The reliable fix is a verification workflow, not a better-sounding prompt. Use legal AI to spot issues, organize research, or draft language, then independently verify every case, statute, quotation, pinpoint, and factual assertion against an authoritative primary source before relying on it or filing it. A citation that looks plausible or opens a real document is only a lead until the cited text supports the exact proposition you wrote.
The American Bar Association’s 2025 judicial guidance says generative AI can provide incorrect or misleading information and that, as of February 2025, no known generative-AI tool had fully solved hallucinations. Human verification of all AI output remains essential.
What counts as a hallucination or citation error?
A legal-AI hallucination is a plausible-sounding statement that is false or misleading. The model may invent a case, statute, docket number, quotation, procedural history, factual detail, or legal rule. It may also combine fragments from several authorities into one fictional account.

A citation error is broader. The authority may be real, yet the citation can still fail because it points to the wrong court or date, uses an incorrect reporter or docket number, gives a bad pinpoint, quotes language that does not appear in the source, or cites a passage that does not support the sentence. The practical test is twofold: does the source exist, and does the exact passage support the exact proposition?

Why the risk is material
Published assessments show that hallucination is not a rare edge case. A 2024 assessment of leading AI legal-research tools reported hallucination rates of 17% to 33%. A separate 2024 study asking ChatGPT-4 and Llama 2 specific, verifiable federal-case questions reported rates from 58% to 88%. The figures use different methods and should not be treated as a single benchmark, but both show why a citation must be checked rather than trusted.

Set a constrained task before asking for authorities
Broad prompts encourage a model to fill gaps with likely-sounding material. Put the legal boundaries in the request and require the model to show uncertainty.
Specify the legal frame
- Name the jurisdiction and the exact court level, such as a particular state supreme court, federal district, or circuit.
- Set a date range and identify whether you need current law, historical law, or both.
- State the legal issue, procedural posture, party type, and material facts that must be assumed.
- Limit acceptable source types to primary authorities when the answer will support a filing.
- Ask the model to separate authorities it actually retrieved from search suggestions or unverified leads.
Use an uncertainty instruction
A useful instruction is: Return only authorities you can identify. For each one, provide the full caption, court, date, citation, and a short description of the holding. If you cannot verify an authority or quotation, write “unverified” and do not invent a substitute. Distinguish a holding from dicta and identify the passage that supports each proposition.

This instruction reduces unsupported completion, but it does not replace checking. A model can label an invented citation as verified, so the output remains a research draft rather than evidence.
Eight-step verification workflow
- Constrain the assignment. Record the jurisdiction, court, issue, date range, procedural posture, and permitted source types in the prompt and in your matter file.
- Prefer authoritative sources. Start with official court opinions, statutes, regulations, and a trusted legal database. Treat a model’s source label, hyperlink, or embedded quotation as a lead, not proof.
- Resolve every citation. Search the citation in an authoritative database. Confirm the case caption, reporter or docket number, court, decision date, precedential status, and jurisdiction. Search by caption and date as well as by citation because a typographical error can hide a real case.
- Read the authority yourself. Read the cited opinion or statute, the relevant passage, and enough surrounding analysis to understand the holding, facts, standard of review, and procedural posture. Do not rely on a generated summary.
- Check pinpoints and quotations. Open the official PDF or HTML. Match every quoted word, punctuation mark, bracket, ellipsis, page, paragraph, or section reference. Flag any citation whose document cannot be opened or whose text lacks the quoted language.
- Check current validity. Use Shepardize, KeyCite, or the jurisdiction’s official citator or current-law source as appropriate. Check amendments, overruling, vacatur, abrogation, withdrawn opinions, and later treatment. Record the date of the check.
- Preserve an audit trail. Keep the prompt, model and version, generation date, retrieved documents, working draft, corrections, and completed checklist. Save the exact source passage used for each material proposition.
- Apply a filing gate. No AI-generated authority enters a brief, motion, pleading, opinion, or client advice until the responsible lawyer has personally verified it. A second reviewer should confirm high-risk citations or quotations before filing.
How to verify a case, quotation, and pinpoint
Start with identity, not the proposition
Copy the model’s citation into an authoritative search. If it returns nothing, search the caption in quotation marks, then combine distinctive party names with the court and year. Search the docket number separately when one is supplied. A failure to find the record is a stop signal; do not “repair” an invented case by guessing a similar citation.
Confirm the court and precedential status
Two opinions can share similar captions while carrying different weight. Check the deciding court, panel or en banc status where relevant, publication status, rehearing history, and whether the opinion was withdrawn or superseded. A rule from another jurisdiction may be persuasive, but it is not controlling merely because the wording sounds familiar.

Read the passage in context
Locate the quoted language in the original document. Read the sentences before and after it, the facts to which the court applied the rule, and the disposition. Models often turn a party’s argument, a background statement, or dicta into a holding. Rewrite the draft so its claim matches what the court actually decided.
Validate the pinpoint format
Use the source’s stable page or paragraph numbering. For slip opinions, paragraph numbers may be more reliable than pagination that changes between databases. Confirm that the pinpoint lands on the quoted language and that any parenthetical accurately describes the passage. If the source has no stable pinpoint, identify the section or heading and follow the citation rules applicable to your court.
Compare every component for a mixed citation
Place the model’s citation, the database record, and the original opinion side by side. Compare caption, reporter, volume, first page, pinpoint, court, year, and quotation. If any component belongs to another authority, split the sentence and cite each source separately. Never keep a polished citation simply because most of its fields look right.

What to do when the model cites a statute or regulation
Open the current official code or regulatory text rather than relying on a secondary summary. Verify the title, chapter, section, subsection, effective date, and amendments. Check whether the provision applied on the date relevant to the matter. Read definitions, exceptions, cross-references, and saving clauses that could change the result. For regulations, confirm the issuing agency and version in force; an AI answer can silently combine an old rule with a newer subsection.
Filing, client-advice, and supervision controls
The ABA’s 2025 litigation guidance states: “No brief, pleading, motion or any other paper filed in any court should contain any citations—whether provided by generative AI or any other source—that the attorney responsible for submitting the pleading has not personally read and verified.” Treat that as a minimum control, not a suggestion.

- Assign ownership. Name the lawyer responsible for each citation set and the person who performs any second-level review.
- Separate drafting from approval. A model may produce a first draft, but a licensed lawyer decides what enters a filing or client advice.
- Protect confidentiality. Follow professional duties and firm policy before placing client facts, privileged communications, or personal data into any service. Review retention, training-use, access, and deletion controls.
- Document supervision. Keep the verification record so a supervisor can see what the system produced, what was checked, and what was changed.
- Use a stop rule. If a material authority cannot be opened, its quotation cannot be found, or its current status is unclear, remove the proposition or research it independently.
Failure modes and precise fixes

How to evaluate a legal-AI tool or workflow
Do not rank systems by fluent prose or a claim of being hallucination-free. Compare the controls that make an error detectable and correctable.

Prompt patterns that reduce, but do not eliminate, errors
Authority-first issue spotting
Jurisdiction: [court and governing law]. Date range: [dates]. Issue: [precise question]. First list the controlling statutes and cases you can identify. For each authority provide the full citation, court, date, precedential status, and the exact passage supporting the proposition. Separate retrieved authorities from search leads. If you cannot verify a source or quotation, say “unverified” and do not supply a citation.Drafting from a verified source set
Use only the authorities in the attached verified source list. Do not add cases, quotations, dates, or facts from memory. After each legal proposition, insert the source identifier I supplied. If the source set does not support a proposition, mark the gap instead of inferring a rule.Adversarial citation review
For each citation in this draft, test: (1) does the authority exist; (2) does the court and date match; (3) does the quoted text appear exactly; (4) does the pinpoint land on that text; (5) does the passage support the sentence; and (6) is the authority still valid? Return a table of failures and do not repair a citation by guessing.These prompts make omissions visible, but the person responsible for the work must still open and read each source.
If a hallucinated citation was already filed
- Stop relying on it. Identify every filing, client communication, and internal memo that contains the citation or any proposition derived from it.
- Verify the scope. Determine whether the authority is nonexistent, misquoted, wrongly pinpointed, outdated, or merely misapplied. Preserve the original document and your verification notes.
- Notify the responsible lawyer and supervisor immediately. Do not silently edit a filed document or wait for an opposing party to discover the problem.
- Research the correct authority. Use primary sources and document the replacement analysis. If no support exists, withdraw the proposition rather than substituting another guess.
- Correct the record promptly. The National Center for State Courts guidance says discovered hallucinations should be corrected promptly and that the court and opposing counsel should be notified when appropriate. Follow the applicable procedural rules and the supervising lawyer’s judgment.
- Review the process. Add the failure mode to the matter’s checklist, identify why the gate failed, and require a second reviewer for similar high-risk work.
A final pre-filing checklist
- Every case, statute, regulation, docket, and quoted source exists in an authoritative record.
- The caption, citation, court, date, jurisdiction, and precedential status match the original.
- The quoted language is exact, including alterations, brackets, ellipses, and capitalization.
- Each pinpoint lands on the quoted language or the proposition it supports.
- The passage is read in context and reflects the court’s holding, not dicta or a party’s argument.
- Current-law treatment, amendments, vacatur, and overruling have been checked.
- Facts and procedural history in the draft are supported independently.
- Confidentiality, retention, and access controls comply with professional obligations and firm policy.
- The prompt, model/version, source set, dates, corrections, and reviewer approval are preserved.
- The responsible lawyer has personally verified every authority before submission.
Legal AI is most defensible as an assistant for organizing questions and drafting from a verified source set. It is not the final authority. The filing lawyer remains responsible for accuracy, competence, supervision, confidentiality, and prompt correction of errors.
