The advertiser—not the AI tool—remains responsible for every claim an ad communicates. To keep AI-generated copy within regulated claims, review the complete ad for express and implied messages, document evidence for each objective claim before publication, test whether omissions or qualifiers change the overall takeaway, verify disclosures and endorsements, and obtain specialist review for health, safety, financial, or other high-risk claims.
This workflow uses the U.S. Federal Trade Commission (FTC) standard as its core. The European Union’s AI Act adds a separate, date-sensitive transparency question for certain AI-generated or manipulated content; labeling AI involvement does not make an inaccurate product claim lawful.
What “within regulated claims” means
AI-generated advertising is judged by the message a reasonable consumer is likely to take from the finished ad, not by the prompt, the model’s intent, or the marketer’s preferred interpretation. The FTC evaluates the full context: words, phrases, images, layout, landing-page content, material omissions, and whether a representation could affect a consumer’s decision.
The FTC’s Advertising and Marketing guidance states: “Under the law, claims in advertisements must be truthful, cannot be deceptive or unfair, and must be evidence-based.” Its small-business guidance adds: “Under the law, advertisers must have proof to back up express and implied claims that consumers take from an ad.” Those are responsibilities of the advertiser even when a model drafted the headline, selected an image, or supplied a citation.

Express claims
An express claim says something directly. Examples include “reduces delivery time by 30%,” “works for every skin type,” “the safest option,” “carbon-neutral shipping,” or “customers save $50 a month.” A claim can be express even when it is phrased as a slogan or placed in a graphic rather than the body copy.
Implied claims
An implied claim is a reasonable takeaway created by the combination of language, imagery, context, and omissions. A photograph of a person running after using a supplement may imply improved athletic performance even if the text only says “feel your best.” A “doctor recommended” badge may imply broad medical endorsement. A comparison chart may imply that every competing product performs worse, even if the ad names no competitor.
Why fluent AI copy is not evidence
A model can produce confident prose, realistic statistics, plausible study names, or a working-looking URL without establishing that the underlying fact is true, current, applicable to the product, or permitted for advertising. Treat generated citations as unverified leads. Evidence must come from records you can inspect and retain before the ad is disseminated.

The following gates turn the legal standard into an editorial process. It is an internal control, not a regulator-approved checklist or safe harbor. Particular ads remain fact-dependent, and sector or state rules may impose additional requirements.
| Gate | Question | Required output |
|---|---|---|
| 1. Complete-ad review | What will a consumer actually see and where will the click lead? | Frozen copy, creative, placement, landing page, and material qualifiers |
| 2. Claim inventory | Which express statements and implied takeaways are objective or material? | Numbered claim register with risk level and owner |
| 3. Evidence check | Is competent support available for every objective claim before release? | Evidence record tied to each claim, product version, market, and date |
| 4. Context and omissions | Would a reasonable consumer be misled by missing limits or ambiguous wording? | Qualifier and layout review, including mobile presentation |
| 5. Disclosure and endorsement review | Are opinions genuine, and are material connections clear and conspicuous? | Approved disclosure text and substantiated endorser statement |
| 6. Specialist and jurisdiction review | Do health, safety, financial, children’s, political, or cross-border rules apply? | Documented escalation and market-specific approval |
Step 1: Freeze and inspect the complete ad
Do not review an isolated AI paragraph. Assemble the version that could actually be published:
- Headline, primary text, calls to action, footnotes, captions, alt text, and URL display text
- Images, video, audio, charts, badges, product demonstrations, and before-and-after visuals
- Landing page, checkout flow, terms linked from the ad, and any pop-up or post-click disclosure
- Placement, audience, device, language, country, and whether the ad is organic, paid, affiliate, or influencer content
- Any generated testimonial, review, expert quotation, or “customer” story
Save a timestamped copy. A qualifier that is visible on a desktop landing page may be hidden below the fold on a mobile ad; a disclosure in a separate terms page may not cure a misleading headline. Review the composition as a consumer would encounter it, in sequence and at the intended size.

Step 2: Build a claim inventory
Read the ad once for its overall impression, then mark every statement or visual that could be understood as a factual representation. Record the likely consumer takeaway rather than only the literal words.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minute| Claim category | Typical AI-generated wording | Review question |
|---|---|---|
| Performance or outcome | “Cuts processing time in half” | What test, population, baseline, and conditions support the number? |
| Comparative | “The leading low-cost option” | Compared with which products, market, period, and metric? |
| Price or savings | “Save $200 every year” | Is the reference price real, available to the advertised audience, and calculated with all mandatory costs? |
| Environmental | “Zero-impact delivery” | What activity and scope does the statement cover, and what limitations must be disclosed? |
| Health or safety | “Prevents seasonal illness” | What scientific evidence and specialized rules apply before dissemination? |
| Social proof or authority | “Recommended by professionals” | Who recommends it, what did they evaluate, and is the representation genuine? |
| Visual or omission-based | Unqualified before-and-after image | What result, typicality, or condition would a reasonable viewer infer? |
Separate objective claims from obvious puffery, but do not assume a phrase is puffery merely because it sounds promotional. “Best,” “safe,” “clean,” “proven,” and “works” can communicate measurable or safety-related messages in context. Flag a statement when a reasonable consumer could rely on it in deciding whether to buy.
Step 3: Tie every objective claim to evidence before publication
For each numbered claim, create an evidence entry that another reviewer can retrieve and understand. At minimum, record:
- The exact wording, visual, or implied takeaway being supported
- The source document, study, test, dataset, certification, or business record
- Who produced the evidence, when, and under what method or conditions
- The product version, market, sample or population, comparison, and time period covered
- Any limitation that changes how a reasonable consumer should interpret the claim
- The person who verified that the evidence actually supports the ad’s wording
Evidence must exist before dissemination. Do not publish while waiting for a study, plan to “add the source later,” or rely on the model’s confidence. A citation that cannot be opened, does not measure the advertised product, or supports a narrower proposition is not substantiation.
Match wording to what the evidence establishes
If a test shows an average result under controlled conditions, do not turn it into an unconditional promise for every customer. If a study concerns an ingredient, do not automatically claim that the finished product produces the same outcome. If the evidence is limited to one country, device, plan, or date range, carry that limitation into the copy or change the claim.

Store the approved ad, evidence files, review notes, model output, edits, and final sign-off together. Version control matters when a later model revision changes a number, a landing page removes a qualifier, or a product formulation changes. The record should show what was known and approved when the ad ran.

Step 4: Test the overall impression and missing qualifiers
A disclaimer does not automatically cure an unsupported headline or a deceptive overall impression. Ask what a reasonable consumer would believe after seeing the ad quickly, then check whether the evidence and qualifications support that belief.
Use an omission test
- Write the likely takeaway in plain language, without repeating the advertiser’s preferred wording.
- List facts a consumer would need to avoid being misled: eligibility, duration, dosage, exclusions, required equipment, recurring fees, typicality, or material risks.
- Check where each qualification appears, how prominent it is, and whether it is understandable in the ad’s medium.
- Read the headline, image, and call to action without the footnote. If that combination creates a stronger promise than the qualified text, rewrite the claim or the creative.
- Repeat the check on a phone and at the actual ad size, including captions and video frames.
Do not bury a material limitation in a separate page, use technical language that the audience cannot reasonably understand, or present a dramatic result while qualifying it only in small type. The relevant question is the net impression, not whether a technically accurate sentence appears somewhere in the campaign.
Step 5: Review disclosures and endorsements
FTC endorsement guidance says endorsements must be honest and not misleading, and an endorser cannot be used to make a claim the marketer could not legally make. If an endorser has a material connection that consumers would not reasonably expect and that could affect how they evaluate the endorsement, disclose it clearly and conspicuously. FTC online advertising resources direct advertisers to its .com Disclosures guidance for effective online disclosures.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteCheck the depicted experience
For an AI-assisted testimonial, verify that the person exists, used the product as represented, had the stated experience, and is authorized to be depicted. Do not fabricate a human testimonial or imply product use that has not been established. A model-generated first-person sentence is not proof of a customer experience.
Check the claim behind the opinion
“I love it” may be an opinion, but “it eliminated my pain,” “it paid for itself,” or “it is safer than other treatments” conveys objective or health-related claims. Those claims need the same substantiation as marketer-written copy. An influencer’s personal story cannot extend the advertiser’s lawful claim set.
Make material-connection disclosures conspicuous
Place the disclosure where the endorsement appears, use wording ordinary consumers understand, and ensure it remains visible in the format being used. A disclosure that appears only after a “more” expansion, in a profile biography, or on a separate linked page may not be adequate for the specific post. Check the complete user experience, including video, livestream, audio, and mobile views.

Step 6: Escalate health, safety, and other specialized claims
The FTC Health Products Compliance Guidance states: “Before disseminating an ad, advertisers must have adequate substantiation for all objective product claims conveyed, expressly or by implication, to consumers acting reasonably.” It explains that the needed substantiation depends on the product and claim, and that health-benefit or safety claims generally call for competent and reliable scientific evidence.
Route the following to qualified subject-matter and legal reviewers before release:
- Claims about diagnosing, treating, curing, preventing, or reducing a disease or symptom
- Safety, toxicity, side-effect, or “risk-free” representations
- Medical devices, supplements, food, cosmetics, personal care, and children’s products
- Financial returns, credit, insurance, employment, housing, education, alcohol, gambling, or political advertising
- Environmental, accessibility, privacy, security, or regulated-profession claims that depend on technical standards
Do not assume that a “results may vary” or “not medical advice” statement fixes a stronger unsupported promise. The required evidence and disclosures depend on the claim, product, audience, medium, and applicable specialized rules.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Step 7: Add a separate jurisdiction check
The FTC materials describe the U.S. framework. They do not replace state, federal-sector, or foreign requirements. Before approving a campaign, identify the audience’s country, the seller’s role, the product category, and the media channel. A U.S. review may be necessary but insufficient for a campaign shown elsewhere.
EU AI Act transparency is a separate question
The European Commission published guidelines on transparency obligations for providers and deployers of AI systems on 20 July 2026. The Commission says the Article 50 transparency obligations apply from 2 August 2026. The AI Act Service Desk summary describes duties for certain AI-generated or manipulated content and points to the underlying Article 50 text.
Application depends on the organization’s role, the type of content, how it is presented, and applicable exceptions. Therefore, do not state a categorical rule that every AI-written advertisement must carry the same label. Check the current Article 50 provisions and Commission guidance for the specific system, content, deployment, and audience.

| Question | U.S. advertising review | EU AI transparency review |
|---|---|---|
| Primary issue | Whether the ad’s claims are truthful, non-deceptive, fair, and substantiated | Whether applicable AI-generated or manipulated-content transparency duties are met |
| When to check | Before the ad is disseminated | For applicable deployments, with Article 50 duties applying from 2 August 2026 |
| What labeling does | Disclosure may address a material connection or other context, but does not prove a product claim | Transparency about AI content does not establish that a product claim is accurate |
| Decision basis | Consumer takeaway, evidence, context, omissions, and specialized rules | Provider/deployer role, content type, presentation, and statutory exceptions |
Run these checks in parallel. An ad can satisfy an AI-transparency obligation and still make a deceptive or unsupported performance, health, or safety claim.
Controls for AI-assisted drafting teams
Constrain the prompt without treating it as compliance
Give the model approved product facts, prohibited claims, audience limits, required qualifiers, and a direction to mark unknowns instead of inventing numbers. This reduces avoidable errors, but it is only a drafting control. The final ad still requires human claim and evidence review.
Require a claim-and-source handoff
Ask the drafting workflow to output a claim list separately from prose. For every factual statement, require a source identifier supplied by the team—not a citation invented by the model. A reviewer can then approve, narrow, or delete the statement before it enters creative production.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Use independent review for high-risk copy
The person who wants a bold claim should not be the only person deciding that its evidence is sufficient. Assign a second reviewer for objective claims and specialist counsel for regulated categories. Record unresolved questions rather than allowing a deadline to convert uncertainty into publication.
Common failure modes and fixes
| Failure | Why it fails | Better control |
|---|---|---|
| Publishing a model-generated statistic because it sounds precise | Precision and fluency do not establish an underlying measurement | Require a retrievable source and verify its scope before use |
| Reviewing only the text box | Images, layout, landing pages, and omissions can create additional claims | Freeze and inspect the complete consumer experience |
| Adding a tiny disclaimer to a sweeping headline | The net impression may remain misleading | Rewrite the headline or make the material limitation prominent in context |
| Using an invented testimonial | It misrepresents a person’s experience and may convey unsupported results | Use only a verified, authorized experience or remove the testimonial |
| Assuming an AI label solves claim risk | Transparency about production is different from substantiation of the product claim | Complete claim, disclosure, and jurisdiction reviews separately |
| Applying a U.S. checklist worldwide | National and sector regimes differ | Identify each market and obtain local specialist advice where needed |
Final release checklist
- The approved reviewer has seen the headline, body, creative, placement, landing page, and qualifiers together.
- Every express and material implied claim is listed in a claim register.
- Evidence for each objective claim existed before dissemination and matches the exact wording, product, market, and conditions.
- Model-generated citations, statistics, studies, testimonials, and quotations were independently verified or removed.
- Material limitations are understandable and prominent in the same consumer context as the claim.
- Endorsements reflect genuine experiences, and material connections are clearly and conspicuously disclosed.
- Health, safety, and other specialized claims received the required subject-matter and legal review.
- The campaign’s countries, audience, sector, and channel were identified, with additional local checks documented.
- For relevant EU deployments after 2 August 2026, Article 50 transparency requirements were assessed separately using current Commission guidance.
- The final ad, evidence, approvals, disclosures, and version history are retained together.
This process reduces preventable risk, but it is not a universal safe harbor. FTC endorsement staff guidance expressly cautions that it does not provide a safe harbor, and outcomes depend on the facts. When a claim could materially affect a consumer’s health, safety, finances, or legal rights, pause publication until qualified counsel and the appropriate subject-matter reviewer resolve it.
