Investigate a suspected data breach as a verified incident, not as a story: activate a response team, contain further loss without destroying evidence, preserve volatile records, build a fact-based timeline, identify the data and people affected, and then make remediation and notification decisions with qualified legal advice. An alert is a lead to test. It does not, by itself, prove that a breach occurred or that anyone stole or misused information.
What to do first when a breach is suspected
The first objective is controlled fact-finding. CISA’s federal incident-response playbook describes detection and analysis as determining whether an incident occurred and establishing its type, extent and magnitude. Use that principle even if you are not a federal agency, while avoiding agency-specific reporting instructions that do not apply to your organization.
1. Activate the response team and open an incident record
Mobilize the people needed for the particular event. Depending on the facts, that may include security, IT, operations, forensics, legal counsel, communications, human resources, management, an insurer and a relevant service provider. Assign one incident lead and one person responsible for maintaining the record.

- When and how the suspicion surfaced.
- Who reported it and what that person directly observed.
- Named systems, accounts, devices, applications or providers.
- Changes already made, such as password resets, blocked addresses, deleted accounts or rebuilt machines.
- Facts that are confirmed, facts that are only allegations and questions still unanswered.
Interview the discoverer and other people who may know what happened. Route customer or employee reports to a documented channel so that relevant details are not scattered across informal conversations.
2. Contain additional loss while preserving evidence
Secure affected physical areas and take proportionate steps to stop ongoing exposure. The Federal Trade Commission advises taking affected equipment offline but cautions against turning machines off before forensic experts arrive. That is general business guidance, not a universal command for every technical situation. Follow your incident plan and qualified responders’ direction where safety, cloud architecture, service continuity or an active adversary changes the appropriate action.
Containment can include isolating a host, disabling a compromised account, blocking a malicious session, restricting a database route or removing improperly exposed personal information from a public location. If information was posted publicly, remove the post and check for copies, mirrors and cached versions. Record every containment action, its time, its operator and the reason for it.
Do not casually reimage, wipe, reboot or power down a potentially important device. A quick cleanup can remove memory-resident malware, active sessions, timestamps and other facts needed to determine what happened.
Preserve the evidence an investigation will need
Preservation is both a technical and documentation task. The FTC’s concise warning is: “Don’t destroy any forensic evidence in the course of your investigation and remediation.” Collect from sources that exist in your environment, and prioritize records likely to expire or be overwritten.
Collect logs and system records
Potentially useful sources include:
- Perimeter, firewall, VPN and network telemetry.
- Endpoint, server and operating-system logs.
- Identity, authentication, privilege and access records.
- Audit and transaction logs.
- Intrusion-detection records and connection data.
- Cloud control-plane, storage, application and provider logs.
- User-activity records and relevant email or collaboration-system events.
- Backups and other preserved copies that can establish earlier system state.
CISA’s playbook lists audit, transaction, intrusion, connection, system-performance and user-activity logs among the records that can support verification and investigation. Make a copy in a controlled location before normal retention processes overwrite it. Preserve the original where your tooling permits, and record the method used to export or image each source.

Prioritize volatile evidence
Short-retention data can disappear while the team is debating what to do. CISA’s ransomware guidance highlights system memory, security logs and firewall buffers as examples of evidence that may be lost quickly, and discusses memory capture and device imaging where appropriate. Those examples are ransomware-focused; apply them according to the incident and your response plan rather than treating them as mandatory steps for every event.
For endpoint forensic analysis, responders may capture memory and disk images from representative or affected devices. Imaging should be performed by people who understand the tools, write-blocking or equivalent safeguards, hashing and secure storage. If you lack that capability, obtain specialist help before making changes that could alter the evidence.
Maintain an evidence register
For every item, record an identifier, source, collection time and time zone, collector, collection method, storage location, access restrictions and any transfer or analysis performed. Note the system clock condition if it is relevant, and preserve the original timestamps alongside normalized timeline values. Keep a decision log showing why evidence was collected, why a system was isolated or left online, and who approved each action.
NIST SP 800-86 provides practical computer and network forensics guidance covering files, operating systems, network traffic and applications. NIST describes it as IT-oriented guidance, not an all-inclusive investigation procedure or legal advice. Consult management and legal counsel about the laws and regulations that apply to your situation.
Build a timeline and test competing explanations
A timeline separates observed facts from hypotheses. Start with reliable time sources and document differences between device, application, cloud and log timestamps. Place alerts, logins, privilege changes, configuration changes, data access, exports, containment actions and recovery work on the same timeline.

For each important conclusion, write:
- Observed: the record or witness account that directly shows an event.
- Inferred: the explanation that best fits several observations.
- Unresolved: what the available evidence cannot establish.
Correlate records across systems and compare suspicious behavior with normal baselines. CISA specifically notes the need to deconflict suspicious activity with authorized work, such as legitimate administrator actions. Check change tickets, maintenance windows, automation accounts and provider activity before labeling an event malicious.

Use interviews as corroboration
Ask the discoverer what was seen, when it was seen, which systems or data appeared involved and what changed afterward. Ask administrators and providers who had access during the relevant window, whether credentials were shared or reset, and what actions they performed. Interviews can reveal missing systems or retention gaps, but technical records should corroborate the account whenever possible.
Identify the access path
Map the likely route from the initial account, device or exposed service to each affected asset. Identify credentials, privileges, trust relationships, segmentation boundaries, remote access paths and service-provider connections. Record alternate explanations when the evidence does not distinguish between them.
Determine what data and people may be affected
Do not stop at the first compromised host. The central scope questions are what information was reachable, during which period, by whom and through which systems.
Classify the event precisely
Your report should distinguish:
- Exposure: information was reachable by an unauthorized party or placed where unauthorized parties could reach it.
- Access or acquisition: records show that an unauthorized party accessed or obtained the information.
- Disclosure: information was sent or made available to another party.
- Confirmed misuse: evidence shows use such as fraud, extortion or account takeover.
Evidence may establish exposure without proving that an attacker viewed or used every record. State the strongest conclusion the evidence supports and identify the remainder as unconfirmed.
Answer the FTC’s core scope questions
Review whether encryption was enabled and effective when the event occurred, what types of information were involved, approximately how many people may be affected, who could access the data then and who can access it now. Determine whether a service provider could reach the information and obtain evidence of that provider’s activity and remediation rather than relying only on an assurance.
Use database access logs, object-storage events, query history, download records, email logs, endpoint artifacts and backup inventories to identify the affected population. Reconcile technical counts with business records, and explain sampling or estimation methods when a precise count is not possible.

Check current access, not only historical access
Remove permissions that are no longer needed, rotate exposed credentials and review service accounts, tokens, keys and provider integrations. Preserve the evidence of the old permissions before changing them where practical, then record the new state and the approval for each change.

Decide whether internal capability is sufficient
An internal investigation can work when the organization has skilled responders, reliable logs, independence from the affected system owners and enough time to preserve evidence. Outside incident-response or digital-forensics expertise is prudent when volatile evidence may disappear, the environment is large or technically complex, the suspected actor is still active, independence is important, or the organization must coordinate with counsel, law enforcement, insurers and providers.
| Decision factor | Questions to ask |
|---|---|
| Forensic skill and independence | Can the team capture and analyze evidence defensibly, and can it challenge assumptions made by system owners? |
| Scale and complexity | How many endpoints, identities, cloud services, applications and providers must be correlated? |
| Volatile evidence | Could memory, short-retention logs or firewall buffers disappear before qualified collection? |
| Documentation | Can the organization maintain an evidence register, chain of custody and decision log? |
| Coordination | Must the investigation align with counsel, law enforcement, an insurer or a provider? |
| Operational urgency | Is the adversary active, is sensitive information still exposed, or must critical services remain available? |
The FTC says organizations may consider independent forensic investigators to identify source and scope, capture forensic images, collect and analyze evidence and outline remediation. It also advises consulting legal counsel, including outside counsel with privacy and data-security expertise where appropriate.
Remediate the weakness that enabled the incident
Use the findings, not assumptions, to drive corrective work. Address the exploited vulnerability, compromised credentials, excessive privileges, missing segmentation, unsafe provider connection or inadequate monitoring identified by the investigation.
- Fix or disable the vulnerable service and verify the fix.
- Reset credentials, revoke tokens and keys, and review multifactor-authentication coverage where compromise is possible.
- Reduce privileges and remove dormant accounts.
- Segment systems so a compromised account or host cannot reach unrelated sensitive data.
- Review service-provider permissions, logging and contractual incident obligations.
- Improve retention and alerting for the records needed to investigate a recurrence.
- Track each remediation item to an owner, deadline, validation result and residual risk.
Ask an independent responder to map each recommendation to the evidence that supports it. A remediation action that cannot be tested is not a completed fix.
Communicate carefully and decide on notification
Prepare separate messages for employees, customers, regulators, providers, insurers and law enforcement as applicable. Explain what is known, what remains under investigation, what protective steps people should take and how to obtain updates. Avoid claiming that data was stolen, viewed or misused unless the evidence supports that statement. Do not publish technical details that could enable further attacks or expose additional personal information.

Coordinate proposed wording with counsel and, where appropriate, law enforcement. Notification duties depend on jurisdiction, data type, organization, sector and incident facts. The FTC provides U.S. business-oriented guidance, while the Information Commissioner’s Office addresses UK personal-data breach management. Neither source supplies a universal deadline for every organization. Have counsel or the relevant regulator confirm the current rule that applies to your specific situation.

Common investigation mistakes and their fixes
Destroying evidence during cleanup
Rebooting, wiping or rebuilding first can erase the facts needed to identify the access path. Isolate proportionately, preserve volatile evidence and involve qualified responders before destructive changes.
Treating an alert as proof
An alert can be a false positive, authorized activity or evidence of a smaller event than initially feared. Correlate records, test competing explanations and label conclusions according to their evidentiary strength.
Looking only at the first device
An endpoint may be a symptom rather than the entry point. Trace identities, privileges, network paths, cloud services, backups and providers across the relevant time window.
Accepting an unsupported provider assurance
Request logs, access history, containment actions and remediation evidence. Record what the provider can establish and what remains unverified.
Confusing exposure with confirmed misuse
Report access, acquisition, disclosure and misuse as separate findings. This avoids both under-reporting a serious exposure and making a claim the evidence cannot support.
Applying the wrong reporting rule
CISA’s federal instructions, FTC guidance and ICO guidance serve different audiences and jurisdictions. Do not infer a universal reporting destination or deadline from one source. Obtain advice for the organization, location, data and facts involved.
