Capcom’s public video policy does not authorize a scripted Resident Evil fan film. It covers certain commentary-led videos made from Capcom game footage and expressly says it is not a license to create derivative works. To use Resident Evil characters, settings, names, logos, dialogue, designs, music or other recognizable franchise elements in a film, make a specific written licensing inquiry to the relevant rights holder and obtain signed permission before production or release. A disclaimer, a free release, a crowdfunding promise or a Partner Portal submission is not permission.

The direct answer

There is no published Capcom fan-film application, standard approval route, fee schedule or response-time promise in the company materials reviewed for this question. Capcom also does not publicly state that it routinely approves Resident Evil fan films. The practical route is therefore a rights inquiry, not reliance on a general community policy.

Ask Capcom, through an official business or inquiry channel, whether it controls the exact rights you need and whether another Capcom licensing partner or third-party owner must be involved. Describe the proposed film and distribution in enough detail for the company to assess it. Do not shoot, advertise, crowdfund, submit to festivals or publish on the assumption that silence or a noncommercial plan equals approval.

Why the ordinary “video policy” does not cover a fan film

What Capcom’s Video Policy is designed for

Capcom USA’s Video Policy, labeled last updated March 15, 2021, encourages certain videos that use Capcom game footage on video and streaming platforms. Its examples are commentary-centered formats such as gameplay commentary, walkthroughs, tutorials, reviews and streams. The policy also discusses platform advertising and partner-program monetization for qualifying videos, subject to its restrictions.

A scripted film in which actors or animated characters perform a new story is a different use. It normally involves derivative expression: characters, identities, settings, dialogue, visual designs, logos, plot elements or other protected material are being incorporated into a new work. The policy does not turn that use into an automatically permitted video.

The policy’s explicit limitation

Capcom’s own wording is decisive: “It is not intended to be, nor should be considered as, express permission nor an official license or authorization for you to create mods or derivative works of Capcom titles or content.” That sentence prevents a filmmaker from treating the policy as a blanket fan-film grant.

Monetization language is not film permission

Rules allowing advertising or partner-program revenue for qualifying gameplay videos do not authorize a scripted Resident Evil production. Free access does not solve the underlying rights issue, and a film can have commercial exposure even when viewers are not charged—for example, through sponsorship, advertising, donations, crowdfunding rewards, festival promotion or a monetized channel.

What other Capcom pages establish—and what they do not

Terms of Use

Capcom USA’s Terms of Use reserve rights in covered content to Capcom, its licensing partners or suppliers. They prohibit derivative works or exploitation without express permission, subject to the stated Video Policy exception. Because the Video Policy excludes authorization for derivative works, the Terms of Use do not create a separate fan-film path.

Partner Portal submissions

The Capcom Partner Portal warns that submitting material does not grant the submitter the right to use Capcom or its licensors’ trademarks, copyrights, patents or other intellectual-property rights. It also says a submission is nonbinding and does not create an agreement; without a written agreement signed by an authorized representative, the submission does not entitle the submitter to compensation.

That is a submission disclaimer, not an offer of Resident Evil film rights. Uploading a script, pitch deck or concept there cannot substitute for a signed license that expressly covers your production.

Capcom Japan’s gameplay FAQ

A Capcom Japan support FAQ updated December 1, 2025 distinguishes individuals posting videos under its guidelines from corporations and contracted creators, for whom permission is required. The FAQ addresses gameplay-video distribution. It should not be expanded into a rule that permits a scripted fan movie, nor should an individual creator interpret it as approval for a derivative film.

Regional licensing pages

Capcom Taiwan lists Resident Evil among licensed intellectual properties and describes categories such as campaigns, attractions, toys, figures and apparel. That demonstrates that Capcom operates licensing programs, but it does not show that fan-film rights are available, identify the correct territory for your project or prove that the Taiwan page controls film rights elsewhere.

Define exactly what you want to use

A vague request such as “permission for a Resident Evil fan film” leaves the rights holder unable to evaluate the proposal. Make an inventory before contacting anyone.

  • Characters: list every named character, creature, organization or recognizable identity, including brief appearances.
  • Story elements: identify locations, fictional companies, incidents, terminology, symbols, weapons, costumes and distinctive designs.
  • Branding: identify the Resident Evil name, game titles, logos, typefaces, taglines and any marks planned for the title card, poster, thumbnail or merchandise.
  • Audio and imagery: list game music, sound effects, voice lines, still images, extracted models, textures, trailers or gameplay footage you intend to include.
  • New material: explain which dialogue, scenes, performances, animation, visual effects and storylines are original to your team.

Separate “inspired by” ideas from material that viewers would identify as Resident Evil. If your concept uses only original characters and a different fictional setting, state that clearly; it may require no Capcom license, although other legal questions can still arise from close resemblance or copied expression.

Prepare the film and release plan before making the inquiry

Production details to provide

  • Format: live action, animation, machinima or another production method.
  • Approximate running time, script status, production stage and proposed completion date.
  • One-paragraph logline and a fuller synopsis that identifies the requested franchise elements.
  • Whether the project is a standalone short, episodic series, proof of concept, festival film or feature-length work.
  • Names and roles of the producer, director, company, financiers and distribution partner, if any.

Release and business details

  • Countries or territories where the film would be shown.
  • Languages, subtitles and dubbed versions.
  • Planned platforms, festivals, theatrical screenings, physical editions and private screenings.
  • Whether viewers would pay, and whether advertising, sponsorship, donations, crowdfunding, memberships, licensing merchandise or other revenue is expected.
  • Whether the film will be promoted with Resident Evil marks, character images or clips.
  • Any target release date, exclusivity request or proposed term.

Be candid about commercial exposure. Calling a film “noncommercial” while accepting sponsorship or monetizing its channel can undermine the inquiry and create a mismatch between the requested and actual rights.

How to contact the rights holder

  1. Start with an official Capcom business or inquiry channel. Ask for the department handling intellectual-property licensing or entertainment rights. Do not assume a customer-support address, social-media account or fan forum can grant rights.
  2. Ask who controls each requested right. Request confirmation of whether Capcom owns the relevant Resident Evil character and production rights in your territory, or whether a licensing partner or another owner must be approached.
  3. Attach a concise package. Include the logline, synopsis, rights inventory, production details, release plan, business model, team information and contact details. Send a script or storyboard only through a channel that is willing to receive it and whose submission terms you understand.
  4. Ask what materials and terms are required. Request the correct application process, review criteria, authorized contact, confidentiality expectations and any required forms. Public Capcom pages do not publish a dedicated fan-film process, so the recipient’s written response matters.
  5. Keep an auditable record. Save the sent inquiry, attachments, replies, dates, names and any revisions. A verbal assurance or informal social-media reply should not be treated as a grant.

If an official channel redirects you to a licensee, follow that direction and confirm the licensee’s authority in writing. A regional office may handle some commercial categories without controlling worldwide film rights.

Do not begin rights-dependent work until permission is written

Development can create commitments that are difficult to unwind. Before casting, commissioning costumes, hiring visual-effects artists, announcing a title, collecting crowdfunding money or booking a festival, obtain written confirmation that the proposed use is authorized. A rights holder’s silence is not acceptance. Neither is a “for entertainment only” notice, a fan-work disclaimer, attribution, a statement that no infringement is intended, or the absence of admission fees.

Ask that any approval be issued by an authorized representative of the rights owner or licensee. Retain the fully signed document and check that the legal entity named in it matches the entity that controls the rights.

What a negotiated license should spell out

No standard Capcom fan-film license is published in the materials available for this topic. The following are issues to compare when a rights holder sends proposed terms; they are not known Capcom package options.

License issue Questions to answer in writing
Protected elements Which characters, names, locations, logos, designs, dialogue, footage, music and other materials are included or excluded?
Medium and format Does the grant cover live action, animation, machinima, trailers, behind-the-scenes clips, stills and promotional assets?
Territory Which countries, language markets and online audiences may receive the film?
Term When does the permission start and end, and what happens to copies already distributed when it expires?
Distribution Are festivals, social platforms, streaming services, theaters, physical media, educational screenings and private links allowed?
Commercial use Are advertising, sponsorship, donations, crowdfunding, subscriptions, paid access or merchandise permitted?
Approvals and edits Who approves the script, casting, designs, cut, title, marketing, subtitles and localization, and how are deadlines handled?
Credit and branding What attribution, trademark notices, logos and disclaimers are required, and where may they appear?
Exclusivity Is the permission exclusive, nonexclusive or restricted by platform, territory, character or release window?
Payment and expenses Are there fees, royalties, minimum guarantees, cost reimbursements, audit rights or taxes?
Liability and termination Who bears claims, insurance obligations, indemnities, takedown duties and re-edit costs if permission ends?

Do not infer any of these terms from a casual email. If the grant does not expressly cover a use, treat that use as unapproved and ask for clarification.

Clear rights in music, footage and other incorporated material

Character permission alone may not clear every asset in a film. Capcom’s Video Policy cautions that some music in games may be licensed from third parties. The same issue can arise with music, voice performances, photographs, trailers, stock footage, artwork, fonts, locations and performer likenesses.

  • Ask who owns each game track or sound recording and whether synchronization, public-performance and online-distribution rights are needed.
  • Do not assume that recreating a scene clears the original music, sound recording or artwork.
  • Obtain written releases from actors, voice performers, composers, illustrators and locations where applicable.
  • Track the license for every externally supplied asset, including territory, term, media and commercial restrictions.
  • Replace an uncleared asset before picture lock rather than relying on attribution after release.

Ask the rights holder whether it can grant a bundled clearance or whether separate owners must be contacted. A Capcom response may cover Capcom-controlled elements while leaving third-party assets outside the grant.

Stop using the protected elements

If no license is available, remove Resident Evil character identities, franchise branding, copied artwork, game music, extracted assets and other protected material from the production and its marketing. Do not simply change a character’s name while retaining the same distinctive design, biography, setting and signature elements.

Rebuild as an original project

You can develop a survival-horror story with original characters, organizations, locations, mythology, visual designs, dialogue and music. Document your creative process and asset sources. If the result remains closely reminiscent of a protected character or world, obtain advice from a lawyer familiar with the countries where you will produce and distribute the film.

Request clarification rather than guessing

A rejection may identify a narrower use that is acceptable, but do not interpret it yourself. Ask whether the decision applies to every proposed element, territory and medium, and whether a revised concept may be submitted. Until you receive a new written grant, keep the protected material out of production and promotion.

Common mistakes that do not create permission

  • “It is a fan film, so it is automatically fair use.” Fair-use or similar exceptions are fact-specific, vary by jurisdiction and are not a substitute for a negotiated license where one is required.
  • “The film is free, so no rights are needed.” Free viewing does not erase derivative-work, trademark, music or publicity-rights issues.
  • “I credited Capcom.” Credit acknowledges a source; it does not grant the right to use the source.
  • “I added a disclaimer.” A disclaimer can prevent confusion about affiliation, but it does not authorize the underlying use.
  • “The Partner Portal accepted my upload.” Portal terms expressly say that submission grants no intellectual-property rights and creates no agreement.
  • “A gameplay video rule covers my script.” The published examples concern commentary-style game footage, while the policy expressly excludes authorization for derivative works.
  • “A regional licensing page proves film rights are available.” A list of licensed merchandise or promotional categories does not establish availability, price or territory for a fan film.

Country, platform and legal differences

Rights and exceptions can differ by country, and online distribution can reach multiple territories at once. Identify where the production company is based, where filming occurs, where the film will be made available and which law governs the proposed agreement. A permission limited to one country or one festival cannot be assumed to cover a worldwide upload.

Platform rules are separate from copyright and trademark permission. A platform may host user videos under its own terms while still removing a film after a rights complaint. Festival acceptance likewise does not prove that all underlying rights are cleared. Obtain jurisdiction-specific legal advice if the project uses close approximations, parody, real-person likenesses, sensitive trademarks or an international release.

Sample written inquiry

Adapt the following wording to your project. It requests information; it does not itself grant or reserve any rights.

Subject: Resident Evil character licensing inquiry for [film title]

Hello [Capcom licensing or business-contact team],

I am [name and role] with [company or production entity]. We are developing a [live-action/animated] film of approximately [length]. The story is [brief logline]. We would like to request permission to use these Resident Evil elements: [specific characters, names, settings, marks, designs, dialogue, footage and music].

The project would be produced in [country] and made available in [territories and languages] through [platforms, festivals or other outlets]. Our current plan is [free/paid] access, with [advertising, sponsorship, crowdfunding, donations or other revenue, if any]. The target release window is [date or range].

Please confirm whether Capcom controls the requested rights in these territories, whether another licensee or rights holder must be contacted, and what submission materials, review process, fees and terms apply. We will not begin rights-dependent production or distribution without written authorization from the appropriate rights holder.

Project summary and rights inventory are attached. Please direct this inquiry to the authorized representative for film or entertainment licensing.

Regards,
[name, organization, email, telephone]

What the public record does not tell you

The official Capcom materials identified for this question do not publish fan-film approval odds, a standard price, a guaranteed response time or a dedicated application form. Treat every commercial term as negotiable and project-specific unless Capcom states otherwise in a signed document. Do not budget on an assumed fee, promise investors a release date or announce approval before the rights holder confirms it.

The safest sequence is to define the proposed use, submit a focused inquiry, identify every additional rights owner, negotiate written terms and only then commit to production and distribution. Until that sequence is complete, describe the project internally as unlicensed development and keep public claims about affiliation or approval out of your marketing.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
