Start with the game’s credits, packaging or store listing, official website, and copyright notice. Use those sources to identify the developer, publisher, and named claimants, then verify the likely parties in copyright and trademark records. Finally, confirm in writing that the person or company you contact controls the exact asset, territory, media, term, and use you need. A publisher or credit line is a lead—not proof that it owns every character, recording, logo, or other element in a game.
Define exactly what you want to license
Ownership research is only useful when the proposed use is specific. A request to show gameplay footage in a documentary can involve different rights from a request to reproduce a character on merchandise, use the game’s title in advertising, or synchronize its music with a video. Before searching, write down the complete rights package.
- Game identity: title, edition, release year, region, platform and any remaster, expansion or bundled version.
- Asset: the complete game, source code, gameplay footage, screenshots, character art, story, dialogue, logo, title, soundtrack, individual recordings, promotional art or another element.
- Use and media: advertising, editorial publication, film, streaming, social media, merchandise, live events, software, a website or another channel.
- Commercial terms: whether the use is commercial, sponsored, monetized, internal or non-commercial; whether you need exclusivity; and whether you will modify the asset.
- Scope: countries or territories, language versions, platforms, audience, launch date, duration and any renewal period.
These details determine which rights must be cleared and which records are relevant. A worldwide, perpetual license for a logo and a one-time editorial clip are not the same transaction. Game creators and publishers may hold different rights, and pre-existing third-party material can sit inside the same product.
Build an attribution file from the game and its official channels
Collect clues before searching government databases. Save screenshots or PDFs, record the date you accessed each page, and copy legal company names exactly rather than relying on a studio nickname or brand.

Check the in-game credits
Use the credits menu, title screen, manual and end-credit sequence. Note the developer, publisher, producer, composer, music supervisor, licensors, middleware providers and any copyright line. A credit may identify a contributor without saying who currently owns that contributor’s work, so treat every name as a lead to verify.
Review packaging and store listings
Physical packaging, instruction books and digital store pages often identify the publisher, copyright claimant, distributor and edition. Capture the listing for the exact platform and region you plan to use. Store metadata can change, and a distributor or platform operator is not necessarily the copyright owner.
Inspect the official website and announcements
Look for legal notices, licensing pages, privacy or terms pages, press releases, investor announcements and acquisition news. Record the full legal entity, former names, subsidiaries and the date of each statement. A studio may have been acquired, renamed or dissolved after the game shipped.
Read every copyright notice
Copyright notices in the game, manual, website or promotional assets can identify a claimant and year. The Library of Congress recommends examining notices, publishers and authors as initial leads. A notice does not establish that the named party controls every component today, but it gives you names to test against formal records.
Search U.S. copyright records
For a U.S. clearance, search the U.S. Copyright Office records by the game title, likely claimant, developer, publisher and individual creator names. Search spelling variants, former company names and titles for expansions or ports. Records from 1978 onward are available online. The Office says registrations, renewals and transfers from before 1978 require a manual search.

What to examine in a result
- Work title and type: determine whether the entry concerns a computer program, audiovisual work, sound recording, musical composition, artwork or another component.
- Claimant and authors: compare the legal names with the credits and corporate documents you collected.
- Registration date and number: record them for your file, but do not treat registration alone as proof of present-day control.
- Recorded documents: inspect assignments, licenses, security interests, mergers, name changes and other transfers.
- Scope clues: check whether the record covers the edition or element you intend to use rather than a different version.
A registration search is evidence to follow up, not a complete chain-of-title certificate. A record may omit later private agreements, a transfer may cover only selected rights, or the registration may concern one component while your request covers another. If the ownership trail stops, ask the prospective licensor to explain the missing link and provide confirmation or documentation.
When a manual search is needed
If the relevant work or transfer predates 1978, use the Copyright Office’s manual-search process. Circular 22 and Circular 23 describe the Office’s recommended approaches for records and transfers. Allow extra time for a pre-1978 investigation and keep a written record of the search terms, dates and results. An unsuccessful search does not make the game free to use.

Search trademarks separately for titles and logos
Copyright and trademark protect different subject matter. If your license uses the game title, logo, character name, publisher mark or another source-identifying brand, search trademark records in every relevant jurisdiction in addition to copyright records.
Use the trademark record to test identity and assignments
In the United States, search the U.S. Patent and Trademark Office database for the exact wording, design mark, owner name and related goods or services. Inspect the registration status, owner address, filing and renewal information, and recorded assignments. The USPTO directs owners to its Assignment Center for recorded ownership changes.
A trademark result can show who claims a name or logo for specified goods and services. It does not prove that the same party owns the game’s code, artwork, characters, story, music or recordings. Conversely, the absence of a federal registration does not by itself establish that a title or logo can be used without permission. Match the proposed use and territory to the relevant trademark rights.

Map the game’s rights element by element
Do not assume that one contract covers the entire game. A modern title can combine original work, employee-created material, commissioned work and pre-existing licensed content. Use an asset map to identify the party that must approve each part.

WIPO’s 2026 overview of video-game rights describes developers and publishers as rights holders for many elements while noting that games may contain pre-existing, separately licensed material. Ask specifically whether each requested element was created for the game or brought in under a third-party license. The answer can change the number of permissions you need.
Compare possible counterparties before choosing whom to contact
Several names may appear in credits and records. Compare them against the rights you actually need rather than choosing the most recognizable brand.

Evaluate each candidate on six points: the asset controlled, the legal right involved, territory, requested media and uses, term and exclusivity, and evidence of authority including transfers and sublicensing power. A party that can authorize gameplay footage may still lack power to clear a recording embedded in that footage.
Contact the likely rights holder through an official channel
Use the legal, licensing or business-development address published by the likely rights holder’s official website or corporate filings. Avoid relying on an old social-media account, an unaffiliated fan page or a reseller. State the exact game edition and attach your asset map so the recipient can route the request to the correct owner.

Questions to ask in the first exchange
- What legal entity currently owns or controls each requested asset?
- Did the company acquire the rights from another developer, publisher or creator, and can it document that transfer?
- Does the authority cover the countries, languages, platforms, media and duration in your proposal?
- Can the company sublicense the rights, or are separate permissions required from a composer, performer, artist, writer, trademark owner or other licensor?
- Are there approval, attribution, editing, brand-safety or distribution restrictions?
- Who is authorized to sign the grant, and which entity will be named as the licensor?
Ask the contact to confirm authority over the specified asset rather than accepting a general statement that the company owns the game. If the contact cannot answer an asset-specific question, pause that portion of the project and identify the additional rights holder.
Put the permission in a written, asset-specific grant
Verbal assurances, a credit line and an email saying “that should be fine” are not a dependable license. The Library of Congress recommends written permission that identifies the material, duration, intended use and context. Your agreement should also state the territory, media, language, edition, exclusivity, payment, attribution, editing rights, approvals, warranties, indemnities and termination rules appropriate to the transaction.
Minimum information for a permission request
- Game title, edition, platform and release year.
- Exact asset, such as a named character image, a specific recording, a logo or a defined number of seconds of footage.
- How the asset will appear, including edits, captions, synchronization, placement and surrounding content.
- Media and distribution channels, including websites, apps, broadcast, theaters, events, physical products or social platforms.
- Countries, languages, launch date, license term and renewal option.
- Commercial status, compensation proposal and whether the license is exclusive.
- Required credit, approval process, delivery format and technical restrictions.
- Name and title of the authorized signatory and the legal entity granting the rights.
A concise request structure
Subject: Permission request for GAME TITLE, EDITION, and ASSET
We request permission to use ASSET from GAME TITLE, EDITION, in MEDIA and CONTEXT.
The proposed territory is TERRITORY, the term is TERM, and the use is COMMERCIAL OR NON-COMMERCIAL.
Please confirm which legal entity controls this asset, whether any third-party approvals are required,
and whether the proposed use, edits, platforms and distribution are authorized.
Please identify the authorized signatory and provide written terms covering the asset, territory,
media, duration, exclusivity, attribution and approval requirements.Keep the signed agreement, schedules, asset files, approvals and correspondence together. If the deal covers multiple assets, list each one rather than relying on a broad reference to “the game.”

Records can disagree. A credit may name a studio while a trademark record names a parent company; a copyright entry may show an earlier claimant; a publisher may have distribution rights but not music rights. Reconcile the differences by asking for dated transfer documents, acquisition information, licensing schedules and a statement of current authority.

Stop when the chain of title is unclear
Do not publish, distribute or sell the material while ownership is unresolved. Limit the project to elements with documented permission, or replace the disputed asset. If the records conflict, the rights are valuable, or the proposed use is high-risk, engage a rights-clearance specialist or attorney in the relevant jurisdiction.

An unlocated owner is not permission
The Library of Congress states: “There is no special legal protection for using works just because they are orphan works, so you cannot use a work without permission simply because the rights holder cannot be easily located.” A diligent search may help document your efforts, but it does not convert an unidentified work into public-domain material or eliminate liability.
Account for territory and jurisdiction
The Copyright Office and USPTO procedures described above are U.S.-specific. Copyright and trademark ownership, record access, moral rights, publicity rights and licensing formalities vary by country. WIPO’s international industry context is useful for understanding the mix of rights in games, but it is not a jurisdiction-specific legal opinion.
If your use is outside the United States, search the applicable national or regional copyright and trademark offices, review local assignment records and ask counsel whether additional permissions apply. A U.S. registration or trademark record does not automatically establish rights everywhere. Define territory in the agreement and confirm that the licensor can grant rights in every country where the material will be available.
Use a final clearance checklist before release
- The title, edition, platform and territory match the material you will actually use.
- Every asset is listed separately, including music, recordings, characters, logos, footage and promotional art.
- Credits, notices, official sources and government records have been preserved with access dates.
- Copyright searches include title, claimant, company, creator and former-name variations.
- Transfer and assignment records have been reviewed, with unresolved gaps documented.
- Trademark searches cover the title, logos and other source-identifying marks in relevant jurisdictions.
- Third-party licenses and performer, composer, artist, writer or publicity approvals have been identified.
- The signer’s legal entity and authority to sublicense the requested rights are confirmed.
- The written grant states asset, territory, media, use, term, exclusivity, attribution, approvals and restrictions.
- Signed terms and asset-specific approvals are stored where the production and legal teams can retrieve them.
The practical route is therefore attribution first, records second, asset-by-asset verification third and written permission last. That sequence gives you a defensible answer to both questions a licensing project must resolve: who appears connected to the game, and who can legally authorize the particular use you plan to make.
