You can give shares to a child by transferring them into a custodial account established under the applicable state’s UGMA or UTMA law. The child owns the gifted property; an adult custodian manages it for the child until custodianship ends under the governing state rules. The transfer is generally irrevocable, and the child’s dividends, later sale, and eventual control of the shares can all have tax or financial consequences.

Before moving shares, confirm that the receiving brokerage accepts the specific securities, check the account’s governing state law and agreement, and gather the donor’s tax-basis records. The steps and tax figures below distinguish rules cited for 2025 from rules that must be checked for the year you make the gift.

How a gift of stock to a child works

A UTMA or UGMA account is a way to hold money, securities, or other property for a minor without creating a formal trust. The account names the child as beneficiary and an adult as custodian. Under FINRA’s description, the child generally becomes the owner when the gift is made, while the custodian manages and invests the property for the child.

Depositing property is generally an irrevocable transfer from the donor to the child. In practical terms, the donor should not treat the shares as a temporary holding that can be reclaimed or redirected later. The custodian’s authority is also a fiduciary-like responsibility to manage the property for the beneficiary, not permission to use it as the adult’s own money.

The custodian may manage transactions and make withdrawals for the minor’s benefit while the account remains custodial. The property must ultimately be transferred to the child when custodianship terminates under the applicable law and account paperwork. FINRA’s 2019 examination findings describe the beneficiary as owner from the time of the gift and say the custodian must transfer custodial property when the minor reaches the applicable age.

That means a custodial account is not simply a way to label a parent’s investment account as “for the child.” The child’s ownership begins with the gift, while the adult’s role is to administer the property for that child. Consider whether you are ready to give up the ability to reclaim the shares before signing transfer documents.

Steps to transfer shares

The exact forms and processing sequence are brokerage-specific. Confirm the receiving institution’s current requirements before initiating a transfer; the official general guidance does not establish that any particular brokerage will accept every security or transfer method.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Choose the account structure. Decide whether the child should own the shares now through a UTMA/UGMA account or whether another child-focused arrangement better fits your goals. Compare ownership, control, permitted use, investment choices, taxes, and administrative costs before making an irrevocable gift.
  2. Check the governing state rules. Ask which state’s law governs the account and review the account documents. Confirm the custodianship termination age, any permitted extension, and how the property is transferred when custodianship ends. Do not assume that every state uses the same age.
  3. Ask the receiving brokerage about the specific shares. Confirm whether it accepts the shares in kind, what account registration and documents it requires, whether the donor must open the custodial account first, and whether fees or restrictions apply. “In kind” means transferring the shares rather than selling them and transferring cash; whether that route is available depends on the provider and the security.
  4. Open or complete the custodial account as instructed. Use the brokerage’s current forms and registration requirements for the child and custodian. Check the account agreement to make sure the named beneficiary, custodian, and governing state are correct before assets are deposited.
  5. Submit the transfer and retain its confirmation. Keep the brokerage’s transfer confirmation, the date and number of shares transferred, and the valuation used for gift records. Retain the donor’s acquisition and adjustment records as well; the child may need them when calculating gain or loss on a later sale.
  6. Review the completed account and tax records. Verify that the shares arrived in the intended custodial account and preserve any transfer or gift-tax documents. Track dividends and other income attributed to the child’s property for the relevant tax year.

Before initiating the transfer, ask the brokerage to spell out any account-opening prerequisite and whether it needs instructions from both the donor and the custodian. Ask which transfer method it accepts, whether any security-specific restrictions apply, and whether there are administrative fees. These checks can help prevent a delay or an unintended sale if the provider cannot accept the shares in kind. Obtain answers from the receiving brokerage’s current account documentation rather than assuming that procedures are identical across firms.

Who owns and controls the shares?

The child is the beneficial owner; the adult is the custodian. The custodian manages and invests the property while the child is a minor and may use custodial assets only for the child’s benefit. A custodial account therefore does not preserve the donor’s control over the shares after the gift.

The age at which the child takes control is not safely summarized as one nationwide number. State provisions differ, and the governing law and account paperwork matter. Before gifting, identify the law that applies and verify the termination age and transfer process from current state sources or qualified legal advice. FINRA’s general materials describe control passing at the applicable statutory age, not at a universal age.

That transition is a central planning trade-off: the child eventually receives control of the property, and the donor generally cannot make the gift contingent on the child using it for a particular future purpose after control transfers. If retaining control or imposing conditions is important, get legal advice about a different arrangement before transferring assets.

Do not rely only on a general description of UTMA or UGMA rules when deciding whether the eventual handoff fits your plan. Confirm the account’s governing law, review the brokerage agreement, and determine what happens at termination. The relevant age and transfer procedure should be checked for the particular account; a common age cited for one state or arrangement does not establish the rule for another.

Gift-tax rules and the annual exclusion

The IRS’s 2025 instructions for Form 709 state an annual exclusion of $19,000 per donee for gifts of present interests made during that calendar year. This is a 2025 figure, not a permanent threshold; verify the exclusion and reporting rules for the calendar year of the gift.

The exclusion applies only when the gift qualifies as a present interest. The same 2025 instructions say a gift to a minor qualifies as a present interest only under specified conditions: the property and its income may be used for the minor before age 21, the remainder passes to the minor on the 21st birthday, and specified rights apply if the minor dies before turning 21. Whether a particular custodial arrangement and transfer meet these requirements depends on its terms and applicable law. Do not assume that every UTMA/UGMA transfer automatically qualifies.

A gift above the annual exclusion does not, by itself, establish that immediate gift tax is owed. Filing and tax results depend on the donor’s circumstances, all gifts during the year, applicable elections, and current rules. Consult the current Form 709 instructions for your situation. Large gifts, split gifts, trust arrangements, nonresident situations, or other unusual facts are good reasons to seek professional tax advice.

Keep the calendar year in view when planning a transfer. The cited $19,000 amount is for 2025 and applies to qualifying present-interest gifts per donee; it is not a general cap on the value of stock someone may give. A gift’s treatment and any reporting obligation depend on the facts and current rules, including the donor’s other gifts and any applicable elections. If the gift is substantial or the arrangement is unusual, check current IRS instructions rather than relying on a prior-year figure.

Taxes on dividends and other investment income

Income generated by property given to a child is generally the child’s income. IRS Publication 550 says this includes property placed in an account under UGMA, UTMA, or a similar law. Dividends, taxable interest, and capital gains are examples of unearned income. An important exception applies when income is used to satisfy a parent’s or guardian’s legal support obligation: that amount is taxable to the responsible adult instead.

The child may have a tax-return filing requirement, and the rules commonly called the kiddie tax can affect how unearned income is taxed. They do not mean that every child’s dividends are automatically taxed at a parent’s rate. The child’s age, support, income, and filing circumstances matter, as do the year’s instructions.

For tax year 2025, the IRS Form 8615 instructions state that a child with more than $2,700 of unearned income must file Form 8615 only when the other listed filing conditions are also met. Form 8615 calculates tax on net unearned income using the parent’s tax rate under its rules. The threshold is specific to the 2025 instructions; check the form and instructions for the tax year at issue.

A parent may be able to elect to report certain child income using Form 8814, but that possibility does not erase every separate filing obligation. Review current IRS instructions for the child’s actual income and circumstances rather than assuming the parent can simply include all dividends on their own return.

In practice, keep a record of dividends, taxable interest, and sales tied to the child’s holdings, and identify the tax year in which each item was received or realized. The fact that the account is managed by an adult does not by itself make all of its income the adult’s. Review the applicable IRS instructions to determine who reports the income and whether a child return, Form 8615, or a parent election is relevant.

How to handle the stock’s tax basis

The gift-date market price is not automatically the child’s tax basis. IRS Publication 551 explains that basis calculations for gifted property can depend on the donor’s adjusted basis immediately before the gift, the shares’ fair market value at the time of the gift, and any gift tax paid.

If the shares’ fair market value on the gift date is lower than the donor’s adjusted basis, the basis used to calculate a later gain may differ from the basis used to calculate a loss. This can make accurate records particularly important if the child sells the shares. Do not rely on a brokerage’s displayed cost figure as a complete substitute for the donor’s tax records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep a record set that includes:

  • The donor’s original acquisition dates, purchase records, and adjusted basis immediately before the gift.
  • The share quantity and transfer date, plus the fair market value used for the gift-date records.
  • The transfer confirmation and any relevant gift-tax filings or documents.
  • Records of later transactions, including reinvested dividends or sales, as applicable.

Think of the basis file as something the child may need years after the transfer, not just paperwork for the day the shares move. If the donor cannot document the acquisition history, it may be difficult to determine the correct gain or loss when the child sells. Preserve the records with the transfer confirmation, and update the file with later transactions so the history does not disappear when the original donor is no longer managing the account.

Compare a custodial account with alternatives

A UTMA/UGMA account is not the only way families may set aside assets for a child. FINRA identifies custodial accounts, a parent-held brokerage account intended for future use, and other child-focused savings arrangements as approaches to consider. Their control, restrictions, tax treatment, and ownership are not interchangeable; compare the actual terms rather than treating them as equivalent accounts.

Route Ownership and control Investment or use considerations What to verify
UTMA/UGMA custodial account The child generally owns the gifted property when it is transferred. The custodian manages it until custodianship ends under applicable state rules. Custodial property may be used for the minor’s benefit. FINRA says UTMA accounts can offer broader investment flexibility than UGMA accounts. State termination age and transfer procedure, permitted use, brokerage transfer availability and fees, and tax treatment of income and sales.
Parent-held brokerage account for future use FINRA identifies this as an approach families may consider; the specific account ownership and control depend on how it is established. The general FINRA material cited here does not establish detailed investment, tax, or distribution rules for a particular account. Account registration, who legally owns the assets, how and when the child may receive them, tax consequences, and any transfer process.
Trump Account A distinct traditional IRA for eligible children, not a general-purpose custodial brokerage account. Investor.gov says eligibility, age, contribution, and distribution rules apply. During the growth period, investments are limited to eligible broad U.S. equity index mutual funds or ETFs. Current eligibility and enrollment rules, investment restrictions, contribution and distribution requirements, and current IRS/Investor.gov guidance.

The IRS announced a $1,000 pilot contribution for eligible U.S. citizens born in 2025 through 2028 when the required election is made. This is a specific pilot provision announced in 2026, not a general contribution available to every child. Because this account is new and implementation guidance can change, check current IRS and Investor.gov information before acting.

For any route, compare whether the gift is irrevocably the child’s, who controls it and when, what uses or distributions are allowed, which investments are permitted, how income and later sales are taxed, how contributions are treated for gift-tax purposes, and what administrative costs or transfer limitations apply.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

These comparison points matter because a lower-maintenance or more flexible arrangement may have different ownership consequences. A custodial account puts the asset in the child’s ownership now and eventually transfers control under state rules. A parent-held account may leave ownership with the parent, depending on how it is established. A Trump Account is a restricted IRA arrangement with its own eligibility and distribution rules, not a substitute for a child’s general-purpose brokerage account. Verify the terms that apply to the specific account rather than choosing by name alone.

Common mistakes to avoid

  • Assuming the donor can reclaim gifted shares. A custodial contribution is generally irrevocable; decide before transferring whether you are comfortable giving up ownership.
  • Assuming one age applies nationwide. Find the governing state law and account terms rather than relying on a generic age quoted for another jurisdiction.
  • Assuming every broker accepts an in-kind transfer. Confirm acceptance, registration, forms, timing, fees, and any security-specific restrictions directly with the receiving provider.
  • Using the transfer-date market value as the only basis record. Preserve donor basis as well as gift-date fair market value because a later gain and loss calculation can use different basis rules.
  • Treating the 2025 tax thresholds as current for every year. Check the applicable year’s Form 709, Form 8615, and other current IRS instructions.
  • Assuming the child’s tax is always the parent’s tax. Filing and kiddie-tax rules depend on the child’s specific facts and the tax year.

Sources and date-sensitive rules

The federal tax figures in this guide are tied to the identified IRS materials: the 2025 Form 709 instructions for the $19,000 annual exclusion and present-interest conditions; IRS Publication 550 for income from a child’s property; the 2025 Form 8615 instructions for the $2,700 threshold and kiddie-tax conditions; and IRS Publication 551 for gifted-property basis. FINRA’s Regulatory Notice 20-07 describes the generally irrevocable transfer, and its 2019 examination findings describe ownership and custodial control. Investor.gov and the IRS provide the cited Trump Account information, including the 2026 pilot contribution announcement.

These are general U.S. federal explanations, not individualized tax or legal advice. State custodial statutes differ, and the account’s brokerage terms determine provider-specific transfer procedures. Verify both the law and the tax-year instructions that apply when you make the gift.

Frequently Asked Questions

Can I transfer stock I already own to a child without selling it first?

Possibly. Ask the receiving brokerage whether it accepts the specific shares in kind, meaning the shares move rather than being sold and transferred as cash. The firm may require a particular account registration, forms, or that the custodial account be opened first, and it may have fees or security-specific restrictions. Confirm its current procedure before initiating a transfer.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I take the shares back if I change my mind?

A deposit into a UTMA/UGMA account is generally an irrevocable gift to the child. The child becomes the owner, and the custodian manages the property for the child’s benefit. Do not transfer shares on the assumption that you can later reclaim them or redirect them to someone else.

At what age does a child take control of a UTMA or UGMA account?

There is no safe single age to apply nationwide. The governing state law and account paperwork determine when custodianship ends and how the assets are transferred. Check the current rules for the specific account and jurisdiction before making a gift.

Who pays tax on a child’s dividends?

Income from property given to a child is generally the child’s income, including dividends, although an amount used to satisfy a parent’s or guardian’s legal support obligation is taxable to that responsible adult. Whether the child must file a return or is subject to kiddie-tax rules depends on age, support, income, and other filing conditions. Check the IRS instructions for the relevant tax year.

Does the child’s basis become the share price on the day I give the stock?

Not necessarily. IRS Publication 551 says gifted-property basis can depend on the donor’s adjusted basis immediately before the gift, the fair market value on the gift date, and any gift tax paid. If gift-date value is below donor basis, gain and loss calculations may use different basis rules, so keep both donor records and gift-date valuation information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does giving more than the annual exclusion mean I owe gift tax immediately?

Not automatically. The IRS’s 2025 Form 709 instructions list a $19,000 annual exclusion for qualifying present-interest gifts per donee, but gift reporting and tax results depend on all gifts, applicable elections, and current rules. The amount is year-specific, and not every transfer to a minor automatically meets the present-interest conditions. Check current IRS instructions or seek professional advice for a large or unusual gift.

Is a Trump Account the same as a custodial brokerage account?

No. It is a distinct traditional IRA for eligible children, with eligibility, age, contribution, investment, and distribution rules. Investor.gov says investments during the growth period are limited to eligible broad U.S. equity index mutual funds or ETFs. Check current IRS and Investor.gov guidance before deciding whether it fits your goal.

The Bottom Line

A UTMA/UGMA transfer can give a child stock now, but it generally makes the child the owner and is irrevocable. Before transferring shares, confirm the governing state’s control rules, ask the brokerage about in-kind acceptance and fees, preserve donor-basis and gift-date records, and check current-year tax instructions. Compare alternatives if you need different control, use, or investment restrictions.
