Surplus government property is not simply anything old or left unused. In the U.S. federal system, an agency first determines that it no longer needs personal property, reports it for federal screening as excess, and only after the General Services Administration (GSA) finds no federal requirement does it become surplus. It can then move to donation, public sale, or an authorized final-disposition method.

The correct path starts with two questions: who holds title, and is the asset personal property or real property? Federal executive-agency procedures cover items such as equipment, vehicles, furniture, and machinery. Land and buildings follow a different GSA process. State, county, city, school-district, and other local assets are governed by the owning jurisdiction’s rules, which vary by location and asset type.

This guide explains how an agency or prospective recipient can identify the responsible authority, follow the federal sequence, use the right forms and systems, and avoid taking, transferring, selling, or destroying property without authorization.

What “excess” and “surplus” mean

Federal terminology describes stages in a controlled process rather than the physical condition of an item.

Stage What it means What normally happens next
Internal need ends An agency activity no longer needs the property. The agency should offer it to another activity within the same agency.
Excess The property is not required by the holding agency and is reported for federal screening. GSA makes the report available so other federal agencies can request the asset.
Surplus GSA determines that no federal requirement exists. Eligible organizations may seek donation; unselected items may be sold or sent through an authorized final-disposition route.

Federal executive agencies are legally required to report excess personal property to GSA for screening and disposal, according to the U.S. General Services Administration. An item therefore does not become available to the public merely because it is parked, stored, or visibly unused.

Identify the owner and the type of property

Confirm who holds title

Begin with the property record, not the item’s location. A government contractor, cooperative, or project grantee may physically hold an asset while the federal government retains title. The owning agency’s property officer or authorized custodian controls reporting and release. A member of the public has no disposal authority and should not remove an item from a government site without written authorization.

For nonfederal assets, contact the relevant state, county, city, school district, transit authority, or other public body. Ask for its property-control, surplus, procurement, or auction office. Federal guidance does not establish one universal state or local procedure.

Classify personal versus real property

Personal property is a physical item other than land or an interest in real estate. Federal examples include office furniture, computers and other equipment, vehicles, aircraft, vessels, animals, scientific instruments, and heavy machinery. Federal records are excluded from the ordinary federal surplus-personal-property donation category. Land and buildings are real property and use a separate process.

Flag categories needing specialist review

Before describing or moving an asset, check for rules involving aircraft, vessels, firearms, animals, hazardous materials, weapons, export controls, privacy, data security, environmental obligations, and title documentation. These categories can require special forms, handling, screening, or recipients. An agency property officer should identify the applicable specialist before listing or transferring the item.

Build an identification file

  • Record the owning agency, accountable organization, property number, serial or vehicle identification number, and title status.
  • Describe the make, model, quantity, dimensions, accessories, operating condition, and known defects without overstating capability.
  • Document the exact location, custodian, access requirements, and whether the asset is installed or attached to a facility.
  • Note maintenance records, contamination or hazardous-material information, data-storage devices, and any legal or program restrictions.
  • Take clear photographs of the whole item, identification plates, damage, included components, and loading area. GSA’s resource materials direct custodians to reporting checklists and photo guidance; accurate descriptions help agencies screen the item and help recipients judge whether they can use it.

Federal personal-property disposal: the complete sequence

1. Offer the asset for reuse inside the agency

When one activity no longer needs an item, federal regulation directs the agency to offer it elsewhere within that agency first. Agencies must, to the maximum extent practicable, satisfy requirements by using existing assets or obtaining excess property from another federal agency before buying new property. Internal reuse can preserve mission capability and avoid the costs and restrictions associated with an external transfer.

2. Report excess property to GSA

After internal reuse has been considered, the federal executive agency reports the excess personal property to GSA. The normal reporting and selection system is the Personal Property Management System (PPMS). An approved manual submission can use Standard Form (SF) 120, Report of Excess Personal Property. Confirm the current PPMS workflow and SF 120 instructions with the agency’s GSA Area Property Officer because procedural details can change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assign a property custodian while the report is pending. The custodian safeguards the asset, keeps its record accurate, arranges inspections or showings, answers questions, and coordinates release only after an authorized selection and transfer.

3. Allow federal screening and transfer

GSA publishes the identifying information needed for other federal agencies to find, evaluate, and request reported property. The holding agency keeps custody until the authorized transfer is completed. GSA identifies SF 122 for direct transfers of personal property valued at $10,000 or less; verify the current threshold and instructions before preparing the form. The receiving agency must confirm that the item meets a documented federal requirement and that it can handle transportation, installation, maintenance, and any restrictions.

4. Move unneeded property into the surplus-donation stage

If no federal requirement is established, GSA classifies the property as surplus. Eligible state and local agencies and certain public organizations or nonprofits may request it through their State Agency for Surplus Property. The state agency—not the federal agency’s interested recipient—determines eligibility, processes the request, and explains any public-purpose conditions.

5. Sell property that is not donated

Surplus personal property that is not selected for donation may be sold to the public using competitive methods such as sealed bids, spot bids, or auctions. GSA Auctions provides electronic bidding for federal personal property. Each lot’s notice controls: read its condition description, inspection arrangements, payment deadline, pickup window, loading rules, and removal requirements before bidding. The purchaser is responsible for payment, access, loading, transportation, and removal to the extent stated in that sale’s terms.

6. Use authorized abandonment, destruction, or recycling

When utilization, donation, and sale do not dispose of the asset, control for final disposition returns to the owning agency. GSA describes abandonment or destruction procedures and recycling as possible routes. The agency must follow environmental laws and U.S. Environmental Protection Agency requirements, along with rules for hazardous substances, refrigerants, batteries, electronic data, and other regulated materials.

Federal regulation permits a written determination for property with no commercial value or when continued care and handling is expected to cost more than sale proceeds. That determination belongs in the agency’s records and does not authorize an employee or member of the public to take the item. The agency must still use an approved contractor or recycling channel and retain any required certificates of destruction or recycling.

How donation through a State Agency for Surplus Property works

Check eligibility before selecting an item

Eligible nonfederal public agencies and qualifying public organizations or nonprofits apply through the State Agency for Surplus Property (SASP) serving their jurisdiction. The SASP reviews the applicant, confirms the intended public use, and identifies available property. Eligibility is not established by an item’s appearance or by a seller’s informal statement.

Budget for the real cost of a donation

Donation does not necessarily mean free delivery. A SASP may charge handling, transportation, and administrative fees. Recipients should also estimate inspection, loading, storage, installation, insurance, maintenance, accessibility modifications, and disposal costs at the end of the item’s useful life.

Accept and document use restrictions

GSA says a donated-property recipient must begin using the property within one year of acquisition and use it for at least one year thereafter. A state agency may impose additional terms. Aircraft, vessels, and certain foreign gifts have extra restrictions. Failure to comply can require return of the property or reimbursement of its fair-market value. Obtain the transfer document, restriction period, reporting duties, and consequences in writing before accepting the asset.

Use the correct transfer form

GSA identifies SF 123, Transfer Order Surplus Personal Property, for State Agencies for Surplus Property. The SASP will tell the recipient whether additional state forms, certifications, or payment are required. Do not substitute a purchase order or informal email for the authorized transfer documentation.

Buying federal surplus at public sale

Find the official listing

GSA Auctions is the federal electronic-bidding channel for many personal-property lots. Listings can include vehicles, equipment, furniture, and other assets. Read the complete lot description and any attached documents; the title, condition, photographs, and included accessories are limited to what the notice states.

Evaluate a lot before bidding

  • Confirm whether inspection is offered and whether an appointment is required.
  • Check whether the asset starts, operates, or is sold strictly as-is; do not infer performance from a photograph.
  • Read title, registration, export, hazardous-material, and end-use restrictions.
  • Calculate the full cost of the winning bid, applicable charges, transport, loading equipment, storage, repairs, and lawful disposal.
  • Verify the exact payment method and deadline, pickup dates, identity requirements, and consequences of failing to remove the lot.

Complete payment and removal

  1. Register through the official auction system and review the bidder agreement.
  2. Inspect the lot when the notice permits and compare the physical item with the description.
  3. Submit a bid only after confirming that you can meet the payment and removal schedule.
  4. Pay by the method and deadline in the award notice.
  5. Bring the required identification, vehicle, lifting or loading equipment, and any qualified specialist needed to handle the item safely.
  6. Obtain the release paperwork and remove the property within the stated window. If a delay is unavoidable, contact the sale office before the deadline; do not assume an extension.

Real property: land and buildings

Federal land and buildings are not processed through the ordinary personal-property donation route. GSA handles excess federal real property through channels that can include transfers to government agencies for public purposes, public-benefit conveyances for qualifying uses and entities, negotiated sales in specific circumstances, and public auctions.

The property’s notice determines which programs, uses, eligibility rules, environmental disclosures, and conditions apply. Individuals can browse federal real-property sales at realestatesales.gov. Review the specific notice, title information, zoning or land-use restrictions, inspection terms, closing requirements, and environmental material before making an offer. State and local land or building sales require the owning jurisdiction’s own process.

Choosing the appropriate disposition route

Property officials should compare routes using the same decision axes rather than choosing the quickest-looking option.

Question Why it changes the route
Who owns the asset? Federal, state, local, contractor-held, and privately titled property have different authorities and forms.
Is it personal or real property? Land and buildings use GSA real-property programs; equipment and vehicles use personal-property channels.
Can another agency use it? Internal reuse and federal transfer take priority before donation or sale.
Is a recipient eligible and is there a public purpose? Donation requires SASP review and continuing-use obligations.
What is the net economic result? Compare expected sale proceeds with storage, handling, transportation, inspection, and compliance costs.
Are restrictions or hazards present? Data, privacy, weapons, export, environmental, title, and safety rules may require a specialist route.
Can the item be removed safely and on time? Loading equipment, access windows, transport permits, and storage capacity can determine whether a sale or donation is practical.

Common mistakes and how to prevent them

Calling an unused item “surplus” too soon

“Surplus” is a formal status after federal screening. Use “potentially excess” or “unneeded” internally until the owning agency and GSA process establish the status.

Assuming location proves ownership

An item in a federal building, base, warehouse, or contractor facility may belong to a different organization. Check the accountable record and title before advertising, donating, selling, or discarding it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Bypassing the custodian

Only the owning agency’s authorized property officials can approve release. Route questions through the custodian, property officer, GSA Area Property Officer, SASP, or sale office identified in the official notice.

Ignoring restrictions because an item is inexpensive

Low value does not remove requirements for data sanitization, hazardous-material handling, export control, firearms, aircraft, vessels, animals, or environmental compliance. Document the specialist review.

Missing an auction deadline

Winning a bid does not replace payment and removal duties. Put every deadline from the lot notice on the responsible person’s calendar and obtain written clarification before a deadline passes.

Accepting a donation without a use plan

Recipients should identify the program that will use the property, the start date, the one-year continuing-use period, storage and maintenance funding, and the person responsible for records before signing the transfer.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical checklist

  1. Identify the title holder and authorized property contact.
  2. Classify the asset as personal or real property.
  3. Record identifiers, condition, location, restrictions, and photographs.
  4. Screen for internal agency reuse.
  5. For federal excess personal property, report through PPMS or an approved SF 120 process.
  6. Support federal screening and complete any authorized SF 122 transfer.
  7. If no federal need exists, coordinate donation through the SASP and review all fees and restrictions.
  8. If offered for sale, read the complete lot notice and plan payment, loading, transport, and removal.
  9. If no transfer or sale is viable, document the authorized abandonment, destruction, or recycling decision and meet environmental requirements.
  10. For land or buildings, use the specific GSA real-property notice or the owning state or local government’s procedure.

Following this sequence protects public assets, gives eligible recipients a lawful path to useful property, and keeps disposal decisions with the agency or jurisdiction that owns the asset.
