If a GST adjudication order imposes only a penalty, you generally appeal to the Appellate Authority under section 107 of the Central Goods and Services Tax Act by filing FORM GST APL-01. The ordinary deadline is three months from the date the order was communicated. For a genuinely penalty-only order, the current section 107 text requires a pre-deposit equal to 10% of the penalty, in addition to payment of any amount arising from the order that you admit. A further period of up to one month may be allowed when sufficient cause prevented a timely appeal, but that extension is discretionary.
The correct authority, limitation date, payment amount and grounds depend on the order, the officer’s designation, the taxpayer’s jurisdiction and the applicable Central, State or Union Territory GST law. Treat the steps below as a procedural guide, then verify the live law and portal instructions before submitting.
What a penalty-only GST appeal involves
A penalty-only order is an adjudication order that demands a penalty without demanding GST tax. It may still be appealable even when the tax component is nil. Section 107 expressly covers appeals against such orders and applies a special pre-deposit rule to them.
Your first appeal normally contains four linked decisions:
#1 Best Overall
- What is the appealable order? Identify the final order, not merely the show-cause notice or a portal summary.
- Where and when must you file? The officer’s designation and jurisdiction determine the Appellate Authority; communication of the order starts the ordinary limitation period.
- What must be paid? Pay admitted amounts and the statutory pre-deposit applicable to the order’s actual mix of tax and penalty.
- What relief are you requesting? State facts, grounds and a precise prayer tied to the findings and penalty provision.
A missing document, wrong authority or incorrect payment calculation can delay or jeopardize an otherwise valid appeal. Preserve the submitted form, attachments and acknowledgment.
How do I check whether the order is really penalty-only?
Read the complete order and its demand summary before calculating the deposit. Record every amount separately rather than relying on a headline total.
- Order number and date.
- Date and method by which the order was communicated.
- Name and designation of the adjudicating officer.
- Statute and section used to impose the penalty.
- Tax, interest, fine, fee and penalty amounts shown in the order.
- Tax period and issue under dispute.
- Whether any tax is actually demanded, as opposed to being discussed in the reasoning.
An order is penalty-only for the special pre-deposit rule only when it demands penalty without involving a tax demand. If the order also demands tax, use the ordinary disputed-tax rule for the disputed tax component and account separately for admitted amounts. If the wording or demand summary is unclear, obtain a written analysis from a qualified GST professional before paying or filing.

What is the time limit to file a GST appeal?
Ordinary three-month period
Section 107(1) provides three months for a person aggrieved by an adjudicating authority’s order to appeal. The period runs from communication of the order. Use the date on which the order was effectively delivered through the relevant portal, email or other recognized method, and retain evidence showing that date.
Do not automatically use the order date printed on the document. The order date and communication date can differ, and the latter is the date that matters for limitation.
Possible one-month extension
Under section 107(4), the Appellate Authority may allow an additional period of up to one month when sufficient cause prevented filing within the initial three months. This is not an automatic grace period. File an explicit delay-condonation request explaining the dates, the cause, the steps taken and the evidence supporting the explanation. Waiting for the extension instead of filing within the ordinary period creates unnecessary risk.
Build a limitation record
- Download or preserve the order as received.
- Save the portal event, email, digital signature record or other delivery proof.
- Write the communication date in the appeal working papers.
- Count the three-month period and set an internal filing date several days earlier.
- If filing late, prepare the sufficient-cause explanation and supporting evidence with APL-01.
A limitation calculation can change with the applicable State or Union Territory rules and the precise method of communication. Confirm the calculation for the jurisdiction before submission.

Do I need to pay a pre-deposit for a penalty-only GST order?
Yes. The current section 107(6) text includes a special proviso for an order that demands penalty without a tax demand: the appeal cannot be filed unless 10% of the penalty has been paid. This is different from assuming that a nil tax demand means a zero deposit.
Section 107(6) also requires full payment of the amount arising from the order that the appellant admits. Therefore, identify admitted amounts separately from amounts challenged in the appeal.
| Order profile | Payment to verify before filing | Key distinction |
|---|---|---|
| Penalty demanded without a tax demand | Admitted amounts arising from the order, plus 10% of the penalty under the current penalty-only proviso | The 10% is calculated on the penalty, not on disputed tax |
| Tax and penalty both demanded | Admitted amounts, plus the general pre-deposit applicable to the disputed tax component | Do not apply the penalty-only proviso as though the order had no tax demand |
| Other amounts shown in the order | Classify each amount as admitted or disputed and follow the portal’s current calculation | The order’s full demand breakdown controls the filing analysis |
The GST Portal’s general guidance commonly describes a 10% pre-deposit by reference to disputed tax. That general explanation does not replace the enacted penalty-only proviso. Check the current statutory text, the order and the live portal calculation on the filing date. Keep challans, payment references and screenshots or receipts showing the amounts paid.
Which authority should receive the appeal?
The first appeal is made to the Appellate Authority under section 107, but the correct office depends on the level and designation of the officer who passed the order, the jurisdictional assignment and applicable notifications or rules. Do not select an authority by guessing from the taxpayer’s address.
Check the order for the officer’s designation and jurisdiction, then verify the corresponding appellate authority in the current GST rules, portal options and jurisdictional instructions. Proceedings under a State or Union Territory GST statute may use the matching State or Union Territory law and authority rather than the Central statute alone.
What documents and information should you prepare?
FORM GST APL-01 requires enough detail for the Appellate Authority to identify the order, understand the dispute and know the relief sought. Assemble one indexed electronic record before opening the portal application.
Core order and communication records
- The signed impugned order and demand summary.
- Proof of communication, including the relevant portal or email record.
- The show-cause notice and documents relied on by the department.
- Your reply, written submissions and hearing correspondence or record.
Substantive evidence
- Invoices, returns, ledgers, reconciliations or other records addressing the factual findings.
- Documents showing compliance, correction, authorization, reporting or payment where those matters are relevant to the penalty provision.
- Correspondence or procedural evidence supporting any objection about notice, hearing or reliance on material not supplied.
The exact evidence depends on the penalty section and the findings. The list above is practical preparation, not a universal mandatory bundle. Follow the form’s attachment instructions and any case-specific direction from the portal or authority.
Appeal narrative and payment proof
- A concise chronology and statement of facts.
- Numbered grounds of appeal.
- A specific prayer identifying the relief requested.
- Details of amounts admitted and disputed.
- Proof of the admitted payment and the applicable pre-deposit.
- Authorization and representative details, if someone is filing or appearing for the taxpayer.
Which form is used for a GST appeal?
The general first appeal is filed in FORM GST APL-01. The form asks for appellant and GSTIN details, the order number and date, the officer who passed it, communication date, issue and period under dispute, amount breakdown, statement of facts, grounds of appeal, prayer and the appellant’s request for a personal hearing.
Before drafting, gather the exact spelling and numbers from the order. A mismatch in GSTIN, order number, date or officer designation can cause validation problems or make the application difficult to match with the underlying proceeding.
How do I file GST APL-01 online?
The GST Portal FAQ describes the following route. Portal labels can change, so follow the current on-screen instructions if they differ.
- Sign in to the GST Portal using the taxpayer account connected with the order.
- Open Services > User Services > My Applications.
- Choose the appeal application option, start a new application and select the relevant order type.
- Enter the order number, order date, communication date, officer details, dispute period and amount fields exactly as shown in the order.
- Complete the statement of facts, numbered grounds and prayer. Indicate whether you want to be heard in person.
- Upload the order, communication proof, notice, reply, evidence, payment records and any other documents requested by the form.
- Review the admitted and disputed amounts and the pre-deposit calculation against section 107 and the actual demand.
- Authenticate and submit using the method available for the taxpayer account.
- Download the submitted APL-01, attachments and the acknowledgment immediately.
When the order is not uploaded
The portal FAQ describes a situation in which a self-certified copy of the order must be submitted within seven days when the order is not uploaded to the portal. Treat that deadline as a filing requirement for the case shown by the portal. A late copy can affect the filing date or processing, so submit it promptly and retain the delivery confirmation.
Provisional versus final acknowledgment
Save both the initial or provisional acknowledgment and the final acknowledgment or appeal number when issued. The final number is the durable reference for correspondence and status checks. Keep a complete local copy of the form exactly as submitted, including file names and versions of attachments.

Grounds should answer the order’s actual reasoning, not rely on a generic statement that the penalty is unfair. Number each ground and connect it to a finding, document or legal provision.
Challenge the legal basis
Identify the exact penalty section used by the officer and explain why its statutory conditions are not met, were misapplied or were not established on the record. Distinguish the elements of the provision from conclusions stated in the order.
Challenge factual findings
Point to the return, invoice, ledger, reconciliation, correspondence or other evidence that contradicts a factual finding. Use page or annexure references so the authority can locate the material quickly.
Address procedure
Where supported by the record, explain defects in the notice, an opportunity to reply or be heard, disclosure of relied-upon material, consideration of your response or the reasoning in the final order. Do not allege a procedural defect without identifying what was missing and how it affected the case.

Challenge computation
Recalculate the penalty using the figures and period in the order. Identify arithmetic errors, duplicate periods, incorrect classifications or amounts treated as admitted when they were disputed. Attach a clear reconciliation.
State the prayer precisely
Ask for the specific relief supported by your grounds, such as setting aside the penalty, reducing or remanding the matter where legally appropriate, and granting consequential relief. The prayer should correspond to the findings you challenge and the documents you filed.
The available procedural material cannot predict which grounds will succeed. A penalty is not automatically invalid merely because no tax is demanded; the Act expressly contemplates penalty-only appeals and imposes a deposit for them. Case-specific merits require review of the order, notice, response and governing penalty provision.

- Monitor the application using the appeal number and portal status.
- Respond to requests for missing documents or clarification within the stated time.
- Keep the payment references, acknowledgment and complete submission package together.
- Prepare for the personal hearing if you selected that option or receive a hearing notice.
- Use the same chronology, grounds and evidence in any written follow-up; do not introduce unexplained figures that conflict with APL-01.
Filing the appeal does not remove the need to comply with portal or authority communications. Check the account and registered contact channels regularly.

Common mistakes and how to avoid them
Counting from the order date instead of communication
Use documented communication of the order for the three-month calculation. Preserve the delivery record.
Assuming nil tax means nil pre-deposit
For a genuinely penalty-only order, the current proviso requires 10% of the penalty. Confirm the order has no tax demand before applying that rule.
Using the general disputed-tax explanation for every case
Portal FAQs may describe the ordinary 10%-of-disputed-tax rule. Read the enacted penalty-only proviso and classify the order before paying.
Filing with no proof of admitted payment
List admitted amounts, pay them in full as required and attach the payment evidence.

The Central GST section 107 procedure is the framework described here, but State and Union Territory GST proceedings may involve the corresponding State or Union Territory statute, forms, authority and jurisdictional instructions. Confirm which law and authority issued the order. A portal workflow or local notification can affect the available authority, document submission and payment process.
When should you obtain professional help?
Consider qualified Indian GST advice when the communication date is disputed, the one-month extension may be needed, the order combines tax and penalty, the authority is uncertain, the penalty section is technically complex or the record contains a hearing or evidence issue. Professional review is especially important when a late filing could be rejected or when the portal’s calculation differs from your reading of the current Act.
