope, and professional functions that define the work.
  • Occupational classification: Explain how both roles fit the relevant occupational field, rather than relying on an employer’s internal title.
  • Level and scope: Note material changes in seniority, people management, technical specialization, client responsibility, or work setting.
  • Evidence consistency: Make sure the new offer letter, resume, job description, and any Supplement J answers describe the same position.

Build a side-by-side job file

Keep the original petition’s labor-certification or job description, the I-140 support letter, and the new employer’s detailed offer letter. Create a comparison that quotes or summarizes the duties in both roles and identifies the shared essential qualities. Include organizational charts, project summaries, credential requirements, or other records only when they clarify the occupational relationship.

A title-only comparison is weak because employers use titles differently. The individual comparison cannot be completed without the actual descriptions of both jobs.

Use Form I-485 Supplement J at the correct time

Supplement J is the USCIS filing mechanism for confirming a continuing job offer or requesting portability to a new offer. Follow the edition and filing instructions USCIS currently specifies; the USCIS instructions identified for this topic are edition 04/01/24.

  1. Confirm the 180-day date. Calculate from the I-485 receipt date and retain the receipt notice showing the date.
  2. Confirm the case basis. Identify the I-140, preference category, and any transfer of the underlying basis.
  3. Obtain the new employer’s information. The employer should provide a bona fide, permanent offer and complete the employer portions required by the current Supplement J instructions.
  4. Describe the position accurately. Use duties and occupational information that match the signed offer and the evidence supporting the same-or-similar analysis.
  5. File in the posture USCIS permits. Do not submit a portability Supplement J before the I-485 has been pending 180 days. Use the current USCIS filing location and delivery instructions for the applicable case posture.
  6. Keep proof of delivery and copies. Retain the complete form, signatures, supporting documents, delivery confirmation, and any USCIS receipt or upload confirmation.
  7. Answer later USCIS requests. USCIS may request Supplement J or other proof that the original offer remains bona fide and available, even when you have not changed jobs.

What Supplement J does not do

Supplement J does not approve the I-485 by itself, convert an ineligible category into an eligible one, or make an unrelated job qualify. It documents the continuing or new offer so USCIS can apply the portability rules to the underlying adjustment case.

Account for a transfer of the I-485 underlying basis

Some applicants request that a pending I-485 be transferred to a different employment-based category supported by a new I-140. USCIS policy explains that, in this situation, the portability period is measured from the transfer request. The original I-485 filing date may therefore not control the portability clock for the transferred basis.

Treat a basis transfer as a material timeline change. Before relying on an earlier 180-day date, identify when the transfer was requested, which I-140 now supports the application, and whether USCIS accepted or approved the transfer. The transfer request and the new petition should be kept with the original I-485 record.

Keep the case moving during the job change

Maintain one dated case timeline

  • I-140 filing and approval dates
  • I-485 receipt date and calculated 180-day date
  • Any request to transfer the underlying basis
  • Employment start and end dates
  • Supplement J signing, delivery, and receipt dates
  • Requests for evidence, notices of intent, interviews, biometrics, and address changes

Use the dates on USCIS notices rather than memory. A timeline prevents a common error: treating the I-140 or priority-date history as the start of the 180-day portability period.

Keep the new offer genuinely available

The regulation requires the applicant and intended employer to demonstrate an intention for employment under the continuing or new offer within a reasonable period after permanent residence is granted. The offer is prospective, but it must be bona fide. Keep the signed offer, start-date communications, compensation and duties, work location, and any condition of employment that affects whether the position is real and permanent.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Report changes that affect USCIS delivery

Update USCIS when required by your case instructions, especially after moving. A missed request for evidence or interview notice can stop a case even when the portability analysis is sound. Keep copies of address-change confirmations and monitor the case record using the receipt number.

Coordinate the departure and start dates

Do not resign solely because 180 days have elapsed. First confirm the category, petition status, job comparison, and Supplement J plan. Preserve pay records and employment documentation from the original job through the transition; they may help explain the case history if USCIS asks about the continuing offer or the timing of the change.

Common mistakes and how to correct them

Counting from the wrong filing

Mistake: Counting 180 days from the I-140 filing, labor certification, priority date, or first day of employment.

Correction: Recalculate from the I-485 receipt date shown on the notice. If the I-485 basis was transferred, examine the transfer-specific rule before using the original date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Filing Supplement J too early

Mistake: Submitting a portability Supplement J before the I-485 has been pending 180 days.

Correction: Wait until the threshold is met and follow the current USCIS instructions for the filing posture. A continuing-offer request from USCIS is a different situation from a premature portability filing.

Relying on a title or salary match

Mistake: Treating “software engineer” to “software engineer,” or an unchanged salary, as conclusive.

Correction: Compare actual duties, essential occupational qualities, classification, and scope. Preserve detailed descriptions for both jobs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assuming every employment-based case qualifies

Mistake: Applying ordinary AC21 portability to an extraordinary-ability petition, an NIW, or another category with different requirements.

Ignoring a pending or damaged I-140

Mistake: Treating an I-140 that is pending, withdrawn, or revoked as equivalent to an approved petition.

Correction: Obtain the latest USCIS notice and account for the requirement that a pending petition ultimately be approved, along with any applicable conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Leaving the employer section incomplete

Mistake: Filing a Supplement J with inconsistent duties, missing signatures, or an offer that is not clearly permanent and bona fide.

Correction: Reconcile the offer letter, form answers, petition record, and supporting evidence before filing. Keep a complete copy and proof of delivery.

A practical document checklist

  • I-485 receipt notice showing the received date
  • I-140 receipt and approval notices, or current evidence of a pending petition
  • Any USCIS notice concerning withdrawal, revocation, request for evidence, or intent to deny
  • Original petition job description and supporting employment documents
  • New employer’s signed permanent job offer and detailed duties
  • Side-by-side same-or-similar occupational comparison
  • Completed and signed Form I-485 Supplement J, when the filing is permitted
  • Delivery confirmation and USCIS receipt for the Supplement J submission
  • Employment records that establish the transition dates and duties
  • Copies of address updates and all later USCIS correspondence

When an individualized review is especially important

A general rule cannot resolve a case when the category, petition history, or job descriptions are unclear. Get case-specific immigration guidance before changing jobs if the I-140 is pending or has been withdrawn or revoked, the I-485 basis was transferred, the new role is materially different, the case involves extraordinary ability or an NIW, or USCIS has issued a request for evidence, notice of intent to deny, or other adverse notice.

An attorney is not automatically required for every job change, but the consequences of an incorrect portability filing can be significant. Any consultation should be based on the actual notices, the two job descriptions, and the complete filing timeline rather than on job titles alone.
