How to evaluate an AI mental health chatbot before sharing personal information: read its privacy policy and in-app settings first, then verify what it collects, why it uses it, who receives it, how long it keeps it, and whether deletion is real and permanent. Do not treat a “private,” “secure,” or “HIPAA compliant” label as an answer by itself. If the service cannot clearly answer those questions, do not enter identifying or intimate details.
Why an AI mental health chat deserves extra scrutiny
A conversation can reveal far more than a name or email address. Statements about anxiety, medication, trauma, sleep, relationships, self-harm, sexual health, or a family member may constitute health information even when no clinician has made a diagnosis. The Federal Trade Commission (FTC) says consumer health information can include information that conveys or enables an inference about health.
A chatbot may also receive account details, device identifiers, IP addresses, voice recordings, uploaded files, timestamps, and usage logs. Those pieces can be combined to identify a person or infer sensitive circumstances. The fact that a service is marketed as wellness software rather than medical care does not make the conversation harmless.

Start with a five-minute pre-disclosure check
Before typing a personal story, open the service’s privacy policy and settings while logged out if possible. Use this sequence:
- Find the policy and the controls. Look for a current privacy policy, a data or privacy center, account settings, chat-history controls, and a way to contact the privacy team.
- Search within the policy. Use terms such as conversation, content, health, training, improve, service providers, advertising, retention, delete, de-identify, and law enforcement.
- Record concrete answers. Note the exact data categories, purposes, recipients, retention periods, deletion process, and settings. “We value privacy” is not a data practice.
- Test the controls with a low-risk account. Check whether chat history can be disabled, whether model-improvement sharing has a separate switch, and whether the account can be deleted without contacting support.
- Share only the minimum. Start with a hypothetical or generalized question. Remove names, exact dates, addresses, employers, schools, phone numbers, photographs, and identifying details.
If any material question remains unanswered, stop at the low-risk test stage. You can use the chatbot without disclosing the facts that would make the conversation sensitive.
What to extract from the privacy policy
Data collected: what leaves your device?
Make a list of every category, not just “personal information.” Check whether the service collects:
- Chat prompts, responses, conversation titles, feedback, ratings, and attachments.
- Account identifiers such as email address, username, age, profile fields, or subscription records.
- Device and network data, including IP address, browser or operating-system details, advertising identifiers, cookies, and approximate location.
- Audio, video, images, documents, or contacts when the app offers those features.
- Inferences, such as topics of interest, likely preferences, or health-related categories generated from your use.
- Information obtained from sign-in providers, analytics tools, payment processors, or other integrated services.
Pay attention to definitions. A policy may define “content” broadly enough to include prompts and uploaded files, while “usage data” may include detailed interaction records. If the policy says data is “processed” without explaining whether it is stored, ask the provider for a specific answer.
Purposes: why is it used?
Separate purposes that are necessary to deliver the chat from optional secondary uses. The policy should distinguish account administration, safety monitoring, troubleshooting, analytics, personalization, advertising, and developing or improving models.
Look specifically for language saying conversations may be used to “train,” “fine-tune,” “evaluate,” “improve,” or “develop” artificial-intelligence models. “Product improvement” can include model development, human review, automated quality checks, or creation of datasets. If the policy uses a broad purpose such as “business operations,” ask whether chat content is included and whether you can opt out.

Do not infer an answer from a toggle’s name. A setting labeled “Improve the service” may affect model training, human review, or analytics—or only some of them. Read the explanatory text and determine whether the choice applies to existing conversations, future conversations, or both.
Recipients: who can access the information?
Identify each recipient category and its role. Common categories include cloud-hosting companies, customer-support contractors, analytics vendors, payment processors, security providers, affiliated companies, advertising partners, and authorities responding to legal demands.
“Service providers” is not automatically harmless. Determine whether vendors may access full conversation content, whether they may use it for their own purposes, and whether the provider remains responsible for deletion. Advertising language deserves separate attention: targeted advertising based on mental-health interests can create risks even when the ad partner never sees the full transcript.
Check whether information is transferred across borders and which organization controls the data. A change-of-control clause may allow transfer of stored conversations during a merger or sale.
Retention and deletion: what happens after you delete?
Find the retention period for active accounts, backups, safety logs, abuse investigations, and de-identified or aggregated data. “Deleted” may mean removed from the user interface while copies remain in backups or legal records.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →A credible deletion explanation states what you can delete, how to request it, when deletion starts, how long backups persist, and what the provider keeps for legal or security reasons. It should also explain whether de-identified data can be retained indefinitely and whether it can be re-linked to your account.

The FTC recommends deleting information when there is no longer a legitimate business need to retain it. Treat an indefinite retention period, an unexplained backup exception, or a requirement to email support for routine deletion as a reason to limit what you disclose.
Will your chats be used to train the AI?
Ask this question in writing if the policy is unclear: “Are my prompts, uploaded files, or chat transcripts used to train, fine-tune, evaluate, or improve models? Is human review involved? Does opting out apply to data already collected?” Save the response.
A service may use conversation data for several kinds of improvement, each with different consequences:
Free tools Windows power users keep installed
One-click scans. No signup required.
- Model training or fine-tuning: content may influence future model behavior or datasets.
- Evaluation and safety testing: excerpts may be inspected to measure quality, bias, or harmful responses.
- Support and troubleshooting: staff or contractors may review a transcript to resolve a ticket.
- Personalization: the service may retain information to tailor future replies.
Look for separate controls for chat-history storage and model improvement. Turning off history may not disable all retention, and opting out of training may not erase existing records. Only the provider’s current policy and settings can establish what a particular service does; do not assume that one chatbot’s controls apply to another.
Does this chatbot keep my conversations private?
“Private” has no single technical meaning. A service might encrypt data in transit, restrict employee access, and still retain transcripts for months or share them with vendors. Evaluate privacy as a set of specific controls:
- Access: Can staff, contractors, or support agents read transcripts? Is access logged and limited?
- Security: Does the policy describe encryption, authentication, breach response, and account protections in understandable terms?
- Visibility: Can you view, export, correct, or delete your information?
- Account separation: Are chats connected to an identifiable account, advertising profile, or device identifier?
- Third-party exposure: Are analytics, advertising, or other embedded tools active in the app or website?
Security safeguards reduce risk but do not change the provider’s purposes or retention rules. A breach is not the only privacy concern; routine collection and sharing can matter just as much.

Why a HIPAA label is not enough
In the United States, HIPAA generally does not cover health information that a consumer enters into a personal app unless the app is provided by a HIPAA-covered entity or its business associate. The U.S. Department of Health and Human Services (HHS) explains this distinction in its guidance on personal phones and tablets.
That means a consumer chatbot can handle highly sensitive information without being a HIPAA-covered service. Conversely, a product used by a covered provider may have a different legal relationship and contractual protections. The label alone does not tell you which situation applies.
HHS guidance also addresses online tracking technologies used by HIPAA-covered entities and business associates. Tracking tools, cookies, pixels, and analytics can create separate disclosure and sharing issues. Ask which organization is providing the service, whether it is acting for a covered provider, and what other privacy laws apply in your location.
FTC rules, state privacy laws, breach-notification requirements, consumer-protection laws, and contractual promises may still apply even when HIPAA does not. The FTC warns against misleading health-data claims and burying material information. This is U.S. guidance; legal applicability varies with jurisdiction, provider status, and product design.

Test privacy settings without exposing your story
- Create the least identifying account available. Avoid optional profile fields and social sign-in if the service allows another method.
- Open privacy and data controls before starting a chat. Record default settings, especially history, personalization, model improvement, voice, and location permissions.
- Use a neutral test prompt. For example, ask for general information about coping with exam stress without giving a name, diagnosis, employer, school, or exact event.
- Inspect the history. Determine whether the prompt is saved, searchable, exportable, or visible on other devices.
- Change one setting at a time. Confirm what the interface says will happen to future and existing conversations.
- Delete the test chat and, if appropriate, the account. Capture the confirmation screen and note any stated waiting period or exceptions.
- Check again later. A deleted item disappearing from the interface is not proof that backups or vendor copies are gone; look for the provider’s stated completion notice.
Do not upload a photo, medical document, voice recording, or real crisis narrative merely to test a feature.
Red flags that should stop disclosure
- The policy is missing, undated, difficult to find, or materially different from the in-app explanation.
- It says the provider may use “all information” for broad business purposes without identifying whether conversations are included.
- Training, human review, advertising, or vendor access is described only in a separate document that users are unlikely to see.
- Deletion is unavailable, requires an unexplained manual process, or excludes backups and derived profiles indefinitely.
- The service promises “private,” “secure,” or “HIPAA compliant” use without explaining the legal entity, covered relationship, data flows, or limits.
- Permissions request contacts, precise location, microphone, camera, or files that are not necessary for the feature you intend to use.
- Support cannot answer whether a transcript is used for training or whether an opt-out applies retroactively.
One red flag does not prove unlawful conduct, but it does mean you should withhold sensitive details until the uncertainty is resolved.
Minimize what you disclose if you decide to use the chatbot
Privacy protection is strongest when the service never receives the identifying detail. Replace specifics with general descriptions:

- Describe a city or region broadly rather than giving an address or exact workplace.
- Summarize a medical issue without uploading prescriptions, test results, or insurance documents.
- Remove account numbers, usernames, phone numbers, email addresses, and links to social profiles.
- Do not paste another person’s private information without their permission.
Review the text before sending it. Details that seem harmless in isolation can identify someone when combined with a date, location, employer, or unusual event.
What to do when you need a human or urgent help
An AI chatbot is not automatically a therapist, doctor, crisis line, or confidential healthcare provider. If you need diagnosis, treatment, medication advice, or a documented clinical relationship, ask a licensed professional how their service handles records and privacy before sharing details.
If you may hurt yourself or someone else, or cannot stay safe, use your local emergency service or a crisis resource in your country rather than relying on a chatbot. Share only the information necessary to obtain immediate help.
A decision rule you can use
Proceed only when you can answer all five questions in plain language:
- What exact information does the service collect from my conversation and device?
- Is any of it used for training, evaluation, personalization, advertising, or human review?
- Which vendors, affiliates, advertisers, or authorities can receive it?
- How long is each category retained, including backups and derived data?
- How do I delete it, and what evidence shows deletion is complete?
If the answer to any question is “not stated,” use a hypothetical prompt or choose a service whose documentation and controls are clearer. The most reliable privacy decision is the one made before a real name, diagnosis, document, or identifiable life event enters the chat.
