If a hotel or booking site advertised one price, disclosed a condition differently, or added an unavoidable charge only at the end, preserve the offer immediately, document the exact mismatch, and ask in writing for a specific remedy. Contact both the booking intermediary and the hotel when both were involved. If the response is unsatisfactory, use the official consumer-protection route for the country whose law governs the booking. A regulator complaint can document suspected misconduct or support enforcement, but it does not automatically produce an individual refund.
This process is different from cancelling a clearly disclosed nonrefundable reservation or simply changing your mind. Whether you are legally owed money depends on the advertisement, confirmation, seller, payment flow, cancellation terms, location, and applicable deadlines.
First decide whether the problem is a misleading offer
A refund request is strongest when you can show a specific representation that changed or was incomplete, rather than dissatisfaction with a valid booking term.
Situations that may support a misleading-price complaint
- The first price shown for the selected room and dates was lower than the unavoidable amount charged at checkout.
- A mandatory resort, destination, cleaning, service, or facility fee appeared only after you had selected the room or entered payment details.
- A discount was calculated against an inflated or unavailable reference price.
- A “limited-time” or “only one room left” message did not match the selected dates, room type, or actual availability.
- A booking site represented free cancellation, a refund, or another condition that conflicts with the confirmed reservation.
- The seller presented a price or condition for one room, occupancy, currency, or date range while the transaction used another without making the difference clear.
Situations that are usually different
A clearly identified nonrefundable rate, a disclosed optional extra that you selected, a tax that was shown before payment, or a genuine change of mind is not automatically a misleading-price claim. A price can also change before you book. The relevant question is what was represented for the transaction you actually completed and when each charge or condition was disclosed.

Dynamic pricing is not, by itself, proof of deception. In the United States, the Federal Trade Commission says businesses may adjust prices for demand or inventory as long as the pricing information is not misleading. The same principle does not excuse hiding a mandatory charge or changing the room or dates without clear notice.
Step 1: Preserve exactly what you were shown
Prices, availability messages, and cancellation text can change as soon as a booking session ends. Save the evidence before contacting anyone or revisiting the page.
Evidence checklist
| Save | What it establishes |
|---|---|
| Screenshot or print-to-PDF of the listing | The advertised room, dates, occupancy, currency, headline price, discount, scarcity message, and disclosures visible at that moment. |
| Checkout screens showing the itemized total | When taxes, mandatory fees, and optional extras appeared, and the amount immediately before payment. |
| Search details | The exact dates, number of guests, room type, board basis, package, and filters that generated the offer. |
| Confirmation and booking reference | The contractual price, cancellation window, payment schedule, and seller identified after booking. |
| Receipt, card statement, or payment record | Who took the money, the amount, currency, transaction date, and any separate charge. |
| Emails, chat logs, and hotel messages | Promises, refusals, explanations, and the identity of the person or company making each statement. |
| Terms in force when you booked | The version of the cancellation, fee, and rate conditions that applied to your transaction. |
Keep original files and note when and how you captured them. If a page is available only after logging in, save the URL shown in your account and export the page or take sequential screenshots that include the address bar. Do not edit images in a way that removes dates, amounts, or surrounding context. If a staff member explains the charge by phone, write a dated summary immediately and ask the business to confirm it by email.
Step 2: Describe the mismatch in one precise calculation
Separate the amount you expected from the amount you were required to pay. A clear calculation is more persuasive than a general statement that the price “felt misleading.”
| Question | How to answer it |
|---|---|
| What was the first price? | Quote the exact amount, currency, room, dates, occupancy, and whether it was per night or for the whole stay. |
| What did that price include? | List taxes, mandatory fees, breakfast, cleaning, resort access, and any other component shown or omitted. |
| When did each charge appear? | Identify whether it was visible on the first result, the room-selection page, the checkout page, or only after payment. |
| Was the charge mandatory? | Explain whether you could decline it without losing the room or whether it was unavoidable. |
| Did the claim match the transaction? | Check discount comparisons, “from” prices, countdowns, remaining-room messages, dates, occupancy, and room type. |
| Who made the representation and who charged you? | Distinguish the hotel, online travel agency, metasearch site, payment processor, and any separate supplier. |
| What did the confirmation say? | Quote the accepted rate and cancellation wording, including deadlines and any stated penalties. |
For example, if the listing showed $199 per night and checkout required an additional mandatory $39 resort fee, state the advertised amount, the fee, the resulting total, and the screen on which the fee first appeared. Do not describe an illustrative amount as a typical fee; your evidence must concern your own booking.
Step 3: Identify every business involved
The company that displayed the offer may not be the company that accepted payment or controlled the reservation. Use the names and addresses on the confirmation, receipt, card statement, and terms.

When an online booking intermediary was involved
Send the complaint to the intermediary because it displayed or sold the offer, and to the hotel because it may have imposed the fee, denied the represented condition, or processed the stay. State which business made each representation instead of sending an identical accusation to everyone.

A comparison page may only have directed you elsewhere. Preserve its result, but focus the refund request on the seller that accepted the booking and the hotel that supplied the room. Ask the comparison service to correct a demonstrably inaccurate listing if it continues to display it.
When the hotel charged you directly
Address the hotel’s reservations or customer-relations team, using the property name, booking reference, and payment record. If a chain or management company appears on the receipt, copy that entity as well.
Step 4: Make a written request for a defined remedy
Use email, an account message center, or another channel that produces a dated record. Attach the evidence in a readable order and ask for a written answer by a reasonable date. Avoid threats and do not claim that a refund is legally guaranteed unless an authority or court has established that for your facts and location.
Include these six elements
- Booking date, property, room, stay dates, seller, and booking reference.
- The exact price, offer, or cancellation condition shown.
- The specific amount charged or term later asserted.
- Why the difference was unavoidable, late-disclosed, or inconsistent with the representation.
- The remedy you want and the amount, if you can calculate it.
- A response date and a request that any refusal identify the booking term and facts relied upon.
Copy-and-adapt request
On [date], I booked [hotel/room/dates] through [seller], booking reference [reference]. The offer showed [exact price/claim/condition], but I was charged or told [specific discrepancy]. I have attached [screenshots, confirmation, receipt, messages]. Please [refund $/£/€ amount, remove the disputed mandatory charge, or honor the stated offer] and explain your decision in writing by [reasonable date].
Choose one primary remedy. If the fee made the advertised total inaccurate, request removal or reimbursement of that fee. If the represented cancellation right was different, request the promised cancellation and refund or, if you still want the stay, confirmation that the stated terms will be honored. You can offer a reasonable alternative, but do not let several possible demands obscure the core discrepancy.
Recommended Free Tools
Keep a log of dates, case numbers, names, and attachments. If the business makes a partial offer, ask whether it resolves only the disputed charge or the entire complaint. If it rejects the request, ask it to identify the exact rate rule, fee disclosure, and cancellation term it relies on.

United States: what the federal lodging-fee rule changes
The Federal Trade Commission’s Unfair or Deceptive Fees Rule took effect on May 12, 2025. It covers businesses advertising or offering short-term lodging, including hotel rooms and vacation rentals. For covered offers, the total price—including known mandatory fees—generally must be disclosed upfront and prominently.
What must be in the upfront total
A required resort fee is part of the total price. Government charges, shipping charges, and optional extras can be excluded from the initial total, but they must be disclosed before payment and included in the final amount paid. A fee that cannot be declined is not optional merely because it is listed under a separate label.
How to use the rule in a request
Point to the screen where the first price appeared, the screen where the mandatory charge was added, and the final receipt. Explain whether the fee was known to the seller and unavoidable. The rule addresses disclosure duties; it does not make every booking automatically refundable. Contract terms, state law, the identity of the seller, and the facts of the transaction can still affect the remedy.

Reporting suspected violations
You can report suspected conduct to the FTC through ReportFraud.ftc.gov. The FTC says a business that violates the rule may be ordered to comply, refund money, or pay civil penalties. A report helps the agency identify conduct and may support enforcement, but it is not a guaranteed individual refund process. Continue pursuing the written request and any available payment-provider dispute at the same time.
United Kingdom: hidden charges, discounts, and scarcity claims
The Competition and Markets Authority’s hotel-booking work addressed hidden charges, promotional and discount claims, scarcity messages, and the way booking information is presented. Its 2019 case page records formal commitments and compliance activity by booking sites.
CMA principles say popularity and availability statements should be clear, disclose relevant limitations, and be supported by the site’s data. A time-limited offer must actually end when the stated period ends; an offer should not be described as time limited if it will continue beyond the stated period.

The CMA materials establish regulatory expectations, not an automatic refund for every affected customer. Ask the seller for the remedy first, then use the appropriate official UK consumer-advice or complaint route for the transaction’s circumstances.

EU consumer guidance warns that a price-reduction claim can mislead when the reference price has been inflated. It also says consumers should receive transparency when prices are personalized through profiling. Save the reference price, the current price, the explanation of the reduction, and any notice that the price was tailored to you.
For an unfair-pricing concern, the guidance directs consumers to their national consumer association or the European Consumer Centres network. The Your Europe guidance was last checked on April 30, 2026. It is not a universal hotel-refund ruling: national law, the seller’s location, the hotel’s location, and the booking facts determine the available remedy. For a cross-border booking, provide both businesses’ countries and ask which body has jurisdiction before filing.
Step 5: Escalate in a controlled order
- Complete the seller and hotel complaint. Give the businesses the evidence and a reasonable response date. Keep the request factual and specific.
- Use the official jurisdictional channel. Select the consumer-protection agency, advice service, national consumer association, or cross-border network that covers the hotel or seller. Include your timeline, attachments, booking terms, and the response or refusal.
- Ask your card provider about its dispute process. The provider can explain applicable grounds, documentation, and deadlines for your card and country. Ask what happens if you have already accepted a partial refund or are still in possession of the service.
- Preserve every submission. Save confirmation numbers and copies of forms. A regulator report may support enforcement or advice but does not guarantee that the agency will recover your money.
Payment disputes are not a substitute for proving the advertisement was misleading. Do not assume that a chargeback will succeed, and do not wait for a regulator before checking the card provider’s deadline; those rules and outcomes vary.
Match the remedy to the actual problem
| Problem shown by the evidence | Reasonable request | Useful supporting material |
|---|---|---|
| Mandatory fee added after the first price | Refund or removal of the disputed fee, or the difference between the advertised and required total. | Initial price, checkout breakdown, receipt, and proof the fee was unavoidable. |
| Confirmed cancellation right denied | Honor the stated cancellation and refund the amount covered by that condition. | Cancellation text, confirmation timestamp, cancellation attempt, and refusal. |
| Wrong room, occupancy, date, or currency used | Correct the booking or refund the resulting overcharge. | Search parameters, selected room page, confirmation, and payment record. |
| False discount or reference price | Refund the demonstrated overcharge or another remedy the seller can substantiate. | Reference price, sale price, dates displayed, and comparable terms for the same room. |
| Scarcity or countdown claim did not match the offer | Honor the represented offer or reimburse the difference, if the seller can verify the transaction. | Timestamped message, selected dates and room, and later availability or continued offer. |
Common dispute patterns and the next move
“The result showed one total, but checkout charged more”
Compare the first result, the room-selection page, and the final payment page. Identify each added item and classify it as tax, mandatory fee, or optional extra. Request the difference that was unavoidable and appeared too late, rather than demanding reimbursement for an optional item you knowingly selected.
“A resort or facility fee was hidden”
Show that the fee was required to obtain the room or use the advertised rate. Ask where it was disclosed before payment and why the first total omitted it. In the United States, connect the request to the federal upfront-total requirement for covered short-term lodging, while recognizing that the refund decision still depends on the booking and other applicable law.

“The site said free cancellation, but the hotel says nonrefundable”
Locate the exact free-cancellation wording, its deadline, and the room or rate to which it applied. Check whether the confirmation adopted different terms before you paid. Send the evidence to both the intermediary and hotel, request the promised cancellation or refund, and ask the rejecting party to identify the conflicting term and when it was disclosed. If the wording applied only to a different room, date, occupancy, or rate, the dispute may be a selection error rather than a misleading offer.
“A discount or countdown looked urgent, then continued”
Capture the message, its stated end time, and what happened after that time. Verify that the same room, dates, occupancy, and conditions remained available. A continuing offer does not automatically prove you are owed the entire booking price, but it gives the seller and the relevant authority a concrete representation to investigate.
“The price changed while I was deciding”
Save both versions and the time of each. A demand-based price change before booking can be lawful when presented accurately. The stronger issue is a false statement about what the current price included, the room available, or the terms attached to it.

Mistakes that weaken a refund request
- Waiting until the listing, fee breakdown, or cancellation page has changed.
- Sending only a card statement without the advertisement and confirmation that explain the discrepancy.
- Complaining that the price was high without identifying a false or incomplete representation.
- Calling repeatedly but keeping no written record of what was promised.
- Calling a mandatory charge “optional” when declining it would cancel the room or remove the advertised rate.
- Demanding a refund for a clearly disclosed nonrefundable rate solely because plans changed.
- Threatening legal action or asserting a guaranteed right without checking the governing jurisdiction.
- Assuming a regulator complaint, chargeback, or partial credit automatically resolves the rest of the dispute.
- Ignoring the identity of the business that actually took payment.
A compact case file to prepare before escalation
Put the following in one folder or PDF, in chronological order:
- A one-paragraph timeline from search to payment to complaint.
- The first price and offer screenshot, with the search dates, occupancy, room, and currency.
- The complete checkout and itemized receipt.
- The confirmation and terms, including cancellation wording.
- Proof of payment and the names of the hotel and intermediary.
- Your written request, attachments, response deadline, and every reply.
- The exact remedy requested and a calculation of the disputed amount.
- The jurisdictional complaint number or payment-provider instructions, if you escalated.
This file lets a seller, consumer agency, or card provider see the same facts without reconstructing the booking from memory. Keep the originals in case a later reviewer asks when a page was captured.
What a successful resolution can look like
The outcome may be a refund of a mandatory charge, correction of the final total, honoring of the represented cancellation term, cancellation without the stated penalty, or a partial payment that both sides agree resolves the documented difference. An authority may instead provide advice, record the report, seek a broader compliance change, or take no individual action. Get any settlement, credit, or revised cancellation status in writing before treating the matter as closed.
