AI can draft MedTech outreach quickly, but it does not carry responsibility for the claims, audience data, or sending process. Treat every model output as an unapproved draft. Before anyone receives it, map each objective statement to current evidence and approved product language, check the device’s actual regulatory status and intended use, review the message’s overall impression, and run channel- and jurisdiction-specific controls. The workflow below is designed for commercial, marketing, regulatory, legal, medical, and privacy teams working together.
Why AI-generated MedTech outreach becomes inaccurate or noncompliant
Generative models optimize for plausible language, not truth, authorization, or legal sufficiency. A draft can combine an old product specification with a new one, turn a limited study into a broad clinical promise, or describe a cleared component as though the entire platform had the same status. It can also create a persuasive implication without stating a plainly false sentence.
The Federal Trade Commission (FTC) states in its Health Products Compliance Guidance that advertising must be truthful and not misleading and that objective claims need an adequate basis before dissemination. The agency evaluates express and reasonably implied claims from the advertisement’s overall net impression, including wording, names, visuals, and context. As the guidance puts it: “Under FTC law, a marketer is equally responsible for the accuracy of claims suggested or reasonably implied in advertising.” AI assistance does not change that allocation of responsibility.
Accuracy is only one control. A campaign can contain supportable copy and still fail because the recipient list was not lawfully obtained, an unsubscribe was not honored, a sender identity was misleading, or a country-specific rule was ignored. The applicable requirements depend on the device, claim, recipient, channel, data source, and jurisdiction.

Start with the device, claim, and market—not the prompt
Confirm what the product is authorized to do
The U.S. Food and Drug Administration (FDA) regulates medical devices, including AI-enabled devices, under the Federal Food, Drug, and Cosmetic Act. Its risk-based approach considers intended use and technological characteristics. Relevant premarket pathways include 510(k) clearance, De Novo classification, and premarket approval; the status of a modification can also matter when it could significantly affect safety or effectiveness.
Do not compress those distinctions into a generic “FDA approved” statement. A product may be cleared rather than approved, classified through De Novo, covered only for a particular indication, or marketed with limitations that the draft omits. Use the exact status, product name, model or version, indication, population, and conditions stated in current authorized materials. If a claim concerns a component, algorithm, or workflow rather than the complete device, make that scope explicit.
Define the intended-use boundary
Write a one-sentence boundary before generation: what the device does, for whom, in what setting, using which inputs, and for which decision or workflow. Mark excluded uses and populations. A draft that says software “detects disease” may exceed a specification that only supports “assists qualified professionals by prioritizing images for review.” Intended-use language should come from the current labeling, instructions for use, cleared or approved submission, and internally approved claims library.
Classify the risk of each proposed assertion
Separate factual housekeeping from claims that could affect a clinical or purchasing decision. The following matrix gives a practical routing rule; it is an internal control, not an official agency scoring system.
| Claim category | Typical outreach wording | Evidence to attach | Minimum escalation |
|---|---|---|---|
| Product identity and features | “Exports DICOM studies” or “supports single sign-on” | Current product specification and version record | Product owner or quality reviewer |
| Performance | “Reduces review time by 20%” or an accuracy figure | Study protocol, population, endpoint, statistical result, and limitations | Clinical or medical reviewer plus regulatory review |
| Clinical outcome | “Improves diagnostic outcomes” | Direct, relevant clinical evidence supporting that exact outcome | Medical, regulatory, and legal reviewers |
| Safety | “Prevents missed findings” or “safe for all patients” | Risk analysis, adverse-event information, and approved safety language | Regulatory, clinical, and safety owners |
| Comparison | “More accurate than competing systems” | Fair, current comparative method and complete conditions | Legal and regulatory review |
| Regulatory status | “FDA approved” or “clinically validated” | Exact authorization, clearance, classification, or validation record | Regulatory affairs owner |
| Intended use | “Diagnoses” or “recommends treatment” | Current authorized intended-use statement | Regulatory and medical review |
A human-reviewed workflow for AI-assisted outreach
Use the same release process for a single email and a multi-step sequence. The model may assist with drafting, variation, or plain-language editing, but a named person owns approval and deployment.
- Set the campaign envelope. Record the product and version, purpose, audience, country or countries, channel, send date, and owner. State whether the message is prospecting, customer communication, event follow-up, or another category. Do not let the model infer these parameters.
- Prepare a controlled source set. Supply only current, approved materials: labeling, instructions for use, regulatory decision documents, validated performance summaries, approved FAQs, pricing or implementation facts that are still in force, and required disclaimers. Remove superseded drafts and mark the source version and effective date. If a fact is not in the source set, instruct the model to leave it out or flag it for review.
- Generate with explicit boundaries. Identify prohibited expansions such as diagnosis, treatment recommendations, guaranteed outcomes, unsupported superiority, or claims outside the authorized population. Require the model to preserve qualifiers, units, denominators, time periods, study conditions, and uncertainty. Ask it to return a claim list alongside the prose so reviewers can inspect assertions separately.
- Build a claim ledger. Give every objective statement an identifier and record its exact wording, source document, page or section, scope, qualification, owner, and review status. Include implications created by the subject line, call to action, images, testimonials, product name, and sequence context. A sentence can be technically true yet misleading when paired with a dominant visual or omitted limitation.
- Perform a whole-message review. A qualified reviewer should read the email as a recipient would, not merely compare individual sentences with a source. Check the net impression, implied clinical or safety promise, population and workflow assumptions, and whether the call to action suggests an unauthorized use. Review every step of a sequence together; later messages can change the meaning of an earlier one.
- Escalate high-risk claims. Route clinical outcomes, safety, comparative performance, intended use, regulatory status, evidence strength, and material limitations to the appropriate medical, clinical, regulatory, legal, or privacy owner. Human review is a recommended operational control derived from substantiation duties and transparency principles, not a regulator-prescribed sales-copy checklist.
- Run channel and data controls. Before scheduling, verify sender identity, routing fields, subject line, required disclosures, physical address, unsubscribe mechanism, suppression list, consent or other lawful basis, and the permitted use of the contact data. These checks belong in the campaign system or compliance checklist, outside the language model.
- Approve a specific version. Record the final copy, source-set version, reviewer names and roles, approval date, audience, jurisdictions, channel, model-assisted draft or prompt version, and deployment configuration. A later regeneration is a new draft and must not inherit approval automatically.
- Monitor and correct. Watch bounces, complaints, opt-outs, objections, replies that reveal misunderstanding, and any product or regulatory change. Pause the sequence when a claim, device status, or data permission changes. Apply corrections to templates and suppression lists, then document what changed and who authorized the replacement.
How to verify claims instead of trusting fluent wording
Numbers and study results
Check the numerator, denominator, population, comparator, endpoint, confidence interval or other stated uncertainty, study design, date, and version. “95% accuracy” is incomplete without the task, dataset, prevalence, and evaluation method. Preserve a qualification such as “in a retrospective evaluation of…” in the same sentence as the number. Never convert a one-time pilot result into a recurring or universal promise.

Clinical and safety language
Words such as prevents, eliminates, guarantees, safe, diagnoses, and improves outcomes carry strong implications. Replace them only when the approved evidence supports a narrower statement, and retain required limitations. A disclaimer cannot repair a headline or visual that creates a contrary overall impression.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Comparative claims
Require a defined comparator, identical test conditions, a current time frame, and a fair measure. If the evidence shows a difference on one benchmark, do not generalize it to all hospitals, users, or patient groups. Legal review should assess whether the comparison is likely to be understood as objective and whether material qualifications are prominent enough.
Regulatory-status statements
Use the exact pathway and scope: for example, a particular device’s 510(k) clearance for a specified intended use. Do not imply that an AI feature, update, accessory, or service has the same status as the complete device without documentation. FDA’s statement is useful shorthand for the boundary: “The FDA does not regulate AI as such; it regulates medical devices, including AI-enabled medical devices.”
U.S. commercial email: controls an AI sequence must pass
The FTC’s CAN-SPAM guide covers commercial email, including business-to-business messages. A model can draft text, but only the sending organization can configure and verify the email system, list, and suppression logic.
| CAN-SPAM control | Operational check before launch |
|---|---|
| Accurate header information | Confirm the From, To, Reply-To, routing domain, and technical sender fields identify the business and do not mislead. |
| Truthful subject line | Compare the subject with the message’s actual commercial purpose and offer; remove curiosity wording that implies a different topic. |
| Advertising identification | Include a clear indication that the message is an advertisement where required by the campaign’s presentation. |
| Valid physical postal address | Insert the organization’s current street address, registered post-office box, or qualifying private mailbox address. |
| Opt-out mechanism | Test that the unsubscribe route is clear, works without a login or fee, and identifies the address or addresses being suppressed. |
| Prompt suppression | Ensure opt-outs are honored within 10 business days and are propagated to every system and sequence using the address. |
| Responsibility for vendors | Document oversight of any outside email marketer; outsourcing delivery does not remove the marketer’s responsibility. |
Do not apply CAN-SPAM assumptions to calls or text messages. The cited guidance does not provide a complete analysis of the Telephone Consumer Protection Act, state telemarketing rules, or SMS requirements. Treat those channels as separate legal workstreams and obtain current jurisdiction-specific review.

EU contact data and direct marketing
For European campaigns, first establish where the contact data came from and whether the source can demonstrate lawful collection under the General Data Protection Regulation (GDPR) and permission to use the data for advertising. A purchased or third-party list is not made lawful merely because it contains professional addresses.

Email direct marketing also has to comply with ePrivacy rules as implemented in the relevant member state. The practical controls are:
- Record the data source, collection notice, lawful basis, permitted purpose, and any restrictions attached to the list.
- Check whether the recipient has objected to direct marketing. Once a person objects, do not continue using that data for direct marketing.
- Make the identity of the sender and the commercial purpose understandable, and provide the required objection or unsubscribe path.
- Apply suppression across CRM, marketing-automation, event, enrichment, and agency systems before every send.
- Have privacy counsel confirm the member-state implementation and campaign facts; a generic “EU compliant” label is not a legal analysis.
When EU AI Act transparency may matter
Article 50 transparency obligations are scheduled to apply from 2 August 2026. The European Commission’s explanation covers marking and detection of AI-generated content, including certain deepfakes and some AI-generated text of public interest. It does not establish that every ordinary one-to-one sales email must carry an AI-origin label.
Therefore, do not add a blanket statement that EU law always requires disclosure of AI assistance in sales outreach. Instead, describe the actual use, audience, content, and deployment, then check the current AI Act guidance and any applicable code or national implementation. The Commission describes the code of practice as voluntary while the underlying Article 50 transparency obligations are legal requirements. If a campaign approaches a covered category, obtain a documented legal determination and implement the required marking or disclosure in the channel where recipients will see it.

Data governance and model controls
Contact records and clinical details require different protections. Minimize what enters the model, exclude patient-identifying or unnecessary sensitive information, and use an approved environment with access controls, retention limits, and logging. Keep a record of which source set was used, but do not retain more personal data than the campaign purpose requires.
Define who may prompt the system, who may export drafts, and who may change approved templates. Test that an opt-out or objection is honored even when a model proposes a follow-up. If a model is connected to a CRM, prevent it from selecting recipients or changing suppression status without deterministic rules and human authorization. A language model should not be the system of record for consent, regulatory status, or claim approval.
Records that make approval auditable
As an operational practice, retain a compact evidence package for each campaign:

“The model cited a study, so the claim is approved.”
Why it fails: The citation may be fabricated, outdated, mismatched to the product, or unable to support the wording. Fix: Require a human to open the authoritative study or approved summary, verify population and endpoint, and enter the exact supported language in the claim ledger.
“Our disclaimer says results vary.”
Why it fails: A small disclaimer does not neutralize a dominant promise of guaranteed clinical or safety results. Fix: Rewrite the headline, body, visual, and call to action so the overall impression is accurate, then retain only qualifications that the evidence requires.
“FDA approved” is easier for prospects to understand.
Why it fails: It can misstate a 510(k) clearance, De Novo classification, limited indication, or the status of a feature. Fix: Use the product’s exact authorized status and scope, with regulatory review for every change.
“Business addresses do not need email opt-outs.”
Why it fails: CAN-SPAM covers commercial business-to-business email. Fix: Apply the same header, subject, advertising-identification, postal-address, unsubscribe, and suppression controls to B2B sequences.
“A purchased European list is fine because the vendor collected it.”
Why it fails: You must be able to establish lawful collection and permitted advertising use, and you must stop direct marketing after an objection. Fix: obtain provenance and contractual assurances, validate the campaign’s legal basis and ePrivacy conditions, and synchronize suppression before sending.

“Every AI-written email must carry an EU AI label.”
Why it fails: Article 50’s described categories do not automatically cover every ordinary sales email. Fix: assess the actual content and use against current guidance instead of applying a blanket rule.
How to evaluate workflow software or outside support
No tool can make a campaign legally compliant by itself. Compare an internal process, agency, or software category against the controls that remain under your organization’s ownership:
| Decision axis | Questions to ask |
|---|---|
| Jurisdiction and channel | Can the process separate U.S. email from EU email, and email from phone or SMS, with country-specific rules and suppression? |
| Claim risk | Does it route clinical, safety, comparative, intended-use, and regulatory-status assertions to qualified reviewers? |
| Evidence traceability | Can every objective claim link to current substantiation, approved wording, scope, and qualification? |
| Human accountability | Is there a named approver, documented escalation rule, and immutable approval record? |
| Data governance | Can it record list provenance, lawful-use restrictions, objections, opt-outs, retention, and access? |
| Change management | Can you distinguish an approved version from a regenerated draft and identify what changed before reuse? |
Ask vendors to describe controls and evidence, but do not imply that a product is regulator-approved or legally compliant merely because it offers a review, consent, or email feature. Your organization still owns the claims and deployment decisions.

Before scheduling, the campaign owner should be able to answer “yes” to each applicable item:
- The audience, country, channel, purpose, product, and version are documented.
- Every objective claim has current evidence or approved wording with scope and qualifications.
- The whole message, including subject, visuals, sequence context, and call to action, has been reviewed for implied claims.
- Clinical, safety, comparative, intended-use, evidence-strength, and regulatory-status claims have reached the right specialist reviewers.
- The product’s exact FDA or other market status is stated accurately and is not generalized from a different feature or device.
- U.S. commercial-email controls are configured where applicable, including the 10-business-day opt-out requirement.
- European data provenance, advertising permission, objection handling, and member-state ePrivacy conditions are addressed where applicable.
- Any potential AI Act Article 50 use case has been assessed against current guidance rather than a blanket labeling assumption.
- Suppression lists, objections, sender fields, postal address, links, dates, numbers, and campaign settings have been tested outside the model.
- The approved copy, source set, reviewers, dates, model-assisted draft, deployment, and later changes are retained.
That gate turns AI from an unsupervised author into a controlled drafting aid. It also gives commercial teams a defensible explanation of what was claimed, why it was supportable, who approved it, and which recipients were permitted to receive it.
