Start with the IRS notice, the tax years involved, the type of dispute, and every response date. Then look for a tax controversy attorney whose practice matches that stage—examination, administrative appeal, collection, lien, refund, or court. Verify the lawyer’s active state-bar standing and eligibility to practice before the IRS, and compare written engagement terms before signing. Depending on the matter, an eligible CPA or enrolled agent may also represent you before the IRS.
If cost is a concern, contact a qualifying Low Income Taxpayer Clinic (LITC). Clinics can provide free or low-cost help in audits, appeals, collection disputes and some federal-court cases, but each clinic decides eligibility and whether it has capacity.
Identify the IRS problem before searching
“Tax attorney” is not a sufficient search description. The right professional depends on what the IRS is doing, where the matter is in the process, and what you need the representative to do. Read the notice carefully and create a one-page case summary before contacting anyone.
Build a case summary
- Notice: Record the notice number, date, tax form or account involved, and the IRS telephone number or mailing address shown on it.
- Tax years: List every year at issue. A professional may need to treat each year as a separate matter.
- Stage: Identify whether this is an examination (audit), an administrative appeal, a collection matter, a lien or levy issue, a refund dispute, or a case already filed in court.
- Response date: Write down every deadline and hearing date. Hiring a representative does not automatically extend a deadline. Do not ignore a notice while you search.
- Documents: Gather returns, schedules, notices, IRS transcripts, prior correspondence, payment records and any appeal or court papers.
- Goal: State what you want the representative to accomplish—for example, correcting an assessment, negotiating collection, challenging a penalty, or handling a court case.
If the notice is unclear, ask a candidate whether the office can identify the procedural stage before you agree to representation. A lawyer should be able to explain what is known, what is missing and which date controls the next action without promising a particular result.

Match the search to the procedural stage
| Issue or stage | Experience to look for | Questions to ask |
|---|---|---|
| IRS examination | Representation in audits, information-document requests, substantiation disputes and penalties | How many matters involving this type of examination has the proposed team handled? Who will respond to IRS requests? |
| IRS Independent Office of Appeals | Administrative appeals and settlement discussions after an examination or other determination | Will the engagement include preparing the protest, attending conferences and responding to Appeals requests? |
| Collection | Installment agreements, offers in compromise, currently-not-collectible requests and collection due-process work, when applicable | Will the representative review financial information and communicate with the collection function, or only prepare forms? |
| Lien or levy | Release, withdrawal, discharge, subordination or levy-resolution work appropriate to the notice | What immediate action is available, and is routine lien assistance better handled through the IRS Centralized Lien Operation? |
| Refund or credit dispute | Claims, refund litigation strategy and administrative responses to IRS adjustments | Will the office handle only the administrative claim, or also a court proceeding if necessary? |
| Tax Court or other federal court | Tax litigation and admission to the particular court | Is the attorney admitted to that court, and does the written engagement include pleadings, discovery, hearings and trial work? |
An attorney who mainly prepares returns may not have the controversy experience your case requires. IRS Publication 4134 (Rev. 1-2026) advises taxpayers to ask whether a professional has the expertise needed to resolve their tax problem. Treat that as a screening question, not as a guarantee that a credential or directory listing proves specialization.
Find candidates through authoritative channels
State-bar directories
Use the bar authority for the state in which the lawyer is licensed. Confirm the exact name, license status and any public discipline information. If several lawyers are involved, check each person who may advise you or sign submissions—not only the firm name.
IRS credential information
The IRS credential directory can help you locate attorneys, CPAs and enrolled agents, but it is a candidate-finding resource, not proof that a person handles your kind of controversy. Use it to identify names, then verify current standing with the relevant licensing body and ask for specific experience with your notice and procedural stage.

A referral from another professional or a community organization can produce useful leads, but apply the same independent checks. Ask whether the referral source knows the candidate’s controversy work or is simply passing along a general business contact. No directory or referral replaces a written scope and authority check.
Low Income Taxpayer Clinic finder
If your income and circumstances may qualify, use the current Taxpayer Advocate Service clinic finder or IRS Publication 4134 (Rev. 1-2026). Publication 4134 notes that the listed location is generally a clinic’s main office and that some clinics operate at additional locations. Contact the clinic directly to confirm service area, language availability, eligibility and capacity.
Verify that the person can represent you
Attorney authority before the IRS
IRS Publication 947 states that an attorney admitted in good standing to the bar of a U.S. state, possession, territory, commonwealth or the District of Columbia may practice before the IRS if the attorney is not suspended or disbarred from IRS practice. Confirm both parts: active good standing in the jurisdiction and no IRS practice suspension or disbarment.

The IRS says, “When working with the IRS, all taxpayers have the right to retain an authorized representative of their choice to act on their behalf.” That right does not make every tax preparer an authorized representative for every stage.

Eligible CPAs and active enrolled agents may also practice before the IRS. Choose among an attorney, CPA and enrolled agent according to the actual work required, demonstrated controversy experience, and whether court representation could become necessary. A title by itself does not establish competence in an examination, appeal or collection case.
Limited rights of some preparers
Some return preparers have only limited representation rights. Annual Filing Season Program participants may have limited rights in certain examination matters involving returns they prepared, but they cannot represent taxpayers before IRS Appeals or in collection matters. An active preparer tax identification number (PTIN) alone does not confer broad representation authority. Ask the candidate to identify the authority that applies to your particular stage.
Use the correct IRS authorization form
Ask what authorization the representative will file and what it permits.
| Form | What it does | What it does not do |
|---|---|---|
| Form 2848, Power of Attorney and Declaration of Representative | Designates an eligible representative and grants the specified authority to act for you in the matters and periods listed | It does not give unlimited authority beyond the matters, tax forms and periods stated on the form |
| Form 8821, Tax Information Authorization | Allows the named person to inspect or receive confidential tax information | It is not a power of attorney and does not, by itself, authorize the person to represent you before the IRS |
Read the tax forms and the engagement agreement together. The agreement explains the business relationship; the IRS authorization controls what the representative can do with the agency.

Questions about similar matters
- Have you handled this type of notice or dispute at this procedural stage?
- Which tax years, forms or transactions would the proposed engagement cover?
- What facts or documents normally determine the next step?
- Who will prepare responses, communicate with the IRS and attend conferences?
- Will I work directly with the attorney, or primarily with a CPA, enrolled agent, associate or assistant?
- If the matter moves to Appeals or court, what additional qualification or engagement will be required?
Ask for examples in general terms rather than confidential client details. A useful answer describes the type of issue, forum and work performed without disclosing another taxpayer’s information. Be cautious if a candidate guarantees a refund, penalty abatement, settlement or deadline outcome before reviewing your records.
Test the proposed strategy without demanding a prediction
Before retaining the professional, ask what the office needs to evaluate the case and what uncertainties could change the recommendation. A responsible consultation distinguishes between facts already documented, issues that require transcripts or additional records, and decisions that belong to you. It should not substitute a definitive legal opinion for a review that has not occurred.
Compare engagement agreements and fees
Do not rely on a verbal promise that “the IRS matter” is covered. Request a written engagement agreement and read every definition of scope, billing and termination.

Scope checklist
- Covered matters and periods: List each notice, tax year, return, form and IRS function included.
- Services: Specify document review, transcript requests, correspondence, conference calls, examination meetings, Appeals submissions, collection applications and court work.
- Appeals and litigation: State whether an administrative appeal is included and whether Tax Court or other federal-court work requires a separate agreement.
- Responsible personnel: Name the attorney or other authorized representative who will supervise the file and identify who may perform routine tasks.
- Communication: Set out the primary contact, expected response method, document- sharing process and how urgent notices are escalated.
- Billing method: Identify hourly billing, a fixed fee, a retainer or another arrangement, along with the rate or calculation method for each person.
- Additional expenses: Ask about filing fees, transcripts, expert or investigative work, travel, delivery, copying and work outside the stated scope.
- Changes in scope: Require written approval before substantial additional work begins, when feasible.
- Ending the relationship: Understand how either side may terminate, how unused funds are handled, and how your file and deadlines will be transferred.
The available government materials do not establish a universal private-attorney fee or typical case duration. Any number quoted to you is specific to that professional’s assessment, staffing and scope; compare like-for-like written proposals rather than an online “average.”
Compare proposals on the same facts
| Comparison point | Proposal A | Proposal B | What to verify |
|---|---|---|---|
| Issue and tax years | Write the exact notices and periods | Write the exact notices and periods | Are both proposals addressing the same matter? |
| Primary representative | Name and credential | Name and credential | Who is authorized and who will do the work? |
| Included stage | Examination, Appeals, collection or court | Examination, Appeals, collection or court | Is the next stage excluded or separately priced? |
| Billing and expenses | Method and stated rates | Method and stated rates | What work or expenses can increase the total? |
| Communication plan | Contact and response process | Contact and response process | Who receives urgent IRS notices? |
Do not select solely on the lowest initial quote. A lower price may cover only form preparation while a higher quote may include meetings, Appeals work or a broader document review. The relevant comparison is the work and authority included in writing.
Lower-cost help through Low Income Taxpayer Clinics
LITCs are independent organizations that assist qualifying taxpayers with IRS disputes and educate people who speak English as a second language. They may represent taxpayers in audits, administrative appeals, collection disputes, other tax disputes and federal court. Services are generally free or provided for a small fee, but the clinic—not the IRS—decides whether you qualify and whether it can accept the case.

2026 income guideline
For calendar year 2026, the Taxpayer Advocate Service and IRS Publication 4134 describe a general representation threshold of 250% of the federal poverty guidelines. The published one-person ceilings are:
| Household or geography | 2026 guideline information |
|---|---|
| One-person household, contiguous United States and District of Columbia | $39,900 |
| One-person household, Alaska | $49,875 |
| One-person household, Hawaii | $45,900 |
| Each additional person, contiguous United States and District of Columbia | $14,200 |
| Each additional person, Alaska | $17,750 |
| Each additional person, Hawaii | $16,325 |
These are eligibility guidelines, not a promise of acceptance. Clinics may consider other eligibility criteria, the nature of the dispute, geographic rules, language needs and available capacity. Contact the nearest clinic to confirm the current calculation and services. If your income is above the general guideline, ask whether another exception or service category applies rather than assuming the answer.
What LITCs accomplished in 2024
The Taxpayer Advocate Service reported that LITCs represented more than 21,000 taxpayers in 2024 and educated more than 175,000 taxpayers and service providers. The program also reported securing more than $10 million in refunds and reducing or correcting more than $53 million in tax liabilities. These are program-level results, not an estimate of your likelihood of receiving help or prevailing in a dispute.

Centralized Lien Operation
The IRS Centralized Lien Operation handles routine lien matters. A routine request may not require the same service as a contested liability, levy, bankruptcy issue or court case. Ask the IRS or your representative which channel applies before paying for work that a government unit handles directly.
CP14 notices
For a CP14 notice, USAGov directs taxpayers who disagree with the billed amount to call the telephone number printed on the notice. Keep a record of calls and correspondence. If the issue involves complex evidence, multiple years, collection action or a looming deadline, ask a qualified representative whether additional help is appropriate.
A practical hiring process
- Read and preserve the notice. Make a complete copy, including pages with response instructions and the IRS telephone number.
- List the facts and deadlines. Note tax years, amounts, filings, payments, prior contacts and every date stated by the IRS or a court.
- Choose the needed stage. Search for examination, Appeals, collection, lien, refund or litigation experience—not merely “tax preparation.”
- Create a short candidate list. Use state-bar information, the IRS credential directory, referrals and the LITC finder when applicable.
- Verify authority. Check state-bar standing, IRS practice eligibility and any court admission needed. Ask whether the person has ever been suspended or disbarred from IRS practice.
- Hold structured consultations. Give each candidate the same factual summary and ask who will handle the file, what work is included and what information is still needed.
- Compare written agreements. Put scope, stages, staffing, billing, extra costs, communication and termination terms side by side.
- Authorize only the agreed matters. Review Form 2848 or another appropriate authorization for the correct tax forms and periods. Do not treat Form 8821 as permission to represent you.
- Track the case after hiring. Keep copies of submissions, IRS responses, receipts and calendar dates. Ask promptly when a notice falls outside the engagement.
Warning signs that require clarification
- The person will not identify the individual responsible for your file.
- The proposal uses “all tax issues” without listing notices, years, stages or exclusions.
- The professional promises a guaranteed refund, settlement, penalty removal or court result before reviewing records.
- The agreement does not explain whether Appeals or litigation is included.
- You are asked to sign an authorization with incorrect tax years, forms or representative information.
- The person claims a PTIN or a general preparer credential provides unlimited IRS representation.
- Urgent payment demands are made without a written engagement or explanation of additional costs.
- The office will not explain how it protects and returns your records or how you will learn about new IRS deadlines.
A warning sign is a reason to ask for clarification or obtain another consultation, not proof of misconduct. If a lawyer’s license or an IRS practice status cannot be verified, do not assume the person is authorized.
Use a decision scorecard
After consultations, score each candidate against the same criteria and keep notes. A simple written comparison reduces the chance that a polished sales conversation will outweigh a poor fit.
| Criterion | What a strong answer looks like | Evidence to retain |
|---|---|---|
| Issue match | Recent work at the same IRS stage and involving comparable forms or transactions | Interview notes describing the type of work, without confidential client details |
| Authority | Verified state-bar standing and eligibility for the required IRS or court forum | License lookup and representative information |
| Responsible person | A named professional will supervise and explain who performs routine tasks | Engagement letter and staffing description |
| Scope | Notice, years, submissions, meetings, Appeals and court exclusions are stated | Signed written agreement |
| Cost transparency | Billing method, rates or calculation, retainer handling and extra expenses are explained | Fee section and written answers to questions |
| Access and communication | There is a practical process for urgent notices and status updates | Communication plan and contact details |
| Lower-cost alternative | You checked whether an LITC or issue-specific public resource fits | Clinic contact record or explanation of why it does not apply |
What to bring to the first meeting
- The complete IRS notice and envelope, if the mailing date matters.
- Federal and state returns for the years involved, including schedules and amended returns.
- IRS account transcripts, correspondence, examination requests and prior appeal submissions.
- Payment confirmations, installment-agreement records, lien or levy documents and collection notices.
- Organized records supporting income, deductions, basis, credits, business activity or other disputed facts.
- A chronology of IRS contacts, names or identification numbers provided by representatives, and what was promised.
- Your questions about scope, fees, Forms 2848 or 8821, communication and possible escalation to Appeals or court.
Label documents by tax year and keep the originals. Ask whether the office wants a secure upload rather than ordinary email, and confirm when the file is considered complete enough for an initial evaluation.
Bottom line for choosing counsel
Choose the professional whose verified authority, controversy experience, written scope and communication plan fit your exact IRS stage. An attorney may be the best match when litigation or complex legal questions are possible; an eligible CPA or enrolled agent may be appropriate for other IRS representation when that person has demonstrated experience with your issue. If you may qualify, an LITC can offer free or low-cost assistance. Whichever route you choose, preserve every deadline, use the correct IRS authorization and obtain the agreement in writing before work begins.
