Evaluate the exact cloud service and workload—not the provider’s slogan or the region name—against eight dimensions: strategic control, legal jurisdiction, data and AI control, operational autonomy, supply-chain dependence, technology openness, security and compliance, and environmental sustainability. Require current, service-specific evidence for each dimension, set a minimum assurance level for each objective, and document unresolved dependencies. An EU data-center location or “sovereign cloud” label alone cannot establish who controls the service, which laws may reach it, who can access data, or whether you can continue operating and exit.
What digital sovereignty means in a cloud assessment
Digital sovereignty is the ability to keep lawful control over digital assets and services, make independent decisions about them, and remain resilient when a provider, government, supplier, or technology dependency changes. In cloud procurement, that means examining the whole service chain: the contracting entity, parent companies, operating staff, software, hardware, support arrangements, subprocessors, legal terms, data flows, and exit options.
It is broader than data residency. Residency answers where a selected copy of data is stored. Sovereignty also asks who can administer the platform, who holds or can override cryptographic controls, where support personnel are located, which foreign laws may apply, whether an upstream supplier can suspend a critical component, and whether the customer can migrate without an impractical cost or loss of functionality.

It directs a contracting authority to assess tender answers, supporting evidence, and public documentation for eight sovereignty objectives. Assurance is assigned to each objective, while a separate comparative score can describe additional features. A weakness in a contributing factor can reduce the assurance assigned to an objective.

Define the decision before contacting providers
Name the service boundary
Record the provider, exact service and tier, enabled regions, support plan, optional features, subprocessors, and management services. A provider-wide statement is not evidence for every product. A managed database, an AI API, a backup service, and a virtual-machine region can have different operators, locations, subcontractors, and contractual terms.
Describe the workload and every data class
Separate customer content from metadata, account records, logs, telemetry, monitoring data, backups, snapshots, support tickets, derived analytics, and management-plane information. For AI-enabled workloads, include prompts, outputs, embeddings, fine-tuning data, model telemetry, and any data used for training or service improvement. Identify where each class is stored, processed, replicated, cached, and recovered.
Set the consequence of failure
State what happens if the service is inaccessible, support is withdrawn, a region is isolated, a legal order requires disclosure, or an upstream supplier stops providing a component. Map regulatory, contractual, safety, financial, and public-service consequences. These impacts determine whether a workload needs only jurisdictional assurance or a higher level covering data control, resilience, and full independence.
The eight sovereignty objectives
| Objective | What to establish |
|---|---|
| Strategic sovereignty | EU/EEA legal, financial, and industrial anchoring; ownership stability; governance influence; and the ability to sustain the service if support is disrupted or withdrawn. |
| Legal and jurisdictional sovereignty | Governing laws, provider and parent-company exposure, cross-border legal reach, and practical channels for compelled access. |
| Data and AI sovereignty | Storage and processing locations, cryptographic control, privileged access, auditability, deletion, model hosting, prompts, outputs, and data-pipeline governance. |
| Operational sovereignty | Who can run, patch, restore, support, and evolve the service; where staff are located; and whether operations can continue independently. |
| Supply-chain sovereignty | Provenance and control of hardware, firmware, software, updates, subprocessors, and critical upstream services. |
| Technology sovereignty | Open interfaces, documented standards, architecture visibility, auditability, interoperability, and practical avoidance of lock-in. |
| Security and compliance sovereignty | Control and location of security operations, incident response, certifications, compliance arrangements, and resilience measures. |
| Environmental sustainability | Long-term resilience against energy constraints, material scarcity, and dependencies that could threaten continued operation. |
1. Strategic sovereignty
Examine who owns and controls the provider, where decisive governance occurs, and whether the business can remain viable if financing, ownership, or a major support relationship changes. Ask for ownership and control information, governance arrangements, continuity plans, investment in the service, and commitments that survive a change of control. A local subsidiary may operate a region while strategic decisions, intellectual property, or essential support remain elsewhere.
2. Legal and jurisdictional sovereignty
Identify the contracting entity, its place of establishment, parent and control structure, governing law, dispute forum, and locations from which legal and operational decisions are made. Ask whether non-EU laws with cross-border reach could apply to the entity, its parent, subcontractors, or support providers. Require an explanation of how the provider receives, challenges, narrows, and reports government requests, and what technical or contractual barriers limit access.
Physical location does not settle this question. Route conclusions about a particular country’s laws, conflicts of law, and sector obligations to qualified counsel. Record the legal opinion, assumptions, and date alongside the provider’s contractual answer.
3. Data and AI sovereignty
Obtain a current data-flow diagram covering primary storage, processing, backups, disaster recovery, monitoring, support, failover, and deletion. Confirm whether the service can be confined to specified regions without an automatic third-country fallback. Establish who creates, stores, rotates, and can override encryption keys; how privileged access is approved; where operators connect from; and which access events the customer can inspect.

Ask for evidence that deletion is irreversible, including retention in backups, replicas, caches, logs, and derived datasets. For AI features, determine where models run, whether prompts and outputs are retained, whether customer data is reused for training or improvement, who controls model updates, and how pipelines, evaluation data, and model access are governed. Customer-effective cryptographic control, visible privileged access, strict regional confinement, and verifiable removal are stronger evidence than a residency statement.
4. Operational sovereignty
Map the people and authorities able to administer, patch, restore, monitor, and support the service. Identify operator locations, language and time-zone coverage, escalation paths, required vendor involvement, and the skills available to EU-based teams. Ask whether those teams can keep the workload running if a non-EU vendor is unavailable, compelled to suspend service, or withdraws support.
Review operational documentation, staffing commitments, continuity exercises, recovery objectives, and the customer’s ability to perform critical actions without opening a support case. A service may be hosted locally yet remain operationally dependent on remote personnel or proprietary tooling.
5. Supply-chain sovereignty
Request a service-specific dependency map extending beyond the contracting provider. It should identify critical hardware and manufacturing, firmware, software components and update channels, subprocessors, telecommunications, identity services, and other upstream platforms. For every dependency, record ownership, jurisdiction, failure impact, replacement time, and available audit or substitution rights.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsAsk how the provider discovers vulnerabilities, authenticates updates, handles supplier changes, and notifies customers of material dependencies. A local facility does not remove external control if essential servers, firmware, software updates, or support are supplied from elsewhere.
6. Technology sovereignty
Inspect APIs, export formats, protocols, identity integrations, infrastructure-as-code support, and documented standards. Request architecture and data-flow documentation sufficient for independent review. Determine whether the customer can run workloads on another platform, what features would need rewriting, and whether proprietary control planes or data formats create technical lock-in.
Test portability with representative data and dependencies rather than accepting a theoretical export promise. Measure the time, bandwidth, transformation work, licensing changes, and downtime required to restore elsewhere. Record which functions have no equivalent outside the provider.

7. Security and compliance sovereignty
Establish where security monitoring, threat detection, incident response, key security decisions, and forensic work are performed and controlled. Review relevant certifications, audit reports, scope statements, incident-notification terms, vulnerability-management practices, and operational-resilience evidence. Confirm that a certificate covers the exact service, region, edition, and time period being procured.
Security compliance supports sovereignty but does not replace it. A platform can be well secured while remaining exposed to foreign legal control, a single upstream supplier, or an impractical exit path.
8. Environmental sustainability
Assess whether energy availability, water constraints, raw-material scarcity, or geographically concentrated infrastructure could threaten long-term service continuity. Request the provider’s resilience assumptions, dependency disclosures, and sustainability information relevant to the selected regions and hardware lifecycle. Treat sustainability as a continuity issue, not only as a carbon-reporting exercise.
Request evidence that can be checked
Turn each requirement into a question with a pass threshold and an accountable reviewer. Ask for documents tied to the exact service and retain their version and date.
| Evidence area | Useful evidence | Review focus |
|---|---|---|
| Service scope | Product and tier description, region list, feature and support boundaries, subprocessor register | Does the evidence cover the purchased configuration? |
| Legal control | Contracting entity, ownership and control information, governing-law clauses, government-request procedure | Which laws and entities can reach the service? |
| Data flows | Architecture diagrams, processing locations, backup and recovery paths, retention schedules | Do any data classes leave the approved boundary? |
| Keys and access | Key-management design, privileged-access workflow, access logs, support-access controls | Can the customer prevent, detect, and investigate access? |
| Deletion | Deletion procedure, backup-retention policy, certificates or technical verification | Can removal be shown to be irreversible? |
| Operations | Staffing and operator locations, continuity plans, recovery tests, support escalation model | Can local teams sustain the service during disruption? |
| Supply chain | Dependency inventory, supplier jurisdictions, update provenance, substitution plans | What fails if an upstream party is unavailable? |
| Technology and exit | API and export documentation, standards, portability runbook, migration test results | What would migration actually cost and how long would it take? |
| Security and compliance | In-scope certifications, audit reports, incident procedures, resilience evidence | Does assurance match the service and workload? |
Keep the evidence date, assumptions, open questions, and reviewer for every answer. Public documentation can support an assessment, but a contractual commitment is stronger where the requirement is critical.
An eight-step evaluation sequence
- Define scope and decision. Name the service, tier, regions, features, support arrangement, subprocessors, workload, data classes, legal obligations, and consequences of disruption.
- Convert requirements into evidence requests. For every relevant objective, specify the question, minimum assurance, acceptable proof, service boundary, and accountable reviewer.
- Separate legal control from physical location. Examine the contracting entity, parent structure, governing law, cross-border exposure, and government-request process. Obtain qualified legal advice for jurisdiction-specific conclusions.
- Trace data, keys, access, and deletion. Follow every data class through production, backup, support, monitoring, failover, and recovery. Confirm customer-effective key control, auditable privileged access, regional confinement, and verifiable deletion.
- Test operational resilience and exit. Identify who can administer and restore the service, then run a migration exercise using real data, formats, dependencies, recovery objectives, and realistic bandwidth.
- Inspect supply-chain and technology dependence. Review hardware, firmware, software, updates, subprocessors, upstream services, APIs, standards, architectural visibility, and substitution rights.
- Score by objective and workload. Set a minimum level separately for each objective. Weight consequences appropriately and document why any lower level is acceptable.
- Keep claims current. Recheck the framework version, contracts, ownership, subprocessors, operating locations, legal terms, and architecture whenever they change.
Use SEAL levels as minimums, not as a shortcut
Version 1.2.1 defines five assurance levels. They describe the framework’s progression and must be applied to a stated objective and assessment scope; they are not a universal certification.
| Level | Framework meaning | How to use it |
|---|---|---|
| SEAL-0 | No sovereignty | Suitable only where the objective has no sovereignty requirement. |
| SEAL-1 | Jurisdictional sovereignty | Addresses the relevant legal and jurisdictional conditions. |
| SEAL-2 | Data sovereignty | Adds control over data location, access, and related protections. |
| SEAL-3 | Digital resilience | Adds resilience and continuity expectations for the assessed objective. |
| SEAL-4 | Full digital sovereignty | Represents the framework’s highest level across the applicable factors. |
Write tender or procurement requirements as minimum SEAL levels by objective, not as one blended provider score. The framework states that failure to meet required minima consistently can disqualify a bid, while a separate score can rank additional sovereignty features. Do not average away a critical legal, access-control, or exit failure because other dimensions score well.

Make continuity and exit testable
Run a realistic migration exercise
Export representative production data, configurations, identities, encryption metadata, logs needed for operations, and application dependencies. Restore them on an alternative platform or documented fallback environment. Measure transfer time, transformation effort, downtime, feature loss, rekeying, validation, and the staff skills required. Record every manual step and proprietary dependency.
Model provider and upstream disruption
Ask what happens if the provider is compelled to suspend service, loses a critical region, withdraws a product, or cannot obtain an upstream component. Identify the customer’s last known good backups, independent credentials, alternate support route, replacement hardware or software, and contractual termination assistance. A continuity plan that depends on the unavailable provider is not an independent exit plan.
Check operational authority
List actions that require provider intervention: restoring backups, rotating keys, changing network routes, recovering an account, exporting data, or investigating an incident. For each action, specify who can authorize it, where that person operates, the expected response time, and what evidence is produced.

Common evaluation mistakes
Treating an EU region as proof of sovereignty
A region identifies physical processing geography, not ownership, legal reach, operator location, supply-chain control, or portability. Use the region as one data-flow fact within the broader assessment.
Accepting a company-wide label
Assess the purchased service and configuration. Managed features, support plans, AI options, and disaster-recovery paths can introduce different dependencies from the core region.
Relying on policy language without technical proof
Ask for diagrams, access records, key-control design, deletion verification, test results, and contractual commitments. A general privacy statement cannot establish that a particular backup or support workflow remains inside the required boundary.

Ignoring change over time
Ownership, subprocessors, regions, support locations, terms, and architectures change. Reassess on those triggers and preserve the evidence version used in the decision.
Keep the assessment governed after procurement
Assign an owner for each objective across procurement, legal, security, architecture, operations, data protection, and business continuity. Store the requirement, evidence, assurance level, residual risk, exception approval, review date, and change triggers in a register. Require notification before material changes to ownership, governing law, subprocessors, operating locations, encryption controls, AI data use, or exit terms.
Review the framework’s current edition before issuing a tender. The Commission announced that it would publish an updated version based on procurement lessons, so version 1.2.1 (October 2025) should be treated as a dated baseline, not assumed to remain the operative version indefinitely.

On 17 April 2026, the European Commission announced four contracts for Union entities to procure sovereign cloud services for up to EUR 180 million over six years. The tender used the eight objectives and SEAL levels, with SEAL-2 as its eligibility threshold. Three selected provider groups reached SEAL-3 and one reached SEAL-2.
This is evidence of one Commission procurement, with its own scope, eligibility rules, and contract conditions. It is not a universal ranking, certification, or proof that a provider meets another organization’s requirements. Provider lineups and offerings can change, so current contracts and service documentation must be checked before relying on the example.
A decision record you can reuse
- Workload: business owner, data classes, sensitivity, recovery objectives, and legal or sector obligations.
- Service boundary: exact product, tier, regions, features, support plan, subprocessors, and management services.
- Objective minima: required SEAL level or equivalent assurance for each of the eight objectives.
- Evidence: document title, version, date, scope, provider answer, technical proof, and reviewer.
- Dependencies: suppliers, jurisdictions, operator locations, legal channels, proprietary interfaces, and failure impacts.
- Tests: access review, deletion verification, continuity exercise, and migration results.
- Residual risk: unresolved issue, business impact, compensating control, owner, expiry date, and approval authority.
- Reassessment triggers: ownership, contract, architecture, region, subprocessor, legal, AI-data-use, or support-location change.
The resulting decision should state precisely what the provider supports, for which service and workload, at what assurance level, and subject to which assumptions. If a material dependency cannot be evidenced or controlled, record it as an unresolved risk rather than hiding it inside an overall score.
