To find U.S. jobs where H-1B sponsorship may be possible, use past USCIS and Department of Labor filings to identify employers worth investigating, then verify a live opening and ask the recruiter whether the company will sponsor that specific role and applicant. A filing history is a lead—not a promise that an employer will sponsor a current vacancy.

The most reliable approach combines three kinds of evidence: historical employer activity, labor-condition details that resemble your occupation and location, and a current answer from the hiring organization. Treat each as a separate checkpoint. This avoids spending weeks pursuing a posting that only appears sponsorship-friendly because the company sponsored someone in a different job several years ago.

What H-1B sponsorship records can—and cannot—tell you

H-1B employer records help you build a shortlist. They can show that an employer has participated in the program, and Department of Labor records can add context about occupations, work locations, and wages. Neither type of record establishes that the employer has an open job today, still sponsors similar positions, or will file a petition for you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep the stages of the process distinct. Employers submit a Labor Condition Application (LCA) through the Department of Labor’s FLAG system. DOL says that after an LCA is certified, the employer may proceed through the USCIS and Department of State process. An LCA is therefore useful evidence of labor-condition activity, but it is not itself an H-1B petition or proof that a particular job offer will result in sponsorship.

The most useful question is not simply, “Has this company sponsored H-1B workers?” It is, “Does this employer have recent activity that resembles my target occupation and work location, a relevant opening that is active now, and a willingness to sponsor someone in my circumstances?”

Public records are best used as screening evidence. They cannot tell you whether a hiring manager has an internal “no sponsorship” rule, whether a position is funded, or whether the employer’s policy changed after the filing year you found. They also do not evaluate your own immigration history, degree, job duties, or timing. Those questions require a direct employer response and, when needed, individualized legal advice.

Step 1: Define the job and location you are targeting

Before searching employer records, write down the role types and places where you can realistically work. DOL labor-condition records are associated with occupations and intended employment areas, so a company-wide filing count may be much less useful than activity related to your target work and location.

What’s actually slowing this PC down?

  • Role: List the job titles you are pursuing and close variants employers might use. Compare the actual duties and occupation context, not just a matching word in a title.
  • Location: Identify the city, state, or ZIP code you would target. If you are open to more than one area, track each one separately rather than treating the employer’s nationwide activity as a match.
  • Work authorization question: Be clear about what you need the employer to do. Depending on your circumstances, you may need to ask about a new cap-subject petition, a transfer, or an extension. These are different questions; do not assume an employer’s answer to one covers the others.
  • Timing: Note any date by which you need an employer decision, such as the end of current work authorization or a planned start date. Recruiters need this information to assess whether their process can accommodate you.
  • Work arrangement: Record whether you can work only at a particular site or can consider another intended employment area. The location connected with a labor-condition filing matters, especially when a posting lists several offices.

This target list gives you a basis for comparing records. A company with substantial activity in an unrelated occupation or location may be a weaker lead for your search than an employer with more directly relevant activity.

Step 2: Build an employer shortlist with USCIS history

Search the USCIS H-1B Employer Data Hub for employers connected to your target role and geography. USCIS describes searches by fiscal year, NAICS code, employer name, city, state, or ZIP code. Its FY2024 characteristics report says the Hub covered fiscal years 2009 through 2024 and was updated quarterly. Because that coverage period comes from the FY2024 report, check the live Hub for the newest available release before treating any year range as current.

  1. Search the employer name or a relevant location or industry field.
  2. Review the fiscal years available and note which years show activity. Recent and continuing activity is a more relevant screening signal than an old filing alone, but it still does not predict an outcome for your application.
  3. Record the employer’s legal name and any aliases or name variations you encounter. A search under a familiar brand name may not capture records filed under a different legal entity.
  4. Keep the search criteria and years you checked in your notes so you can distinguish a searched employer from one you have not yet investigated.
  5. Look for continuity rather than a single large year. A recurring pattern can justify further checking, while one isolated record needs stronger confirmation from a current posting and recruiter.
  6. Separate the employer’s different locations or business units in your notes. Activity in one city or subsidiary should not automatically be treated as evidence for every office.

Use the Hub to generate leads, not to declare a company a “sponsor” for every role. A search result describes past program activity at the level reflected in the data; it does not state the employer’s current hiring policy or make a commitment to a particular candidate.

Step 3: Cross-check relevant details in DOL LCA records

Use DOL LCA information to see whether the employer’s filings appear connected to the work and geography you want. DOL explains that employers submit LCAs electronically through FLAG and that certified applications may proceed through later immigration steps. Compare the employer, occupation, worksite, and wage context rather than relying on a raw total of company filings.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The wage information has a specific meaning. DOL says employers must attest to paying at least the higher of the actual wage paid to similarly experienced and qualified workers or the prevailing wage for the occupation in the intended employment area. That makes LCA information useful context for understanding a role and work location; it does not guarantee that a current posting has the same terms or that you will be offered a particular wage.

DOL’s public-access guidance describes records employers must make available, including the LCA, wage rate, prevailing wage and its source, and notice documentation. Additional records apply to certain H-1B-dependent employers and willful violators. These records can help you understand the labor-condition context, but do not treat them as a substitute for asking the hiring organization about a live position.

When you compare an LCA with a posting, check whether the occupation appears reasonably related to the listed duties, whether the intended employment area resembles the advertised worksite, and whether the timing is recent enough to be meaningful. A mismatch does not prove that sponsorship is unavailable; it simply lowers the value of that record as evidence for this particular opening.

Step 4: Find and verify a live opening

Once you have a shortlist, search each employer’s own careers page. Job boards, sponsor directories, and search results can help uncover leads, but the employer’s current listing is the best place to confirm that a vacancy is still active and to read the terms the company has chosen to publish.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Search the employer’s careers site using the job titles and variants from your target list.
  2. Filter or search for the locations you are willing to work in, then read the full posting for the role’s duties and worksite.
  3. Look for explicit work-authorization language. Record whether the posting mentions sponsorship, requires existing authorization, or says nothing about sponsorship. Silence is not confirmation either way.
  4. Check that the role is still listed on the employer’s site and save its URL and the date you checked. Recheck before applying or following up if time has passed.
  5. Compare the role and location with the historical employer records. A general company history is less informative when it does not resemble the opening you found.
  6. Check for duplicate postings with different requisition numbers. One may be closed, limited to a different office, or written for a different level even when the title looks identical.

Read the authorization language literally. “Must be authorized to work without sponsorship” is different from “sponsorship may be available,” and neither phrase answers every question about a transfer or extension. A posting that says nothing may reflect a template rather than a policy decision, so ask instead of guessing.

Do not assume an old job-board listing remains open, or that a directory’s sponsor label applies to every team, position, or applicant. The question to resolve is whether the employer is currently considering sponsorship for this vacancy.

Step 5: Ask about sponsorship for this vacancy and your situation

Ask the recruiter early enough to avoid a long application process built on an incorrect assumption. Make the question specific to the position and the kind of support you need. A useful message is:

“I’m interested in the [job title] role in [location]. For this vacancy, does the company consider H-1B sponsorship for a candidate who needs [a new cap-subject petition / a transfer / an extension]? If so, are there timing or work-authorization requirements I should know about?”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Replace the bracketed text with your actual circumstances; do not send several alternatives if you already know which applies. If you are unsure which category fits, get qualified immigration advice rather than guessing. The goal of the recruiter question is to learn the employer’s policy for the opening and whether your needs fit it, not to ask the recruiter to decide your legal eligibility.

Useful follow-up questions include:

  • Does the answer apply to this requisition and hiring team, or only to the company generally?
  • Would the company consider a new cap-subject filing, an H-1B transfer, or an extension in this role?
  • Are there start-date, worksite, or existing-authorization requirements?
  • Who can confirm the policy if the recruiter does not handle immigration matters?
  • When should you raise the issue again if the application advances?

Interpret replies narrowly. A general statement that a company has sponsored workers before is not confirmation for this role. A posting that says sponsorship is available may still have role-specific conditions. Ask whether the answer applies to this vacancy and your work-authorization needs, and note any timing limits or other conditions the recruiter identifies.

If the answer is unclear, politely restate the exact role and support you need in writing. If the answer is no, record it and move on rather than trying to infer an exception from historical filings. If the recruiter says the question is decided later, ask at which stage and who makes the decision; that helps you plan without treating uncertainty as approval.

Step 6: Track leads so you can prioritize follow-up

A simple tracking sheet prevents historical records, current openings, and recruiter answers from getting conflated. Use one row per employer and, when necessary, separate rows for different openings at the same company.

Field What to record Why it helps
Employer legal name and aliases The name searched and any related names found in records or postings Reduces confusion when an employer’s public-facing name differs from a filing name.
USCIS search Fiscal years and search fields checked; relevant activity noted Shows what you actually reviewed and helps distinguish recent activity from older records.
DOL comparison Related occupation, worksite or intended employment area, and wage context Keeps the comparison tied to your target role and location.
Live opening Employer careers-page URL, job title, location, and date checked Makes it possible to verify that you are following up on a current vacancy.
Posting language Any stated work-authorization or sponsorship terms, or that none were stated Separates explicit posting language from assumptions based on silence.
Recruiter response Answer, date, and whether it addressed this opening and your sponsorship need Preserves the scope of the employer’s answer.
Application and follow-up Application status and a follow-up date, if appropriate Helps manage next steps without treating a filing record as an application outcome.
Timing notes Any stated start-date, authorization, or internal review deadline Shows whether the employer’s process may fit your practical timeline.

Prioritize employers using several signals together: how recent and continuous the USCIS activity is, whether DOL records resemble your occupation and area, whether a relevant posting is active, whether its authorization language is clear, and whether a recruiter confirms sponsorship for your case. There is no reliable single company-wide filing count that can substitute for those checks.

A practical comparison method for two employers

When several employers look promising, compare them on the same axes instead of choosing the one with the largest headline number. First, compare recency and continuity of USCIS activity. Second, ask whether DOL filings match the occupation and intended employment area. Third, verify that each employer has an active posting whose duties and location fit your target. Fourth, weigh the clarity and date of the recruiter’s answer. Finally, retain the wage and worksite context as a check on whether the historical records are genuinely comparable.

This method prevents a common error: treating volume as probability. An employer with many filings may use sponsorship only in a narrow business unit, while a smaller employer with a recent, role-matched filing and a clear affirmative answer may be a more practical lead. The comparison still cannot guarantee a petition or approval.

Common mistakes that lead to false confidence

  • Equating a past filing with a current commitment. Records show past activity, not a promise to file for a specific job seeker. Verify the vacancy and ask the employer directly.
  • Counting every filing as a match. Activity in another occupation or intended employment area may not be relevant to the opening you want. Compare the role and location.
  • Treating an LCA as a visa or petition. An LCA is a labor-condition step in the process. DOL describes additional USCIS and Department of State steps after certification.
  • Assuming every H-1B job must first be advertised to U.S. workers. DOL says H-1B employers generally need not recruit U.S. workers before seeking H-1B workers. Additional recruitment obligations apply to H-1B-dependent employers and willful violators in specified circumstances, not universally.
  • Reading silence as approval or rejection. If a posting does not address sponsorship, ask. Do not infer the employer’s answer from missing language.
  • Relying on a third-party ranking as an official sponsor list. A directory can be a discovery aid, but it does not replace USCIS and DOL records or confirmation for a particular opening.
  • Ignoring the legal employer. A brand, staffing company, parent, and subsidiary may appear separately. Confirm which entity would employ you and file any petition.
  • Waiting until an offer to disclose timing constraints. Ask early enough to learn whether the employer’s process can accommodate your authorization timeline, while recognizing that the recruiter is not your legal adviser.

Check current rules before making a time-sensitive decision

Immigration requirements can change, and an employer’s history does not tell you which rules apply to your petition. The Department of Labor’s H-1B overview surfaced a September 2025 presidential proclamation concerning certain petitions; a Department of Homeland Security announcement described a change to cap selection for FY2027 with an effective date of February 27, 2026. Those notices are time-sensitive. Consult the current official notices for operative details, and do not assume a general announcement determines who must pay a fee, which petitions are affected, or how selection applies to your circumstances.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For an individualized assessment—particularly if you are unsure whether you need a new cap-subject petition, a transfer, or an extension—consult a qualified immigration attorney. The employer’s recruiter can explain the company’s hiring policy; legal advice is needed to assess how immigration rules apply to your case.

Frequently Asked Questions

How can I find jobs that sponsor H-1B visas?

Use the USCIS H-1B Employer Data Hub to identify employers with relevant historical activity, cross-check occupations and worksites in DOL LCA records, then verify a current opening on the employer’s careers page. Ask whether that specific vacancy supports your needed petition type. Historical activity alone is not confirmation.

Which companies sponsored the most H-1Bs?

A large company-wide filing count is not enough to choose a job. Compare recency, continuity, occupation, intended employment area, active posting language, and recruiter confirmation. USCIS data cover historical fiscal years and should be checked in the live Hub for the newest release; do not treat third-party rankings as official guarantees.

Does an LCA mean my employer will sponsor me?

No. An LCA is a Department of Labor labor-condition step. After certification, an employer may proceed through USCIS and the Department of State process, but the LCA does not prove that a matching job is open or that the employer will file for you.

What should I ask a recruiter about H-1B sponsorship?

Name the exact job and location, state whether you need a new cap-subject petition, transfer, or extension, and ask whether the company considers that support for this vacancy. Also ask about timing, worksite, existing-authorization requirements, and who can confirm the policy.

What if a job posting does not mention sponsorship?

Silence is not approval or rejection. Check that the posting is current, then ask the recruiter directly. Record the answer and whether it applies to the exact requisition and your immigration need.

Do all H-1B employers have to recruit U.S. workers first?

No. DOL says H-1B employers generally need not recruit U.S. workers before seeking H-1B workers. Additional recruitment obligations apply to H-1B-dependent employers and willful violators in specified circumstances.

Should I hire an immigration lawyer while job searching?

For questions about your own status, petition category, timing, or eligibility, consult a qualified immigration attorney. A recruiter can explain company policy but cannot replace individualized legal advice.

The Bottom Line

Use USCIS history and DOL LCA details to build a focused employer list, not to predict sponsorship. Match the records to your occupation and worksite, verify a live employer posting, ask about the exact petition support you need, and track the answer and timing. Recheck current official rules and obtain qualified legal advice for case-specific questions.
