To find out whether a restaurant filed for bankruptcy, search the federal PACER Case Locator by the restaurant’s name, then confirm the filing and current notices in the court’s docket. To check a gift card or deposit, look for case-specific orders and notices: bankruptcy does not automatically cancel every card, guarantee that a restaurant will honor it, or promise a refund. The debtor’s exact legal identity, the payment date, and the court’s current instructions all matter.
How do I find out if a restaurant filed for bankruptcy?
Start with the restaurant’s name, but do not assume the familiar brand name is the company that filed. A restaurant may be operated by a parent company, an affiliated entity, or a franchisee. The case documents—not the storefront name or a news report—should establish who the debtor is and whether that entity is connected to your location or transaction.
If you do not know which federal court handled the filing, search the PACER Case Locator. It searches federal bankruptcy cases nationwide and its index updates daily; newly filed cases typically appear within 24 hours. A PACER account is required to search and view records. If you know the court, searching its own case-record system can provide information updated immediately rather than waiting for the locator’s next index update.

- Search the restaurant’s familiar name, including an exact-name search if the locator offers that option.
- If nothing appears, try the parent company, operating company, or legal entity shown on a receipt, reservation contract, or the restaurant’s terms.
- When a result looks plausible, open the case record and check the petition or other filed documents for the debtor’s legal name and the relationship to the restaurant you used.
A brand may operate through several legal entities. One location’s operator could be the debtor while another location, franchisee, or related company is not. Do not infer that all restaurants using the same name are included just because one entity filed.

Where can I look up a restaurant bankruptcy case?
Use PACER for federal bankruptcy records. The nationwide locator is useful when you do not know the district; the specific bankruptcy court’s electronic docket is the better place to confirm the latest entries once you know where the case is pending. PACER’s locator is an index, not a replacement for the current docket. Federal PACER does not include state or county court cases, so a search that finds no bankruptcy case does not rule out a state-court receivership or another non-bankruptcy proceeding.

Federal bankruptcy records can also be reviewed at a clerk’s office. Most bankruptcy courts offer limited automated telephone information. If you cannot identify the case or interpret a public docket entry, ask the bankruptcy clerk for help locating records. Clerks can assist with court-record access, but do not treat them as a substitute for legal advice about your rights or likely recovery.
What case details should I verify?
Before relying on a result, record the exact debtor name, case number, court, filing date, bankruptcy chapter, and current status. These details help distinguish similarly named companies and make sure you are reading the right case. The petition and docket should confirm the legal entity; do not guess the relationship between a brand and a debtor from the name alone.

Next, review the docket itself, not only a search-result snippet or a news headline. Begin with the petition and early motions or orders that could address customer programs. Then check later entries, because a subsequent order or notice may change an earlier arrangement. Useful docket search terms include “gift card,” “customer program,” “deposit,” “bar date,” “proof of claim,” “sale,” “liquidation,” and “claims.” These are search prompts, not a guarantee that every case will contain a document under those labels.
Can I still use my gift card if a restaurant files for bankruptcy?
Possibly, but the filing alone does not answer the question. A restaurant operating in Chapter 11 may ask the court for permission to honor gift cards bought before the bankruptcy filing. The court may authorize redemption subject to conditions or limits. The restaurant might also stop accepting cards, particularly if the business closes or is liquidated. Check the current court order and the operator’s actual redemption policy before relying on the card for a meal or event.
Separate three questions when you investigate:
- Is the card currently being honored? Look for an order authorizing redemption, including any stated limits, and confirm the business is actually accepting cards.
- Does that order cover your location and card? Check the debtor and any relevant operating entities, locations, purchase dates, or other limits in the document. A franchise or affiliate may not be part of the debtor’s case.
- What happens to unused value if redemption ends? You may be able to assert a monetary claim, but whether it is allowed, what priority it receives, and whether any payment is made are separate questions.
A 2017 bankruptcy decision involving a restaurant debtor illustrates why the docket matters: the court permitted gift-card redemption while the debtor continued operating in Chapter 11, but expressly did not decide the general priority status of prepetition gift-card claims. That ruling is an example from one case, not a nationwide rule for other restaurants.

What happens to a restaurant gift card in Chapter 11?
Chapter 11 is a reorganization process, but a Chapter 11 filing does not itself guarantee that the restaurant will remain open or keep honoring cards. A debtor may request authority to redeem cards while it operates. Read the motion and resulting order to learn whether the court allowed redemption, when it applies, and whether the order imposes conditions. Check for later docket entries before acting on an older notice.

The 2017 decision discusses different treatment for prepetition and postpetition gift-card claims. The purchase date may affect what legal analysis applies, so preserve a receipt, transaction history, or other evidence showing when you bought or loaded the card.
If a business stops honoring cards, the remaining balance may be a monetary claim in the bankruptcy case. That does not mean a claim will be paid in full—or at all. Courts have treated unredeemed prepetition gift-card claims differently: some decisions classified them as deposits that could receive priority treatment, while others treated them as general unsecured claims. The 2017 opinion describes the case law as scarce and says the Bankruptcy Code does not expressly settle the treatment of prepetition gift-card claims. Do not assume a gift card automatically has priority just because it represents prepaid value.

Are restaurant gift cards treated as deposits in bankruptcy?
Not categorically. A gift card and a payment tied to a particular reservation, catering job, banquet, or event may raise different issues. Official Bankruptcy Form B 410 includes a limited priority category for certain deposits toward personal, family, or household property or services. Whether a particular restaurant payment meets that category depends on the facts and applicable requirements. The existence of that category does not establish that every restaurant deposit qualifies, and the treatment of gift cards has varied among courts.

Keep the documents that show what you paid for and what the restaurant promised. For an event deposit, the contract and correspondence may matter as much as the card or bank statement. For a gift card, preserve the card number and a balance record if available. These records can help support a request or claim, but they do not determine its legal classification on their own.

Find the notice of bankruptcy and any separate deadline notice in the case docket. The case’s notice and court orders control; do not use a date from a different company’s case, even if the restaurants share a brand, or assume deadlines are the same across bankruptcy chapters. A Chapter 11 creditor receives a specific bar-date notice. The Northern District of California’s bankruptcy FAQ explains that asset Chapter 7 cases state the deadline in the notice of bankruptcy and deadlines. Use the notice filed in your restaurant’s case to identify the applicable date and filing instructions.

- Open the correct case using its debtor name and case number.
- Find the notice of bankruptcy and search later entries for a bar-date or proof-of-claim deadline notice.
- Read the complete notice to identify the deadline, the correct court, and the permitted filing method and address.
- Keep a copy of the notice and a record of how and when you filed, if you submit a claim.
Do not infer that a claim deadline has passed—or that it has not—from a news story or another debtor’s filing. Confirm the controlling notice in the docket. If you cannot find one, ask the clerk how to locate the case’s notices; the clerk can help with access to the record.
How do I prepare a proof of claim?
Official Form B 410 is the federal Proof of Claim form. The official form listing says it was updated April 1, 2025, and is effective December 1, 2024. Use the current form and its instructions, then follow the specific court’s electronic or paper filing directions for the case. A proof of claim states the debt and should include documentation showing what gave rise to it and supporting evidence. The claim is filed with the bankruptcy court where the case is pending.
Gather relevant records before completing the form:
- Gift-card number, purchase receipt, and available balance record.
- Reservation confirmation, catering or event contract, and cancellation terms.
- Payment-card or bank statement showing the transaction and date.
- Emails, letters, or other correspondence about the service, refund, or card balance.
Attach supporting documentation as required by the form and local filing process. A proof of claim is a way to state a debt in the case; filing one does not guarantee that the court will allow it, assign it a particular priority, or pay it. If the amount or classification is disputed, or the claim has significant consequences, a bankruptcy lawyer can advise you about your specific situation.
What if I cannot find the case or the answer in the docket?
- The restaurant brand returns no result: Search likely parent and operating-company names, including names on your receipt or contract. Verify any match in the petition before concluding it covers your transaction.
- The case may have been filed recently: The nationwide locator’s index updates daily, and new cases typically appear within 24 hours. If you know the likely court, search that court directly for more immediate information.
- The docket description is unclear: Open the filed motion, notice, or order. A short docket entry may not state its full scope or conditions.
- The docket does not address customer value: Check later entries and related customer-program or sale documents. If the public record still does not answer a practical question, ask the clerk how to locate relevant documents.
- No federal case appears: PACER covers federal court records, not state or county cases. A restaurant could be involved in a different process that will not appear as a federal bankruptcy filing.
A practical way to make the decision
Before trying to redeem a card, waiting for a deposit refund, or filing a claim, match your situation to the case record. Confirm the debtor, identify whether the business is operating or being liquidated, read the latest order affecting customers, and use the case’s own deadline notice. For a gift card, determine whether the order and operator cover your location and card. For a transaction deposit, preserve the contract and payment evidence and assess the deposit under the case’s instructions rather than assuming it has the same treatment as a card.
