There is no single “LATAM” hiring rule, and no contract label or hiring service makes a cross-border hire risk-free. Start with the engineer’s actual country and work location, then determine whether the real working relationship is employment or independent services under the laws that apply there. Country-specific labor and tax advice is essential before onboarding.
How do I hire developers in Latin America without legal risk?
You cannot eliminate legal risk with a particular contract, contractor label, or payroll arrangement. You can reduce avoidable mistakes by matching the hiring route to the worker’s real location and working relationship, documenting the arrangement, and checking local requirements before work begins. The examples below cover Argentina, Colombia, and Mexico; they are not a survey of every country in Latin America or a legal opinion about an individual hire.
1. Confirm where the engineer will actually work
Record the engineer’s country and usual work location, and require advance notice of a move or extended work from another country. Location can affect which labor and remote-work rules apply even when the hiring company is foreign. Do not assume that the law governing the contract or the company’s headquarters settles the issue.

Assess how the work will operate in practice: who directs it, how integrated it is into the business, how long it is expected to last, and how the worker is paid and organized. A contract heading saying “independent contractor” does not by itself determine status. If the intended arrangement looks like employment, investigate local employment rather than relying on a label.

3. Check the obligations for the specific country and work arrangement
Before onboarding, confirm the applicable rules for written terms, registration, payroll, tax withholding, social security, working time, leave, benefits, termination, and remote-work expenses and equipment. Also review privacy and monitoring, data handling, confidentiality, and intellectual-property assignment with local counsel.
4. Assess business and cross-border issues separately
Labor classification is only one part of the review. Ask advisers to assess any corporate tax, permanent-establishment, foreign-exchange, or entity-registration implications. The country examples below do not resolve those issues.

Can a US company hire a LATAM engineer as an independent contractor?
Possibly, but the answer depends on the worker’s location, the actual relationship, and the laws that apply. US Department of Labor guidance describes a six-factor analysis under the Fair Labor Standards Act (FLSA): opportunity for profit or loss, the worker’s investment, permanence, control, whether the work is integral to the business, and skill and initiative. The Department says its 2024 rule became effective March 11, 2024. That is an input to the US-law analysis, not a substitute for the worker-location country’s rules. Check the agency’s current policy and litigation status before treating the rule as controlling.

In particular, do not conclude that a US-compliant classification necessarily satisfies local law. A foreign company contracting with a worker in Colombia, for example, is expressly addressed by Colombia’s remote-work law. Whether a particular arrangement is employment or independent services still requires a fact-specific, country-specific assessment.

What the country examples show
Argentina: dependency, a conditional exception, and the place of work
Argentina’s Law 20,744 describes an employment contract as a person providing services for another under that party’s dependence in return for remuneration. Article 23 provides a presumption when services are performed under dependency. The current text, reflecting amendments effective March 6, 2026, also provides that the presumption does not apply to specified contracts for works or professional or occupational services when requirements involving receipts, invoices, or qualifying payment methods are met. That is a conditional legal exception, not an automatic contractor safe harbor; assess the actual relationship and conditions with Argentine counsel.
Argentina’s updated telework law addresses transnational telework by pointing to the law of the place where the worker performs the tasks. It also addresses privacy in monitoring and protection of work information. For a worker located outside Argentina, do not treat the fact that the hiring company is Argentine—or the contract’s chosen wording—as a replacement for checking the law where the work is performed.

Colombia: foreign companies and workers located in the country
Law 2121 of 2021 expressly applies to foreign companies that contract workers located in Colombia. It establishes remote work as a mode of employment contract, preserves limits on working time and non-waivable minimum rights, and allows schedules to be agreed within those limits. A foreign employer should therefore check the Colombian employment framework rather than assume that an overseas headquarters or contract makes it irrelevant.

This specific case should not be generalized into a rule that every cross-border worker relationship uses Colombian law.

Mexico: telework threshold and employer duties
Mexico’s Federal Labor Law defines covered telework as subordinate, paid work away from the employer’s premises using information technologies, when work from the employee’s home or chosen location exceeds 40% of working time. Occasional or sporadic work is excluded from that chapter. The threshold is more than 40%, not 40% or more.
For covered telework, written conditions are required. Employer duties include providing and maintaining necessary equipment, covering relevant telework costs, protecting data, registering workers for mandatory social security, and respecting the right to disconnect. Confirm the currently applicable consolidated law and implementing standards before advising on a particular hire.

Compare routes only after local counsel confirms which are available and suitable for the worker’s country and actual duties. An employer-of-record (EOR) or payroll provider is a service category to investigate, not a guarantee against liability. For any route, separately address intellectual-property assignment, confidentiality, privacy, monitoring, and cross-border data handling. The appropriate documents and obligations depend on the applicable law and facts.
A practical pre-onboarding checklist
- Document the location. Record the engineer’s country and normal work location, and establish a process for notice before either changes.
- Write down the real work arrangement. Identify expected duties, supervision, schedule, duration, tools, payment, and how the work fits into the business. Have local counsel assess status from the substance, not just the contract title.
- Confirm local employment and remote-work requirements. Check written terms, registrations, payroll, withholding, social security, hours, leave, benefits, termination, equipment, expenses, and any applicable telework rules.
- Review data and work product. Check monitoring and privacy practices, information security, confidentiality, and ownership or assignment of intellectual property.
- Get separate tax and corporate advice. Ask whether the proposed arrangement affects corporate tax, permanent establishment, foreign exchange, or entity-registration obligations.
- Select the route after the review. Compare direct local employment, an EOR or payroll arrangement, and genuine independent services based on local advice and the company’s actual needs. Confirm in writing what any provider does and does not handle.
- Reassess when facts change. A move to another country, a shift in duties or control, or a change in the work schedule can alter the analysis. Review the arrangement when those facts change.
