Short answer: do not treat a VPN tunnel or a provider’s advertised region as proof of data residency or compliance. Evaluate the complete service: what data it collects, where each copy is stored and processed, which entities and subprocessors can access it, how support and government requests are handled, which transfer mechanism applies, and whether identity-based access controls and independent assurance match your obligations.

A VPN can encrypt traffic between endpoints, but it does not determine where authentication records, connection logs, telemetry, backups, support tickets, or provider-controlled keys are kept. A zero-trust service should make an explicit, continually evaluated decision for each user, device, and resource rather than trusting a network location. The framework below lets you compare providers against your own jurisdictional, contractual, security, and operational requirements.

Define what “data residency” and “compliance” mean for your organization

“Data residency” can mean different things: storage in a named country, processing within a legal region, remote access only from approved locations, support personnel restricted to certain countries, or a ban on onward transfers. Write down which interpretation applies to each data set before reviewing providers. A service may satisfy storage residency while still allowing an administrator in another country to view content or allowing telemetry to be processed elsewhere.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Separate residency questions from security and legal-transfer questions. Encryption in transit protects a connection; it does not answer where plaintext is processed, where logs are retained, or whether a foreign authority can seek access. Compliance is likewise obligation-specific. Sector rules, customer contracts, government-cloud requirements, and privacy laws can impose different controls on the same service.

Record the scope that a provider must satisfy

  • Countries, states, or legal regions in which data may be stored, processed, backed up, or accessed.
  • Data categories, such as customer content, personal data, credentials, device posture, billing records, support messages, and security telemetry.
  • Users, administrators, contractors, workloads, and resources that will use the service.
  • Requirements covering storage, processing, remote access, support, government access, deletion, or all of these.
  • Applicable privacy, sector, procurement, and contractual rules, including any required transfer mechanism.

Do not start with a list of product features and attempt to retrofit obligations later. Your requirements become the pass/fail gates for every provider response.

Map the provider’s real data flows

Request a service-specific data-flow description, not a generic statement that a region is available. For every data class, ask where it is collected, stored, processed, backed up, replicated, and deleted; which legal entities and subprocessors handle it; where privileged support can access it; and what happens when an authority makes a request. Include data generated by the access service itself, not only the traffic moving through a tunnel.

Data or activity Questions to document Evidence to request
Customer content and application traffic Is traffic terminated, inspected, or transformed? In which locations are transient and persistent copies created? Architecture diagram, processing description, regional service terms, encryption and key-management details
Identity and directory data Where are usernames, group membership, authentication events, and recovery information stored and processed? Identity-service data-location statement and subprocessor list
Device and posture data What operating-system, certificate, health, and credential attributes are collected? Are they retained after access ends? Telemetry schema, retention schedule, deletion procedure
Logs and security telemetry Which connection, policy, administrative, and threat events are logged? Where are hot and archived copies kept? Logging catalogue, retention and export controls, regional commitments
Backups and disaster recovery Are backups replicated to another country or cloud? How are backup deletion and restoration handled? Backup topology, recovery-region list, deletion attestations
Support and administration From which countries can support or engineering staff view metadata, tickets, diagnostics, or content? Is just-in-time access used? Privileged-access model, support-access locations, approval and recording controls
Subprocessors and onward transfers Which entities receive data, for what purpose, and with what notification or objection process? Current subprocessor register, contract clauses, change-notice terms
Authority and law-enforcement requests Which entity receives demands, who assesses them, and when can the customer be notified? Contract language, transparency reporting where available, request-handling policy

This inventory is a practical diligence method; it is not an assertion that every provider handles every listed category or that every category is personal data. The objective is to identify the actual recipient and transfer arrangement for each flow. A marketing label such as “EU region” is not a substitute for that map.

Check the transfer and contractual story

If personal data leaves the European Economic Area, establish the legal mechanism for each transfer, the entities it covers, and any onward transfers. The European Commission’s toolkit includes adequacy decisions, standard contractual clauses (SCCs), binding corporate rules, approved certification mechanisms, codes of conduct, and limited derogations. The appropriate mechanism depends on the circumstances and the parties involved.

Mechanism or safeguard What to verify with the provider
Adequacy decision Which destination and recipient are covered, whether the service and entity fit the decision, and how the provider handles a decision that is amended or withdrawn
Standard contractual clauses Which module and parties apply, what technical and organizational measures accompany the clauses, and whether onward transfers are covered
Binding corporate rules Whether the relevant provider entities are within the approved rules and whether external subprocessors are addressed separately
Certification or code of conduct The exact certification or code, scope, validity, and how it applies to the service you will buy
Derogation The specific, exceptional condition relied on and why it is not being treated as a routine operating model

An adequacy decision can permit transfers to the covered country under that mechanism without an additional safeguard, but the Commission notes that decisions may be maintained, amended, or withdrawn. Put a change-management obligation in the contract rather than assuming today’s status will remain unchanged.

Ask precise questions about government access

Ask which provider entity responds to government or law-enforcement demands, whether the provider verifies jurisdiction and legal sufficiency, whether it challenges invalid or overbroad requests, and when it can notify you. Require the contract to explain processor duties, onward disclosure, preservation requests, and assistance with your own regulatory response.

The European Data Protection Board adopted final Guidelines 02/2024 on GDPR Article 48 on 5 June 2025. The Board explains that a judgment or administrative decision from a third country is not automatically recognized or enforceable in Europe. A provider must identify the applicable legal basis and transfer conditions; in some situations the assessment is case by case. Ask the provider to describe its process rather than accepting a blanket statement that it will comply with any foreign order.

Evaluate the access architecture, not just the tunnel

NIST Special Publication 800-207 defines zero trust as an approach that moves defenses from static network perimeters toward users, assets, and resources. It states that no implicit trust should be granted solely because an account or asset is on a particular network or is enterprise-owned. In practice, authentication and authorization should occur before a session to an enterprise resource and should be reevaluated as context changes.

VPN capabilities and their limits

A traditional VPN can provide an encrypted path and convenient network-level reachability. It may still grant broad access after a user connects, rely heavily on a device’s network location, and produce logs in locations unrelated to the protected application. Ask whether the service enforces resource-level policy, verifies device posture, limits lateral movement, and records the decision that allowed each session. If it cannot answer those questions, it is a connectivity control rather than a complete zero-trust architecture.

Identity, device, and resource decisions

For multi-cloud and hybrid environments, examine the identity tier and network tier separately. NIST SP 800-207A describes identity-aware policy, service identities, authentication and authorization, and enforcement points such as gateways for cloud-native and multi-cloud access. A provider should show how a policy decision is made for a named resource, not merely how a user obtains an IP address.

Ask how decisions use the following context:

  • User identity, role, group, and authentication strength.
  • Device health, credential status, certificate state, and management posture.
  • Resource sensitivity, application identity, environment, and requested action.
  • Connection location and network characteristics, treated as signals rather than proof of trust.
  • Observed behavior, session risk, and changes that trigger reauthentication or revocation.

Request a demonstration or policy export showing the enforcement point, decision inputs, deny behavior, and emergency-revocation path. Verify that administrators can review and change policy without creating an unlogged bypass.

Review monitoring, retention, and operational governance

Residency commitments are incomplete without operational controls. Determine which events are logged, who can read them, how long they remain available, and whether you can export them to your incident-response platform in an approved region. Distinguish customer-accessible logs from provider-internal telemetry; the latter may follow different retention and location rules.

  • Define retention separately for authentication, administrative, policy, connection, threat, and support records.
  • Confirm whether logs contain content, identifiers, source addresses, or device attributes that create additional obligations.
  • Require time-synchronized records, tamper-evident storage, and an audit trail for policy changes and privileged access.
  • Document how exceptions are approved, expire, and are reviewed.
  • Test account suspension, device loss, key rotation, backup restoration, and provider-incident notification before production.

Operational fit matters as much as architecture. The service must integrate with your identity provider, endpoint-management tools, cloud accounts, change control, and incident procedures. A technically strong design that your team cannot administer or monitor reliably is not a compliant operating model.

Validate audits, certifications, and other evidence

Ask for current, service-specific evidence and read its scope. Record the legal entity assessed, service components and regions included, data types covered, assessment period, independent assessor, exclusions, control exceptions, remediation status, and customer responsibilities. A certificate for a parent company or a different hosting service does not automatically cover the access service you are buying.

Use NIST implementation material correctly

NIST SP 1800-35, published in June 2025, documents 19 example zero-trust implementations developed with 24 collaborators. Those figures describe the guide’s cooperative work, not market adoption or measured effectiveness. The publication provides implementation models and mappings between zero-trust principles, technologies, and common standards; it does not endorse a commercial product. Use it to structure control questions and mappings, then obtain provider-specific evidence.

Build an evidence register

  1. List every requirement and the provider control or contractual clause that addresses it.
  2. Attach the exact report, certificate, architecture document, or policy statement supporting the response.
  3. Note the document’s issue date, validity period, scope, exclusions, and responsible provider entity.
  4. Mark items that depend on your configuration, such as identity integration, log routing, or regional key selection.
  5. Assign an owner and review date for unresolved gaps, compensating controls, and provider commitments.

Do not accept a logo wall or an undated summary as proof. Evidence must be traceable to the service, location, and period in your proposed deployment.

Compare providers with a decision scorecard

When two or more providers remain, compare them on the same evidence-backed axes. Use your own weighting and mandatory gates; the official sources do not prescribe a universal scoring formula.

Axis Questions to score Minimum evidence
Data location and flow Are storage, processing, backups, logs, telemetry, support access, and subprocessors identified by location? Are changes notified? Service data-flow map, regional terms, subprocessor register
Transfer and access risk Which transfer mechanism applies? Are onward transfers, authority requests, and supplementary safeguards addressed? Executed clauses or other mechanism, request procedure, technical measures
Access architecture Are users and devices verified before resource access? Is authorization resource-specific and enforced across hybrid or multi-cloud systems? Architecture, policy examples, enforcement-point documentation
Observability and governance Can you see decisions, privileged actions, policy changes, and exceptions? Can records be retained in an approved location? Logging catalogue, retention settings, audit exports, workflow controls
Assurance Does an independent assessment cover the correct entity, service, region, period, and customer responsibilities? Current report or certificate, scope statement, remediation record
Operational fit Can the service work with your identity, endpoint, cloud, and incident-response practices without unsafe workarounds? Integration design, test results, support model, recovery procedures

Treat an unproven mandatory requirement as a procurement gap, not as a favorable score. Obtain a dated remediation commitment or select another design.

Questions to put in the request for proposal and contract

  • List every country and legal entity that may store, process, support, or access each data category.
  • Identify all subprocessors, their purposes, locations, transfer mechanisms, and change-notification period.
  • State whether traffic, credentials, device posture, logs, backups, and support records are included in regional commitments.
  • Describe encryption in transit and at rest, key ownership, key locations, rotation, and provider-access controls.
  • Explain authentication, device verification, resource authorization, policy enforcement, session re-evaluation, and emergency revocation.
  • Specify logging fields, retention, customer access, export format, and deletion behavior.
  • Describe government-request validation, challenge procedures, notification limits, disclosure records, and customer assistance.
  • Provide current audit reports and certificates with scope, dates, exclusions, assessor, and remediation status.
  • Commit to notifying you of region changes, new subprocessors, legal-transfer changes, material incidents, and control failures.
  • Define return, deletion, and backup-erasure obligations at termination, including verification evidence.

Common failure modes and how to correct them

“The provider has a local region, so all data stays local.”

Correct the assumption by tracing identity data, telemetry, support access, backups, and subprocessors. Make each location and permitted access path explicit in the contract.

“A compliance certificate covers the deployment.”

Check entity, service, region, period, exclusions, and shared responsibilities. Map each control to your configuration and obligations.

“Zero trust means buying a product with that label.”

Test the actual decisions: identity and device verification, resource-level authorization, enforcement points, logging, and policy governance. A label without those capabilities does not establish zero trust.

“We can solve gaps with a policy exception.”

Document the risk owner, compensating control, expiration date, monitoring, and approval. Permanent exceptions usually indicate that the selected service does not meet a mandatory requirement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Make the decision and keep it current

Select the provider whose documented flows, transfer mechanism, access controls, and assurance evidence satisfy your mandatory requirements with manageable residual risk. Before go-live, test the regional configuration, identity and device policies, log destinations, support-access workflow, incident notification, and deletion process. Retain the evidence register with the contract.

Reassess when the provider changes regions, subprocessors, architecture, legal terms, audit scope, or government-request policy, and when your own data categories or jurisdictions change. Provider locations, transfer decisions, subprocessors, and legal rules can change, so a residency decision is an ongoing governance activity rather than a one-time product selection.
